The Applicant was represented by attorney Alan Dill. The Protestant, West Vail Liquors was represented
by attorney Mary Jo Berenato. Town Attorney, Tom Moorhead served as legal advisor to the Authority.
Testimony was presented by both parties. For the applicant, the following Vail residents provided
testimony as to why the license should be granted: Kit Williams, Herman Staufer, Scott Wirth, Thomas
Maw, Robert Lazier. Max Scott of Edipus, Inc., a professional survey firm presented a survey which was
done to determine the needs and wants of the neighborhood, which indicated 81% were in favor of the
license.
For the Protestant the following Vail residents provided testimony in opposition to the license: Scotty
Magoun, Sherry Wilson, Charles Crowley, Bill Anderson, Jeff Nichols, Howard Gardner, and Tom Mullen.
The Protestant then produced a petition containing approximately 500 signatures opposing the license.
Upon hearing the testimony presented by both parties, the Authority found that the needs of the
neighborhood and the desires of the inhabitants therein were accurately reflected in the survey
presented by the Applicant.

Publication was made on May 23 and the premise was posted in a timely manner, also on May 23.
All documents are in order and the file is complete, pending the receipt of FBI and BI reports. A

June 27, 1997.
The Authority was reminded that in June, 96, the Jackalope Cafe & Cantina was found guilty
of service to an intoxicated person. The license was suspended for 5 days, 3 of which were
held in abeyance for 1 year; and in December, 96, the Jackelope Cafe & Cantina was found
guilty of service to an intoxicated person. The license was then suspended for 25 days, 20
days were held in abeyance for 1 year.

Dave Chapin updated fellow Board members on the status of the Keg Tag program, a plan
designed to curb underage drinking.

For the record my name is Holly McCutcheon and I am the Secretary to the Local Licensing
Authority. This application was filed within the filing deadline on April 8, 1997. Appropriate
publication was made on May 23, 1997 and the premise was posted in a timely manner also
on May 23rd. All documents are in order and the file is complete. The City of Aspen has
shared information with me regarding CBI & FBI investigations done on the applicants.
Nothing has been reported that would be detrimental to the granting of this license. A
