SUBJECT: Vail LionsHead Mall Construction
Some members of the Town Council have requested that-the Community Development '
Department see if phasing of some improvements in the Lionshead mall in 1983
would reduce construction time in 1984. Also, to determine what safety areas
need to receive attention in 1983.
Below are estimated- Town of Vail costs for some of the construction and safety
items in 1983:
1. Phasing of all construction recommendations for 1983
a. Looping water main
The Water and Sanitation District are meeting next week to determine
what their priorities are for new water main construction in 1983.
Looping of the water main in the fall of 1983 can save up to 2 or 3
weeks of disrupt-ion in the mall area in 1984. Totivn costs are estimated
to be approximately $30,000 for our part of the looping costs. Our
recommendation is to go through and install the water main in 1983 so
that we can have pedestrians use the mall and not have a major trench
down through the middle of the mall in 1984.
b. Design and engineering
The estimate for design and engineering fees ~s $150,000. This would
allow time for bid packages to be developed, sent out to contractors,
returned, and to determine the most favorabie cost for the Town of Vail.
We would also be able to determine which areas need to be redesigned
in order to meet the budget. Since we will rat be using a construction
manager for the project, we can request individual bids, have time to
review them, request additional contractors sa~bmit bids if necessary
and to have the best price far the work that needs to be done. Our
recommendation is to go through and do the design and engineering work
through the summer and in the fall and get bid packages sent out late
fall, and get them. back so that we can deteraine costs and move ahead
with the project.
2. The following are items. that we consider need mediate attention
but are considered band-aids because they will nat be part of or a limited
-part of construction in 1984.
a. The light system within the Lionshead mall has been failing for several
years. There are lights in front of the Sward and between Montanero's

I and the Sunbird that currently are not operating, There may be other
problems that we don't know about and will have to correct. Our estimate
is to have approximately $8,000 available in order to insure that the
light system will be working for the entire summer and next winter and
also to increase the amount of light by putting new light bulbs in
throughout the mall. The amount of light coming out of the present
street lights was noted as a problem by merchants and property. owners
at a meeting that was held yesterday regarding mall design.
b, Stair repair
We need to go into the mall and repair certain stairs that are a safety
problem: It is estimated that to repair the stairs so that they would
be in good condition for the summer and for next winter would be approxi-
mately $5,000 in expense.
c. Removal of the berm. by the Vail Cookie Company, Charlie's Gondola
Ski Shop, Current's Jewelry
One of the main problems that has previously been noted in the Lionshead
mall is the inability of the tourists to actually be walking near where
the shops are located. It is our recommendation that we would go
through and remove the berms that are along the area by the Lionshead
Center Building and that we would repair the area with an asphalt patch
over this area. In addition, comments .were received that we would like
to receive some moveable planters in that area, so that we would not
just have a major asphalt area for this summer, but that it would be
broken up with planters. Estimated cost for doing this would be approxi-
mately $18,000.
These are the recommendations for items that need to be handled immediately in
the Vail Lionshead mall.
Yesterday, Steve Patterson, myself and Jeff Winston had meetings with Public
Works and .the Fire Department regarding the mall design and in the afternoon
had meetings with Lionshead merchants and property owners regarding the final
design of the mall. The meetings were extremely positive. They are definitely
interested in continuing and insuring that the project moves ahead, They also
had some good suggestions on minor modifications that should be incorporated
in the final design.
In discussing with Bill Pyka the need for funds to continue with the program
of phasing the Lionshead mall and taking care of sa:~e of the problem areas,
Bill stated that we should be able to have short term borrowing in order to accom-
plish the needed construction or rehabilitation in 8983. It is the staff's re-
commendation that we follow the approach outlined in this memorandum.

Dear Kaiser:
In re-evaluating the .proposed assessments for the Lionshead Special
Improvement District, it has been brought to our attention that Phase II
of the Marriott Mark was not included in the original square foot
calculation. The notice received by M-K Corporation noted 24,236
square feet of residential and 16,234 square feet of commercial.
The initial assessment proposed for M-K was $11,388.97.
Adding Phase II, there is an additional 52,062 square feet of residen-
tial and 15,390 square feet of commercial. Therefore, the revised
(new assessment is proposed to be a total of $12,686.38 which includes
both phases.
We regret the lateiness of this information, but trust that your long-
term support. for the improvement district remains strong.

