Following is a summary of flooding, rockfall,.and sloughing problems which
affect Town of Vail prooerty. A brief description of each solution and the
' associated approximate cost are included.

Dear Mr. Caplan:

We would Pike to present to you, and through you, to the town
council and any appropriate boards or agencies, our request under the
Vail zoning code, section 18.64.080.
Our request is that unit C-1 in the Lodge .at Lionshead be changed. from
one non-conf orming use (an interior decorating store) to a different
non-conf orming use (a professional office for the practice of psychology).
We believe this use is quite compatible with the surrounding area, with
an appearance and activity level which will maintain, the attractiveness
of the area.
We have been inf ormed that the condominium association of the Lodge
is fully in support of this change. Mr. James I. Miller, president of
the association, is sending you a.letter to that effect.
We do not expect any difficulty with parking problems., since our
client traffic is limited, and the adjacent location of the Lionshead
parking structure should provide ample parking space.
Thank you for your assistance. We hope this issue can be resolved
next Tuesday, July 12, since we are committed to leave this space July 23,
and must make some interior changes in the new space bef ore moving in.
That work cannot begin until this unexpected difficulty is solved.

18.64.060 Maintenance and repairs.
Nonconforming uses, structures, and site improvements may
be maintained and repaired as necessary for convenient, safe, or
efficient operation or use, provided that no such maintenance
or repair shall increease the discrepancy between the use,
structure, or site improvement and the development standards
prescribed by this title. (Ord. 8(1973) § 20.600.)
18.64.070 Discontinuance.
Any nonconforming use which is discontinued for a period
of twelve months, regardless of any intent to resume operation
or use, shall not be resumed thereafter, and any future use of
the site or structures thereon shall conform with the provisions
of this title. (Ord. 8(1973) § 20.700.)
18.64.080 Change of use.
A nonconforming use shall not be changed to another
nonconforming use unless permission has been granted by the
town council. Prior to granting such permission, the council
shall determine that the proposed use does not substantially
differ from the existing nonconforming use in terms of
compatibility with tl~e character of the area in which it is
located, and the council shall determine that the proposed use
does not increase or aggravate the degree of nonconformity
existing prior to any such change of use. (Ord. 8(1973) §
20.800.)
18.64.090 Restoration. _ '
A. Whenever a nonconforming use which does not conform
with the regulations for the district in which it is located, or
a nonconforming structure or site improvement which does
not conform with requirements for setbacks,
