Susan Scanlan An ordinance repealing and reenacting Chapter 8.28 of the Kristan Pritz Municipal Code of the Town of Vail to expand, strengthen, and clarify code provisions relating to Air Pollution Control. Applicant: Town of Vail. Action Requested of Council: Approve Ordinance No. 42, Series of 1990, on second reading. Background Rationale: The Ordinance originally presented to Council on December 18, 1990 has been revised at the request of Council and now contains those changes which staff was directed to make. 1. Ordinance No. 42 has been modified at Council request to prohibit the. construction of any new fireplaces or wood stoves in the Town of Vail after the effective date of the ordinance, unless they are to be equipped with gas logs. 2. Provisions are also included for remodels and alterations relating to number of allowable solid fuel burning devices. Coupled with this ordinance will be a public education program to inform people of the health effects of wood smoke, the benefits of conversion - health effects and visual impacts to community, etc. Staff Recommendation: Approve Ordinance No. 42 on second reading. 8:30 5. Appointment of DRB & PEC Applicants. All terms will be for two years. Action Requested of Council: Appoint board members for position openings. 8:40 6. Appointment of Housing Authority Board. Board appointments will be for 1, 2, 3, 4 or 5 year terms. Action Requested of Council: Recommend appointments to the Housing Board of Commissioners to the Mayor. 9:00 7. Resolution No. 1, Series 1991 - A Resolution of the Susan Scanlan Town Council Designating the President's Holiday Weekend, February 16, 17, 18, 1991, as to the 11th Annual Smokeless Weekend, and setting for the details relating thereto. Action Requested of Council: Approval of Resolution No. 1, Series of 1991. Background Rationale: For the past ten-years the Town has designated this weekend as a smokeless weekend whereby we encourage citizens and guests to refrain from burning wood. This is done to increase people's awareness of the impact wood-burning has on the air quality in our valley. With the recent focus on the air quality and fireplace regulations this seems an appropriate step to determine the impacts of voluntary control measures. Staff Recommendation: Approve Resolution No. 1, Series of 1991. 9:10 8. Adjournment. MINUTES VAIL TOWN COUNCIL MEETING JANUARY 8, 1991 7:30 P.M. A regular meeting of the Vail Town Council was held on Tuesday, January 8, 1991, at 7:30 P.M., in the Council Chambers of the Vail Municipal Building. MEMBERS PRESENT: Kent Rose, Mayor Tom Steinberg, Mayor Pro-Tem Jim Gibson Merv Lapin Robert Levine Peggy Osterfoss MEMBERS ABSENT: Lynn Fritzlen TOWN OFFICIALS PRESENT: Ron Phillips, Town Manager Larry Eskwith, Town Attorney Pam Brandmeyer, Town Clerk The first item on the agenda was approval of the minutes of the December 4, 18, and 19, 1990, meetings. With a corrected spelling of Edward Mayne's name in the December 19, 1990, minutes. Tom Steinberg moved the approval of the three sets of minutes, seconded by Merv Lapin. The motion passed unanimously, 6-0. The second item on the agenda was Citizen Participation, of which there was none. Item No. 3 on the agenda was Ordinance No. 44, series of 1990, first reading, an ordinance requesting a Special Development District for the Sonnenalp redevelopment, located at 20 Vail Road; a part of Lot L, Block 5-E, Vail Village 1st Filing. (Applicant: Sonnenalp Properties, Inc. - Johannes Faessler.) Mayor Rose read the full title of the ordinance. Johannes Faessler took the stand and stated that a letter had been written requesting the Town Council table this ordinance indefinitely. No further work was being done since they felt like they were in a hopeless corner. Mayor Rose stated that the proposal was close to something the Council could approve, but the applicant should be willing to enter negotiations with the Town to determine just what changes would meet a consensus of the Council. Merv Lapin stated there might not be a great deal of difference if the applicant would be willing to engage in some give-and-take. Instead of tabling this ordinance indefinitely, he suggested it be tabled until July 2, 1991, while the present council members are still on the board. Merv Lapin made a motion to table this ordinance until the July 2, 1991, evening meeting, which Tom Steinberg seconded. A vote was taken and the motion passed unanimously, 6-0. The fourth item on the agenda was Ordinance No. 36, Series of 1990, second reading, an ordinance repealing and reenacting Section 18.52.160, Parking Exemptions and repealing Section 18.52.180, variances of the Town of Vail Municipal Code and setting forth