Rctian Requested of Council: The applicant has requested
that the item be tabled indefinitely.
Background/Rationale: At the December 19th, 1990 Council
meeting, the Council voted to table the Sonnenalp SDD
proposal to January 8, 1991.. Council did this in order to
vote an the project at a regular meeting, which would
require only four positive votes for project approval.
Later in the meeting, after Council discussion, the
applicant requested to withdraw the proposal. Because it
had already been tabled to January 8, some action at this
meeting must be taken.
Staff Recommendation: Staff recommends tabling the item
indefinitely.

8:00 6. Ordinance No. 45, Series of 7.990, second reading, an
Shelly Mello ordinance requesting a major amendment to SDD #4, commonly
known as Cascade Village, Section 18.46 - Area D, in order
to adjust the phasing in order to allow for an office
addition to the Glen Lyan Office Building, 1000 South
Frontage Road West, Lot 45, Block K, Glen Lyon Subdivision.
Applicant: Glen Lyon Office Building Partnership.
Action Requested of Cauneil: Approve/deny Ordinance No. 45,
Series of 1990, on second reading.
Background/Rationale: The applicant is requesting to amend
SDD #4 in order to allow for the enclosure of an existing
deck without meeting all of the conditions of approval
related to the SDD. The proposed deck enclosure is part of
the 2800 sq. ft. office expansion approved by PEC and
Council in March, 1990. The PEC voted unanimously to
approve the amendment.

Staff Recommendation: The staff recommends approval of the
request. The staff feels it is unreasonable to require the
applicant to meet all of the conditions set out in the
appraved SDD #4 in order to complete this 400 sq. ft,
addition.
8:25 7. Ordinance 4fi, Series of 1990, second reading, an ordinance
Shelly Mello amending Sections 18.54.020 E of the Vail Municipal Code to
provide for Design Review Board Meetings on the First and
Third Wednesdays of each month only; amending Section
18.54.050 A.6 to provide that asphalt and fiberglass
shingles may be permitted on structures within the Town of
Vail under certain circumstances; deleting Section 18.54.050
6.13 of the Vail Municipal Code; and setting forth details
in regard thereto. Applicant: Town of Vail.
Action Requested: Approve/deny Ordinance No. 46 on second
reading.
Background/Rationale: The PEC voted unanimously to
recommend approval of the Staff's & DRB's request to amend
the DRB Guidelines.
Staff Recommendation: The AEC, DRB, and Staff recommend
approval of Ordinance No. 46. The changes are minor
modifications of the guidelines. They will not have any
effect an GRFA site, site coverage, or any other
development standards.
8:55 8. Resolution Nn. 25, Series of 1990, a resolution declaring
Larry Eskwith the need for a housing authority to function in the Town of
Vail, Colorado.

7:40 3. Public discussion of the Proposed Amendments to Ordinance 42
Susan Scanlan relating to fireplaces.
Action Requested of Council: Give staff direction as to the
changes to be made to the ordinance so it can be redrafted
far second reading. Also, solicit public input on the
proposed ordinance changes to create a well-rounded
progressive ordinance.
i3ack~round Rationale: Council had initially agreed upon a
fee for fireplaces in all new construction, but would a1 so
like to include a deadline for complete conversion of all
woodburning units to gas or removal of the woodburning unit.
These ideas currently are not 'in the first ordinance and
will be discussed with the public.
Staff Recommendation: Provide recommendations for
progressive measures which will address the fireplace issue
and best serve the needs of the community now and into
the future.

