Request for additional horse-drawn carriage business on Stan Berryman Vail streets Ken Hughey Kristan Pritz Action Requested of Council: Approve request for additional horse-drawn carriage business. Background Rationale: The Town has an existing agreement with Darwin McWilliams to conduct a horse-drawn carriage business in Vail (see enclosed agreement). This agreement is specifically "non-exclusive" and is valid through October 31, 1991. The agreement allows Mr. McWilliams to operate a maximum of two carriages. The Town has received a request from Michael Parker to also operate a horse-drawn carriage business (see enclosure). Town staff has evaluated the report and recommends approval providing Mr. Parker can fulfill all conditions and terms of the McWilliams agreement. Staff Recommendation: Approve request for additional horse-drawn carriage business. 2:15 2. Discussion regarding local recycling efforts Mauri Nottingham Susan Scanlan Action Requested of Council: Approve/deny/modify the Charlie Wick recycling plan proposed to the Town by Mauri Nottingham. Background Rationale: In order to upgrade and enhance local recycling efforts principal sponsors are needed and the Town of Vail can assume a leadership role. Staff Recommendation: Approve a one year use of the loading dock area of the old Post Office for expanding recycling efforts. Direct staff to work with Mauri and other principal sponsors to seek intermediate and long range regional recycling solutions. 2:30 3. Mike Mollica Action Requested of Council: Schedule a joint meeting. with the Council and VMRD to discuss the petition and appropriate response. Background Rationale: A petition has been submitted to the Community Development requesting that the pool be removed from the Master Plan. In addition, the petitioners are requesting that Ford Park be preserved in its present state with no more construction except for improvements to existing facilities. If Necessary, Further Discussion of the Vail Village Parking Structure Expansion/Decision on Contractor Notice to Proceed. Frontage Road Vail, CO 81657 Gentlemen: SUBJECT: Carriage Rides in the Town of Vail REQUEST: To receive a Business Permit to operate a carriage ride business in the Town of Vail, Colorado. BACKGROUND: l) I have been informed that the current ordinance limits one carriage ride business, and 2) I am cognizant of the potential conflict and/or interference with the vehicles operating on the byways of the Town of Vail. It is apparent that the carriage ride activities can not interfere with the traffic, especially the motorized vehicles/buses, that operate in the Town of Vail. SUGGESTIONS: 1) Approve a business permit beginning April 1, 1990 for a six month probationary period. 2) Approve a permit to operate in the Town of Vail, but not on the bus routes. APPLICANT CAPABILITIES: 1) The Applicant has been a resident of the Town of Vail for six years. 2) The Applicant is the Lead Driver for the carriage ride-owner that operates presently in the Town of Vail. There has been considerable experience gained on the streets and in the environment of the Town of Vail. Approximately 65~ of all of the carriage rides in Vail during the past one year has been accomplished by the Applicant. 3) The Applicant is purchasing equipment that will enhance significantly, the overall appearance and beauty of Vail. See the photos that illustrate the actual carriage and horse that will be used. 4) The Applicant has applied for, and received prelim- inary approval, for the insurance, as required. I look forward to hearing from you as to how I should proceed. Sincerely, Zichael ar er /r Y HORSE DRAWN CARRIAGE AGREEMENT THIS AGREEMENT is made and entered into this ~"~ day of ~~ 1989, by and between the Town of Vail, Colorado, a Colorado municipal corporation ("the Town") and Darwin McWilliams ("McWilliams"). WHEREAS, McWilliams wishes to operate a horse drawn carriage business on the streets of the Town; and WHEREAS, the Town is willing to let McWilliams operate said business in accordance with the terms set forth herein. NOW, THEREFORE, the parties agree as follows: Section 1. Definitions. Whenever used in this Agreement, the following words, terms and phrases respectively shall have the following meaning: Horse Drawn Carriage - a multi-wheeled, hooded, or unhooded vehicle that is propelled by horse power, is used in the transport of passengers and is available for hire on the public streets of the Town with a driver. Section 2. Term. In consideration of the conditions, provisions and premises contained in this Agreement, McWilliams is granted from November 1, 1989 through October 31, 1991, to establish, own, 1 maintain, and operate a horse drawn carriage company over and upon the streets of the Town which are designated for such operation by the Town Manager. The Town Council shall have the right to revoke or terminate the privileges granted herein at any time for cause upon ten (l0) days prior notice to McWilliams in writing and no lapse of time, expenditure of money or any other thing shall be deemed to give McWilliams any vested interest or right in the continuation of his horse drawn carriage business. The term "cause" as used in this Agreement shall include but not be limited to any interference by the horse drawn carriage operation with the scheduling or operation of Town buses, emergency services, or general town traffic. The determination as to whether cause for the termination of this Agreement exists shall be made solely by the Town. Section 3. 