of 3971 Bighorn Road, Vail, Colorado.

4. PUBLIC HEARING - Hearing and Order to Show Cause for Suspension or
Revocation of a Hotel and Restaurant Liquor License with extended hours, held
by Slalom, Inc., d /b /a Nick's, at the location of 228 Bridge Street, Vail, Colorado.
The Town of Vail was represented by Town Attorney, R. Thomas Moorhead
who introduced the case against the above license holder, and presented the
Local Licensing Authority with a stipulation. The Licensee was represented
by Manager, Tim Goff; Attorney Terrence O'Connor; and Consultant, Ron
Riley. After considering the incidents, the alleged violations, and reviewing
the proposed stipulation, the Local Licensing Authority approved by a 4 -0
vote, the following:
1. The License holder was found guilty of a single violation of Article 47,
Title 12, CRS by:

(a) the Licensee or his agents, servants, or employees on or about
March 14, 1996, sold malt, vinous, or spirituous beverages to a
visibly intoxicated person, in violation of C.R.S. 12- 47- 128(1)(a),
as amended.
(b) The Licensee or his agents, servants, or employees on or about
March 28, 1996, sold malt, vinous, or spirituous beverages to
persons under the age of twenty -one years, in violation of 12-47 -
128(1)(a), as amended.
2. The License is suspended for five (5) days to be served in September
or October, 1996.
3. The Licensee was assessed a fine of $2,500.00 to cover the cost of
investigation and all administrative costs related to the
suspension /revocation procedure. The full amount being due within
seven (7) days of the stipulation agreement. The fine was not a
payment in lieu of license suspension pursuant to CRS 12-47- 110(3).
4. The Stipulation is consistent with the findings and penalties
established by the Local Licensing Authority on July 10, 1996.
The License holder was then directed to confirm the dates in which to serve
the five (5) days suspension with the Town Clerk.

On March 14, 1996. There were trespassing and criminal injury to property charges
filed against an individual named Samuel Jobes who had spent the evening drinking in
Nick's bar. Upon leaving Nick's Jobes became disoriented and lost while trying to find
his way to his condo. Jobes said in the police report that he became very cold and was
trying to find a place to go and get warm. He saw some lights across a field and
decided to go to the houses for help. As he was heading to the houses, he came to a
creek which he tried to jump over, but fell in. Jobes said he was scared and freezing,
and thought he might die. Apparently Jobes did reach the houses on Sunburst Drive,
and when nobody answered his knock, he busted the door open. When a woman who
was sleeping upstairs discovered Jobes in her living room, she called 911. Jobes then
left the unit. Officers found Jobes sleeping in another unit not far away. That door had
also been kicked in.
On March 22, 1996, there was an altercation outside of Nick's bar on Bridge Street.
Officers responded to a dispatch regarding a fight in progress at Nick's bar.
Approximately 50 feet from the entrance to Nick's an individual named Kevin Lach was
involved in a fight with another party. Lach had an unidentified party down on the
ground and was hitting him numerous times in the face. The person being assaulted
was able to extricate himself and ran from the scene.
On March 28, 1996, there was an assault with a knife which occurred at the second
level of the transportation center on the south end. This incident originated in Nick's

where an individual by the name of Ramirez had been §een harassing women in the
bar. Several individuals informed the doorman who spoke with Ramirez. Ramirez

became involved in an altercation in the bar and was punched in the face. He was
then escorted out of the bar. When three individuals reporting this incident, left the bar,
they saw Ramirez standing outside. Ramirez followed them as they walked
northbound on Bridge Street and then turned westbound on East Meadow Drive at the
bus plaza. As they approached the intersection of Crossroads and International Bridge
near Haagen Dazs, one of the individuals suddenly yelled "I've been stabbed."
Ramirez was then observed with a knife in his left hand stabbing one of the three
individuals several times.

April 10, 1996 LLA - It was noted that the February 28 letter sent to Nick's

manager, Tim Goff, regarding an underage drinking incident was not answered.
The Authority found there was probable cause that a violation had occurred and

to serve upon Nick's a notice of hearing and order to show cause why the
license should not be suspended or revoked, and that the hearing should take

place at the next regular meeting on June 12. On June 5, the Town Clerk was
presented with a letter from licenseholder requesting the hearing be continued
and the Chairman felt the hearing could be continued until July 10.

RECENT FINDINGS BY THE LOCAL LICENSING AUTHORITY
At its regular meeting today, the Town of Vail Local Licensing Authority found an area bar guilty of two
violations: 1) selling alcohol to a visibly intoxicated person, and 2) selling alcohol to a minor. The license
was suspended for five (5) days and the licensee was required to pay a fine in the amount of $2,500 to cover
administrative and investigation costs.
Last month the Authority found a license holder guilty of having allowed a visibly intoxicated person to be
served and suspended that license for five (5) days. Three (3) days were held in abeyance for a period of one
year pending no further violations, two (2 )days suspension must be served.
CHANGE IN AGE REQUIREMENTS
A new bill which has recently been passed made it legal for persons 18 years old or older to serve malt,
vinous and spirituous liquors as long as they are actively supervised by a person at least 21 years of age who
is present on the licensed premise. This provision of allowing persons 18 years old or older to serve does
NOT however apply to liquor stores or taverns that do not regularly serve full meals.
FOOD REQUIREMENTS
Did you know that if you are a Hotel /Restaurant license holder you must serve full meals until 8:00 p.m. and
sandwiches and light snacks after 8:00 p.m until closing? Tavern, Beer & Wine, or 3.2 Beer on premise
license holders must have sandwiches and light snacks available during hours of operation.
NEW CLASS OF LICENSE
A new class of retail license called a "Brew Pub" is now available which allows for product to be
manufactured, sold wholesale, consumed on premise, or to go in sealed containers.