The Town Council of the Town of Vail, Colorado, met in
regular session at the Vail Municipal Building, Vail, Colorado,
the regular meeting place thereof, on Tuesday, the 4th day of
January, 1983, at the hour of 7:30 p.m.

ORDINANCE NO. 1
SERIES OF 1983
AN ORDINANCE CREATING LIONSHEAD IMPROVEMENT
DISTRICT; APPROVING THE PLANS FOR AND
AUTHORIZING THE CONSTRUCTION AND INSTALLATION OF
SPECIAL AND LOCAL IMPROVEMENTS THEREIN IN
CONNECTION WITH WHICH SPECIAL ASSESSMENTS SHALL
HEREAFTER BE LEVIED TO PAY A PORTION OF THE COST
THEREOF; APPROVING THE METHOD OF APPORTIONING
SUCH ASSESSMENTS; MAKING FINDINGS AND
CONCLUSIONS BASED UPON EVIDENCE PRESENTED AT A
PUBLIC HEARING CONCERNING THE FOREGOING; AND
SETTING FORTH DETAILS IN RELATION THERETO
WHEREAS, pursuant to the Charter of the Town of Vail,
Colorado, Title 20 of the Vail Code, and Resolution No. 21,
Series 1982, the Town Council held a public hearing on November
30, 1982, relating to the creation of a special improvement
district for the construction and installation of certain
special and local improvements to the LionsHead Mall and
surrounding areas; and
WHEREAS, the Town Council has considered the testimony and
other evidence presented at said hearing and all comments made
by affected property owners and members of the general public
relating thereto.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL,
COLORADO, THAT:
Section 1. Based upon all the evidence, the Town Council
finds as follows:
A.) Pursuant to Resolution No. 21, Series 1982, the
Town Council has duly initiated by appropriate order the special
and local improvement project described herein.

` B.) Notice of a public hearing thereon in the required
legal form was duly published in The Vail Trail on November 12,
1982.
C.) A copy of the same notice was duly mailed to all
affected property owners at the last known address of each such
owner as shown on the records of the County Assessor of Eagle
County, Colorado, by first-class postage prepaid mail on
November 12, 13 and 16, 1982. In addition, steps were taken by
Town officials to ascertain current owners of affected
properties and their addresses and attempts made to furnish them
with actual notice via mail.
D.) A public hearing on the project was duly held on
November 30, 1982, and full opportunity was afforded all
affected property owners to present their views at said
hearing. Said hearing was continued to the date of this meeting.
E.) Schematic design plans have been duly presented to
the Town Council for the improvements proposed to be constructed
and installed, which generally include replacing paving in major
areas of the LionsHead Mall, relocating planting areas,
providing new focal points of interest, unifying and upgrading
utility systems, providing emergency access to all areas of the
Mall, installing a cascading fountain, a sculpture plaza, a new
lighting system and street lights for the surrounding area,
benches, kiosks, planters, bicycle racks, drinking fountains,
and other amenities, and generally improving the aesthetic
quality of the Mall and the surrounding area. Said plans
conform to good architectural standards and practices and are

appropriate for the LionsHead Mall area. Schematic design plans
are hereby deemed satisfactory.
F.) The improvements to be constructed and installed
are special and local improvements which also confer general
benefits upon the Town. It is therefore appropriate that the
general public share in a portion of the cost of the
improvements. The total estimated cost of the improvements is
$2,600,000. The portion of the cost of the improvements to be
borne by the Town is $1,600,000. The portion of the cost of the
improvements to be defrayed by special assessments against
affected properties specially benefited shall not exceed
$1,000,000. Said cost estimate and apportionment are
satisfactory and reasonable in every respect.
G.) Properties proposed to be assessed abut or are in
the vicinity of such improvements and will benefit from the
construction and installation thereof. Assessments are to be
levied because substantial special benefits will result from the
improvements to all of the affected properties within the
boundaries of the district, which special benefits are separate
and distinct from the general benefits to the Town which will
also result therefrom.
H.) The proposed assessments have been determined by
using a method of assessment and a formula which apportions the
cost of the improvements on a fair and equitable basis and
reflects a reasonable apportionment consistent with the benefits
to be conferred. The proposed apportionment of the cost and the

