SPECIAL MEETING

1. Consideration of the Authority of a Manager Registration and
Modification of Premise of a Hotel and Restaurant License with
Extended Hours for VIP, LTD., DQTR, Inc. d /b /a Garton's, at
the location of 143 E. Meadow Drive, Vail, Colorado.

b. Modification of Premise
PEC Approved on 5/12/95 with the following conditions:
1. Handicapped access to Garton's Saloon shall be maintained per the American
Disability Act (ADA) at all times. The ADA lift must be operable and accessible
at all times.
2. Loading for Garton's Saloon shall be staged from the approved Crossroads loading
areas only.
3. Valet parking shall be provided by Garton's as needed and per the parking plan
attached to the May 9, 1994 PEC memo.
4. In order to reduce noise impacts to the surrounding community, the applicant shall
close down all activities on the outdoor dining deck by 10:00 PM. This includes
bar, restaurant, wait service and music. Patrons should be allowed to naturally
disburse off the deck up to 11:00 PM when all patrons must be off the deck.
Between the hour of 10:00 PM and 11:00 PM patrons may go inside Garton's to
purchase beer and bring it back out on the deck, but all people must be off the
deck by 11:00 PM.
5. The applicant shall conduct a sound test prior to opening the dining deck
activities. The sound test shall be used to establish maximum volume levels for
amplified sound, so that noise levels at the property lines meet TOV noise
ordinances. A timer for automatic shut -off of music must be installed so music on
the deck is off by 10:00 PM.
6. The applicant shall contact the Community Development Department to schedule a
walk -thru.

At their meeting on May 8, 1995 the Planning and Environmental Commission (PEC) approved
your request for a conditional use permit to allow for outdoor dining at Garton's Saloon at
Crossroads Center, located at 143 E. Meadow.Drive/Lot 1, Block 5B, Vail Village First Filing.
The PEC approved the conditional use permit for the term of May 15, 1995 through November 1,
1995 with the following conditions:
1. Handicapped access to Garton's Saloon shall be maintained per the American Disability