1. Non-exclusive. The granting of the privileges pursuant to this Agreement shall in no way imply that the privileges granted herein are exclusive. The Town reserves the right at any time to grant the same privileges to qualified applicants if and when the Town Council shall determine that the public convenience and necessity would best be served by doing so. 2. Designation of hours and areas of operation. A. There shall be no restrictions on the hours of operations for horse drawn carriages except during Town 2 designated special events such as the Coors International Bicycle Classic, Jerry Ford Golf Tournament, the 4th of July, Christmas Tree Lighting, American Ski Classic, and other events which may be designated by the Town. During such events, horse drawn carriages will be prohibited from operation so as not to conflict directly with these events. B. The area designated for operation shall be from the easterly end of Sunburst Drive in the golf course. neighborhood, westerly to West LionsHead Circle and the Marriott Mark. C. From November 22, 1989 through April 15, 1990 and November 21, 1990 through April 14, 1991 (ski seasons), horse- drawn carriages will not be equipped with gate openers and will be prohibited from operating in the gate restricted areas of the Town. D. At all times, horses shall be equipped with "slings" which will catch excrement. Any excrement which is not contained by the required "slings" shall be cleaned up by McWilliams. The excrement shall be deposited only at the location where the horses are permanently or usually stabled. The excrement shall not be deposited in any dumpsters or trash containers unless securely packaged and only with previous approval of the Environmental Health Officer. If the excrement is not immediately removed by the driver, it may be removed by the Town and the expense of such removal shall be paid by McWilliams. 3 E. Horse drawn carriages shall at no time be left un- attended. Drivers shall remain with the carriages at all times. F. Drivers shall be experienced in the operation of horse drawn carriages. G. Horses shall be trained to operate safely in pedestrian congested areas. Section 4. Traffic Laws Applicable to Horse Drawn Carriages. McWilliams, his agent or employees, shall be granted all rights and shall be subject to all the duties applicable to the rights of a horse drawn vehicle pursuant to Article XVII of the Model Traffic Code for Colorado municipalities, 1977 edition, adopted by Chapter 10.04 of the Municipal Code of the Town of Vail. McWilliams, his agent or employees, shall operate horse drawn carriages in such a manner that they do not interfere in any way with the operation of the Town buses and bus system, emergency vehicles, pedestrians, or other traffic. Section 5. Schedule of Charges to the Public. McWilliams shall file with the Town Manager a schedule of the current fees to be charged to the public for horse drawn carriage services. An amended fee schedule shall be filed at any time the fees McWilliams charges to the public are changed. Section 6. Number of Horse Drawn Carriages. It is the judgement of the Town Council that in order to enable the Town bus system to function properly and to protect pedestrians within the Town that controlling the number of horse 4 drawn carriages operating within the Town of Vail is within the public interest. To this end, the number of horse drawn carriages permitted to be operated on the streets of Vail is two (2). The maximum and minimum number of horse drawn carriages operated by McWilliams shall at all times be within the limits determined by the Town Council applying the principles of a public convenience and necessity. Section 7. Driver's License. Neither McWilliams, his employees or agents shall be permitted to operate a horse drawn carriage within the Town without first having obtained a valid Colorado driver's license. Section 8. Character of Horse Drawn Carriages. All horse drawn carriages used in connection with this Agreement shall be well maintained and shall carry no advertising signs. All horse drawn carriages operated in the Town of Vail shall be equipped with brakes. Section 9. Insurance. Before McWilliams operates horse drawn carriages in accordance with this Agreement, he shall furnish the Town Manager evidence that he has obtained the following insurance coverage and McWilliams agrees to maintain such coverage at all times. A. Employees' Liability and Workmen's Compensation. B. For every horse drawn carriage owned, operated or leased by McWilliams, public liability insurance with minimum limits of not less than $500,000 on each person and $500,000 for each accident and $500,000 for property damage. 