method of assessment assure every property owner equal
protection and due process of law.
I.) There have been valid protests filed in accordance
with the Charter and Title 20 of the Vail Code, numbering 84.
The Town Council finds that the number of protests so filed are
less than fifty percent (50~) of the affected property owners
constituting the basis of assessment of the district. The Town
Council duly considered each and every protest, objection and
remonstrance and determined the same to be without merit, and
hereby declares and rules the same overruled and finally passed
on by the Town Council and that the project should proceed
notwithstanding the same as it is necessary for the preservation
of the public health, safety and welfare and is in the public
interest.
J.) The Town Manager or his delegee has duly held
meetings relating to the improvements for the purpose of
informing affected property owners about the same and about the
assessments proposed and for the purpose of obtaining their
reactions thereto.
K.) All necessary legal requirements and conditions
precedent for initiation of the improvements and for the public
hearing on the same held on November 30, 1982, have been fully
performed, met and satisfied.
Section 2. Based upon the above findings and the
additional findings stated below, the Town Council finds,
concludes and orders as follows:

A.) It has jurisdiction over the LionsHead area where
the improvements are to be made and all of the affected
properties described on Exhibit A attached hereto.
B.) There is hereby created within the corporate
limits of the Town of Vail, Colorado, a special improvement
district to be known and designated as "LionsHead Improvement
District" for the purpose of constructing and installing
improvements to the LionsHead Mall. and surrounding areas and of
assessing a portion of the cost thereof to the property
benefited thereby, which property is described on Exhibit A
attached hereto.
C.) All action not inconsistent with the provisions of
this Ordinance heretofore taken by the Town Council and the
officers of the Town directed toward the creation of the
District, the construction and installation of the improvements
therein, and the levy of assessments to pay a portion of the
cost thereof is hereby ratified, approved and confirmed.
D.) The extent of the District to be assessed for the
cost of the improvements and the area to be included within the
boundary of the District shall be all the real property
described on Exhibit A attached hereto.
E.) The schematic designs for the improvements are
hereby approved, however, detailed design may be subject to
modifications which could be imposed due to the amount of the
resources available from the bond proceeds, and the construction
and installation of the improvements within the District as

shown by said preliminary plans are hereby authorized and
ordered.
F.) Upon authorization of the voters of the Town, the
Town will pay $1,600,000 of the cost of constructing and
installing the improvements. In addition, the Town will pay any
part of the project cost which exceeds the estimated cost of
constructing and installing the improvements subject to the
availability of proceeds from the bonds.
G.) The Town Council has determined, and does hereby
determine, that assessments shall be levied against the affected
property in the~District (the property specially benefited by
the improvements therein) according to the method described in
Exhibit B attached hereto.
H.) After considering all of the circumstances
existing within the District and weighing the factors specified
in Title 20 of the Vail Code, the Town Council has determined,
and does hereby determine, that said method of assessment is a
fair and equitable method, and that such assessments shall be in
proportion to the special benefits conferred upon such property,
sufficient to cover the portion of the total cost of the
improvements to be defrayed by special assessments; the
assessment amounts apportioned thereto shall be in proportion to
the special benefits conferred upon said properties as
determined by the Town Council; and as a result of the
improvements to be constructed and installed within the District
each such property will receive a special benefit, including
without limitation increased market value, in an amount which

shall equal or exceed the maximum amount of the particular
assessment to be assessed against each such property;
accordingly, said method of assessment is hereby approved.
I.) The total cost of the project (excepting the
amount to be paid from sources other than special assessments)
upon the completion of the improvements shall be apportioned in
an assessment roll against each property to be assessed as
herein described, and after notice thereof and a hearing
thereupon, assessments shall be levied by ordinance of the Town
Council. The method of assessment provided for herein shall be
used and followed at the time such assessments are so levied.
Said assessments shall be a lien until paid in the several
amounts assessed against each such property.
J.) The Town Council, in addition to the express
determinations hereinabove set forth, by the adoption of this
Ordinance, overrules all other objections and remonstrances that
may have been made, either in writing or orally at the public
hearing.
K.) All assessments shall be due and payable without
demand within thirty (30) days after publication of the
assessing ordinance after its final passage. Property owners
shall be permitted, at their election, upon the levy of
assessments to pay such assessments on an installment basis not
to exceed a fifteen (15) year period with interest not to exceed
sixteen percent (16%) per annum and not less than the highest
interest rate on any special asssessment bonds issued to pay the
cost of the improvements. Interest shall be computed on the

