Rene Enterprises, LLC, d /b /a The Original Palmos Capuccino & Spirits filed an application for a 100% transfer of ownership of a hotel and restaurant license held by Michael's II in the Gateway building. A Temporary License was requested as of January 2, 1997, and granted by the Authority. APPROVED, 4 -0 6. PUBLIC HEARING - Consideration of the Authority of a New Issue for HMC Acquisition Properties., Inc., d /b /a Marriott's Vail Mountain Resort, a Hotel and Restaurant License at the location of 715 Lionshead Circle, Vail, Colorado. a) New Issue - Robert E. Parsons, Jr., President Christopher G. Townsend, Vice -P resident/Secretary Bruce Wardinski, Treasurer b) Registered Manager - Marc Hoffman This application was filed on December 31, 1996. The Authority granted a temporary license to the Marriott, also on that date, as the license was allowed to expire. General Manager, Marc Hoffman was present. APPROVED, 4 -0 7. Rene Enterprises, LLC, d /b /a The Original Palmos Capuccino & Spirits filed an application for a 100% transfer of ownership of a hotel and restaurant license held by Michaels II in the Gateway building. A Temporary License was requested as of January 2, 1997, and granted by the Authority with the co�njitlio g n that the applicant settle any and all outstanding town business (specifically ar `� andtn sales tax ire) prior to issuance of the license. The TOV sales tax department has informed me that J. Rene Enterprises mr is in good standing with the Town. , Trod. p d 6.j t { Gi- r9 -, a ' -rry ' +t y On 01.31 Michael Ditch, of Michael's /l, licenseholder of the premise, informed me that the applicant was in default of a Management Agreement, and stated that certain issues remained to be worked out between the parties, and that in the event the parties could not reach an agreement, he would request the transfer withdrawn. The State Liquor Enforcement Division advised me that the seller (Michael's) has a right to terminate the transfer if he so desires and that under 12.47.106 the license is good until suspension, revocation or expiration (or by due process) with or without a lease, as long as the licenseholder is not operating, if it is without a lease. Appropriate publication was made and the premise posted in a ti el manner on January 31, 1997. A Character Investigation has been received does not reveal or include any information that would be detrimental to the granting of said license. All documents are in order and the file is complete. 6.