5 Section 10. Conduct, Appearance and Dress of Horse Drawn Carriage Drivers. All horse drawn carriage drivers employed by McWilliams shall conduct themselves in a manner which demonstrates tact, courtesy and good judgment. They shall be dressed in a neat and clean manner during working hours. A. Prior to any of McWilliams' horse drawn carriage drivers operating the horse drawn carriages on the streets in Town, each shall be required either individually or as a group to meet with Mr. Skip Gordon, Town Transit Superintendent. He can be reached at your convenience at the Town offices, 479-2174. B. All horse drawn carriage drivers will attend at least one "Guest Relations" seminar or class before operating a horse drawn carriage. Proof of attendance must be presented to the Town Transit Superintendent at the meeting outlined in (A) above. Section 11. Conformity to Law. McWilliams agrees to conduct his business under this Agreement in accordance with the laws of the State of Colorado, and the Town of Vail. Section 12. Indemnity. McWilliams shall indemnify, defend, save and hold harmless the Town and all its officers, agents and employees from any and all suits, actions or claims for damages including costs and reasonable attorney's fees of any character, name and description to any person including personal injuries resulting 6 t in death, or to any property occasioned by or arising out of the conduct of McWilliams' business. Section 13. This Agreement shall not be assigned or its privileges sublet, nor shall any of the rights or privileges granted or authorized herein be leased, assigned, sold or transferred without the prior consent of the Town Council. ORDINANCE N0. 7 Series of 1986 AN ORDINANCE AMENDING CHAPTER 6.08 "LIVESTOCK ON PUBLIC STREETS" OF THE MUNICIPAL CODE OF THE TOWN OF VAIL; PROVIDING A DEFINITION OF HORSE DRAWN VEHICLE; RESTRICTI~JG THE USE OR OCCUPANCY OF PUBLIC STREETS WITHIN THE TOWN OF VAIL BY LIVESTOCK OR HORSE DRAWN VEHICLES AND SETTING FORTH CERTAIN EXCEPTIONS TO SAID RESTRICTIONS. WHEREAS, the Town Council would like visitors, guests and residents of the Town of Uail to enjoy rides on horse drawn vehicles throughout the public streets of the Town of Vail under certain circumstances; and WHEREAS, the Town Council further believes that such service would add to the ambiance of the Town. NOW, THEREFORE, be it ordained by the Town Council of the Town of Vail, Colorado as follows: Section 1. Section 6.08.010 "Definitions" of the Municipal Code of the Town of Vail is hereby amended by the addition of paragraph D to read as follows: 6.08.010 Definitions D. Horse drawn vehicle means any vehicle which is operated or pulled by a horse or horses which may be hired for the transportation of passengers. Section 2. Section 6.08.020 "Restrictions" is hereby repealed and reenacted with amendments to read as follows: 6.08.020 Restrictions It is unlawful for any person whether acting as owner, principle, agent, employee, lessee or permittee to operate or cause to be operated any horse drawn vehicle upon the public streets of the Town of Vail or to allow livestock to use or occupy the public streets of the Town of Vail without having first obtained a permit therefor. Nothing contained in this Section shall prohibit the grantees of any valid livestock easement from using the easement within the town limits of the Town of Vail. Section 3. Section 6.08.040 "Exceptions" of the Municipal Code of the Town of Vail, Colorado is hereby repealed and reenacted with amendments to read as follows: 6.08.040 Exceptions The Town Council by resolution may approve the issuance of a permit for the operation of horse drawn vehicles upon the public streets and right-of-ways within ~~ . the Town subject to whatever conditions, regulations and restrictions the Town Council deems necessary to protect the public health, safety and welfare. In addition, the Town Council or the Town Manager may from time to time permit livestock to use or occupy any of the public streets within the Town for parades or special events upon such terms and conditions, regulations and restrictions as the Town Council deems necessary to protect the health, safety and welfare of the inhabitants of the Town. Section 4. If any part, section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 5. