1. PUBLIC HEARING - Consideration of the Authority of a Special Event Permit for the Vail Inernational
Hockey Tournament at the location of the Vail Public Library, 292 W. Meadow Drive, Vail, Colorado,
on Friday, April 11, 1997 from 2:00 p.m. - 10:00 p.m.

Event Organizer, Howard Gardner and Event Manager, Judy Rodriguez presented the item.
Town Clerk, Holly McCutcheon informed the Authority that during the processing of the
application the premise had not been posted due to staff oversight. The Authority was asked
to hold a special meeting in order that the posting requirements could be met.
Mary moved to call a special meeting to be held by phone on Thursday, March 27, 1997, at 10
a.m., Kathy seconded the motion.
APPROVED, 4 -0
2. Consideration of the Authority of a Change of Corporate Structure for the West Vail Liquor Mart, a
Retail Liquor Store and the location of 2151 N. Frontage Road, Vail, Colorado.
Thomas P. Mullen, Secretary/Treasurer, Director and 33% Shareholder
Howard Gardner, President of the corporation presented the item.
Connie moved to approve the Corporate Change, second by Mary.
APPROVED, 4 -0
Howard then explained the "Operation Keg Shadow" program, a strategy which helps curb
underage drinking. He asked the Authority to participate in the program and carry it forward to
the Town Council.
Mary moved to direct staff to pursue the program and preparing a recommendation to the
Town Council. Connie seconded.
APPROVED, 4 -0
3. Consideration of the Authority of recent renewals:
Vail Amphitheater Corporation;
Sweet Basil, Inc., d /b /a Sweet Basil;
Steven Satterstrom, Inc., d /b /a Seasons at the Green;
Alfalfa's Vail, Inc., d /b /a Alfalfa's Market; and
DJ Corporation of Vail, Inc., d /b /a DJ's McCadams
The Authority was asked to approve the Alfalfa's license with the condition that paperwork
for a transfer of the license was received, due to a merger of Alfalfa's Vail, Inc., into Wild
Oats Market, Inc.
APPROVED, 4 -0
4. Any other matters the Authority wishes to discuss.
Dave Chapin informed fellow Members of an article he'd seen relating to a senate
bill which relieves retail liquor stores of penalties for first time offenses.
The Authority was then informed of an application that had been received for a new
3.2 beer license from City Market. City Market is planning a grand opening
scheduled for April 30, but missed the deadline to be put on the Agenda for the April
9 regular meeting before the Local Licensing Authority. City Market requested a
special meeting be held on Friday, April 11, 1997, to accommodate their planned
grand opening.

• Authority Members requested the applicant appear at the regularly scheduled
meeting on April 9, 1997, and that a special meeting be held by phone on April 11.
• The Authority was then informed of the following incidents:
Service of Alcohol to a Visibly Intoxicated Person /Over Service
On November 16, 1996 at approximately 11:55 p.m., Vail police officers were contacted
on Bridge Street by an entertainer at the Club, informing them that a chugging contest was
in progress and requested their presence, stating contestants could get out of hand.
During the contest the audience was to determine which contestant was the most wasted
and that person would win a mountain bike. Two officers responded to the Club and
observed "contestants" consuming several shots and beers, and described in their report
the details of the contest, and the behavior of participants.
A summons was served to Scott Munns, an employee of The Club. Munns was charged
with 2 counts of Sales of Alcohol to an Intoxicated Person, and plead guilty to both counts
on March 6. He was fined $100 on each offense and given a deferred sentence for 1 year.
Authority members agreed that a letter to the license holder discussing the matter
be drafted for David's signature.
Service of Alcohol to a Visibly Intoxicated Person /Over Service
On November 17, 1996, officers observed an intoxicated person staggering down Bridge
Street, talked to him and made sure he joined a group of his friends who said they'd take
care of him. Later on a bar check at the Hong Kong, officers observed the same individual
drinking in the bar. The individual told officers he was served by the bartender. When
approached by officers, the bartender denied having served the individual. The intoxicated
party then changed his story and told police that he just took the drink and wasn't served
by the bartender.
The Bartender was served with a County Summons and the case is set for further
proceedings in County Court on March 18.
Authority members asked the matter be discussed further at the April 9 meeting
• The March 10, 1997 resignation of Chairman, Don White was discussed. Dave
Chapin was then nominated to serve as Chairman of the Local Licensing Authority.
APPROVED, 3 -0 -1, Dave abstaining.
Mary Zarba was nominated to serve as Vice - Chairman.
APPROVED, 3 -0 -1, Mary abstaining
• Holly informed the Authority that Public Notices and display advertising announcing
vacancies existing on Town of Vail Boards had been published and will run this
week. A letter interest had been received from Bill Bishop, former Chairman of the
Liquor Board who had served 8 years.
• The regular meeting scheduled for May 19 was canceled, as many members are
scheduled to be out of town.
5. Next scheduled meeting April 9, 1997.

At this time I'd like to inform the Authority that during the processing of this application,

I have received an application for a new 3.2 beer license from City Market. City
Market weqW operating by April 30, however they have just
missed the deadline to be put on the Agenda for the April 9 liquor board meeting.
The liquor code requires that once an application for a new license or transfer is
received by the Local Authority, a hearing may not be held for 30 days. Therefore,
City Market is requesting a special meeting be held on Friday, April 11. RppO B'H

This process began in October, 1996 and I was working with a gentleman from City
Market's Grand Junction Office. Apparently, in January, another person was
assigned to the task and had to begin the process all over again.

You should have all received a copy of Don's resignation letter effectie 03.10.97. A
new chairman should be made - you can decide among you. Public notices have
been published in the newspaper announcing the vacancies on town boards and a
display ad is being run in the Vail Daily this week. So far we've received a letter of
