RE: LOCAL LICENSING AUTHORITY MEETING — September 10,
2003
Your attendance at this meeting is important. The Local Licensing
Authority will not move forward on your item unless you or a
representative is in attendance at this meeting. If you or your
representative does not show up, your agenda item will be tabled to the
October 8, 2003 meeting. I have enclosed an agenda for your use.
The meeting is scheduled for Wednesday, September 10, 2003 at
10:00 a.m. Please plan to be in the Town Council Chambers no later
than 10:00 a.m. at 75 South Frontage Road, Vail, Colorado. If you have

2. Consideration of the Authority for a Manager Registration change for Safeway
Stores 46, Inc. dba Safeway Store #0631, a Retail 3.2% Beer Off Premise
liquor license, located at 2131 North Frontage Road, Vail, Colorado.

3. Consideration of the Authority of a Request from Alpine Wine and Spirits to
discuss possible opening of second security curtain during hours of operation.
Feedback and discussion on information received from Colorado Department of
Revenue and Local Licensing Authority.
Mick Ireland and Mickey Warner have suggested they would install a solid wall
with t -bar panels /bolted into floor, from the far eastern door to center post and
decorated with wine crate fagade panels 1 /4" thick, which would be at least 40
inches high.
Discussion ensued by the LLA board. They are concerned about the thinness of
wall and height.
Tom Mullin from West Vail Liquor Mart, asked for clarification of some of the
issues. Wants reason for changing walls.
Mick said it was aesthetics (looks closed with the gate down), visually attractive,
storage issue and security.
Tom Mullin said it's not the TOV job or the authority's job to make sure the
public knows the store is open. It is the establishments job not the authority's
job to ensure the establishment has opportunity for getting their customers to
know they are open. Tom went through the history of Alpine Wine and Spirits,
from change of location, etc. including letters from Don Pace with Colorado
Liquor Enforcement Division regarding the gate being down and width of
opening, as well as Regulation 47 -302 Changing, Altering, or Modifying Licensed
Premises, Section 2 and 4(B). (see attached notes). He stated the population
and other needs of the neighborhood has not changed in the last few years. He
feels the change is not necessary as there are no representatives of the
neighborhood stating they think they are closed, nor it is about seeing that it is
aethestically pleasing, etc.
Mick responded to the objections that were made. There was no executive
session on the original motions for approval, and there were no violations. This
is not a mini - hearing about a liquor license to be issued. The other issues about
under age, shoulder tapping etc. are not appropriate at this discussion about the
wall change. There is nothing in the code that is contrary to what they are
trying to do. Does their proposal meet the LLA conditions or needs? They think
they have met those needs. The needs of the neighborhood are being met and
the manager is getting comments that they thought the store was closed. It
rings true.
Rob stated he thinks the LLA needs to take all things into consideration. Bob 5
Louthan stated if they look at the obligation to enforce the state codes, and the A
wall is not a stack of boxes it meets the state laws. Connie stated she is
against the thin wall. She was against the liquor store being in a grocery store in
the first place. She said the gate does look like East Colfax and a high crime
area. She wants the planter box because it is more substantial than what is
being proposed.
Mick said their preference is for the thinner wall and screwed into the floor.
If the board insists on an 18 inch deep flower box, they will get a planter box.
Dave Chapin asked if the alteration would require a public meeting. The LLA can
make the choice to have this be an agenda item at the next meeting.
Connie suggested they come back with another proposal.
Mick proposed that they would submit a plan but would not implement it until
the Chairman of the LLA signed off on it. He does not want to come back for a
fourth meeting.
Lorelei stated the LLA could make conditions of approval or changes at this

meeting and not have them come back again.
Connie made a motion to approve the request to alter the existing premises to
duplicate the barriers that are on the other side of the post with the same
height,width and depth of the existing planter, with final approval based on
submission of documentation of the diagram and infrared security system to the
Authority by October 8, 2003.

4. Any other matters the Authority wishes to discuss.
a. The Stipulation and Agreement for Fubar was signed by Todd Milner and
will be on record in the Town of Vail liquor files for Fubar.
b. The annual liquor establishment meeting that is usually held in November
has been moved to December 10, 2003 from 1 -3pm.
5. Next regular Meeting of the Vail Local Licensing Authority will be Wednesday,
October 8, 2003 at 10:00 a.m.