Kristan Pritz the need for a Housing Authority to function in the Tawn of
Vail, Colorado.
Discussion of staff research on Housing Authority/Nonprofit
corporation approaches to providing Affordable Housing in
the Town of Vail.
Background Rationale: The Council requested that staff
research the pros and cons of a Housing Authority and also
develop a recommendation on how to approach the construction
of affordable housing on the Mountain Bell site and/or
Town Shnp site.
10:00 5. Letter to the Department of Wildlife concerning trapping 'in
Ken Hughey the Vail Valley.
Action Requested of Council: Support the staff
recommendation as contained in the letter to the Division of
Wildlife from the mayor.
Backaround Rationale: Recerrt trapping incidents in the
Vail Valley have prompted citizen concerns relating to
Division of Wildlife trapping regulations in the Valley.
The Town Council has, therefore, requested staff to draft a
letter of proposed changes.
Staffi Recommendation: Ban trapping from ridgeline to
ridgeline contiguous with the Town of Vail town limits plus
half mile east and west of tf•re current boundaries.

Susan Scanlan An ordinance repealing and reenacting Chapter 8.28 of the
Kristan Pritz Municipal Code of the Town of Vail to expand, strengthen,
and clarify code provisions relating to Air Pollution
Control. Applicant: Town of Vail.
Action Requested of Council: Approve Ordinance No. 42,
Series of 1990, on second reading.
Background Rationale: The Ordinance originally presented to
Council on December 18, 1990 has been revised at the request
of Council and now contains those changes which staff was
directed to make.
1. Ordinance No. 42 has been modified at Council
request to prohibit the construction of any new
fireplaces or wood stoves in the Town of Vail after
the effective date of the ordinance, unless they are
to be equipped with gas logs.
2. Provisions are also included for remodels and
alterations relating to number of allowable solid fuel
burning devices.
Coupled with this ordinance will be a public education
program to inform people of the health effects of wood
smoke, the benefits of conversion ~ health effects and
visual impacts to community, etc.
Staff Recommendation: Approve Ordinance No. 42 on second
reading.
8:30 5. Appointment of DRB & PEC Applicants. All terms will be
for two years.
Action Requested of Council: Appoint board members for
position openings.
8:40 6. Appointment of Housing Authority Board. Board
appointments will be for 1, 2, 3, 4 or 5 year terms.
Action Requested of Council: Recommend appointments to the `
Housing Board of Commissioners to the Mayor.
9:00 7. Resolution No. 1, Series 1991 - A Resolution of the
Susan Scanlan Town Council Designating the President's F4oliday weekend,
February 16, 17, 18, 1991, as to the 11th Annual Smokeless
weekend, and setting for the details relating thereto.
Action Requested of Council: Approval of Resolution No. 1,
Series of 1991.

Background Rationale: For the past ten-years the Tawn has
designated this weekend as a smokeless weekend whereby we
encourage citizens and guests to refrain from burning wood.
This is done to increase people's awareness of the impact
woad-burning has on the air quality in our valley. With the
recent focus on the air quality and fireplace regulations
this seems an appropriate step to determine the impacts of
voluntary control measures.
Staff Recommendation: Approve Resolution No. 1, Series of
1991.

Action Requested of Council: Adopt the proposed Master
P1 an with the attached resolution or request revisions
to it.
Background Rationale: The Master Plan has been reviewed
by the neighborhood, the DRB, and the PEC. Each group
has made suggestions about the design, most of which have
been incorporated into the plan. PEC recommended, with
a 4-0 vote, that Town Council adopt the plan. Please see
staff memo far description of the project and
explanation of the issues that have been identified
during the review process.
Staff Recommendation: Approve the plan and adopt the
resolution.
8:10 5. Modification to the Town of Vail Avalanche, Debris Flow
Andy Knudtsen and Rockfall Hazard Maps. Applicant: Town of Vail.
Action Requested of Council: Approve or deny the
proposed modification.
Background Rationale: As part of the development of the
Stephens Park Master P1 an, the Town hired Art Mears to
evaluate the hazards because he was able to use a
detailed topography map and because the methods used
to determine hazard areas are more sophisticated now than
they were when the Town mapped the hazards in 1984, the
specific areas designated as hazardous have changed.
After the PEC reviewed the attached memo and hazard
reports by Mears, they voted 4-0, recommending approval
of the changes.
Staff Recommendation: Approve the proposed changes.

