On 01.31 Michael Ditch, of Michael's /l, licenseholder of the premise, informed me that
the applicant was in default of a Management Agreement, and stated that certain issues
remained to be worked out between the parties, and that in the event the parties could
not reach an agreement, he would request the transfer withdrawn. The State Liquor
Enforcement Division advised me that the seller (Michael's) has a right to terminate the
transfer if he so desires and that under 12.47.106 the license is good until suspension,
revocation or expiration (or by due process) with or without a lease, as long as the
licenseholder is not operating, if it is without a lease.
Appropriate publication was made and the premise posted in a ti el manner on
January 31, 1997. A Character Investigation has been received does not reveal or
include any information that would be detrimental to the granting of said license. All
documents are in order and the file is complete.