the details in regard thereto. Mayor Rose read the full title of the ordinance. Kristan Pritz asked to withdraw this ordinance and go back to the task force. There was no discussion by Council. Tom , Steinberg made a motion to this effect with a future Council review of February 11, 1991, which was seconded by Rob Levine. A vote was taken and the motion passed unanimously, 6-0. The next item to be discussed was Ordinance No. 42, Series of 1990, second reading, an ordinance repealing and reenacting Chapter 8.28 of the Municipal Code of the Town of Vail to expand, strengthen, and clarify code provisions relating to air pollution control. Applicant: Town of Vail, which title was read in full _ by Mayor Rose. Kristan Pritz proposed that a public discussion be held on January 15, 1991, evening session, and that this ordinance be brought back for the next evening session on February 5, 1991. Rob Levine made a motion to approve this and Peggy Osterfoss seconded it. The motion was unanimously passed, 6-0. -1- Item 6 on the agenda, Ordinance No. 45, Series of 1990, second reading, an ordinance requesting a major amendment to SDD #4, commonly known as Cascade Village, Section 18.46 - Area D, in order to adjust the phasing in order to allow for an office addition to the Glen Lyon Office Building, 1000 South Frontage Road West, Lot 45, Block K, Glen Lyon Subdivision. Applicant: Glen Lyon Office Building Partnership. The mayor read the full title of Ordinance No. 45. Shelly Mello said there was no change from the original. A motion was made by Tom Steinberg and seconded by Peggy Osterfoss. The motion was unanimously passed, 6-0. The next item Mayor Rose read the full title of Ordinance No. 46, Series of 1990, second reading, an ordinance amending Sections 18.54.020 E of the Vail Municipal Code to provide for Design Review Board Meetings on the First and Third Wednesdays of each month only; amending Section 18.54.050 A.6 to provide that asphalt and fiberglass shingles may be permitted on structures within the Town of Vail under certain circumstances; deleting Section 18.54.050 B.13 of the Vail Municipal Code; and setting forth details in regard thereto. Applicant: Town of Vail. A motion by Merv Lapin and seconded by Tom Steinberg was approved for second reading, 6-0. The final item on the agenda was Resolution No. 25, Series of 1990, a resolution declaring the need for a housing authority to function in the Town of Vail, Colorado. Kristan Pritz asked that a public discussion be held on January 15, 1991, and to bring back this ordinance on February 5, 1991, for the evening meeting. The council said this was acceptable and a motion to table this resolution was made by Peggy Osterfoss and seconded by Rob Levine and was unanimously approved, 6-0. ORDINANCE NO. 42 Series of 1990 AN ORDINANCE REPEALING AND REENACTING CHAPTER 8.28 OF THE MUNICIPAL CODE OF THE TOWN OF VAIL TO EXPAND, STRENGTHEN, AND CLARIFY CODE PROVISIONS RELATING TO AIR POLLUTION CONTROL. WHEREAS, the setting of the Town of Vail in a valley between two mountains restricts air movement through the valley; WHEREAS, the movement of air through the Gore Valley is further restricted in cold times of the year thereby causing the increased buildup of pollutants in the air caused by solid fuel burning devices; WHEREAS, the Town Council finds that the pollution caused by solid fuel burning devices is exacerbated by the altitude, topography, climate and meteorology of the Town of Vail; WHEREAS, the Town Council finds that these sources of air pollution may be minimized by existing, practical and economical technologies; WHEREAS, the Town Council has determined that is necessary to encourage environmentally beneficial technologies to prevent further degradation of the air quality of the Vail Valley; WHEREAS, the Town Council considers visually clean air to be an irreplaceable asset enjoyed by guests and residents of Vail. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT; Section 1. The Vail'Municipal Code Chapter 8.28 "Air Pollution Control" be repealed and reenacted to read as follows: 8.28.010 Purpose and Applicability / These regulations are enacted for the purpose of promoting the health, safety and general welfare of the residents and visitors in the Town of Vail. These regulations are intended to achieve the following more specific purposes: 1 1) To protect the air quality in the Town of Vail; 2) To reverse the continuing trend toward increased air degradatio,~ ii, ..::e ~~wn of Vail; 3) To provide heat sources that are efficient and have a reduced polluting effect; 4) And to generally protect the air for the purpose of the public's overall health, safety and welfare. The provisions of this Chapter shall apply to all areas of the Town of Vail. 8.28.020 Definitions 1) Solid Fuel Burning Device: shall mean any fireplace, stove, firebox or.device intended and/or used for the purpose of burning wood, pulp, paper or other non-liquid or non- gaseous fuel. 2) Certified Solid Fuel Burning Device: shall mean a solid fuel burning device which is certified by the Air Pollution Control Division of the Colorado Department of Health to meet the Emissions Standards set forth in Section IV of Regulation No. 4 of Volume I of Colorado Air Quality Control Commission. 