2:00 1. Local Liquor Licensing Authority Board Interviews

Action Requested of Council: Conduct interviews, if
necessary. Steve Simonett's term is ending, and to date he
is the only applicant for the opening.
2:10 2. Discussion of Easement Vacation - Lot 17, Vail Meadows
Kristan Pritz Filing I (Berg)
Action Requested of Council: Approve/deny the vacation of a
water line easement lying upon the westerly 25 ft. and the
southern 20 ft. of Lot 17 and a road easement upon the
westerly 25 ft. of Lot 17.
Background Rationale: Both of these easements were vacated
by Eagle County. However, Stewart Title's opinion is that
it is still necessary that the water line easement be -
vacated by Upper Eagle Valley Water & Sanitation District;
this is due to the fact that the plat states water line
easement and not a general utility easement. The road
easement should be vacated by the Town of Vail.
Staff Recommendation: Staff recommends approval of the two
easements.
2:20 3. Discussion of Vail Village Truck Loading Restrictions
Stan Berryman
Action Requested of Council: Discuss 30-day experimental
period of restrictions held during August and develop policy
for upcoming winter season.
Background Rationale: From August 10 to September 10,
delivery trucks larger than 10,500 lbs. GVW were restricted
from parking in the Village Core loading zone during the
hours between 11:00 a.m. and 5:00 p.m. Trucks were required to utilize "staging areas" east and west of the Core during
these hours.
Staff Recommendation: Approve winter restrictions for a
21-day trial period from November 30 through December 20
during the hours of 8:30 a.m. until 11:00 a.m. and 2:00 p.m.
until 5:00 p.m. The Police, Fire and Public Works
Departments recommend leaving Willow Bridge open to one-way
northbound traffic. The Community Development Department
recommends closing Willow Bridge to all traffic (see
enclosed information).
2:40 4. Discussion of Booth Falls Rockfall Mitigation Proposal
Larry Eskwith
Action Requested of Council: Discuss issues relating to the
construction of rockfall mitigation in Booth Falls with
residents of Booth Falls.
Backqround Rationale: Some Booth Falls residents would like
to proceed with the construction of rockfall mitigation in
Booth Falls. It is expected that the following issues will
be raised: 1) access to Town land for construction
purposes; 2) Town administration and management of the
_ construction project; and 3) financing methods to pay for
the project.
Staff Recommendation: The residents have been told the Town
would not participate in paying for the mitigation, but we
could perhaps help them by giving access to Town land, allow
the berm to be built on Town land and administer and manage
the project. They are discussing the possible formation of
a general improvement district for financing purposes.
3:00 5. Discussion of Alternatives to Street Improvement Districts
Charlie Wick
Steve Barwick Action Requested of Council: Review recommended funding
alternatives presented by staff (see enclosed memo). A
decision to proceed on this matter needs to be made at this
Work Session if the change is to be implemented in 1988.
Background Rationale: Council has requested staff to
examine possible funding alternatives to the current plan of
funding street improvements through local improvement
districts. Staff has examined a number of possible options
and has chosen to focus on property taxes as the most viable
substitute revenue source.
If Council wishes to implement staff's recommended
alternative, the second reading of the budget ordinance will
need to be delayed until November 17.

Applicant: Eric Berg
REQUEST
The owner of Lot 18 is requesting that the Town Council approve
the vacation of a water line easement located on the westerly
25 feet and the southern 20 feet of Lot 17 as well as a road
easement located on the westerly 25 feet of Lot 17.
According to Stewart Title, both of these easements "were
vacated by Eagle County, to whom the easements were granted on
the plat, by resolution, recorded May 13, 1968." However,
Stewart Title's counsel has advised the owner that in order to
avoid any possible confusion, it is appropriate for the Upper
Eagle Valley Water and Sanitation District as well as the Town
of Vail to also sign off on the vacation of the two easements.
Stewart Title has stated in a letter that "the waterline
easement should be vacated by Upper Eagle Valley Water and
Sanitation District. This is due to the fact that the plat
states, 'Waterline Easement' and not a general utility
easement. The road easement should be vacated by the Town of
Vail."
Enclosed is the letter from Stewart Title, UEVWSD's approval of
the vacation, and a Vacation and Abandonment of Existing
Easement agreement for Town Council approval.
BACKGROUND ON THE REQUEST
In April 1987, the Council approved a similar vacation request
for the adjacent Lot 18, Vail Meadows First Filing. The
Council asked that staff contact the owner of Lot 17 to see if
the owner would also like to vacate Lot 17's easements. The
owner decided not to proceed with the vacation process at that
time.

Dear Kristin:
This letter is in reference to the above easements which are
more specifically defined as a waterline easement lying upon
the westerly 25 feet and the southern120 feet of Lot 17 and
a road easement upon the westerly 25 feet of Lot 17, as shown
on the Plat of Vail Meadows Filing No, 1.
Both of these easements were vacated by Eagle County, to whom
the easements were granted on the plat, by Resolution, recorded
May 13, 1968 in Book 262 at Page 790.
It is Stewart Title's opinoin that the waterline easement should
be vacated by Upper Eagle Valley Water and Sanitation District.
This is due to the fact that the plat states waterline easement and
not a general utility easement. The road easement should be vacated
by the Town of Vail.

