Holly informed the Board:
At the last meeting on the 18th the Authority granted a new retail liquor store license to
Peterson Enterprises. Apparently, in the published notice as well as the sign that was posted
on the premise, the physical address which is 2211 N. Frontage Rd. was incorrectly stated as
2111 N. Frontage Rd. The party who opposed the granting of this license sent a letter to Matt
Cook at the State Liquor Enforcement Division addressing this issue, and asked that the state
take into consideration the error prior to rendering a decision on the application. I've copied
that letter for your review. Matt Cook agreed that the correct premise was posted, and that the
mailing address of the applicant (which is Jay Peterson's business address on S. Frontage
Road) was also correctly stated in both the public notice and the posted notice as required by
state statute. He stated that the matter should have been addressed by the opposing party at
the time of the hearing and sees no reason not to grant the license.
The State has recently discovered in processing Jay's application that he is listed as a
'director on the Lancelot's license. Jay did resign from that position back in 1987, but a
corporate structure change removing Jay AND Bill Post as directors was never formally filed
with local and state authorities. Jay is currently completing the appropriate paperwork. The
Authority agreed to approve the Lancelot corporate structure change removing the two
individuals as directors without requiring them to be present at a meeting to expedite the
issuance of Jay's liquor license.
At the June 11 meeting, the Authority approved the renewal of the May Palace liquor license
until the expiration of their lease on June 27. The landlord has now agreed to extend the May
Palace lease until July 31, and the May Palace is requesting their recent renewal also be
extended until that date. The Authority agreed to extend the May Palace license to coincide
with their lease.
On June 19, 1997, the Town of Vail Police Department conducted a liquor sales operation in
the Town of Vail. Four Vail liquor stores were targeted. A confidential informant 20 years of
age agreed to work with the Police Department and make controlled purchases of alcohol at
the four locations. As a result of the operation, the following sales clerks were cited:
Howard Gardner at the West Vail Liquor Mart was issued a summons in lieu of arrest for sale
to minors;
Landon Norton at Lionshead Liquors was issued a summons in lieu of arrest for sale to
minors;
James Bowman at East Vail Spirits was issued a summons in lieu of arrest for sale to minors.
All three individuals are scheduled for arraignment in Municipal Court on July 17.

RECENT FINDINGS BY THE LOCAL LICENSING AUTHORITY
At its regular meeting today, the Town of Vail Local Licensing Authority found an area bar guilty of two
violations: 1) selling alcohol to a visibly intoxicated person, and 2) selling alcohol to a minor. The license
was suspended for five (5) days and the licensee was required to pay a fine in the amount of $2,500 to cover
administrative and investigation costs.
Last month the Authority found a license holder guilty of having allowed a visibly intoxicated person to be
served and suspended that license for five (5) days. Three (3) days were held in abeyance for a period of one
year pending no further violations, two (2 )days suspension must be served.
r CHANGE IN AGE REQUIREMENTS
A new bill which has recently been passed made it legal for persons 18 years old or older to serve malt,
vinous and spirituous liquors as long as they are actively supervised by a person at least 21 years of age who
is present on the licensed premise. This provision of allowing persons 18 years old or older to serve does
NOT however apply to liquor stores or taverns that do not regularly serve full meals.
FOOD REQUIREMENTS
Did you know that if you are a Hotel/Restaurant license holder you must serve full meals until 8:00 p.m. and
sandwiches and light snacks after 8:00 p.m until closing? Tavern, Beer & Wine, or 3.2 Beer on premise
license holders must have sandwiches and light snacks available during hours of operation.
NEW CLASS OF LICENSE
A new class of retail license called a "Brew Pub" is now available which allows for product to be
manufactured, sold wholesale, consumed on premise, or to go in sealed containers.

BBQ'S AND SPECIAL EVENTS
The Town of Vail has been a hoppin' place this summer with events such as the 97 Cycle Classic, Team
Evergreen's Triple Bypass Tour, and the Arts Festival, just to mention a few! We noticed a lot of food
service establishments were doing a little outdoor barbequing to help service the large crowds. Please be
aware that the Town Code does not allow for commercial outdoor barbequing unless you are listed as a
vendor on a Special Events License, and approved by the Town's Environmental Health Specialist. For more
information on outdoor commercial barbequing, please contact Lydia Stinemeyer at 479 -2333.
CHANGES IN THE LIQUOR AND BEER CODES
In addition to an increase in license & application fees, as well as new forms, several changes to the Liquor
and Beer Codes have recently been introduced and passed by the legislature. Here are some highlights on a
few of the latest changes which went into effect July 1.
NO MORE EXTENDED HOURS - As of July 1, hours of operation allowed for ALL on- premise
licenses is 7 AM - 2 AM seven days per week. As a result, renewal fees for some licenses may have
actually decreased slightly.
TEMPORARY LICENSES are no longer available to license holders who neglect to renew their
licenses prior to the expiration date. The latest changes in the code provide for a $500 late fee to be
collected by both local and state authorities in addition to license and application fees, making total
payments rather costly.
CONFISCATED I.D.'s - The newly revised codes extend the time frame for licensees to turn over
confiscated I.D.'s to the local or state law enforcement agency within 72 hours.

For the record I am Holly McCutcheon, Secretary to the Authority. This application was filed
within the deadline on May 29, 1997. Appropriate publication was made June 27, 1997, and the
premise was posted in a timely manner also on June 27. Character investigations do not
reveal or include any information whicA would be detrimental to the granting of said license.
All documents are in order and the file is complete. The applicant has submitted a petition
containing 22 signatures in favor of the license.
The applicant received DRB approval on 7/2. Didn't have to do anything with the PEC.

Upon receiving this information, I spoke with Operations Lutinent, Joe Russell of the Vail PD.
He told me that the operation came about due to numerous complaints from citizens and
parents of underage teens that Vail was an easy place to obtain alcohol and that teens were
already having serious alcohol problems. Letters to retail liquor stores were hand - delivered
by the Vail PD informing licenseholders of the problem, and warning all clerks to be properly
trained in requiring id's from their patrons. Joe said the operation had been in the works for
some time.
All three individuals are scheduled for arraingment in Municipal Court on July 17.
