Action Reauested of Council: No specific action of Council
requested - approval for the project was given at the Work
Session on June 12, 1990.
Background Rationale: Council had several technical
questions on the proposed project which staff did not have
the answers to respond. Mike Poeckes, of UEVW&SD, has
agreed to come and answer the questions Council raised and
any additional questions you might have. Mike is the
project manager on the program for UEVW&SD.
2:00 3. Discussion of request by Sweet Basil Restaurant to expand
Shelly Mello their deck onto Town property (Tract A, Biock 56, Vail
Village 1st Filing, 193 E. Gore Creek Drive) (Applicant:
Kevin Claire/Chuck Rosenquist)
Action Requested of Council: Approve/deny request.
Background Rationale: Sweet Basil Restaurant is requesting
to expand the outdoor dining deck (to the south) along Gore
Creek Drive onto Town of Uail property. They are requesting
to use approximately 100 square feet in the right-of-way.
This request requires a conditional use permit from the
PEC.
Staff Recommendation: The Community Development Dept. and
Public Works recommend denial of the request. Staff feels
that the subsequent narrowing of Gore Creek Drive would have
negative impacts on the loading/delivery process for this
area. In addition, the staff finds that the applicant has
the ability to expand their existing deck so that it would
not encroach onto the TOV right-of-way.

Erik Steinberg Dobson Ice Arena
Action Requested of Council: Approve/deny request.
Background Rationale: See enclosed letters.
Staff Recommendation: Deny request.

Dear Erik:
Thank you for your letter of June 7 concerning Ski Club Vail's request
for five free days' use per year of the John Dobson Ice Arena. Your
request will be placed on the Town Council's agenda for next Tuesday,
June 19, at the Work Session beginning at 2:00 p.m.
My discussion with Steve Connelly by phone was that the Town Council had
made a very clear exception for the World Wide Church of God in granting
free days' usage of the Ice Arena because it is a large convention
bringing in 2,500 to 3,000 people for a nine day period during a low
season of the year with the conference attendees spending $2 to $3
million in a wide range of businesses throughout the community over that
period of time. The Ski Club Vail ski swap and summer toy sale are not
in a similar category of community economic impact as the World Wide
Church of God conference. I also am concerned about setting a precedent
with non-profit organizations having free use of the Dobson Ice Arena.
Another clarification to your letter is that Ski Club Vail is not
entitled to keep sales tax derived from its sports swaps pursuant to
Ordinance No. 12, Series of 1990, because it is a different type of
retail activity from what most non-profit organizations provide as fund
raising events. The distinguishing factor between your event and others
is that Ski Club Vail takes articles under consignment from individuals
and businesses, is paid a fee for attempting to sell the item, and
retains a commission if the item is sold. The type of fund raising
event covered by Ordinance No 12. is where items are donated to
non-profit organizations and sold with no proceeds going to the donor.

If Ski Club Vail desires a cash donation from the Town of Vail or from
the Vail Metropolitan Recreation District, it is suggested that you
approach the Town and VMRD during the budget process for 1991.

Per your f,hore conversation wit: Ski Club Vail on May 31, we
submit the following request.
Whereas, Ski Club Vail is a Col:,rac:o Nonprofit Corpozation in
good standing; and
whereas, Ski Club Vail i~ a recognized contributing member of
the Vail community serving the youth of Eagle county; and
Whereas, Ski Club Vail is not entitled to keep any sales tax
derived from its" annual summer and winter sport swaps,
pursuant to Town of Vail Sales Tax Ordinance #12 Series 1990,
as other county nonprofit organizations are entitled to;
Ski Club Vail respectfully requests the Town of Vail to
donate five days per year, of John Dobson Ice Arena usage, to
the club for use during its" Summer Toy Sale (Memorial Day
weekend) and Annual Ski Swap (Halloween weekend).
Please consider that the savings derived from this donation
would help to cover a good portion of one coach"s salary for
one season.
Please consider that both SwapG are a part of the Vail Valley
Marketing soar"'."s efforts to kick-off the summer and add to
fall"s attractions.
Please consider Ski Club Vail s h:st~ry of sales tax payment
from the Ski Swap. Last year"s tax was $14,902.35. 1990"s
event is expected to net the Town in excess of $16,00.
Ski Club Vail wishes to thank you and the council for your

1. ATHLETIC FIELD LAVATORIES
VA might want to be involved for ski season lockers for Golden Peak.
Jim Gibson said projected cost was too high.
Agreement on:
1) Summer facility only for UMRD/TOU.
2) VA would pay to add other facilities for winter.
3) Talk to VA about staff preliminary design services - Jack Hann and Larry
Lichliter.
4) Location is between Athletic Field parking lot and sixth tee of golf
course.
5) Look into cost of building the facility into the berm as mostly
underground.
6) Should be a formal agreement with VA on parking lot at Athletic Field in
winter. May be able to exchange use of lot for building the entire
facility. VA build it with TOU approval, TOV own it, summer use for TOV
and VMRD.
7) Kristan will check zoning review.
2. PROCESS FOR VMRD TO CONSTRUCT ON TOU LAND
Agreed that #3 is ok without comma after "agrees". Process as outlined in
Kent's March 13 letter to VMRD. UMRD will provide general information on what a par
3, 9 hole golf course will entail in the way of new facilities. Then the Town
Council will hold a public hearing.
3. TOV/UMRD CONTRACT ADDENDUM
Ford Park irrigation system will be brought up to good working order by the TOV
in 1990. Then it will be turned over to UMRD in 1991. An agreement will be reached
concerning future levels of responsibility for both entities similar to Section 5 of
the Master Agreement.
Golden Peak trash removal will be added to the addendum list.
4. FREE USE OF DOBSON ICE ARENA
Discussion of what happened with World Wide Church of God and what will happen
in the future. Agreed to leave everything as is.