outstanding principal and shall be paid with each installment.
Said installment schedule and maximum interest rate are hereby
approved.
L.) The assessments to be levied against the affected
properties shall not exceed the assessment amounts provided in
Exhibit A attached hereto.
M.) The proposed assessment schedule, hereby approved
by the Town Council, is as shown on Exhibit A attached hereto.
N.) Pursuant to the laws of the State of Colorado, the
Charter, and Title 20 of the Vail Code, special assessment bonds
of the Town shall hereafter be issued for the purpose of paying
for the improvements described in this Ordinance, in an amount
not to exceed the cost and expenses of said improvements,
including engineering, legal and incidental costs, as provided
by law. The bonds shall be issued based upon estimates approved
by the Town Council and as authorized by an Ordinance to be
passed by the Town Council at a later date. The maximum net
effective interest rate on such special assessment bonds is
sixteen percent (16%) per annum. The bonds and the interest
thereon shall be payable out of the special assessments
authorized herein to be levied against the real property
included within the District and specially benefited by the
improvements to be constructed and installed.
O.) The officers of the Town are hereby authorized and
directed to take all action necessary or appropriate to
effecutate the provisions of this Ordinance.

P.) All ordinances or resolutions, or parts thereof,
in conflict with this Ordinance are hereby repealed. This
repealer shall not be construed to revive any ordinance or part
of any ordinance heretofore repealed.
Q.) If any section, paragraph, clause or provision of
this Ordinance shall for any reason be held to be invalid or
unenforceable, the invalidity or unenforceability of such
section, paragraph, clause or provision shall not affect any of
the remaining provisions of this Ordinance.
R.) The limitation period of thirty (30) days within
which suits or actions regarding this Ordinance must be brought,
as set forth in Title 20 of the Vail Code, will commence to run
on December 17, 1982.
S.) The Town Council finds that this Ordinance is
necessary to and for the benefit of the public interest and the
public health, safety, and welfare.
INTRODUCED, READ, APPROVED ON FIRST READING, AND ORDERED
PUBLISHED ONCE IN FULL, this 4th day of January, 1983, and a
public hearing on this Ordinance shall be held on Tuesday, the
25th day of January, 1983, at 1:00 p.m. at a special meeting of

Thereupon the following proceedings, among others, were had

The Mayor informed the Town Council that Ordinance No. 1,
Series of 1983, which was introduced, read, approved on first
reading and ordered published at a regular meeting of the Town
Council held on January 4, 1983, was duly published in full in
The Vail Trail, a newspaper of general circulation in the Town,
in its issue of January 14, 1983, and that the publisher's
affidavit of said publication is now on file in the office of
the Town Clerk. Copies of the Ordinance were made available to
the Council and to the public.

regular session at the Vail Municipal Building, Vail, Colorado,
the regular meeting place thereof, on Tuesday, the 1st day of
February, 1983, at the hour of 7:30 p.m.

Thereupon the following proceedings, among others, were had
and taken:

The Mayor informed the Town Council that consideration of
Ordinance No. 1, Series of 1983, on second reading had been
deferred until this date. Copies of the Ordinance were made
available to the Council and to the public.

Ordinance No. 1, Series of 1983, be amended as follows:
Subsection E.) of Section 1 to read as follows:
E.) Schematic design plans have been duly
presented to the Town Council for the improvements
proposed to be constructed and installed, which
generally include replacing paving in major areas of the
LionsHead Mall, relocating planting areas, providing new
focal points of interest, unifying and upgrading utility
systems, providing emergency access to all areas of the
Mall, installing a new lighting system and street lights
for the surrounding area, benches, kiosks, planters,
bicycle racks, drinking fountains, and other amenities
such as a water feature and/or a sculpture plaza, and
generally improving the aesthetic quality of the Mall
and the surrounding area. Said plans conform to good
architectural standards and practices and are
appropriate for the LionsHead Mall area. The schematic
design plans presented are hereby deemed satisfactory.
Subsection F.) of Section 1 to read as follows:
F.) The improvements to be constructed and
installed are special and local improvements which also
confer general benefits upon. the Town. It is therefore
appropriate that the general public share in a portion
of the cost of the improvements. The total estimated
cost of the improvements is $2,600,000. The portion of
the cost of the improvements to be borne by the Town
shall not exceed $1,600,000: The portion of the cost of
the improvements to be defrayed by special assessments
against affected properties specially benefited shall
not exceed $1,000,000. Said cost estimate and
apportionment are satisfactory and reasonable in every
respect.

