PRESS RELEASE: February 19, 1987-.

As an important follow-up to the: three drug arrests made by the
Vail Police Department on February 17, 1987; the following information.
is being made available:
On February 17, 1987 at approximately 2:30 p.m. the Grand Junction
Police Department and federal agents of the Drug Enforcement Administration
arrested Roberto Bueno immediately after a cocaine transaction. Mr. Bueno
had' sold undercover operatives 9 oz.' of cocaine valued at $18,000 and as
a result of comments made by Bueno, it was decided to place him under
arrest. Subsequent to the arrest -police seized 2 loaded handguns-, a bullet
proof vest, and $16,:000 in additional cash..
Mr. Bueno was arraigned in federal court in Denver on February 18,. 1987.
and is being. held without bond on the. Grand Junction' incident and a
transaction which occurred in the Vail area on February 2, 1987. This
involved the purchase from.Mr. Bueno of 2 oz. of heroin valued at $10,000.
and 10 oz. of cocaine valued at $20,000. This Eagle County situation involved
officials from the Drug Enforcement Administration, Vail Police Department,
and Eagle County Sheriff's Office.
It is believedthat Bueno is the primary supplier. to the. three persons arrested
by the Vail Police Department on Tuesday,: delivering the drugs to the Vail
area, from his residence in Garden City, Kansas.
It should also be noted that a Teresa Carranza was arrested with Mr. Bueno
in Grand Junction and is being held without. bond on one count of delivery
of a controlled substance.
The. arrest of the 5 individuals wraps up our investigation and we consider
this case closed. The. total amount of drugs involved includes 25 oz. of
cocaine and over 2 oz. of heroin, with-Aheir total value being approximately
$60,000.

RE: October 16, 1986 McGrath Memo Regarding Highland Meadows
Gentlemen:
The Vail Town Council has asked me to respond to the memorandum dated
October 16, 1986 prepared by J. Nicholas McGrath relating to the
Highland Meadows subdivision. The memorandum is misleading and
inaccurate. Some of the obvious misstatements are as follows:
1. The memorandum states that from conversations with Susan Vaughn
geologic drainage and stability concerns exclude the Tract A area of
Highland Meadows Filing No. 1. On the contrary, one of the buildings
located on that area, the clubhouse for the Streamside Condominiums, had
extensive soil instability problems during construction.
2. Mr. McGrath states that not all the numbered lots actually have
problems. In reality, the studies indicate that all the lots have at
least some minor problems.
3. Mr. McGrath states that the Town of Vail subsequent to
annexation of the subdivision issued a single family building permit on
Lot 3, and four duplex permits on Lots 8, 9, 18 and 25. In fact, the
Town has issued no permits for single family buildings and has not
issued four duplex permits on Lots 8, 9, 18 and 25. In instances where
the Town has issued building permits, it has required site specific
geologic investigations and appropriate mitigation measures based on the
investigations. Moreover, contrary to Mr. McGrath's statement that the

County of Eagle has issued no building permits, it is our understanding
that the County has issued building permits in areas with identified
soil instability.
4. The memorandum states that Lots 26 through 42 were approved by
the Town of Vail as a special development district to be called Highland
Park, but that neither the developer nor Vail recorded the plat until
recently. Once again, the memorandum misstates the facts. The plat for
any units built on Lots 26 through 42 were filed prior to the issuance
of the certificate of occupancy.
If in fact McGrath's memorandum is correct and Lots 1 through 42 of
Highland Meadows Filing No. 1 contained plat restrictions preventing the
issuance of permits until the subdivision improvements agreements were
complied with, why were those restrictions removed by Eagle County
before the property was annexed by Vail and why weren't the restrictions
disclosed by the Planning staff of the County to the Town prior to
annexation.
The Town of Vail disagrees with the tentative conclusions reached by Mr.
McGrath and, of course, disagrees that "Vail's authority and approvals
far outweigh and supersede Eagle County's actions." The appropriate
time, both legally and practically, to have addressed the soil
instability problems was during the subdivision process and prior to the
sale of the lots by the developer to members of the public.
Although the Town of Vail is willing to work with the County to address
any problems that exist in the Highland Meadows Filing No. 1 area in a
cooperative manner, the Town has no intention of annexing that area
until such time the County agrees to participate in such solutions.

1. What could the Municipal Court Judge do that would improve
his effectiveness?
Strive for greater time efficiencies.
Take less time.
Use his time more efficiently.
To communicate with Council on a formal and regular basis,
et al re: court actions and suggested ordinance changes.
2. What could the Municipal Court Judge do that would improve
his relationship with the Council and staff?
Interact with Council in updating sessions.
To come "to the point" faster.
Learn to present ideas in a more concise manner. I find
myself almost falling asleep when Buck speaks.
3. What could the Municipal Court Judge stop doing which would
improve his effectiveness?
No comments.
Miscellaneous extended "chit chat" with other Town employees?
4. What does the Municipal Court Judge do that you find most
helpful or most effective?
Shows an interest in the people before his bench.
His ability to be respectful to all parties, and the fact
that he takes his job so seriously.

EVALUATION OF THE TOWN ATTORNEY
1. What could the Town Attorney do that would improve his
effectiveness?
Speak into the microphone, complete sentences at an audible
volume.
Speak up louder and speak into the mike.
Larry works well with the Council. Have heard complaints
from the public that he can be hard to work with. He must
remember he is in the public's eye and to be sympathetic to
public concerns and problems.
Speak more directly into the microphones at public meetings.
Continue to work on public presentations and displaying
enthusiasm and attentiveness to public requests for
information.
Continue to work on projecting himself at public meetings.
2. What could the Town Attorney do that would improve his
relationship with the Council and staff?
Anticipate legal issues and include memos in council
packets.
I am especially pleased with the attorney's ability to
tactfully disagree with other staff members and Council. I
dislike working with one side of an issue and appreciate
Larry's candor.
3. What could the Town Attorney stop doing which would improve
his effectiveness?
Mumbling.
Mumbling his words.
He has come a long way in controlling his abrasiveness. I
think he just needs to remain aware of that potential
problem.
4. What does the Town Attorney do that you find the most helpful
or most effective?
Gives definite responses to specific questions by Council.
Writes very understandable memos for the lay person to
understand.
Casting a critical eye on projects (Singletree) which have
numerous potential legal problems.
Responding in a timely fashion to Council (or individual)
queries or concerns.
