Summaries of Selected Laws Enacted
strategic plan for implementation of an integrated
criminal justice information system to improve upon the
existing Colorado Crime Information Center (CCIC).
Identifies general performance criteria for the new
system. Requires submission of the strategic plan by
November 1, 1995 for development of a legislative
proposal to implement the plan. Effective May 22,
1995.
HB 95 -1301 Law Enforcement
Records Access for Child Care Organizations
Provides access through the Colorado Bureau of
Investigation to criminal justice records related to
employees and volunteers for certain child care
organizations as necessary to comply with the National
Child Protection Act of 1993, 42 U.S.C. 5119a.
Effective March 30, 1995.
HB 95 -1347 Law Enforcement
Records Related to the Location of Persons with
Outstanding Arrest Warrants
Permits law enforcement agencies, including municipal
police departments, to obtain through the Colorado
Bureau of Investigation "location information" on persons
with outstanding arrest warrants from certain state
welfare agencies and the state Department of Personnel.
Effective July 1, 1995.
beer or liquor code or applicable rules and regulations;
failure to comply with special terms or conditions of a
licensee's license; in the case of a new license, failure to
establish the requirements of the neighborhood or its
adult inhabitants; or evidence that the conduct of the
license premises adversely affects the health, welfare, or
safety of the neighborhood where it is located. This
definition was necessitated by the Court of Appeal's
decision in Squire Restaurant and Lounge. Inc. v.
Derive r, 23 Colo. Law. 2149 (Colo. Ap. 1994) that the
"Good Cause" standard, without further definition, was
unconstitutionally vague. Contains other provisions.
Effective April 13, 1995.
SB 95-131 Motor Vehicles
Alcohol related offenses
Prohibits an insurer that issues motor vehicle insurance
from imposing a surcharge to the policy premium of the
insured or family member of an insured or other person
living in the same household as the insured that is
excessive or unfairly discriminates as prescribed by law.
Allows for the issuance of a driver's license with
limitations to persons with physical or mental limitations
subject to certain medical care and examination
standards. Makes several modifications to the Motor
Vehicle Financial Responsibility Act. Contains other
provisions. Effective May 23, 1995.

Ignition interlock device program
HB 95 -1202 Law Enforcement
Records Related to Sex Offenders
Modifies the existing statute related to registration of sex
offenders, Sec. 18- 3- 412.5, C.R.S., to permit local law
enforcement agencies to release certain information on
persons convicted of sex offenses upon request for such
information from persons residing both within and
without the jurisdiction of such agencies. Provides
criteria for the release of such information. Effective
June 5, 1995.
HB 95 -1145 Liquor
"Good Cause" Definition — License Renewal
Defines "good cause" for purposes of refusing or
denying a beer or liquor license renewal or initial
application issuance as any one of the following:
Violation of or failure to comply with provisions of the
Imposes a 2 year period of license revocation for a
person's second refusal to take a test to determine the
alcoholic content of the person's breath or blood and a 3
year revocation for third or subsequent refusal.
Authorizes issuance of a probationary driver's license to
any person whose adult driver's license or provisional
driver's license has been revoked primarily because of an
alcohol - related offense if the person leases an approved
ignition interlock device to avoid driving while
intoxicated and meets other specified conditions.
Contains numerous other provisions which include
conditions under which a probationary license may be
issued; establishes penalties for violation of the ignition
interlock device and program; and creates the interlock
fund and appropriates money to administer the program.
Requires CDOT to provide an assessment report of the
ignition interlock device program to the General
Assembly by January 1, 1998. Repeals the ignition
interlock devices provisions effective July 1, 1998.
Effective July 1, 1995.