VACATION AND ABANDONMENT OF EXISTING EASEMENT

THIS INSTRUMENT is made this day of ,
1987, by and between ERIC BERG, (hereinafter referred to as
"Owner" and the TOWN OF VAIL, COLORADO, a municipal corpora-
tion.
WHEREAS, a certain easement of record to be abandoned
described as a road and water easement twenty-five (25) feet
in width along the southwest lot line of LOT 17 and a water
easement twenty (20) feet in width along the south lot line
of LOT 17, VAIL MEADOWS, FILING NO. 1, ACCORDING TO THE RE-
CORDED PLAT THEREOF, COUNTY OF EAGLE, STATE OF COLORADO, al-
lowing the Easement Users the use of such easement for a road
and water easement, (hereinafter the "Road and Water Ease-
ment"); and,
WHEREAS, the easement is not presently used for the con-
struction, maintenance and reconstruction of a road or
utilities; and
WHEREAS, no future use of the easement for the construc-
tion, maintenance and reconstruction of a road or utilities
is contemplated; and,
WHEREAS, neither the owner or the General Public real-
ized any beneficial use in allowing such easement to remain;
and,
WHEREAS, the Town of Vail, on behalf of the General
Public, has evidenced its intent to abandon all claim and in-
terest in the easement.
' NOW, THEREFORE, in consideration of the mutual promises
contained herein and the mutual benefits to be derived and
other good and valuable consideration, the parties hereto
hereby covenant and agree as follows:
1) The Town of Vail on behalf of the General Public, by
this instrument hereby forever abandon, vacate, release and
terminate that portion of the Road and Water Easement as now
described as an easement twenty-five (25) feet in width along
the southwest lot line of LOT 17, VAIL MEADOWS, FILING N0. 1,
ACCORDING TO THE RECORDED PLAT THEREOF, COUNTY OF EAGLE,
STATE OF COLORADO. Easement Users hereby convey all their
right, title, and interest in and to that portion of the Road
and Water Easement vacated above, to Owner.
2) This Vacation and Grant shall be binding upon and ,
inure to the benefit of the successors and assigns of the par-
ties hereto.

RE: Vail Village Truck Loading Restrictions
From August 10, 1987 to September 10, delivery trucks larger than 10,500
lbs. GVW were restricted from parking in Village Core loading zones during
the hours of 11:00A.M. until 5:OOP.M. The trucks were required to use
"staging areas" east and west of the Village Core during these hours.
Willow Bridge was signed and opened to one-way northbound traffic to
effectuate more efficient truck loading.
Comments:
° Town staff did not receive any negative comments regarding the
restrictions.
° Most delivery trucks made their deliveries before the 11:00A.M.
closure period.
° Winter delivery truck loading is significantly different from summer
deliveries in frequency and size. -
° Opening of Willow Bridge to one-way northbound traffic did not
significantly impair pedestrian access into the village.
Recommendations:
° In order to minimize delivery truck-pedestrian conflicts and still
meet Village merchant delivery needs, the majority of Town staff -
(see following dissenting comments and recommendations from the
Community Development Department) proposes a 21 day experimental period
of restrictions as follows from November 30, 1987 through December
20, 1987:

1. Trucks larger than 10,500 gross vehicle weight (GUW) will be prohibited
from parking on Bridge Street, Hanson Ranch Road (south of the Red Lion
Building) and Gore Creek Drive (north of the Lodge at Vail) during the
hours from 8:30A.M. until 11:00A.h1. and from 2:OOP.h1. until 5:OOP.M.
2. During the hours from 8:30A.M. until 11:00A.M. and from 2:OOP.M. until
S:OOP.M., trucks larger than 10,500 lbs. gross vehicle weight.will be
required to park in one of three "staging areas" in the Village Core
and use their own wheel carts to deliver goods into the core. The
following truck loading zones will be used for these staging areas:
East - Existing truck loadirig zones on Gore Creek Drive (east
of Mill Creek only).
West - Willow Bridge will be opened to one-way northbound
traffic and truck loading zones established north
and south of the bridge.
North - Village Transportation Center charter bus lot.
3. The above restrictions apply to vehicles larger than 10,500 lbs. GVW.
Delivery vehicles weighing 10,500 lbs. GVW or less are not affected
by the restrictions. Taxis, service trucks (post office, UPS, plumbers,
electricians, etc.) and personal cars are not affected by these
restrictions.

