Inc., d /b /a Safeway Store #631, a 3.2% beer license at the location of 2131 N.
Frontage Road West, Vail, Colorado.
Registered Manager Dennis Spear was present.

2. Consideration of the Authority of a Corporate Structure Change for Manor Vail
Condominium Association, d /b /a Manor Vail Lodge, a Hotel and Restaurant License
at the location of 595 E. Vail Valley Drive, Vail, Colorado.

Registered Manager Robert McCleary was present.

3. Consideration of the Authority of a Modification of Premise for Lion Square Lodge
Conference Center, Inc., a Tavern license at the location of 660 W. Lionshead Place,
Vail, Colorado.
Registered Manager Jim Gernhofer was present and explained that the Lions
Square Lodge and Conference Center, a Tavern license was modifying its
premise to include the adjacent KB Ranch restaurant space. KB Ranch
voluntarily surrendered their Hotel /Restaurant license.
APPROVED, 4 -0.
4. Consideration of the Authority of a Manager Registration for Jackalope, Inc., d /b /a
Jackalope Cafe & Cantina, a Hotel /Restaurant License at the location of 2161 N.
Frontage Road W., Vail, Colorado.
Thomas Olsen, Registered Manager - replacing Bob Doyle
Holly McCutcheon reminded the Authority of the 5 -day suspension of the
license which occurred June 12 for over service. 2 days were served in
September, and 3 days were held in abeyance for a period of 1 year.
The Authority was then informed of 2 recent (October, 1996) police reports
generated. Both incidents took place at the Jackalope and pertain to possible
over service.
Regulation 47.110.1 of the Colorado Liquor Code states that "If it shall come to
the attention of the licensing authority that there is probable cause to believe
that a licensee has violated any such law, rule or regulation, the licensing
authority shall issue and cause to be served upon such licensee a notice of
hearing and order to show cause why his license should not be suspended or
revoked."
Town Attorney Tom Moorhead advised the Authority of possible options and a
motion was made to table the manager registration to the next regular
meeting.
APPROVED, 4 -0
The Local Licensing Authority felt there was probable cause to believe a
violation had occurred and that a show cause hearing should be held. A
motion was then made to schedule a show cause hearing for suspension or
revocation of the license to be held at the next regular meeting.

October 21 Authority members approved by phone a temporary license
for the applicant.

Saturday, December 7,1996; 8:00 a.m. - 4:00 p.m.

10.31.96 - consideration of a temporary license for Stephen
Simonett, d /b /a East Vail Spirits; and
11.12.96 - consideration of a temporary license for VVI Corporation,
d /b /a Vail Village Inn.
10. Next scheduled meeting December 11, 1996.

I , attention of the Local Authority. Both incidents took place last month and
,03pertain over service at the Jackalope.
Regulation 47.110.1 of the Colorado Liquor Code states that "If it shall come to
the attention of the licensing authority that there is probable cause to believe
that a licensee has violated any such law, rule or regulation, the licensing
authority shall issue and cause to be served upon such licensee a notice of
hearing and order to show cause why his license should not be suspended or
revoked."
On June 12 the LLA suspended this license for over service for 5 days; 2 days
were served in September, and 3 days were held in abeyance for a period of 1
year.
Specifics of the reports must be discussed at the time of hearing in order to
allow due process and to give the license holder an opportunity to be
prepared and to defend themselves.
I would recommend tabling this item to the next regular meeting if the
Authority feels there is probable cause to believe a violation has occurred and
theat a show cause hearing should be held.
