The Commissioners are coming to discuss the election with the Council. 3:00 4. Discussion of Playground Expansion of Red Sandstone Andy Knudtsen Elementary School (Applicant: RE50J School District) Action Requested of Council: Give conceptual approval of proposal to lease Town land in order to expand the elementary school's playground. The proposed playground is located on the north end of the pedestrian bridge, west of the school. Background Rationale: Because the proposed playground site is located next to an area designated as rockfall, a mitigation study will be required prior to any Town approvals. The applicant would like to know what Town Council's position is on leasing land for this use prior to investing the time and money in hazard studies. Staff Recommendation: Conceptual approval contingent upon geo-hazard, insurance, and lease issues being resolved. 3:20 5. Presentation on Proposed Shrine Pass Cemetery Kristan Pritz (Applicant: Chuck Ogilby) Action Requested of Council: Comment on the proposal. Background Rationale: The applicant is requesting a special use permit from Eagle County to allow a 2 acre cemetery. The staff will pass on comments from the Council and PEC to the County planning staff. 3:50 6. Discussion of the Granting of Three Utility Easements to Greg Hall Holy Cross Electric Association Action Requested of Council: Decide whether to grant the easements or not. Background Rationale: Holy Cross Electric, during the 1980's, installed 3 separate electric lines on TOV property without acquiring the easements first. The areas are Mill Creek stream tract, Katsos Ranch open space, and behind the old Town Shop. To clean up their records, they are requesting the easements. ~I Staff Recommendation: Approve the easements. 4:05 7. Background Rationale: Staff is preparing a memo outlining the costs of extended outlying route bus service and will present this information at the Work Session. 4:20 8. Applicant: George Gillett., Jr. TO: Town Council FROM: Community Development Department DATE: July 10, 1990 RE: A request to lease land from the Town of Vail to expand the playground of the Red Sandstone Elementary School. Applicant: Eagle County School District represented by Kent Kriehn I. DESCRIPTION OF THE PROPOSAL The representative for the school district, Kent Kriehn, is proposing to lease an area approximately 100'x 150' from the Town of Vail. This would be located west of the elementary school and northeast of the I-70 pedestrian bridge, on Tract C, Vail/Potato Patch. The school district would improve the leased area with an irrigation system and grass. No playground equipment would be installed. There is an existing swing set in the area that would remain. Town records show no approval for the swing set. The area is adjacent to a rock fall area as designated on the Town's hazard maps (see attached map). The applicant will be required to complete a site specific hazard report per the Town of Vail ordinances concerning geo-hazards to insure the site is acceptable for a play area. II. REVIEW PROCESS The Red Sandstone School is located in the Public Use District. In that zone, a public school is a conditional use. The playground site is on an adjacent tract that is zoned agricultural open space. Staff considers the playground to be an accessory use to the existing school (conditional use). If given conceptual approval to proceed by Town Council, the request would be reviewed by the Design Review Board. III. COUNCIL ACTION REQUESTED At this time, conceptual approval by the Town Council is all that is requested. Before the school district puts money into a lease application and consultant's fees, the District would like to know if the Council will allow the proposal to go through the review process and if the Council generally supports the project. The Council will have another opportunity to review this request after hazard studies are completed, insurance and lease issues are resolved, and design plans have been developed. The rights herein granted specifically allow Grantee to install additional underground and/or pad-mounted facilities within the easement described by the attached exhibit. Together with the right to remove any and all trees, brush, vegetation and obstructions within said easement and the right to pile spoils outside said easement during construction and maintenance, when such is reasonably necessary for the implementation and use of the rights hereinabove granted. After the exercise by Grantee of any of its rights hereunder, Grantee shall promptly restore the surface of the ground to its former condition, as nearly as is practicable, and shall promptly replace any and all trees, brush, and vegetation removed or damaged by Grantee. Grantor agrees that all facilities installed by Grantee on t7ie above described lands, shall remain the property of Grantee, and shall be removable at the option of Grantee. Grantee agrees to indemnify and hold harmless the Grantor, its officers, employees and agents from all liability, claims, demands on account of injury loss or damage, including bodily injury, personal injury, death, property loss or damage, or any other loss of any kind, which may arise from Grantee's activities hereunder, including all costs associated with the defense of any such claims such as attorneys fees and court costs. Frontage Road Vail, Colorado 81657 Dear Friends: Thank you for contacting me to share your concern about the Eagle Mine Superfund site. I appreciate having the benefit of your views. As you know, over a hundred years of mining activity along the Eagle River has left a sad legacy: the Eagle Mine superfund site near Minturn. Roughly seven million tons of waste and tailings have been deposited around the old zinc mine, leaching large amounts of toxic metals into the ground and surface water. Because of the water contamination and the proximity of the mine to Minturn drinking water supplies, the Environmental Protection Agency placed Eagle Mine on the National Priorities List in May of 1986. In April of that year, the State of Colorado and EPA agreed that the state would act as lead agency in the effort to halt further pollution escaping from the mine and its tailings. The state sued the former owner of the site, Gulf and Western Industries, and in a court-ordered settlement reached in June of 1988, a course of remedial action was agreed to. This includes plugging several of the mine's portals, removal and consolidation of tailings, and long-term monitoring of the Eagle River and of the Minturn Middle School, where wind-blown materials have been a concern. As of April, 1990 a new and protectively lined waste site has begun receiving loads, several seeps from the mine have been closed, and monitoring of the river and surrounding area continues. However, several new problems have developed, resulting in the continued release of high levels of metals. The state and Gulf and Western entered into an additional agreement on May 11, 1990 that provides for the construction of a water treatment plant and further efforts to halt all seepage of toxic materials. The EFA expects these measures to bring metal and pH levels down to historic numbers.
