Unfortunately these celebrations have traditionally been times when teenagers involve themselves in risk taking behaviors such as drinking alcohol, using illegal substances and/or driving or riding with someone else under the influence. The law enforcement agencies in Eagle County are asking you to work with us to insure a safe and happy spring season for our kids and those they come in contact with. Our goal is to provide a community environment in which not one fatality or serious injury is sustained to any member of our community due to poor decision based upon risk taking behavior that could have been prevented. Local law enforcement has joined together and will be providing party patrols and compliance checks throughout the spring prom and graduation season. The goal of these police activities is to reduce the opportunity for our kids to become involved with drugs and alcohol. If we all work together, we can establish an environment where our events are as safe as possible, while still allowing the kids an opportunity to express themselves. The Colorado Liquor and Beer Codes, specifically 12 -47 -901 (1) (a), C.R.S., states "it is unlawful for any person to sell, serve, give away, dispose of, exchange, or deliver or permit the sale, serving, giving, or procuring of any alcohol beverage to or for any person under the age of twenty -one years, to a visibly intoxicated person, or to a known habitual drunkard." Please help us achieve our goals by reviewing your policies, procedures and practices on the sale of alcoholic beverages to underage persons with your staff to insure that your business is in compliance on every sale. Violations of this state law can result in a criminal summons being issued and/or administrative hearings with the local or state licensing authority. Specific information regarding "best practices" can be accessed at your local law enforcement agency or through the State of Colorado's Liquor Enforcement Division. "TIPS" training is also available and is designed to educate servers of alcoholic beverages in their responsibilities. Please indicate your interest in providing this training for your staff by calling Commander Joe Russell with the Vail Police Department. His direct line is 479 -2329. Any and all violations occurring after March 2, 2004, are not addressed herein and may be viewed by the VLLA as additional offenses. 7 s a 5. The Licensee hereby admits that on or about January 7, 2004, a bottle of alcohol, to wit: a liter bottle of Makers Mark Whiskey, was removed from the licensed premises by an employee of the licensee. The licensee further admits that, even though he may not have been personally involved in the alleged violation, this conduct constitutes a violation of C.R.S. § 12-47 -411, which provides that spirituous liquors be consumed on the licensed premises. By admitting this violation and entering this stipulation, the Licensee acknowledges and agrees that he is admitting that a violation of liquor licensing laws has occurred as alleged and that no further evidence or proof thereof shall be required to establish a violation. Licensee further agrees that as a result of this violation: the liquor license of the Licensee shall be suspended for a period of ten (10) days, with seven (7) of those days to be held in abeyance for a period of one year on the condition that no other liquor license violations occur within said period and that the Licensee complies with all terms hereof. The parties hereto further agree that the three days which the license shall be suspended shall be Saturday, July 3; Sunday, July 4; and Monday, July 5, 2004. 6. The licensee further stipulates and acknowledges that he is entitled to have an attorney represent him in this matter. 7. The stipulations contained herein are set forth as minimums. Licensee should add to these requirements as necessary for each particular event as Licensee will be held liable if the requirements are insufficient to ensure a safe and orderly establishment. This matter will be reviewed by the ALA after the summer season of 2004, to determine if this stipulation has alleviated potential problems as discussed herein. Licensee may also be brought before this board prior to said review for disciplinary actions for future violations of the liquor code not contemplated by this stipulated agreement. IN WITNESS WHEREOF, the parties have caused this Stipulation to be executed this 13th day of April, 2004.
