2:00 1. Local Liquor Licensing Authority Board Interviews
Pam Brandmeyer
Action Requested of Council: Interview applicants at Work
Session and appoint one member to the Board at the Evening
Meeting.
Background Rationale: Colin Gleason resigned because he now
has a direct financial interest in the Gerald R. Ford
Amphitheater (he is part-owner of the group awarded the
concessions). So far, there are three applicants for the
position: Lynn Fritzlen, Kevin Cassidy and Tim Savage.
Applications will be accepted until Monday, 5/6, at 5:00
p.m.
2:20 2. Discussion with Chamber of Commerce and Vail Resort
Association regarding Information Booths and Special Events
Background Rationale: The Chamber Board and VRA Board have
asked to meet with Council to discuss transferring the
information booths and special events contract from URA to
the Chamber.
3:00 3. Discussion concerning Chalkboards and Neon Signage

Action Requested of Council: Community Development would
like to request some further direction of Council on the
proposed revisions to the sign code.
Background Rationale: Several months ago the Council
directed the staff to look into the issue of daily special
boards or chalkboards which were being displayed by local
restaurants and determine if they could be permitted under
the existing code. Several questions have also been raised
about the use of neon signs in different establishments and
we have drafted some suggestions for dealing with this
question.
Staff Recommendation: The only staff recommendation in this
matter would be that stated in the enclosed memo.
3:30 4. Site Visits to Up the Creek Restaurant in the Creekside
Building, Lionshead Centre Mall and Vantage Point
Condominiums
Background Rationale: The Up the Creek Restaurant is
requesting an expansion of their deck onto Town of Vail
property. The Lionshead Centre Building is requesting to
modify planters in the Lionshead Mall in connection with an
expansion of their building. The Vantage Point Condominiums
are requesting a sign height variance.
4:30 5. Discussion of Up the Creek Request to Lease Town of Vail
Rick Pylman Land for a Dining Deck
Action Requested of Council: Review "Up the Creek" proposal
and approve/deny request to lease TOV land for an exterior
dining deck.
Background Rationale: The Up the Creek Restaurant has
proposed a greenhouse expansion that includes a new deck
located on TOU property.
4:45 6. Discussion of Lionshead Centre Mall Improvements
Rick Pylman
Action Requested of Council: Review proposed changes to
Lionshead Mall as proposed by Lionshead Centre Condominium
Association, and grant approval/denial to proceed to
Planning Commission.
Background Rationale: The Lionshead Centre Condominium
Association is proposing a remodel and retail expansion to
their building. The proposal, to be reviewed as an exterior
alteration by the PEC, includes some changes to the
Lionshead Mall.
Staff Recommendation: Staff recommends approval.

Dear Town Council:
I would like to take this opportunity to submit my application for the
vacancy on the local Liquor Board. As some of you may recall, I served
as a member of this board two years ago and lost my seat due to the de-
annexation of West Vail, where I was residing at the time. In the interim,
I had purchased a bar in town and thus could not reapply to the board until
now, since I sold my business and no longer have an interest in a local
liquor license.
I feel I would be an asset to the board due to my previous position and my
experience in owning and operating liquor establishments in Vail over the
past ten years. I fully understand the responsibility one has to the com-
munity when controlling a liquor license. I feel I would have an excellent
working relationship with the current board members, some of whom I have
worked with in the past.. I'm sure that Steve Simonett, Rob Ford, Collen
McCarthy, or Pam Brandmeyer would provide excellent references upon request.
In closing, I would like to say that I hope you will give me the opportunity
to serve my community in away .which I feel I can be most effective.

SUBJECT: Sign Issues
I. CHALKBOARDS
Several months ago the staff was directed by Council to look
into the issue of chalkboards being displayed by restaurants
to advertise their daily specials. The general consensus of
Council was that some provision should be made to allow the
display of these boards. After some discussion of the topic
the staff has developed the following suggestions:
1. Allow the display of chalkboards for restaurants
only, not retailers.
2. Regulate the size of chalkboards so that there is .some
degree of uniformity. In this case we would suggest a
maximum allowable size of three square feet.
3. In keeping with the desire for a degree of uniformity
we would also suggest that the type of board be
limited to the traditional black or green chalkboard
with natural borders as opposed to the white boards.
4. We feel that the location of the special boards should
be limited and would suggest they be attached to/on
the same plane as existing menu boxes or the facade of
the establishment if no menu box exists.
The idea of special boards for display by retail
establishments was also given some consideration. It is
felt that retail establishments have an added advantage over
restaurants as they are able to use their windows
effectively for the display of merchandise.
One possible alternative is to allow retailers to display a
special board and delete the existing provision which allows
for the outdoor display of goods. In order to prevent this
possibility from becoming another enforcement problem we
feel it would have to be an all or nothing policy; that is,
retailers wouldn't be able to choose which they prefer.
II. NEON/3 FOOT RULE
In an attempt to better deal with the issue of neon we would
suggest the following definition of a sign as a revision to
Section 16.04.240 of the Sign Code:
"Sign" means a surface or space as permitted in this
title, whether continuous or not, which is in clear
view of the general public from any pedestrian or
vehicular way, which attracts the attention,
identifies a business or building, conveys a message
to any person by means of letters, numbers, figures or
other symbols, devices, or representations.
We would also propose a change to Section 16.04.330 to read:
"Window sign" means a sign affixed on the interior
surface of a window fronting a public way, which sign
shall not include the three square feet allowed for
the display of the name of the business or organiza-
tion (not to exceed 1.5 square feet), the display of
hours of operation, credit card information, and
similar general information items.
This would remove the current three foot rule loophole being
used to permit the placement of neon.
Possible alternatives for dealing with the issue of neon
would be:
(1) Allow neon signs but require all signs to go to DRB for
approval.
(2) Prohibit neon signage in the Village and possibly in
Lionshead due to the incompatibility of neon with the
the basic ambience and character of the areas.
(3) Interior signs shall be defined as a sign which is at
least ten feet from the window surface.
III. RECOMMENDED PROCESS FOR SIGN ISSUES
(1) Schedule a worksession with the Council to determine
the general policy and direction..
(2) Once the general policy has been established, contact
the restaurant association and merchant groups for
input regarding proposed changes.
(3) Proceed as directed.
