Public Art Task Force Update Report Kristan Pritz Action Requested of Council: Hear update report and make appropriate comments. 2:10 2. Discussion of Intergovernmental Agreement between the Town Kristan Pritz of Vail, the Upper Eagle Valley Consolidated Sanitation District and Vail Valley Consolidated Water District concerning Reciprocal Fee Waivers Action Requested of Council: Review the agreement and ask any questions you may have. Background Rationale: On September lst, the Council met with Mr. Dave Mott concerning a reciprocal fee waiver agreement. The staff was directed to write an agreement for the Council to review. If the Council approves the agreement, staff will submit the agreement to the two districts for their review. Staff Recommendation: Staff recommends approval of the agreement. 2:30 3. Discussion of Selection Process for Architectural Services Tom Braun for the Proposed Visitors Center Action Requested of Council: Offer comments on the proposed process schedule role, members of the Selection Committee, and stated goals and priorities of the project. Background Rationale: At last week's meeting, the staff was directed to establish an interview process to select an architect for the Town's Visitors Center. Our recommended process will be presented at this meeting. Staff Recommendation: Staff recommends to proceed as proposed. 3:00 4. Further Discussion of Street Improvement Alternatives Charlie Wick Steve Barwick Background Rationale: This has been discussed extensively and the budget ordinance was delayed to give time for more discussion and deliberation. Final action will be at the Evening Meeting on Nov. 17. 3:40 5. Discussion of the Proposed New Year's Eve Teen Party to be Pam Brandmeyer held at the Dobson Arena Ted Martin Joann Mattio Action Requested of Council: Approve/deny this Ceil Folz plan/concept, as presented. Background Rationale: After checking the legalities with the Liquor Enforcement Division in Denver, the committee proposes a"gaming" night (i.e., Casino Night) for teens in the 14-20 year old category. We will be soliciting donations for prizes from the community, as well as support for each of the gaming tables, and will additionally supply a DJ, wild music, and a most festive atmosphere for New Year's Eve. The middle school age group, i.e., 5th through 8th grade, will be required to attend a separate New Year Eve's Party at The Cafe. Liquor Enforcement is especially supportive of this event and has lent considerable help to the arrangements. Staff Recommendation: Staff recommends approval. 4:00 6. Other . -2- =s AGREEMENT between the TOWN OF VAIL, the UPPER EAGLE VALLEY CONSOLIDATED SANITATION DISTRICT and the VAIL VALLEY CONSOLIDATED WATER DISTRICT THIS INTERGOVERNMENTAL AGREEMENT is made and entered into this day of , 1987, by and between the TOWN OF VAIL, a Colorado rnunicipal corporation ("the Town"), the UPPER EAGLE VALLEY CONSOLIDATED SANITATION DISTRICT, a quasi-governmental entity ("Sanitation District") and the UAIL VALLEY CONSOLIDATED WATER DISTRICT, a Colorado quasi-governmental entity ("Water District"). RECITALS 1. The Town, the Water District and the Sanitation District wish to contract together to provide for the waiver of certain fees between the Town and the Districts. 2. This Intergovernmental Agreement is authorized pursuant to Section 18, Article XIV of the Colorado Constitution and Section 29-1-20I, et seq., C.R.S., as amended. _ - NOW, THEREFORE, in consideration of the mutual covenants, conditions and promises contained herein, the parties hereby agree as follows: 1. The Town shall waive during the term of this Agreement, for the Water District and Sanitation District, the following fees and costs: A. Street cuts. B. Recreation amenities. C. Clean up. D. Building permit. E. Electrical permit. F. Mechanical permit. G. Plumbing permit. H. Design Review Board. I. Sign application. J. Planning and Environmental Commission application. 2. The Water District and Sanitation District agree to pay the Town's direct expenses for all plan reviews as per Section 304(c) of the U.B.C. and will comply with Chapter 3 of the U.B.C. for application for a permit. The Water and Sanitation Districts agree to pay the Town's direct expenses for all building inspections per Table 3-A, Chapter 3, of the U.B.C. 3. The Water District and Sanitation District shall waive all tap fees for projects on Town of Vail property. These tap fees shall include irrigation tap fees, sewer tap fees and water tap fees. 4. Termination Unless sooner terminated as provided for herein, this Agreement shall be effective and shall terminate Notwithstanding the foregoing provision, either party with or without cause may terminate this Agreement upon the giving of one hundred eighty (180) days prior written notice of such termination to the other respective parties. Notice shall be deemed to have been given upon the mailing of said notice by United States certified first class mail, postage prepaid, and addressed to the parties at the respective addresses as shall appear herein or upon a change of address pursuant to this notice provision. It is the intent of the respective parties that this Agreement shall be renewed for additional periods following the end of the initial -2- period, and unless one of the parties gives notice to the other parties at least one hundred eighty (180) days prior to the end of the initial period that such party desires to terminate this Agreement or to renegotiate the terms, this Agreement shall be automatically extended for an additional period of each not to exceed a total of two (2) such extensions. 5. This Agreement does not and shall not be deemed to confer upon a grant to any third party any right to claim damages or to bring any lawsuit, action or other proceedings against either the Town of the Districts because of any breech hereof or because of any terms, covenants, agreements or conditions contained herein. 6. No modification or waiver of this Agreement or of any covening condition or provision herein contained shall be valid unless in writing and duly executed by the party to be charged. 7. This written Agreement embodies the whole Agreement between the parties and there are no inducements, promises, terms, conditions, or other obligations made or entered into either by the Town or the Districts other than those contained herein. 8. This Agreement shall be binding upon the respective parties, their successors or assigns, and may not be assigned by anyone without the prior written consent of the other parties hereto. 9. The Town has represented to the Districts and likewise, the Districts have represented to the Town that they possess the legal ability to enter into this Agreement. In the event that a court of competent jurisdiction determines that any of the parties hereto did not possess the legal ability to enter into this Agreement, this Agreement shall be considered null and void as of the date of such court determination. -3- IN WITNESS WHEREOF, the parties hereto have executed this Agreement the day and year first written above. MEMORANDUM TO: Vail Town Council FROM: Steve Barwick '74 DATE: October 30, 1987 RE: Parking Issues Per Councilman Affeldt's request, the Town staff has compiled the following figures on parking: A) Charge for Summer Parking An unmanned automated system designed to charge for parking in Town of Vail structures would have the following costs and revenues: COSTS: Two gate machines (capable $18,000 of changing dollar bills or accepting quarters) Six "tire rippers" to install 9,000 in driveways Gate Machine Mntc. - one year 2,000 TOTAL FIRST YEAR COST $29,000 REVENUE: 625 vehicles average per day x 215 days x $.15 per vehicle TOTAL ANNUAL REVENUE $67,188 NET FIRST YEAR REVENUE $38,188 NET OUT-YEAR REVENUE $65,000 PARKING ISSUES MEMO OCTOBER 30, 1987 PAGE 2 B) Charge for Ford Park Mat Parking It is estimated that an average of 100 vehicles per day use this parking alternative during the ski season.
