a. CNI LLC DBA The Dancing Bear, a Tavern Liquor License;

Kathy Vieth made a motion to approve, seconded by Mary Zarba, passed
unanimously 5-0.
2. PUBLIC HEARING - Consideration of the Authority of a license renewal and
trade name change for PHM Partners Inc. Evergreen Lodge Vail Ltd. DBA
Evergreen Lodge Cafe, a Hotel & Restaurant Liquor License located at 250
South Frontage Road, Vail, Colorado.
Represented by Pam Stenmark
a. Trade name change from Evergreen Lodge Cafe to Altitude Billiards &
Sports Club & Cafe
Bill Bishop made a motion to approve, seconded by Mary Zarba, passed
unanimously 5-0.
b. License renewal; expiration date 2/21/00

3. PUBLIC HEARING - Consideration of the Authority of a manager registration
change for Platz'I LLC DBA Platz'I Street Bar, A Tavern Liquor License, at the
location of 242 East Meadow Drive, Vail, Colorado.
a. Change of manager from Scott Richards to David A. Cribbs

Mary Zarba made a motion to approve, seconded by Kathy Vieth, passed
unanimously 5-0.
PUBLIC HEARING - Consideration of the Authority of a manager registration
change for Kaltenberg Castle Brewery Inc. DBA Kaltenberg Castle Royal
Bavarian Brewhouse Vail, a Brew Pub Liquor License at the location of 600
Lionshead Mall, Vail, Colorado.

5. PUBLIC HEARING - Consideration of the Authority of a Modification of Premise
for City Market Inc. DBA City Market #42, a 3.2 Beer License at the location of
2109 North Frontage Road, Vail, Colorado

Connie Knight made motion to approve, seconded by Bill Bishop, passed
unanimously 5-0.
5. PUBLIC HEARING - Consideration of the Authority of a Corporate Structure
Change for Antlers Condominium Assocation DBA Antlers Condominium
Association, a Tavern Liquor License, at the location of 680 West Lionshead
Place, Vail, Colorado.
A. Corporate Structure Change: Tom Riedel, Secretary, replacing Carol
Cockrum as Secretary; and
B. Carol Cockrum, Vice President, replacing Tim Soggin as Vice President

6. PUBLIC HEARING - Consideration of the Authority of a Corporate Structure
Change and Renewal of License for Safeway Store Forty Six, Inc. DBA Safeway
Store No. 631, a 3.2 % Beer Retail Off Premises License, at the location of 2131
North Frontage Road, Vail, Colorado.
A. Renewal of License: Expiration: 1/25/00; Manager: Jim Brookshire

Connie Knight made a motion to approve, seconded by Bill Bishop,
passed unanimously 5-0.

7. PUBLIC HEARING - Consideration of the Authority of a Corporate Structure
Change for Marriott Hotel Services, Inc. & CCMH Vail LLC DBA Marriott's
Mountain Resort at Vail, a Hotel & Restaurant License, at the location of 715
West Lionshead Circle, Vail, Colorado.
A. Corporate Structure Change (for Marriott Hotel Services, Inc. ONLY):

Mary Zarba made a motion to approve, seconded by Kathy Vieth, passed
unanimously 5-0.
8. Any other matters the Authority wishes to discuss.
At this time, Jay Peterson, owner of Alpine Wine & Spirits would like to have a
brief discussion with the LLA regarding a location change.
Tom Moorhead gave the LLA background information regarding a location
change, per Section 12. 7. (page 29) TOV is considered one neighborhood.
Discussed with Matt Cook and recommendation was to look to the LLA to waive
the petition process if appropriate.
Jay Peterson, stated when he discussed this with Tom and called the state for
clarification. He would like to request the LLA waive the petition requirement for
needs of the neighborhood. He is contemplating moving to a retail space inside
City Market. This would be more convenient to City Market shoppers. The
space would be the southern most retail space in City Market retail spaces.
Further discussion ensued.
Dave asked if Jay is comfortable with the liquor laws and the status of things at
City Market.
Mark Pritchard stated if Alpine Wine & Spirits goes in, City market will take away
their 3.2 liquor license and the winery area and they would just have the retail
liquor license on the premises.
More discussion ensued regarding hours of operation, location change rebuttals,
competition, and other issues.
Connie was not comfortable with making a decision at this time. She wanted
more input from others.
Tom explained what is being asked of the LLA ,
Mary Zarba made a motion to not require Jay to present additional petitions for
the location change and bill seconded the motion and it passed —1, Connie
Against.
9. Discussion regarding police reports on incidents at Pepi's and Marriott's
Mountain Resort at Vail.
Sheika Gramshammer represented Pepi's. LLA concern was the manager was
intoxicated and how could he do his job?
Sheika said she investigated this incident and their was a policy that employees
are not allowed to drink while working. The bartender clocked out at 10:50 pm
and he was pulled over at midnight. So he went drinking after he closed Pepi's
and he was drinking at other establishments. She asked other employees about
this incident and they confirmed that Peter did not drink on duty.
David said it was helpful that Sheika has a policy and enforces it. She needs to
reinforce the strict policy and that she will enforce the policy. Connie was not
comfortable with making a decision at this time. She wanted more input from
others.
Was discussed with their application above. David Shahriari explained the
alcohol was given to the juvenile by her guardian and not the staff. Also all
banquet servers and service staff are or will be trained in TIPS. He handed out
the staff affidavits and steps to correct the problem with actions they are taking to
mitigate the issue. The LLA was
Tom stated Joe Russell has been the police department coordinator on the liquor
violations.
Joe said the Trails End has a liquor violation, 8150 has one and the Marriott had an
incident on New Year Eve. He filled them in with the incident particulars.
Employee party underage drinking at trails end.
New years eve changes for special events. Largest gathering of people he has seen in
18 years. Alcohol violations everywhere, no way to dealwith it with 32 officers.
They were overwhelmed. Towon council will be looking into changing it. And
July 4th will be the next issue. On detox issue, release them to responsible party
but on large events it's hard to get detox help. It's getting harder and harder to
get detox help and to control the large crowds.
Tom said with 32 officers on duty and you arrest one on one you get less coverage.
Real concern was loading of buses, tov employees assaulted, serious accident
with buses- VA employee. Coucil is coonsidering if they need to take any action.
Possible special event with alcohol permit. Security may be better, better control
of alcohol, id checks, and limitations on underage drinking, etc. a lot of validity
of controling the event. Downside is it would be difficult to beinsured, merchant
concerned about cover charge to access other locations, a lot of conflicting
issues.
Kathy asked about public drunkenness and how that is being handled. Joe said State of
Colorado has a law that you cannot criminalize public drunkeness.
Tom said there are a number of offenses that are on Colorad books but the public
drunkeness itself is not a criminal offense.
Further discussion ensued.
Further explanations, lodgs were not booked up and so lodges wer filled with kids form
8-10 people. Etc.
10. Next regular meeting of the Vail Local Licensing Authority will be Wednesday,
February 9, 2000.
