I own one of the Texas Townhouse condominiums; because we are very close to the Golcl Peak lift., our area is besieged with skiers, Vail Associates employees, and others who are not able to locate convenient parking. We have found that these people will take the liberty of parking almost anywhere, quite often blocking Texas Townhouse owners` vehicles as well as parking in the Townhouse parking spaces if they are not already filled. In the past we, have been helped by the Vail Police Department who have come to ticket these unau- thorized vehicles and then leave .for other duties. Subsequent to the ticketing, a vehicle tow company would come to remove the offending vehicles. It is of very significant concern to me that if the police department no longer wishes to undertake this respon- sibility, the owners of the townhouses must make ar- rangements to have the vehicles towed and, I understand, advance the towing fee or provide a bond. As you know, although one has intentionally parked in .an unauthor- ized parking area, and is towed away, that party most often becomes irate and indignant, many times so much so that there is a degree of risk to one's personal Page Two Rod Slifer, Mayor, Town of Vail June 29, 1983 property if retaliation occurs. I don't feel that this is a matter which should be handled by individuals on a private basis. Rather, it seems to be clearly a responsibility of the police. I know that having vehicles ticketed and towed is not a popular activity for anyone. However, my understanding of having a police department involves, among other things, an enforcement of codes, albeit unpopular to do so. In the process of ticketing automobiles for unauthorized parking, the police have been both polite and expedient, and are the party with whom the tick- eted must deal. The police are trained and prepared for those kind of contacts, whereas male and female homeowners ranging in age are not. I strongly recommend that the Town of Vail not consider changing the existing ordinance. Rather, if economics are the primary motivation, then I suggest a parking ticket fee. of greater magnitude be put into effect so that the cost to handle and process unauthorized parking can be meta In short, Rod, I think it unwise that the Police Department, for what appears to be an unpopular task, shift the respon- sibility of that task to the shoulders of unprofessional and untrained residents. Eliminating the professional handling of unauthorized parking will only cause, in my judgement, a rapid expansion of unauthorized park- ing in areas which have inadequate parking already. I learned recently through a Vail Trails article that the Town of Vail government is considering the repeal of its private parking ordinance and taking the TOV and the police department out of private parking control. I really think this would be a grave mistake. Regardless of the number of no-parking signs on Mill Creek Circle skiers in their haste to get on the mountain will take the "calculated risk" if they realize that they don't have to contend with the police or the TOV. Under the present system when the parking violator finds his car missing after returning from skiing, he also knows who to contact--the TOV police. Edith the proposed change, there being no central office to turn to the "irate missing vehicle owner" has no idea where his vehicle may be nor who to contact to get it back. I fear that this action by the TOV could result in physical confrontation, or worse, between the irate vehicle owner, home owners and tow operators. The parking problems of Vail cannot be compared with those of other communities such as Denver, Boulder, and Aspen. Lde have a critical shortage of parking and parking control particularly in and around the lift areas. G1e are all concerned with the image of the police force, but we are also just as concerned that laws are enforced and controls are exercised by those who we pay to do this job -- the police.
