New Manager, Monte Park presented the item. APPROVED, 5 -0. 2. PUBLIC HEARING - Consideration of the Authority of a Special Events Permit for The Town of Vail, 75 S. Frontage Road, Vail, Colorado to host an appreciation supper for the Volunteers for Outdoor Colorado, at the location of the Ford Park Soccer Field, 620 Vail Valley Drive, Vail, Colorado, on Saturday, June 29, 1996, from 1:00 p.m. - 2:00 a.m. Robert McLaurin, Town Manager Russell Forest, Event Manager Town of Vail Environmental Officer, Paul Reeves, presented the item. Authority members requested the applicant submit a new map, reducing the size of the licensed premise to a 30' x 30' area around the concession stand, in addition to using snow fencing to control the area, and a minimum of five people to monitor the event. APPROVED, 5 -0. On 04.11.96 Event Manager, Russ Forest, requested the permitted area be enlarged to include 1/4 of the soccer field (approximately 100'x 100'). A phone vote was taken and approved by Don White, Mary Zarba and Connie knight. 3. PUBLIC HEARING - Consideration of the Authority of a Special Events Permit for The Town of Vail, 75 S. Frontage Road, Vail, Colorado to host Earth Fest at the location of the Lower Bench of Ford Park, 700 block of S. Frontage Rd., Vail, Colorado, on Saturday, June 22, 1996, from 9:00 a.m. - 11:00 p.m. Robert McLaurin, Town Manager Russell Forest, Event Manager Town of Vail Environmental Officer, Paul Reeves, presented the item. The Authority requested the applicant to staff a minimum of five people to monitor the event. APPROVED, 5 -0. 4. PUBLIC HEARING - Consideration of the Authority of a Special Events Permit for the Steadman Hawkins Sports Medicine Foundation, 181 W. Meadow Dr., Ste. 1000, Vail, Colorado to host a private dinner and wine auction at the location of the Lower Bench of Ford Park, 700 Block of S. Frontage Rd., Vail, Colorado, on Sunday, August 10, 1996 from 12:00 noon - 9:00 p.m. John McMurtry, Secretary Patricia Herrington, Event Manager Patricia Herrington presented the item. APPROVED, 5 -0. 5. PUBLIC HEARING - Consideration of the Authority of a Special Events Permit for The Vail Valley Tourism and Convention Bureau, 100 E. Meadow Drive, Vail, Colorado to host Jeep White water Festival, at the location of the Gore Creek Promenade area including the pedestrian bridge, the streets of Gore Creek Drive from Willow Bridge Road to Bridge Street, and the Children's Fountain area extending into the intersection of South Wall Street, Vail, Colorado, on Saturday, May 25, 1996, from 8:00 a.m. - 6:30 p.m. Frank Johnson, President Bill Brice, Event Manager AGENDA LOCAL LICENSING AUTHORITY APRIL 10, 1996 PAGE TWO Bill Brice presented the item and reviewed the details of the event. Authority Chairman, Don White, requested the licensed premise be downsized to include only the Gore Creek Promenade area, eliminating the use of Gore Creek Drive. Brice explained that the Promenade alone was too small to contain the event and that vendors would be set up along Gore Creek Drive, and merchants would also be displaying merchandise outdoors. APPROVED, 4 -1, Don White voting in opposition. 6. PUBLIC HEARING - Consideration of the Authority of a 3.2 Beer Special Events Permit, for the Vail Rugby Club, P.O. Box 1895, Vail, Colorado, at the location of the Ford Park Athletic Field, 620 Vail Valley Drive, Vail, Colorado, the following dates and times: Saturday, June 22, 1996, 11:00 a.m. - 6:00 p.m. Saturday, July 27, 1996, 11:00 a.m. - 6:00 p.m. Stephen Lewis, Event Manager Stephen Lewis presented the item. Upon the suggestion of Police Chief, Greg Morrison, Authority members stipulated that security personnel monitoring the event not be allowed to drink while on their shift and that security personnel wear special shirts or uniforms so they were easily identifiable. APPROVED, 5 -0. 7. Consideration of the Authority of a Modification of Premise for a Hotel /Restaurant license with extended hours held by Brewing Company of Vail, Inc., d /b /a Hubcap Brewery, at the location of 143 E. Meadow Drive, Vail, Colorado. Owner, Lance Lucey, was present along with his manager, Boulder. Town Clerk, Holly McCutcheon informed the Authority the license holder had gone through the proper channels with Community Development and had received approvals for the proposed modification from the DRB & PEC. APPROVED, 5 -0. 8. Consideration of the Authority of a Modification of Premise for a Hotel /Restaurant license with extended hours held by Michael Burgermeister, d /b /a KB Ranch Company, at the location of 660 W. Lionshead, Vail, Colorado. Holly McCutcheon provided the following information: On 08.10.95 the Lions Square Lodge & Conference Center took out a tavern license on the conference rooms in the Lodge. At that time, these conference rooms were still a part of the KB Ranch Licensed premise. The KB Ranch license was and is still a valid Hotel and Restaurant License, even though they weren't operating. Since the KB Ranch shut down, the conference rooms were no longer legally held (leased) by KB Ranch. Because the owner of KB Ranch now resides in California, and the modification is a housekeeping item, Holly requested the Authority consider approval of the modification without the owner being present. APPROVED, 5 -0. 