Resolution No. 62, Series of 1989, a resolution recognizing and congratulating Red Sandstone Elementary School for winning the 1989 State Champion physical fitness award. 2. Ordinance No. 29, Series of 1989, second reading, an ordinance authorizing the issuance of Town of Vail, Colorado sales tax revenue bonds, Series 1989 and the construction, improvement and acquisition of a public parking facility and other appurtenances incidental thereto; providing the form, terms and conditions of the bonds, the manner and terms of issuance, the manner of execution, the method of payment and the security therefor; pledging a portion of the sales tax proceeds of the Town and the net revenues derived from the parking facility for the payment of said bonds; providing certain covenants and other details and making other provisions concerning the bonds and the designated sales tax revenues and net revenues; ratifying action previously taken and appertaining thereto; and repealing all ordinances in conflict herewith. 3. Ordinance No. 30, Series of 1989, second reading, an ordinance establishing a program of investments to provide for the payment of the Town's outstanding general obligation refunding bonds, series 1985, on December 1, 1995 and in connection therewith providing for periodic investments of moneys to provide for such payment; providing other details in connection therewith; and repealing all ordinances in conflict herewith. 4. Consent Agenda A. Ordinance No. 24, Series of 1989, second reading, an ordinance amending Section 8 of Ordinance No. 14 Series of 1987 to provide for the amendment of density of the approved development plan for Special Development District No. 6. B. Ordinance No. 25, Series of 1989, second reading, an ordinance amending Title 17 to add Chapter 17.25 dealing with single family subdivisions; amending Section 17.08.210 to provide a definition for single family subdivisions; and setting forth details in regard thereto. C. Ordinance No. 26, Series of 1989, second reading, an ordinance amending Section 18.24.020 of the Municipal Code of the Town of Vail by adding "Commercial Ski Storage" as a permitted use in basement or garden levels within structures in the Commercial Core I Zone District. D. Ordinance No. 27, Series of 1989, second reading, an ordinance amending Chapter 2.20 Local Licensing Authority of the Municipal Code of the Town of Vail, Colorado to add an application fee for temporary liquor license under the Colorado Liquor Code; and setting.forth details in regard thereto. E. Ordinance No. 28, Series of 1989, second reading, an ordinance amending certain sections of Chapter 16.22 so that Chapter 16.22 regulates signs in the Arterial Business District Zone District of the Town of Vail (ABD) as well as the Commercial Core III Zone District (CC3). 5. Reference is made to your letter of November 6, 1989 in which you described CWC legislative record as being enviable. Further, you state "of the 158 bills supported by CWC, 131 have been enacted into law; and, of the 46 bills opposed by CWC, all have been defeated! Ask yourself this question: "lJhat happens if there were no Water Congress?" I have asked myself the question, and have come to the conclusion that we all probably would have been better off without such a myriad of water related statutes and precedent setting court cases (four volumes over 1300 pages) that have created a gridlock detrimental to water development in the State. After practicing over 25 years in engineering related to water rights, I have seen the adjudication process of water rights in Colorado degenerating into a process that is very confrontational, very expensive, and excessively time consuming. Frankly, I question the morality of a system that forces a smal l water right(s) holder to protect his/her water rights (a public resource essential to sustain life) against overwhelming odds of opposers who are well funded and equipped with capable water attorneys and water engineers. I would like to challenge the Colorado Water Congress to undertake or back legislation to affect some fundamental changes~in the 1969 Act that will make the process less confrontational, less costly, and less time consuming. I would be happy to provide input and to participate in such a worthwhile effort. I believe such changes could yield substantial cost savings to a number of CWC members such as cities, special districts and water conservancy districts who are increasingly burdened by large legal and engineering budgets. I would like to request that this matter be placed on the CWC Board Agenda and be discussed prior to the 1990 Legislative Session. Thank you. Sincerely, ~l• Ao S. A brief investigation by your State Engineer's office will quickly show state funds were used to improperly "politically engineer" the facts to favor a Gunnison water alternative that could possibly be controlled by the sponsoring water district. The "stonewalling" explanations contained in the Colorado Water Resources and Power Development Authority's September 26th and 28th docarllents are totally unresponsive and unacceptable. A state inquiry is urgently required, as this seriously distorted study is being used in water court as authoritative state evidence. If this study is not corrected, future East and West Slope water users could be deprived of the unprecedented, multi-year drought protection and cost advantages of a large Gunnison reservoir on the Continental Divide. The legitimate rights of our company's stockholders could also be jeopardized. We sincerely believe a low key State Engineer's investigation would be the most efficient and fairest way to resolve this very important state water matter. Our company will cooperate fully with this inquiry. We believe Arapahoe County and the other Union Park subscribers on both slopes will do the same. Box 567 Miller, President Resources Company Palmer Lake, CO 80133 Dear Mr. Miller: In August 1989, you requested a "state investigation" of the Upper Gunnison-Uncompahgre Basin Study, recently completed by the Water Resources and Power Development Authority. Apparently, a basis of your request was the attached letter from EBASCO Services, Inc., in Lakewood, Colorado. In response to your request, I asked the Water Resources and Power Development. Authority to respond to me in detail concerning your allegations and those contained in the EBASCO letter. I have received their responses, and they are enclosed. I have not initiated an independent investigation of the Water Resources and Power Development Authority. That agency is a quasi-independent state agency, and is not under my direct jurisdiction or control. Further, I am reasonably satisfied with the responses provided to me by the Water Resources and Power Development Authority, although I have not looked beyond the statements provided in its enclosed analysis. Despite the statements in your letter alleging conflict of interest in the preparation of the Upper Gunnison Study, I have never found any basis to question the integrity or honesty of the WRPDA Board. While I have raised some questions concerning the need for, or expense of; certain WRPDA activities, I do not question the integrity of the board or staff. I have no reason ~to subscribe to the statements made in your letter. I trust the enclosed material will be of interest to you and will set to rest your concerns. This water development study was recently completed for the Colorado Water Resources and Power Development Authority (CWRPDA). The final document contains serious technical flaws and misleading conclusions, in spite of numerous written attempts by the City of Gunnison, Arapahoe County, and Natural E,hergy Resources Company to correct these errors during the draft stages. Our basic complaint is that the study was "politically engineered" to favor the water development projects preferred by the Upper Gunnison representative on the Authority's Board. 'T`his governor appointee is Chairman of CWRPDA, while. also serving as the attorney representing the Upper Gunnison River Water Conservancy District (UGRWCD) in opposition to Arapahoe County's competing Union Park water right filing in district court. The study's most seriously flawed areas are as follows: 1. The study concludes Upper Gunnison Basin water consumption is increasing, when in fact it is decreasing because of the Western trends toward improved irrigation efficiency and retirement of marginal irrigated land. 2. 'T`he study distorts cost data to indicate the Authority's proposed Needle Point Pumped Storage Power Project is more efficient than our company's more ,advanced Rocky Point Pumped Storage Project. 3. The study grossly understates the economic, environmental, and multipurpose advantages of a large, off-river reservoir at Union Park, for both slopes, as compared to Aurora and UGRWCD's transmountain concepts from the small Pie Plant or Taylor Park diversion reservoirs to Metro Denver. A cursory check by state investigators will show that most of the study's analysis was devoted to the water development alternatives that could possibly be controlled by UGRWCD. This nonobjective misuse of state funds can seriously impact pending water court proceedings and work to the detriment of the state's long-term water development unity on both slopes. Detailed engineering data in support of this complaint can be supplied to state investigators at the earliest opportunity. Please advise.