3) Wood Burning Fireplace: shall mean an open hearth or fire chamber or similar prepared place in which a fire may be made and which is built in conjunction with a chimney. 4) Gas Appliance: shall mean a fully self- contained, U.L. listed and A.G.A. "fireplace" unit which does not require venting through a chimney and which does not permit the use of solid fuel. 5) Gas Loa Fireplace: shall mean a fireplace as previously defined equipped with an A.G.A. and U.L. listed artificial log unit which is approved for the burning of natural gas. 2 y 6) Dwelling unit: means any room or group of rooms in a two-family or multiple-family building with kitchen facilities designed for or used by one family. as ,an independent housekeeping unit. 7) Accommodation unit: means any room or group of rooms without kitchen facilities .designed for or adapted to occupancy by guests and accessible from common corridors, walks, or balconies without passing through another accommodation unit or dwelling unit. 8) Refuse: means all solid wastes, garbage and rubbish, whether combustible or noncombustible, including rubble. 9) Restricted Dwelling Unit: means any unit in a primary/secondary duplex or single family zone district which cannot be subdivided or sold separately. 8.28.030 Solid Fuel Burnina Devices No new solid fuel burning devices shall be permitted to be constructed or installed within the Town of Vail after the effective date of this ordinance. 8.28.040 Gas Loa Fireplaces Gas log fireplaces may be permitted within the Town of Vail which comply with the following restrictions: 1) Each dwelling unit with the exception of restricted units shall be entitled to three (3) or fewer gas log fireplaces. 2) Restricted units may contain no more than one gas log fireplace. 3) Each accommodation unit may contain one gas log fireplace. a) All gas log fireplaces in accommodation units within the Town of Vail shall be subject to periodic inspection by the Town of Vail Environmental Health Officer. Prior to making any such inspection, the Environmental Health Officer shall give reasonable notice of such inspection to the owner of the property being inspected. 3 The owner of any commercial property containing any gas log fireplace shall pay to the Town of Vail the amount of thirty dollars ($30.00) per year on the first aay oz the year" following the year in which said equipment was installed for each such fireplace, and the first day of each year thereafter during the time the gas fireplace remains within the property. The owner of the property shall allow the Town of Vail Environmental Health Officer sufficient access to the property for the purposes of doing such an inspection. b) All gas log fireplaces in accommodation units within the Town of Vail shall be constructed in such a.manner that access to the firebox is prohibited except for the purposes of repair and maintenance. A sign shall be placed on the gas log fireplace reading: "Caution - Gas Fireplace Only". 8.28.050 Gas Appliances In addition to gas log fireplaces permitted by Section 8.28.040 of this ordinance, gas appliances may be permitted which comply with the following restrictions: 1) Each dwelling unit may contain no more than three (3) gas appliances. 2) Restricted dwelling units may contain no more than two (2) gas appliances. 3) Accommodation units may contain no more than one gas appliance per unit. a) AT1 gas appliances in accommodation units shall be provided with a sign reading: "Caution - Gas Fireplace Only." 8.28.060 -Modification. Alteration or Remodel If one or more separate dwelling units are , combined to form one larger dwelling unit, regardless of the number of solid fuel burning devices previously contained in each separate dwelling unit, the newly formed unit shall: 1) Contain no more than one wood burning fireplace or certified solid fuel burning device; and 2) Cause any additional solid fuel burning devices to be removed or rendered permanently inoperable; or 4 ~ 3) All wood burning fireplaces shall be converted to gas by the installation of gas logs or gas appliances in G`Vii~ll'di'ICe with the terms, conditions, provisions and restrictions of this ordinance. 