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 6. The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. At the present time this center would operate solely by donations. A plan to buy-back certain recycleables may be possible in the future. A possible center in Avon at a future date if a location is found. Containers for deposit of recyclables to be located in West Vail, and Avon. Additional container locations could be located in Minturn, Eagle, East Vail and Gypsum at a later date. Incorporation A non-profit corporation is in the process of being established. Three recycleables (glass, aluminium, newsprint) are collected from a container in West Vail using volunteer help. Newsprint and aluminium cans are taken to Denver by The Vail Trail truck every Thursday. Glass is picked up by BFI and deposited into a larger container located in the lot west of Vail Associates warehouses. When full this container is taken to Denver by BFI. A small warehouse space-(recycling center) would be necessary to expand into the next phase of operations. Approximately 600 sq ft of the old post office would be adequate at this time. Phase II This phase of operation would begin with one full time employee, a small truck for pick-up, a glass crusher and a large glass container. The glass operation would be taken over from BFI. Glass would be picked up from deposit containers located in Avon and West Vail. Containers should be located in Eagle, Minturn, East Vail and elsewhere as soon as available. Glass would be taken to the recycling center and crushed into the larger container. Glass would also be picked up from restaurants and lodges located in Vail, A•,ron, Minturn and Beaver Creek. Regular pick-up sites and schedules would be established. BFI would deliver to the center any glass picked up from their curb- side program. The crushed glass would continue to be delivered to Denver by BFL. Newsprint and aluminium at the West Vail location would continue to be picked-up and transported to Denver by The Vail Trail for the present time. Newsprint and aluminium cans as well as the glass and plastics would then be picked up from all drop-off .locations and taken to the center. Minturn and Eagle should have container locations established by this time. The newsprint will be sorted and stored in containers and delivered to the Eagle-Gypsum plant during a regular pick-up from deposit containers located in those areas. Aluminium cans will be crushed, stored and transported to Denver. Styrofoam and plastic packaging could be collected and resold to local markets. Phase IV ~~ Corrugated cardboard should be added to the list of recyclables as soon as possible since there is a large supply available. This phase of operations will demand additional space to operate a baler and to store about 48 bales of cardboard which is approximately one truck load. April 3, 1990 Dear Mr. Wick: I would Iike to encourage the Town of Vail to participate in the current recycling effort. This effort is benefiting the Town of Vail, Eagle County, the nation and the world. Specifically, recycling provides the Town with another way to show its leadership ire community service, serving the needs of its citizens and a positive impression on the guests that visit here. Eagle County benefits from a reduction in the amount of material deposited in its landfill. AlI of Eagle County uses this landfill, which will be full in 30 short years. The overall benefits to the nation and world are reduced use of resources, reduced pollution and increased green space. Currently, recyclables are deposited in a small cantainer in our parking lot. An impressive amount of material is collected, manually unloaded, stored anal transported to Denver. The aluminum and newsprint is taken several times a day to the Vail Trail's truck. Qnce a week, Allen Best takes the time to personally deliver and unload approximately four tons. We commend the volunteers who empty and maintain the container. They are er..cellent people donating their time to serve others. Browning Ferris Industries has taken charge of the glass. They collect the glass from the container most mornings. They open the gate at the bottom, spill the glass out onto the parking lot and then shovel it into barrels to load on a pick-up. For several obvious reasons this results in a large amount of broken glass spread over our parking lot. Usually, the container is not emptied completely. This forces people to pile their glass outside the cantainer. But, it makes it easier for BFI to load and haul. This situation has been deteriorating in spite of repeated attempts to have BFI improve their system. The condo association, residential owners and shop keepers cannot tolerate this situation. The unsightly appearance of the glass is bad enough. The rapid approach of summer, with is barefoot children, bicycles, etc. makes the potential for injury and its resultant liability unbearable. The result is that we will have to _ force the recycle group to terminate its glass effort. The only escape from this is for the Town to provide a storage and collection area for glass. No ongoing labor, administration or other involvement would be necessary. The group could then clean, sort and crush the glass into a large dumpster. It would be the saving grace for a noble cause. Please consider the minimal negative impact on the Town Government and the great positive good to the community which the Town serves.