Subsection E.) of Section 2 to read as follows:
E.) The schematic designs for the improvements are
hereby approved; however, detailed design may be subject
to modifications which could be imposed due to the
amount of the resources available from the bond
proceeds. The construction and installation of the
improvements within the District as shown by said
preliminary plans are hereby authorized and ordered.
Subsection F.) of Section 2 to read as follows:
F.) Upon authorization of the voters of the Town,
the Town will pay up to $1,600,000 of the cost of
constructing and installing the improvements. The Town
will pay any part of the project cost which exceeds the
estimated cost of constructing and installing the .
improvements subject to the availability of proceeds
from the bonds.
Subsection R.) of Section 2 to read as follows:
R.) The limitation period of thirty (30) days
within which suits or actions regarding this Ordinance
must be brought, as set forth in Title 20 of the Vail
Code, will commence to run on Feburary 1, 1983.
A new Subsection T.) of Section 2 to read as follows;
T.) Based upon objections and remonstrances
presented at the public hearing held November 30, 1982,
and further discussed and considered by the Town Council
thereafter and in reliance upon a written opinion of Mr.
John J. Wallace of Larry Smith & Company Ltd.
supplementing testimony given at the public hearing held
November 30, 1982, the Town Council determines that any
provision of this Ordinance to the contrary
notwithstanding (1) the bus shelter to have been located
near the west entry to the LionsHead Mall shall not be
constructed or installed as a part of this special and
local improvement project; (2) the distances used in
determining the assessments to be levied against
properties in the Vail Spa, The Mark, Enzian Lodge,
Enzian - Building A, Enzian - Building B, and Vail Glo
complexes shall therefore be recalculated accordingly;
and (3) Exhibits A and B attached hereto shall be
revised as required by the foregoing.

Since the completion of the Economic Benefit Analysis Study for the Vail ~
LionsHead Improvement District in October 1982, the Ie~rrn of Vail City
. Council decidad to eliminate the west mall entry bus shelter from the

- major construction improvements to be undertaken as ~r~ of the Vail
LionsHead Improvement District. .~ consequence of t^is decision, `,: - '
assessments of six projects/builc!ings, whose distances factors were cal-
culated based on their proximity to the proposed bus shelter, must be
revised. The revisions are contained in this report aid the revised
assessment roil. The methodology discussed in the oninal~report
remains unchanged. This report s"ould be viewed as an addendum to than
October~1982 report since this report contains ;only the revisions with-
, out a detailed discussion of the methodology., This ad~endum .and the
revised assessment roll also reflects ownership changes and individual
unit size.and use modifications which have occurred or have been ider:t_-
. fled since the earlier report,
. DISTANCE FACTOR CHANGES
The attached revised Table.4 shows the revised distances and benefit
factors assuming the west mall entry bus shelter is eliminated. The
revisions affect only six projects/bull-dings which were measured frori~
the bus shelter. These are: Vail Spa, The Mark Lodge, Enzian Lodge,
Enzian Condos - Building A, Enzian Condos - Building B, and Vail-GIo.
The revised distances were measured from the nearest point of the mall
improvements to the approximate center of each building.
SIZE AND USE .REVISIONS
The attached revised Table 1 and Table 4 show the distribution of
assessed areas by land use in square feet. The square rootage of four
projects have been revised. These include The Mark Lo:'.~e and Lodge at

Based on the revised distance factors and square footage, the sum of ~~
~Y-Factors for all assessed units has begin recalculated to 673,836.003.
So as not to increase any unit assessment, the total district assessM~~_~~~
has boen reduced proportionally from $1_million to $950,413.94.

changes. A summary of these assessments by project and type of use
shown in attached revised Table 7.
