Consideration of the Authority of a Modification of Premise for a Hotel and Restaurant License for D Q T R, Inc., d /b /a Garton's Saloon, at the location of 143 E. Meadow Drive, Vail, Colorado. Dave Garton was present with Manager Steve Olson. The applicants assured the Authority service of alcohol would cease at 10 PM. APPROVED, 4 -0 8. Frontage Road, Vail, Colorado. a) New Issue - Anthony Prinster, President Stanley W. Stephens, Vice - President Ronald L. Warren, Secretary/Treasurer b) Registered Manager - David Hittson John Caldwell, Nick Prinster and David Hittson were present on behalf of City Market and presented a petition containing 96 signatures. 93 were in favor of the license and 3 were opposed. A special public hearing was to be held on Friday, April 11, 1997 in the office of the Town Clerk for the consideration by the Authority of a New Issue of a 3.2% Beer Off - Premise License for City Market, Inc., d /b /a - City Market No. 42 at the location of 2099 N. Frontage Road, Vail, Colorado. 9. Consideration of the Authority of recent renewals: Sonnenalp Properties, Inc., d /b /a Bully Ranch & Bar. Todd P. Milner, Inc., d /b /a The Club. APPROVED, 4 -0 10. Any other matters the Authority wishes to discuss. The Authority was advised of the following: • L'Ostello Lodge surrendered their liquor license on 04107, as the lodge had been sold. • The May Palace lease will soon expire and not be renewed. Michael's will be opening a new restaurant in that location and the May Palace is looking at space in the Vail Commons /City Market project. • New application was received from Campo di Fiori Restorante (out of Aspen) for the transfer of the Ambrosia License and will be reviewed at the June 11 meeting. • At the last meeting the Authority was informed of an incident which occurred at the Hong Kong. That matter was dismissed in Eagle County Court on March 18. 11. Next scheduled meeting is a Special Meeting to be held on Friday, April 11 in the Town Clerk's office. City Market has presented a petition containing 96 signatures. 93 were in favor of the license and 3 were opposed. This application was filed on March 11, appropriate publication was made and the premise posted on March 28. Character investigations for City Market's Officers, Directors, and Registered Manager are already on file and in good standing with the State Liquor Enforcement Division. All documents are in order and the file is complete. A special public hearing will be held on Friday, April 11, 1997 in the office of the Town Clerk for the consideration by the Authority of a New Issue of a 3.2% Beer Off - Premise License for City Market, Inc., d /b /a City Market No. 42 at the location of 2099 N. On Monday the L'Ostello Lodge surrendered their liquor license, as the lodge has been sold. I haven't received information yet as to who bought it and when it will reopen. The May Palace did not renew their license, as they lost their lease. Michael's will be opening a new restaurant in that location and the May Palace is looking at space in the Vail Commons /City Market project. I received an application from Campo di Fiori Restorante (from Aspen) for the transfer of the Ambrosia License. That application will be reviewed at the June 11 meeting. Ambrosia's lease expires the end of this month. Licenseholders must maintain possession of the premise at all time. Therefore, we will do a transfer by operation of the law. I've received a letter from the landlord stating Ambrosia's lease will not be renewed and that a new lease has been signed. At the last meeting the authority was informed of an incident which occurred at the hong Kong. That matter was dismissed in Eagle County Court on March 18. Service of Alcohol to a Visibly Intoxicated Person /Over Service On November 17, 1996, officers observed an intoxicated person staggering down Bridge Street, talked to him and made sure he joined a group of his friends who said they'd take care of him. Later on a bar check at the Hong Kong, officers observed the same individual drinking in the bar. The individual told officers he was served by the bartender. When approached by officers, the bartender denied having served the individual. The intoxicated party then changed his story and told police that he just took the drink and wasn't served by the bartender. The Bartender was served with a County Summons and the case is set for further proceedings in County Court on March 18. Authority members asked the matter be discussed further at the April 9 meeting. Update liquor board as to outcome in Eagle County Court re: Hong Kong overservice. This was dismissed in County Court on March 18. Service of Alcohol to a Visibly Intoxicated Person /Over Service On November 16, 1996 at approximately 11:55 p.m., Vail police officers were contacted on Bridge Street by an entertainer at the Club, informing them that a chugging contest was in progress and requested their presence, stating contestants could get out of hand. During the contest the audience was to determine which contestant was the most wasted and that person would win a mountain bike. Two officers responded to the Club and observed "contestants" consuming several shots and beers, and described in their report the details of the contest, and the behavior of participants. A summons was served to Scott Munns, an employee of The Club. Munns was charged with 2 counts of Sales of Alcohol to an Intoxicated Person, and plead guilty to both counts on March 6. He was fined $100 on each offense and given a deferred sentence for 1 year. Authority members agreed that a letter to the license holder discussing the matter be drafted for David's signature. 11.
