PUBLIC HEARING - Consideration of the Authority of the issuance of a Special Events Permit for the Betty Ford Alpine Gardens, 183 Gore Creek Drive, Vail, Colorado to host Mid - Summer's Night at the location of the Betty Ford Alpine Gardens, 183 Gore Creek Drive, Vail, Colorado for the following dates and times: Sunday, July 10, 1994 - 7:00 A.M. to 2:00 A.M. Officer for this event is Maureen Shapiro, Event Manager APPROVED 5 -0, with conditions of TOV department approval, a signed lease agreement between the TOV and the Alpine Gardens, and a copy of the Certificate of Good Standing from the Secretary of State. Entire area of licensed premise to be roped off. 2. PUBLIC HEARING - Consideration of the Authority of the issuance of a Special Events Permit for the Vail Valley Tourism and Convention Bureau, 100 East Meadow Drive, Vail, Colorado to host a private party for ADP at the location of Track B Vail Village 7th Filing Vista Bahn, Vail, Colorado for the following dates and times: August 15, 1994, 7:00 A.M. to 2:00 A.M. Officer for this event is Jim Feldhaus, Event Manager APPROVED 5 -0, with the following conditions: 1. Need copy of Colorado Sales Tax License. 2. Need signed sublease from VVTCB, VA and Forest Service. 3. Need departmental approval /signoff. 3. Consideration of the Authority of a Modification of Premise Garton's Saloon, a Hotel & Restaurant License with extended hours located at 143 East Meadow Drive, Vail, Colorado. A. PEC Conditional Use Permit was approved on April 25, 1994, with the following conditions: 1. Handicapped access to Garton's Saloon shall be maintained per the American Disability Act (ADA) at all times; to be reviewed by the Town of Vail Building Department. 2. Loading for Garton's Saloon shall be staged from the Crossroads loading area only. 3. Valet parking shall be provided by Carton's as needed and per the attached parking plan. 4. In order to reduce noise impacts to the surrounding community, the applicant shall close down all activities on the outdoor dining deck by 10:00 p.m. This means that all patrons must be off the deck by 10:00 p.m. 5. The applicant shall conduct a sound test prior to opening the dining deck activities. The sound test shall be used to establish maximum volume levels for amplified sound, and shall involve the Community Development staff and a representative from the Village Center Condominium Association and retail shops in order to assess impacts to the condominium and business owners that expressed concern regarding this issue last year. A timer with automatic shut -off for music shall be installed. 6. The applicant shall make the following improvements in the vicinity of the outdoor dining deck to improve the general appearance of the ranchyard operation before the deck is allowed to open for business. An inspection of the site by Randy Stouder, Town Planner, shall be required one week before the deck opens for business. -Turf grass shall be planted along the northern property boundary where last year's loading activities have left a muddy driveway. The large boulder shall remain in its current location. Design Review Board (DRB) may require additional landscaping. -Shrubs shall be placed in areas where last year's foot traffic has beaten a path through the landscaping beds. A landscaping plan shall be submitted to and approved by DRB prior to the opening of the ranchyard. The landscaping shall be planted before the deck is used. ,, Bare light bulbs shall be replaced with permanent lighting that meets the Town's Lighting Ordinance and all loose wiring shall be placed in conduits, painted and secured to the retaining wall. -The retaining wall itself shall be painted and where it is in poor state of repair shall be appropriately maintained, i.e. replacing timbers. -The siding on the east side of Garton's Saloon shall be restained as the lower portion of the siding is severely discolored and unsightly. -The appearance of the handicapped lift shall be improved. A proposal shall be submitted by the applicant to DRB. -All outdoor storage of materials shall be eliminated. All items that are currently outside in the area between the dining deck and the Frontage Road should be removed. No outdoor storage shall be allowed. 10 7. The term of the conditional use permit shall be restricted to the period of June 1 through November 1, 1994. 8. No banners, signs or flyers of any type shall be erected outdoors to advertise the ranchyard operations, beyond the approved signs for Garton's. DRB approved the Modification of the Liquor License Premise with the following conditions: 1. Add another boulder and 3 - 2% inch caliber aspen trees to block access to the deck from the frontage road. APPROVED 4 -0, with conditions. Linda Fried abstaining. 4. Consideration of the Authority of recent renewals: Off The Wall Investments, Inc., d /b /a Clancy's; APPROVED 5-0. Jackalope, Inc., d /b /a Jackalope APPROVED 5 -0. 5.