Backaround Rationale: In 1977, the Town conveyed a
section of right-of-way to Manor Vail. The land conveyed
was a 50-foot wide strip extending From Vail Valley
Drive, east past the front entrance of Manor Vail, to
the pedestrian bridge leading to Ford Park. When the
Town originally conveyed the land, it conditioned the
deed with six restrictions, including the requirement
that Manor Vail dedicate a pedestrian easement through
this area to the Town. However, a clause in the deed
limits the restrictions to 20 years. In other words,
after 1997, the Town would not have a pedestrian easement
to Ford Park.
The proposed ordinance would direct the Tawn Manager to
execute a quit claim deed, releasing what interests the
Town does have in the land. Prior to this action, Manor
Vail will dedicate easements to the Town, and make the
other permanent public access and public utility. The
1977 deed and the 1977 resolution the Town Council passed
are attached. In addition, the proposed deed and
ordinance are attached for Council's review.

Background Rationale.: The Planning and
Environmental Commission voted 6-Q on March
11, 1991, recommending approval of a fifth
view corridor. The view corridor, as
proposed, would extend from Frivolous Sals
looking east to the Gore Range over the Red
Lion and Christiania roofs. Discussion of
adopting this corridor was reinitiated
recently when the Red Lion redevelopment was
reviewed. Since that time, staff has been
working with the property owners in the area
to define this corridor.
At a previous Town Council warksession
regarding this proposal, the Council asked
for a clear indication of the proposed
Christiania expansion in relation to the view
corridor. The attached photographs show the
corridor as it exists today, and as it will
be after the Christiania expansion is built.
The Ordinance is worded so that all
development proposals with Design Review
Board final approval, as of the date of
second reading of this Ordinance, will be
able to be built. However, if an existing

Facilities" as conditional uses. If rezoned,
the town will apply for a conditional use
permit to construct a snow dump. The Town is
planning on leasing the land from the current

Shearer. The motion passed 4-0. The
PEC allowed for a credit for stairways
inside individual dwelling units. The
Town Council approved on first reading,
June 4, 1991.

the PEC reviewed this amendment and
voted unanimously (4-0) to approve the
request. This change compensates single
dwelling units and two family dwelling
units with 225 sq. ft. when this type of
unit is Constricted in RC, LDMF, or MDMF
zone districts. The Town Council
approved on first reading, June 4, 1991.

Background Rationale: Approval of this
SDD will allow the construction of a new
three-story, 18,897 sq. ft., 37 unit,
freestanding employee housing building
alang Chamonix Road at the northwest
corner of the Days Inn property. On
Tuesday, May 28, 1991, the Planning and
Environmental Commission, by a vote of
6-0, recommended approval of the
Chamonix Special Development District
subject to the following conditions:
(1) Prior to issuance of a building
permit, the applicant must:
(a) Sign and execute the required
documentation in order to
permanently restrict these housing
units as rental units for full time
employees of the [3pper Eagle Valley
for a period of not less than 30
consecutive days and to insure
occupancy restrictions are met.
(b) Submit a Development Agreement for
review and approval by the Town
Attorney. The Development
Agreement will set forth the terms
for a 550,000 contribution far the
construction of a left turn lane
adjacent to the project site.
(c) Obtain a geologic hazard study. In
order to obtain a building permit,
the applicant must institute any
mitigation measures required under
the study.
(d) Test the soil adjacent to the fuel
tank to insure no leakage has
occurred. If the soil is
contaminated, applicant must clean
up the soil as required by the
Colorado Department of Health -
Underground Storage Tank Division
and the Environmental Protection
Agency,
(2) Landscaping be increased per staff
recommendations to include:
(a) Five additional Aspen in island at
northern end of the parking area
located east of the Days Inn
building.
(b) Additional landscaping in area east
of pedestrian link between the Days
Inn parking lot and Chamonix Lane.
(c) Addition of one 8-foot, two 10-
foot, acid two 12-foot Spruce in
planting area north of North
Frontage Rd.
(d) Eight additional Aspen in planting
area east of the Days Inn parking
lot and between the pedestrian
links to McDonald's and the West
Vail Mall.
(e} Additional landscaping in planting
area south of employee building and
north of the internal road way.
(f) Additional landscaping in the
planting area south of the internal
road way and north of the pool.
(3) East-west reorientation of existing
trash enclosure north of the
Shoppette building,
(4) Elimination of three parallel
parking spaces an north side of

