Vail Associates Attorney, Tamra Underwood is present with paralegal Penny Masheter; manager, Eric Pottorf; and project manager, Rick Cadell. Tamra will discuss license the new gondola as an optional premise to Eagle's Nest to accommodate weddings and night time guests of the Game Creek Club. If approved, the p�q�t • remise would be located in two jurisdictions, the TOV and Eagle County. The state has tensed a similar situation which was a golf course located in Aurora and Denver, and �k ggested we enter into an /GA with Eagle County, setting forth duties, responsibilities, . ho would be responsible for what, who would respond, etc. One entity waiving i1 jurisdiction and giving resonsibility to the other. VA talked with the County on Monday. Sara Fisher felt it could be workable and recommended allowing alcohol in one direction (going up to Eagle's Nest) only. The premise was posted and the notice published in a timely manner on September 27. Character Investigations have been received and do not reveal any information which would be detrimental to the granting of the license. CBI reports are still pending. PUBLIC HEARING - Consideration of the Authority for Renewal of a Hotel and Restaurant Liquor License held by Garfinkel Enterprise, Ltd., d /b /a Garfinkel's, a Hotel and Restaurant license at the location of 536 W. Lionshead Mall, Vail, Colorado. The Authority will consider the following as well as any other items that may affect the renewal of said license: a) Whether the licensee meets the requirements of C.R.S. 12 -47, Regulation 47.105.1A, Conduct of Establishment in that complaints against the licensee have been presented to the Authority alleging the Licensee permitted rowdiness, undue noise or other disturbances or activities offensive to the senses of the average citizen or the residents of the neighborhood in which the licensed establishment is located. b) Whether, pursuant to C.R.S. 12-47- 106(2), the establishment meets the reasonable requirements of the neighborhood, the desires of the adult inhabitants as evidenced by petitions, remonstrances, or otherwise, and all other restrictions which are or may be placed upon the neighborhood by the Local Licensing Authority. C) Whether the licensed premises constitute a nuisance or adversely affect the surrounding environment by interfering with public decency and good order. At their last regular meeting, the Local Licensing Authority voted to schedule this matter for a renewal hearing, based upon written complaints against the establishment pertaining to its conduct, and allegations that the licenseholder was permitting noise, profanity, rowdiness or other disturbances to occur. The Colorado Liquor and Beer Codes state that whenever a written complaint is filed with a licensing authority, charging any licensee with a violation of the liquor code, the authority shall determine by investigation the probable truth of such charges. We requested and the Vail Police Department has completed their investigation. Members of the department are present today to testify as to their findings. We have subpoenaed Larry Barnes and Rob Dale of Vail Home Rentals, property managers for the Lionshead Centre, and Garfinkel's Registered Manager, Stuart Need, to present whatever relevant information they have concerning the operation of Garfinkels. We have notified all individuals who had previously complained about the establishment of this hearing and offered them the opportunity to testify. I have received additional written statements that are available for the Local Licensing authority to consider. Grant Riva is going to present the evidence on behalf of the Town. Tom Moorhead will advise the Authority. At this time I'd like to turn it over to Grant Riva. Thank you. "The applicant is overdue for a health inspection. On Monday 'W I received an application for a 100% transfer of the Salad Garden's Hotel and Restaurant License for Glendining Enterprises, d /b /a The George. The establishment will be operated by an Avon couple, James .and Leslie Glendining. The paperwork is mostly complete, however I am waiting for a couple of minor items, which I expect to have taken care of today. CBI reports are still pending. The application is set to be considered t the next regular meeting on November 13. Glendining Enterprises is requesting the Authority grant a Temporary License to allow them to do business while waiting to be considered for the t oC, &1 k✓� APP yvwoj . The Vail Hospitality Group has surrendered the Serrano's liquor license. When the building reopens again next spring it will be a new license under - new ownership. 7.