8.28.070 Commercial Antilications The terms and provisions of this chapter shall not apply to licensed commercial kitchens desiring to use wood burning equipment for food preparation. The allowable applications shall be limited to wood burning pizza ovens or mesquite broilers. 8.28.080 Coal Usaae Prohibited The burning of coal within the Town of Vail is prohibited. 8.28.090 Refuse Burning Prohibited The burning of refuse in any solid fuel burning device is prohibited within the Town of Vail. 8.28.100 Permit Reauirements 1) A building permit shall be required for the installation of any gas log fireplace or gas appliance. To encourage the conversion of wood burning and solid fuel devices to gas log fireplaces and gas appliances, all applicable building permit fees for such conversion shall be waived by the Town of Vail. 2) The provisions of this ordinance shall not apply to wood burning fireplaces for which DRB approval has been obtained and a completed application and required construction drawings for a building permit have been filed with the Community Development Department not later than February 15, 1991. f 8.28.110 Penalties It is unlawful for any person to violate any provision of this Chapter or to fail to comply with any of the requirements of this Chapter. Any person performing any act prohibited or declared to be unlawful by this Chapter or failing to perform an act required by or otherwise made mandatory by this Chapter shall be punished by a fine of not more than four hundred 5 ninety-nine dollars ($499). Any such person shall be guilty of a f separate offense for each and every day during any portion of which a violation of any provision of this Chapter is commit::ad, continued, or permitted by such person and shall be punished accordingly. In addition to penalties provided in this Section, any condition caused or permitted to exist in violation of any provision of this Chapter shall be deemed a public nuisance, and may be by this Town similarly abated as such, and each day that such condition continues shall be regarded as a new and separate offense. Section 2. If any part, section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance; and the Town Council hereby declares it would have passed this Ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 3. The Town Council hereby finds, determines and declares that this Ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and inhabitants thereof. Section 4. The repeal or the repeal and reenactment of any provisions of the Vail Municipal Code as provided in this Ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under o.r.by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. 6 INTRODUCED, READ AND PASSED ON FIRST READING.THIS day of 1990, and a public hearing shall be held on this Ordinance on the dp.y of 1990 at 7:30 p.m. in the Council Chambers of the Vail Municipal Building, Vail, Colorado. WHEREAS, the air pollution in the Gore Valley has been increasing with each winter season; and WHEREAS, it is the opinion of the Town Council that it would . be in the public interest to encourage limited use of fireplaces and woodstoves during the President's Holiday Weekend. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, that: 1. The Town Council hereby designates the President's Holiday Weekend, February 16, 17, 18, 1991 as the 11th Annual Fireplace Smokeless Weekend; and 2. All residents and visitors of the Town of Vail shall be encouraged to refrain from using their fireplaces or woodstoves during that weekend unless they are a primary heat source, in order to protect and improve the air quality in the Gore Valley. RE: Request to place "Big Bull" sculpture on Gore Creek Promenade Applicant: John Cogswell On February 4, 1991 the Art in Public Places Board (AIPP) reviewed a request to place the sculpture "Big Bull" by Chris Navarro on Gore Creek Promenade in front of Cogswell Gallery for approximately six weeks. (See attached site plan and picture of sculpture.) Upon review of the piece, the Board discussed a number of items including whether or not it is appropriate for galleries to place pieces for sale on public property. The Board voted 5-0 to deny the request citing: 1) The scale of the piece is inappropriate for the site, and 2) that the antlers of piece pose a hazard and do not meet the AIPP safety requirements. In addition, they felt that there could be impacts on the paving system due to the weight of the piece. The board also recommended that we avoid placing pieces for sale on public property until further discussion has occurred with the Gallery Association. After staff notified the applicant of the AIPP