Discussion of Proposed Ordinance No. 31, Series of 1987, an ordinance repealing and re-enacting Chapter 3.40 Sales Tax of the Municipal Code of the Town of Uail, Colorado to provide for the self collection by the Town of Vail of the Town of Vail municipal sales tax and setting forth details in regard thereto. 5. Trophee Revillion Dog Sled Race Shelbi Williams VRA Action Requested of Council: Act on the request to use the _ lower bench at Ford Park as the trailer storage and staging area for the dogs. Background Rationale: This item has been discussed previously with the Council's suggestion that other sites be examined. A lot of discussion has taken place with the Revillion Representatives and they would like to ask again that the lower bench at Ford Park be considered. URA will have an expert on the dog sled race present to discuss the Council's concerns. 2:20 2. Discussion of Dobson Ice Arena as Back-up Facility for Bob Ron Phillips Hope Concert Pat Dodson Action Requested of Council: Confirm or change the staff's stand on this issue. Background Rationale: Pat has just been contacted this week by Brad Quayle asking that the Dobson Ice Arena be available as a back up facility for the Bob Hope Concert in case of inclement weather on September 6. The Ice Arena has been booked for 9 months for an indoor soccer tournament which will be going on for 3 days with Sunday, September 6 being the second of the 3 days. We feel that it would be inappropriate to cancel or change the soccer tournament to make the Ice Arena available as a back up facility for the . Amphitheatre. We feel this is an important enough issue to share with the Council to see if you agree with the position we've taken. 2:30 3. Larkspur Lane Vacation Request Rick Pylman Action Requested of Council: Approve or deny the applicant's request. Background Rationale: Leonard Quiram is the owner of Lot 2, Block 2, Vail Intermountain. The historical parking area, including a retaining wall, is located on road right-of-way which was designed as a cul-de-sac. This portion of the road way has never been constructed as a cul-de-sac. The applicant desires to own the property he has historically parked on in order to more effectively control and repair the area. Staff Recommendation: Staff recommends denial of the request. The vacation would require a subdivision variance, as it would create a nonconforming situation with regard to required lot frontage. We recommend that the applicant repair the existing wall, with Public Works' approval of the work, and sign a revocable right-of-way agreement. 2:50 4. Information Update 2:55 5. Other 3:10 6. Further discussion of local sales tax collection program and review/discussion of Ordinance No. 31 prior to consideration at the evening meeting. Background Rationale: Council directed staff to prepare an ordinance for consideration regarding the local sales tax collection program. Adjourn -2- 4 ~ TO: Town Council FROM: Community Development Department DATE: September 1, 1987 SUBJECT: Intermountain Road Vacation Request The applicant, Mr. Leonard Quiram, is the owner of Lot 2, Block 2, Vail Intermountain Subdivision. The historical parking area for this property has been a graveled parking pad supported by a timber retaining wall. This was either built by the original , developer of the house or during the original road construction of the subdivision. The retaining wall and parking area is located within the road right-of-way. The area of the parking and retaining wall is a platted cul-de-sac that was never constructed. The retaining wall supporting the parking pad is in a state of failure. The owner of Lot 2, Block 2, Mr. Quiram, wishes to repair the retaining wall in order to maintain the parking area for his dwelling unit. As the retaining wall is on Town property, Mr. Quiram has two options. One is to repair and rebuild the retaining wall, sign a revocable right-of-way agreement and continue parking on Town property. This does provide Mr. Quiram with adequate parking for his unit, yet gives him no control over that parking. Since it is public property, he technically could not enforce that as parking for his unit only. Option No. 2 would be to vacate the cul-de-sac, or at least the eastern half of the platted cul-de-sac. By law, the vacated portion of land would then be split equally among Lot 2 and Lot 1. This would in effect landlock Mr. Quiram's property. He would have no frontage on Larkspur Lane. He has arranged to purchase the parcel of land that would go to Lot 1 which would then give him control of his parking area and legal access to his property. This, however, creates a nonconforming situation with Lot l, as the owners of Lot 1 would have inadequate frontage to meet subdivision regulations. In order to complete the requested vacation, it would be necessary to go through a variance from the subdivision regulations for minimum lot frontage. Staff recommends that the Town retain ownership of the piece of ground. The applicant may repair the wall subject to Public Works' approval and with the issuance of a revocable right-of- way permit continue parking in this area. .1 . BACKGROUND Vail Intermountain has limited parking - design of subdivision - high percent-of rental units - Larkspur Lane has limited parking - almost all parking areas encroach onto public right-of- way In 1975 owners of Lot 2, Block 2(2635 Larkspur Lane) built retaining wall and stairs on county property adjacent to Larkspur Lane - the property is identified on the official Block 2 Vail Intermountain plat dated June 24, 1970 as a cul- de-sac; the cul-de-sac was never built. - the wall provides the structure for the parkinq area - the stairs provide access to the public right-of-way - access and parking area have been_ used continuously by all subsequent property owners. The retaining wall is in need of repair; the stairs appear to be in somewhat better, shape but will need replacing in the future.
