8. Any other matters before the authority.
a. Response to correspondence from attorney, Amanda Bradley.
This Authority granted renewal of the Hotel and Restaurant liquor license for La Bottega,
Inc., d/b/a/ La Bottega on September 14, 2011. The Authority received a letter dated
September 13, 2011 from several property owners at 100 East Meadow Drive expressing
their objections to La Bottega's license renewal. Though no response is required, the
Authority wishes to correct for the record some erroneous statements in that letter.
The first objection raised in the letter was that La Bottega was violating the applicable
Condominium Declaration. In response, the Authority again states that it does not
interpret private covenants such as the Condominium Declaration.
The letter also stated that a public hearing on the renewal was required. This assertion is
unfounded. Pursuant to C.R.S. § 12-47-302(1), the Authority was not required to hold a
public hearing on the application for renewal. Because no public hearing was required,
the Authority was not required to post the premises and provide notice.
The statute cited in the September 13th letter refers to requirements that are imposed when
the Local Licensing Authority considers granting a new license. Here, La Bottega's
application was for a renewal, not a new license. Accordingly, the objection is
misplaced.
Finally, the letter implies that La Bottega was not in lawful possession of the licensed
premises at the time of the renewal. There is nothing in the record to support such an
allegation.
b. Next regular Meeting of the Vail Local Licensing Authority will be
Wednesday, April 11, 2012 at 10:00 a.m.