decision, he revised the request to allow the piece to be sited at the proposed location for only two days. The Board was contacted by telephone for comment. Of the five who voted formally at the February 4th meeting, three of the members indicated that they felt that the placement of the piece would be inappropriate for any amount of time for the same reasons discussed under the original denial. The remaining members were unavailable for comment. ARTWORK LOANED FROM THE COLLECTION Agreements to loan artwork frcm the AIPP collection may be entered into with tax-exempt institutions if such loans are approved by the AIPP Board and Town Council and allowed in the contract with the artist. The time period for the loan shall be clearly stated in the loan agreement. H. TEMPORARY ARTWORK EXHIBITIONS Temporary artwork is considered to be artwork that is _ proposed for a site for a time period not to exceed 30 days. Temporary special exhibitions of AIPP sponsored works of art will be reviewed by the Art in Public Places Board in consultation with appropriate Town departments such as Public Works, Fire, Community Development, Recreation and/or Police. However, a temporary artwork may be approved by an executive committee made up of the AIPP chairperson, Town Council AIPP representative, and one AIPP representative at large in consultation with appropriate Town of Vail Departments for a period of time not to exceed 30 days. The executive committee may determine it is inappropriate to review a project using the executive review. If so desired, the executive committee may determine the proposal must be reviewed by the AIPP Board. The AIPP coordinator shall inform the AIPP Board and Town Council of the executive decision at the next regularly scheduled AIPP meeting and next regularly scheduled Town Council worksession. ` I. PUBLIC DISCLOSURE 1. This statement of policy and related procedures • will be made available to donors or other persons upon requested. 2. The AIPP Board will make available the identity - ~ and description of collection materials acquired and deaccessioned. All other facts pertaining to the circumstances of acquistition, relocation - and deaccession will be adaequately documented in the AIPP's records of the collection. J. REVISIONS AND INTERPRETATIONS OF COLLECTION POLICY Any revisions of formal interpretations of this collection policy shall be made in the form of addenda to the policy in order to provide continuing documentation of such changes. Amendments to policies shall be reviewed by the Town Council and reviewed by resolution. 6 ~ IX. VAIL ART IN PUBLIC PLACES PROJECT SELECTION CRITERIA r- A. ~ SITE SELECTION CRITERIA 1. Prior to selecting a site for an artwork, the Art in Public Places Board and/or selection jury, shall take into consideration the following factors: - a. The visibility of the site by the general public _ . b. Public safety . c. Interior and exterior vehicular and pedestrian traffic patterns d. Relationship of proposed site to existing or future architectural features and t~ natural features e. Facility for users and/or interaction of users with proposed artwork f. Future development plans for the area g. Site design, including landscaping, drainage, grading, lighting and seating considerations h. Relationship of proposed art work to existing artworks within the site vicinity i. Environmental impact such as noise and light associated with the artwork j. Public accessibility to the art work, particularly handicap access k. Impacts on adjacent property owners' views 1. Impacts on operational functions (snowplowing, etc.) of the Town B. ARTWORK CRITERIA f The AIPP Board and/or selection jury shall use the following criteria when reviewing an artwork. The AIPP Board may include additional criteria for a specific project. 29 ~ 1. ~ Quality and Innovation The consideration of highest priority is the inherent artistic excellence and innovation of the artwork. 2. Timelessness Each artwork should be viewed as a long term acquisition that should have relevance aesthetically to the community in future years. Due to the high visibility of public art by _ residents and guests who frequent public places, artworks should be selected that reflect enduring artistic quality. 3. Compatibility With Site _ Works of art should be compatible in style, scale, material, form, and content with their surroundings, and should form an overall relationship with the site. 4. Permanence Works of art shall have structural and surface soundness, and be resistant to theft, vandalism, weathering. Artwork shall not require excessive maintenance or repair costs. Artworks that require expensive and/or continual maintenance are discouraged. 5.
