CO 81657 on Friday, March 5, 2010 from 3:00 p.m. to 8:00 p.m.

These minutes apply to items No. 7 through 13.
Kristin Jennings and Sheri Mintz were sworn in by Lorelei Donaldson.
Kristin Jennings stated that Bright Future foundation will have 3 volunteers at each
gallery, one at the door and 2 in the gallery, and there will also be 1 TIPs trained server
at each gallery, as well as roving' volunteers.
New this year, Bright Future's will be providing transportation from Beaver Creek to Vail
for this event. They usually have between 300-400 people at this event. It is becoming
very successful and popular.
Kaye stated they couldn't have donated alcohol. Lorelei stated, per State of Colorado
regulations, they must purchase their alcoholic beverages if they are charging for the
event.
Kristin and Sherry said they would make sure they were in compliance.
Kristin stated they hold this event two times a year, once around the first part of March
and the other around Labor Day weekend.

14. PUBLIC HEARING: Consideration of the Authority of a Special Events Permit for the

81657 on Friday, March 5, 2010 from 3:00 p.m. to 8:00 p.m.

Matt Mire, Town of Vail Attorney, stated that the liquor licensing authority must uphold
and follow State of Colorado liquor laws. The public posting on the premises did not
comply with State of Colorado regulations. Regulation 12-48-106 (2) states: "(2) Public
Notice of the proposed permit and of the procedure for protesting issuance of the permit
shall be conspicuously posted at the proposed location for at least ten days before
approval of the permit by the local licensing authority."
The posting of the premises was not in compliance with state law per Lorelei Donaldson.
Lorelei proceeded to discuss the timeline and actions related to the violation. The
posting was done by Lorelei Donaldson on Sunday, January 31, 2010 to comply with the
10 day requirement. She posted all 8 special event locations for the Connoisseur Trail
event. When she attempted to post at the Squash Blossom, she was told she couldn't
place it on the door and was directed to post it on the outside of the door onto the
stucco building. She explained to the person in charge on Sunday that the notice must
stay up until after the liquor board hearing on February 10,2010. She went by on
Monday, February 1, 2010 at 9:45 a.m. and the notice was still up. She went by again
on Tuesday, February 9, 2010 around 2:00 p.m. and the notice was gone. She went
inside Squash Blossom and spoke with Amy, the manager. She asked were the poster
was and was told it was in back. Amy said the poster kept falling off the building.
Lorelei informed her she has told the clerk on Sunday that if it didn't stay up that it had
to go on the door. This was not done. The poster was no where in sight. Lorelei
informed Amy, the manager of Squash Blossom, that the required posting was not in
compliance with State law.
Lorelei then went back to the office and sent an email to Amy Phillips and Kristin
Jennings regarding the issue. Kristin requested the item stay on the agenda.
Lorelei spoke with Dan Gunter, at the state of Colorado Liquor Enforcement Division
around 4:00 p.m. on Tuesday, February 9, 2010. Dan stated that if the posting
requirement was not met, the special event permit must be denied per 12-48-106 (2).
Kaye suggested that in the future maybe one of the applicants go with Lorelei to post
the notices so they can explain the importance of the posting or to inform the
establishments that the posting is a state requirement and must be complied with at the
time they request use of the gallery space.
Kristin asked if we could 'beautify" the poster some how. Lorelei said the poster
information is regulated by the state and is there to inform people of a potential liquor
license application at that location. She said some people may think it's a going out of
business sign.
KJ stated people read the information and know it's nota going out of business' sign.
The Bright Future Foundation for Eagle County request for a special event liquor permit
at the Squash Blossom was formally denied and in accordance with 12-48-106 (2).
They cannot have alcoholic beverages on the Squash Blossom premises for the
Connoisseurs Trail event. However they can have non-alcoholic beverages and food and
still participate in the event.
Amy Phillips requested Lorelei send her the information regarding the size of the posting
notice and the information pertaining to what "conspicuously posted" definition means
for future applications. She asked if the posting could be done inside of the location.
Lorelei stated it must be facing outside in a window or door of the establishment, not
the inside as everyone walking by must have the ability to attend and either support or
protest the special event liquor permit application request per state regulations.
Lorelei will follow up and send the requested information.
15. Any other matters before the authority.
State compliance check document passed to authority for their review. Reviewed and
compared Aspen and Vail compliance check information.
Penny Harpe said she did a trade and was in Aspen a few weeks ago. She said they
have a more laid back approach to monitoring liquor licenses.
The Aspen police dept. and fire dept.'s are very different from Vail.
16. Next regular Meeting of the Vail Local Licensing Authority will be Wednesday, March 10,
2010 at 10:00 a.m.
