Good Morning to P►11,
I apologize for my absence. Since our last meeting occurred in September � was
under the impression that our next mcctin� would iake place 12 months later, in
September of this year. Further, attached is the notice we received on Friday Auge�st the
4`� lrtting us know we had a�earing on August 9�. Needless to say, I was already in a
pla.ne heading east on family basiness and unfortunatety this short notice did not p�rovide
Mitch Garfinkel ample time to arrange sic travel. Susan Tull� aur business manager and
Micha.el Dunlap, our bar managcr attended both of our mcetings last year and are fully
qualified and capable o£speaking on my behalf.
Though I am not abk to attend I would like to bring tavo k�yr fac�ors to your
atter�tion. First, on 6/30/2000 Mr. Garfinkel €tew into town for a meeting with the
Lionsheaci Center Condo assoaation. The following peoplt were in attendance: Mitch
Crarfinkel, Susan Tullc, Micbael Aunlap, and mysol£ of Garfinlcc!'s, Larry Barnes at� Rob
Dale af Vail Home Res�ta]s, Kevin Mcann of $lack �arrot Audio, Todd Howe of 1T�
Productions, owner Fred Buck, owner Estaqcprio Cottins, Board member 3ce Macy, ancl
attomcy's rcprescnting cach side. The purpose of the meeting was to address several
general building issnes and the cantiuwing noise problem. I am haPPY to report that the
meating wern very well, certain decisions wcre madc, and w� are hcadiag in a very
positive direetion with both 7odd Howe ac�d Kevin Mcenn currently working on our
property. I think it is imposcent ttmt you know that ow managemeat team an� Mr.
GarSnk�l are taking proactivc steps to dea! with the ongoing co�erns o£ our cvndo
assvciatioq and that relationship is much bette,r off now t6an it was a year ago at this
time. I must stress to you that thc problenns you always heat about are being dealt with to
the best of aur ability, aud suggest t6at Mr. Gar6nkel's atttndance at the raeeting on
6l30/00 could gossibly make up for his unforn�nate absence at this Liqua Board heari�ag.
$econdly, we have had a great year at Garfinkel's. Our relationslrip with the
poliee department has never been better, as we continue co make gcogtcss in ouc tiquar
service policies. At tlus poi� in time we have more doormea and �re maoagemeut that►
we have ever had in the past, taking time co cut peopie off, call taxis for those who �ed
them, and recog,izing poternial problems before they occur. When problems �o o�,�cw
we do not hesztate to alert the police d�cpartment. ?he officas aro our number one aliies
in helping to combat faise identificatioq dealing with issues of over scrvice, and
maintaiting order in L;onshead Yllage �uvhen we close. I oommead a]l of thern for their
job and thaak them for their service ovcr thc cow-se of this past yeai'_ Fnrther, I�uage
you ta speak with any and a�l of the officers about otu rel�tioaship.
Let the records show that any probl�ns we have had this ytar l�ve ban dealt
with in a responsible and professional manner. lt is importaat not to judge our business
nor our efforts based oa the actions or cheracta�s of some of our cliemele. I am proud of

The I,ocal Licensing Authority is composed of five
members appointed by the Town Council. •
Chairperson convenes the Local Licensing Authority
to conduct a public hearing to consider an anplication
for a liquor license, stating the name of the applicant
and the type of license sought.
Chairperson asks the Towri Clerk if all required infor-
mation and fees have been supplied and paid by applicant.
The Town Clerk will state for the record whether the
file is complete or if incomplete, the information that
is lacking. It will also be noted for the record that
notice was duly published and posted, and that the pre-
liminary findings��nd order were sent to the applicant.
4. Chairperson asks the Town Attorney if he has reviewed
the application and if it is properly filled out in
compliance with the Colorado Liquor Code and the Rules
of the Authority.
5. Chairperson asks the �'own Clerk if he has circulated
the referral report to the appropriate Town agencies.
The Town Clerk will then respond by summarizing the
comments from the referral sheet.
6:. If there are adverse comments, the appropriate Town
office will be asked to express for the Authority the
problem or concerns. The applicant will be allowed to
present his position during his presentation.
7-. Chairperson asks the Town Clerk if any petitions or
letters have been received, either in favor of or aqainst
the application and, if so, asks that they be included
in the record.

P'rocedure --�Hearing:
1. Chairperson asks the interested parties present to identify
themselves and the position they wi•11 present.
2� Chairperson asks applicant or applicant's attorney if an
attorney appears, to present the evidence and/or witnesses
in support of the application:
�(a) Any person who testifies will be sworn by the Chair-
person.
(b)• Chairperson then asks members of the Authority and
the Town Attorney if they hnve any questions for the

(c) Chairperson then asks any party in interest if they
would like to question the applicant or person
testifying.
(d) The same procedure is followed with resnect to appli-
cant s witnesses, if any, until all of applicant's

(e) Any letters, petitions, documents, or other�evi-•
dence in support of the application may be intro-
duced at any time during the presentation of
applicant's case.
3. Chairperson then asks opponents if they have evidence
and/or witnesses to present in opposition to the appli-
cativn:
(a). Witnesses should be sworn by the Chairperson prior
• to their testimony. _
(b) Each witness may make a statement and/or may be
examined by the attorneys representing opponents.
(�) After witness's testimony, the Chairoerson asks
the members of the Authority and the Town Attorney
if they have any questions of witness. :
(d) Chairperson then asks applicant or his attorney if
he would like to cross-examine opponent's witness.
(e) The same procedure is followed until all of oppon-
ent's witnesses have testified and have been cross-
examined. �
(f) Any letters, petitions, or documents�in opposition
to the application may be introduced at any time
during the opponent's case.

4. The applicant is then allowed to present evidence or
testimony in rebuttal to.the opponents' presentation.
5. After all of the evidence has been p.resented by the apvli-
cant and the opponents, the Chairnerson asks the applicant
or his attorney if he would like to make a closing state-
ment.
_ 6.�' The Chairperson then asks'the members of the Authorfty
and the Town Attorney if they have any further comments
or statements to make regarding the application.

asks the members if they are ready to make the required
findings ax►d ruling. If they arp not, the matter may