Backaround Rationale: Staff has incorporated
changes discussed and agreed upon by Council
and the Planning Commission at a joint
meeting held May 21, 1991. The ordinance has
been revised to allow the installation of EPA
Phase II certified units and to further limit
the number of gas fireplaces as well as
placing restrictions on changes allowed
during remodels. The PEC reviewed this
request at a Work Session on June 10, 1991 ,
and agreed with the proposed changes.

Action Reauested of Council: Review Planning and
Environmental Commission's approval of three variances, which
are needed for the expansion proposal.
Backaround Rationale: On July 8, 1991, the PEC voted 7-0 to
approve variances for parking, height and common area. Staff
recommended approval of the request, finding that the variance
criteria, Vail Village Master Plan, and the Vail Streetscape Plan
standards had been met. Staff reviewed the project at the July
9, 1991 Town Council Work Session, when the Counci! decided
to call up the item. A revised set of conditions which reflect the
PEC discussions, the staff memo to the PEC, and a set of
drawings are included in this packet for Council's review.
Staff Recommendation: Uphold the PEC's decision.

Backaround Rationale: On 1116/91, the DRB determined the
business faces onto one major pedestrian way. On 4117191, the
DRB reviewed the applicant's sign variance request. Following
discussion, the applicant's representative requested the variance
request be tabled. On 6119191, the DRB again reviewed the
pedestrian frontage issue and upheld their 111 &191 decision that
the business fronts onto one major pedestrian way. On 7117191,
the DRB voted to deny the requested sign variance. The vote to
deny was passed, 3-1. Voting in favor of the motion to deny
were George Lamb, Ned Gwathmey, and Chuck Crist. Sherry
Dorward voted against the motion for the fallowing reasons: A)

Background Rationale: In December, 199x, a major amendment
to the SDD was approved to change the phasing plan for Area D
- Glen Lyon Office Building. This allowed fora 400 sq. ft.
expansion to the building without meeting ail of the site

improvement conditions associated with the previously approved ~ °`
office expansion. The applicant would be required to
underground the utilities and install additional landscaping. Since
the time of the approval, Holy Cross Electric has asked the
applicant to commit to an additional $20,000 in expense to
underground. This is in addition to the $15,000 they are
responsible for. The applicant is unable to expend this additional
amount, and is asking to be relieved from this requirement.
The PEC recommended approval of the amendment with the
condition that the applicant escrow 1.6p/o {400 sq. ft. is 1.6% of
the total approved square footage of the project) of the cost to
underground the main line for the length of the office building
property. The applicant will underground the secondary lines
when the main line is placed underground. The motion was
made by Kathy Langenwalter, seconded by Ludwig Kurz, and
passed by a vote of 5-0. They also required evergreens be
added to the landscape plan.

Background Rationale: On August 7, 1991, the DRB voted 5-0
to approve a modified landscape plan for the Gasthof
Gramshammer. The applicant does not intend to add any
landscaping to what presently exists in the planters on the east
and south sides of the buildings. On two (2) earlier occasions,
the DRB approved plans which included more landscaping than
what presently exists. On January 30, 1991, the DRB approved
the ski storage locker expansion with an accompanying
landscape plan. On June 19, 1991, the DRB approved a plan
which allowed the removal of three {3) Aspen trees on the
southwest corner of the Gasthof Gramshammer site. This
approval was given with the condition ,that the applicant present
an alternative plan, providing an adequate amount of landscaping
to compensate for the three {3) trees which we cut down. With
the DRB approval of August 7, 1991, the applicant is no longer
required to complete the landscaping required with the ski
storage addition nor provide any landscaping to compensate for
the trees which were cut down. The DRB believed that the
existing landscaping was attractive and that the Gasthof
Gramshammer did not need more landscaping to improve its
appearance.