SUBJECT: Comments on Village Delivery Experiment
My comments on the Village delivery experiment are based on
both personal observations, as well as a discussion with Mike
Morgan (the former Community Service officer in charge of Vail
Village). The following are my comments about the specific
experiment, and I will follow with my recommendations for the
future.
* There were not a lot of trucks using the westerly
staging area after 11:00 A.M.
* The trucks that were in the westerly staging area
were generally smaller delivery trucks.
* The traffic on Willow Bridge Road was substantially
more cars (both locals and tourists) than delivery
trucks.
* There was a substantial increase in both traffic and
parked cars on Willow Bridge Road during the
experiment.
* Even with the Sitzmark constructi:on project, the
westerly staging area seemed to work fine.
* The short term parking spaces displaced by the truck
delivery area near the Sitzmark were replaced outside
of Checkpoint Charlie adjacent to the Riva Ridge
North condominiums.
* There continues to be a major enforcement problem
north of Willow Bridge. Many delivery trucks in this
area ignore "No Parking" signs.
* The opening of Willow Bridge Road for trucks and
especially for general traffic was completely
unnecessary.
My recommendations for further action are as follows:
* Keep the new time zoning, keep the staging areas as
per the experiment, but close Willow Bridge road
permanently to all vehicular traffic.
. * The few trucks that will use the westerly staging
area can easily back out with the assistance of the
on-duty Checkpoint Charlie person.
My recommended solution allows all of the advantages realized
by the delivery experiment to continue without compromising the
pedestrian nature of the area. I continue to believe and
emphasize that a full time Village Community Service officer is
a critical element to the improvement of the Village loading
and delivery situation. This person should be employed year
round and should have a bicycle or other means of getting
around quickly for maximum enforcement control. Allowing
Willow Bridge Road to remain open to traffic is going directly
against the direction we are heading with regard to our long
range planning for the Village. Specifically, I cite the
following goals and policies:
1. Town of Vail Land Use Plan,-Policy 1.4
"The original theme of the old Village core should be
_ carried into new development in the Village core
through continued implementation of the Urban Design
Guide Plan."
2. Urban Design Guide Plan, Pedestrianization Goal Statement
"A major objeetive for Vail Village is to encourage
pedestrian circulation through an interconnected
network of safe, pleasant pedestrian ways. Many of
the improvements recognized in the Urban Design Guide
Plan, and accompanying Design Considerations, are to
reinforce and ex and the quality to pedestrian
walkways throughout the Village."
3. Urban Design Guide Plan, Vehicle Penetration Goal
Statement
"In conjunction with pedestrianization objectives,
major emphasis is focussed upon reducinq auto
penetration into the center of the Villaqe "
4. Many provisions of the proposed Vail Village Master Plan
including:
a. Goal statement #3. "To recognize as a top
priority the importance of maintaining and
enhancinq the pedestrian ex erience throuqhout
the Village."
b. Goal #3 Objective 2: "To control and minimize
the amount of vehicular traffic in the Village
to the greatest extent possible."

c. Goal #3 Objective 5: "To minimize conflicts
` between the pedestrian experience and service
delivery functions in the Village."
Basically, these goals, objectives and policies point to the
direction of expanding and enhancing the pleasant pedestrian
experience throughout the entire Village area. Opening Willow
Bridge Road to traffic not only compromises the encouragement -
of pedestrianization throughout the Village area, but actually
displaces the problem from one area (Gore Creek Drive/Bridge
Street) to another (Village Center/Sonnenalp/ Crossroads).
Finally, the Community Development Department remains committed
to the continued exploration of a more permanent, long range
solution to the loading and delivery conflict in the Village
area through participation in the Parking/Transportation Task. .

RE: Alternatives to Street Improvement Districts
Per Council direction, Town staff has reexamined the issue of
funding Vail street improvements. The options examined were: .
1) No change
2) Change funding ratio from 50% TOV/50% Homeowner to
some other ratio
3) TOV funds all street improvements under current
Capital Improvements Fund budget
4) Use new revenue source to substitute for street
improvement districts
Staff continues to believe that street improvement districts are a
feasible and equitable method for financing the planned street
improvements. However, due to the recent level of citizen
opposition to this funding method, it has become clear that other
options should be reexamined.
Of the options listed above, No. 4 was preferred because it is the
only option which maintains the street improvement schedule
without jeopardizing the funding of other capital projects. Staff
recommends the use of additional pro erty tax as the new revenue
source for this option. Property tax would be a fairly equitable
source since the planned street improvements are spread throughout
the town. This funding plan would also be compatible with the
traditional purpose of property taxes, i.e. to protect and enhance
real property.

DETAILS OF SUBSTITUTING PROPERTY TAX FOR SID'S
Per the revised street funding plan (attached), the Town would
need to raise approximately an additional $762,000 per year for
five years in order to eliminate the need for street improvement
districts and pay for the resident's share of the completed West
Vail district. In order to produce the needed revenue from
property tax a levy of 2.35 mills for five years would be
required. The cost of such mill levy per $100,000 of market value
on a residential home is $42.30 per year for five years. If this
scenario should be seriously considered, staff recommends the
additional property tax monies be specifically earmarked for
streets. The tax would automatically end in 1992, the planned
date to have all major street improvement work completed.