9. Consideration of the Authority of recent renewals: Colorado Ski Service, Inc., d /b /a Vista Bahn Ski Rentals; and Sonnenalp Properties, Inc., d /b /a Sonnenalp Restaurant. APPROVED, 5 -0. 10. Any other matters the Authority wishes to discuss. Police Chief, Greg Morrison, and Sergeant, Joe Russell, were present for a discussion regarding Nick's bar. Holly informed the Authority of the following incidents: On March 14, 1996. There were trespassing and criminal injury to property charges filed against an individual named Samuel Jobes who had spent the evening drinking in Nick's bar. Upon leaving Nick's Jobes became disoriented and lost while trying to find his way to his condo. Jobes said in the police report that he became very cold and was trying to find a place to go and get warm. He saw some lights across a field and decided to go to the houses for help. As he was heading to the houses, he came to a creek which he tried to jump over, but fell in. Jobes said he was scared and freezing, and thought he might die. Apparently Jobes did reach the houses on Sunburst Drive, and when nobody answered his knock, he busted the door open. AGENDA LOCAL LICENSING AUTHORITY APRIL 10, 1996 PAGE THREE When a woman who was sleeping upstairs discovered Jobes in her living room, she called 911. Jobes then left the unit. Officers found Jobes sleeping in another unit not far away. That door had also been kicked in. On March 22, 1996, there was an altercation outside of Nick's bar on Bridge Street. Officers responded to a dispatch regarding a fight in progress at Nick's bar. Approximately 50 feet from the entrance to Nick's an individual named Kevin Lach was involved in a fight with another party. Lach had an unidentified party down on the ground and was hitting him numerous times in the face. The person being assaulted was able to extricate himself and ran from the scene. On March 28, 1996, there was an assault with a knife which occurred at the second level of the transportation center on the south end. This incident originated in Nick's where an individual by the name of Ramirez had been seen harassing women in the bar. Several individuals informed the doorman who spoke with Ramirez. Ramirez became involved in an altercation in the bar and was punched in the face. He was then escorted out of the bar. When three individuals reporting this incident, left the bar, they saw Ramirez standing outside. Ramirez followed them as they walked northbound on Bridge Street and then turned westbound on East Meadow Drive at the bus plaza. As they approached the intersection of Crossroads and International Bridge near Haagen Dazs, one of the individuals suddenly yelled "I've been stabbed." Ramirez was then observed with a knife in his left hand stabbing one of the three individuals several times. It was noted that the February letter sent to Nick's manager, Tim Goff, regarding an underage drinking incident was not answered. The Authority found there was probable cause that a violation had occurred and moved to serve upon Nick's a notice of hearing and order to show cause why the license should not be suspended or revoked, and that the hearing should take place at the next regular meeting on June 12. APPROVED, 5 -0. The Authority was then informed of an incident which occurred at the Jackalope in which a bartender was cited for selling alcohol to an intoxicated person. Again, the Authority found there was probable cause that a violation had occurred and moved to serve upon Nick's a notice of hearing and order to show cause why the license should not be suspended or revoked, and requested the hearing be held on June 12. Holly reminded members Connie Knight and Don White of their expiring terms in June and announced that the public notice requesting letters of interest for two vacancies would run in the Trail on May 17 & 24. Deadline to receive letters will be May 30, with Council interviews being conducted at the June 4 work session and appointments taking place at that evening's meeting. 11. Next scheduled meeting June 12, 1996. Ellen informed the Authority she would not be in attendance for the June meeting, and the meeting was adjourned at approximately 11:35 a.m. TOWN OF VAIL Local Licensing Authority Holly L. At that time, these conference rooms were still a part of the KB Ranch Licensed premise. The KB Ranch license was and is still a valid Hotel and Restaurant License, even though they wern't operating. Since the KB Ranch shut down, the conference rooms were no longer legally held (leased) by KB Ranch. Because the owner of KB Ranch now resides in California, and the because the request to modify came from the Town Clerk's Office (it was an oversight -we thought the KB Ranch license was no longer valid) I was hoping the Authority would consider approval of the modification without the owner in attendance today.