18.54.05D, that "primary colors or other bright colors should be
used only as accents and then sparingly such as upon trim or
railings." The DRB approved the color change on the rationale

Backaround Rationale: The Vail Glo Lodge constructed bollards
during the early part of the summer which were not part of an
approved landscape plan. The Staff became aware of the
construction of these bollards at the time of the landscape plan
site inspection and advised the applicant to submit a DRB
application for their approval. The bollards were approved by the
DRB on August 7, 1991 by a vote of 3-1, with Sherry Dorward
dissenting.

Background Rationale: The applicant had exterior lighting
installed to illuminate the trees and grounds at his residence at
424 Forest Road. The lighting was installed before the applicant
applied for DRB review. There was also no electrical permit
issued for the work. On August 7, 1991, the DRB voted 4-0-1 to
deny the rec{uest for approval of existing landscape lighting. The
one abstention vote was made by the PEC representative to the
DRB who had not been on the site visit to the property. The
DRB believed that the lighting design generated impacts on
surrounding properties and was incompatible with the
neighborhood. Based on these two conclusions, the DRB stated
that the proposal was in conflict with Section 18.54.050(C) ti 1)
of the Town of Vail Municipal Cade. This section of the code
reads as follows: "Exterior lighting sha11 be designed and located
in a manner to minimize impact of lighting upon living areas
within a proposed project and upon adjacent structures and
properties."

bermed up over the roofi so that only the east elevation of the
lounge will be visible. In additian to the expansion of the

bicycle lane running the distance of the Pinos del Norte property,
which conforms to the Streetscape Plan and the Recreation
Trails Master Plan. The PEC reviewed the proposal on
September 23, 1991, and recommended approval to the Town

Devries in Denver. These semi-finalists included William

also recommends approval of the selection.

Counci! approve it. Currently, the zoning code allows parking
spaces to be leased between private individuals in the CCl, CCII,
HDMF, PA, and SD zone districts. The code amendment would
include the CCIII zone district, and would allow rental car
agencies to also lease private spaces. There will be no chanae
to the requirement for a lease proposal to be approved by the
zoning administrator. Even if this amendment is approved, the
Town could deny a proposal which caused a parking problem, or
was not appropriate far a given site.

Backaround Rationale: On December 4, 1991, the DRB voted
unanimously to recommend approval of a variance to allow a
menu box for The Chart House Restaurant to be located at the
second landing of the stairs located to the east of the restaurant,
as per the staff recommendation. The DRB found the business
location is a hardship, however the sign should be located within
a reasonable distance to the establishments main access.

Staff Recommendation: Staff recommends denial of the request
to place a menu box at the mall level. The staff does
recommend a variance which would allow a menu box at the
second landing. Please see attached memo for rationale.
8:45 p.m. 9. Review of a sign variance request far The Village Popcorn
Betsy Rasolack Wagon. (Applicant: Ms. Jan Wening)
Action requested of Council: On August 21, 1991, the DRB
considered three sign variance requests for The Village Popcorn
Wagon. The first variance, to allow the wording on the awning to
not contain the name of the business was denied. The DRB felt
the second variance, to allow a greater number of signs than
permitted, and the third variance, to allow a greater sign area
than permitted, were not needed because the exis#ing metal
signs were part of the design of the wagon. Thus, the wagon
would not be aver in number or area of signs.
Staff Recommendation: Uphold the DRB decisions.
9:00 p.m. 10. Appeal of a PEC decision for a conditional use permit request for
Mike Mollica an outdoor dining patio for Russell's Restaurant Deck @ The
Gallery Building, 228 Bridge Street; a part of Lot A, Block 5, Vail

Action Reauested of Council: Uphold/overturn the decision of
the PEC.
Background Rationale: The PEC, at their December 9, 1991,
public hearing, denied the applicant's request by a vote of 3-1.
