Dear Council f1embers,
The Board of Directors of the Eagle Valley Homebuilders Association
met Saturday, February 5, 1983 for the express purpose of reviewing
the final document setting forth the new Subdivision Regulations and
Construction Design Standards for the Town of Vail• We applaud the
Town's effort in developing these long needed standards and, with a
few minor clarification concerns, would support adoption.:of the
Subdivision portion of the ordinance.
Relative to the Construction Design Standards section we have observed
what appear to be a substantial number of engineering inconsistencies
which make us seriously question adoption of this particular body
within the ordinance.
It is our considered opinion that the Town may be exposing itself _.
to a significant liability question by practicing professional
engineering without the benefit of a registered professional engineer.
We sincerely suggest Council further consider this particular segment
of the ordinance before final adoption.

We request Councils' indulgence in considering the below mentioned
alterations or additions.
_17.04.040 Jurisdiction- Paragraph B raises a question of enforceabil-
ity
17.08.120 Lot - after public streets, we suggest the wording be
changed to rea ^public streets, road, or easements"
17.16.020 last sentence should be changed to read "an advisory
review" or a predesign conference"• Developers not'
familiar with our process could misconstrue the present
wording as preliminary plan approval at the staff level.
]7.16.070 Paragraph A-2 after the word prepared, insert "and certified^
17•I6.130 Paragraph B• last sentence after PEC insert ^and the
applicant^
17.16.250 Guarantee for Completion and Maintenance of Improvements
2nd. sentence- said agreement shall cover 1001 of the
current estimated cost of improvements, established through
the current F•W• Dodge Company or R•S• Means Company cost
factors or a firm bid proposal, at the time they are to
be installed as computed by the town engineer and approved
by the town manager. The agreement shall provide all in-
formation necessary to allow the town engineer to formu-
late an estimate. The guarantee shall be in the form of
a performance completion bond or cash escrow at the option
of the applicant.'
17.16.330 Request change from 3 to 5 years
17.22.030 Insert the word "plan" of"ter the word site in the first

Members of our organiztion will be available at work session to further
discuss our reasoning in requesting consideration of these changes.

Zoning Committee, I have been asked to re uest Council
consider a one eek delay in ormal a option of r finance
Our purpose in requesting this one week delay is to
allow our Board of Directors the opportunity to review
and comment on the final document in it'`s final form.
The number of modifications and changes from the exis-
ting subdivision regulations are substantive, and will
have a critical effect on the total real estate and
construction industry in our community.
While our organization is entirely sympathetic to the
requirements for this new document, we feel it would
be in the best interests of all parties to allow this
one final review of the complete document prior to
adoption.
