Background Rationale: The ABC School is
requesting financial assistance for the
school expansion. The staff has only offered
fill for the berm (see enclosed memo and
correspondence).
Staff Recommendation: Uphold the staff
decision to only offer fill material for the
berm.

Council up to date on the planning process.

Finalize the adoption process for the study.
Background/Rationale: The Planning and
Environmental Commission is having their
final work session prior to adoption on the
plan and report May 20th. We would like to
update the Council on the Planning
Commission's concerns and get any further
Council direction. We are doing this prior
to having Planning Commission formally
recommend to the Council adoption of the
plan. In addition, we have included in this
year's citizen survey numerous questions
concerning various aspects of the plan's
implementation and direction. We would like
to have the results of the survey before we ,
finalize the last portion of the Master
Transportation Plan. This being
prioritization, possible financing schemes
and a recommended implementation plan. The
results of the survey will be available
approximately the week of June 24, 1991.
Staff Recommendation: We want Council
direction on all aspects of the plan and
resolve any concerns prior to having the
Planning Commission adopting the plan on July
8, 1991. We would finalize the plan's
priorities on July 2, 1991. After Planning
Commission adoption, we would adopt the plan
July 16, 1991. We may have another work
session in June if concerns brought up need
further resolution or explanation prior to
adoption.

RE: ABC School Request for Funding Assistance
A few months ago the ABC School contacted me asking for Town of
Vail assistance in their building project. They asked for help in
building the berm required to mitigate the debris flow in that
area, and also requested that the town prepare and pave their
parking lot. We have been talking with them periodically and
finally let them know about two weeks ago that we would be glad to
provide the fill necessary for the berm but we would not be
responsible for shaping and final construction of the berm nor
would we pave the parking lot. The ABC School Staff and Board
Members have now requested to approach the Council to request
further assistance.
It is my opinion that direct financial assistance of the type being
requested is not appropriate for the following reasons:
1. The Town of Vail provides the land for the ABC School and
The Learning Tree Child Care Center at no cost to either
entity.
2. The Learning Tree received a $5,000. contribution from
the Town during their expansion several years ago.
Unfortunately, the Town's financial condition is no
longer flush enough to allow contributions to every
organization.
3. There are other private child care centers and early
childhood training centers in the Valley to which the
Town of Vail provides no financial assistance at all. I
think it is difficult to justify providing assistance to
this entity without setting some kind of a precedent for
other entities to request similar assistance.
4. I believe the ABC School will make a part of their
request a contention that the Town has put unreasonable
requirements on them such as the requirement to build the
berm to mitigate against debris flow, etc. The
requirements placed on ABC School are no different than
requirements placed on any other entity developing within
the Town of Vail. For example, the Vail Mountain School
was required to build a berm to mitigate against rock
fall hazards in their area. All other schools have also
been required to pave their parking lots.

ABC School, Inc !s an accredited Preschool/Day Care
Center well-known for its quality programs and staff. It Is
because of this quality that many people seek us out and
want to attend our school. Unfortunately our space is
11mlted and we are currently unable to accept all; the
children we would like to In the 3 1/2 - 6 year old program.
We have been trying to expand our facility for over a
year now. It is a needed addition that would benefit both
the families currently attending our school, as well as
those on the waiting list. We have found construction to be
quite costly and are considering only adding one extra
classroom Instead of all the improvements originally
planned. The cost of Just the one classroom is
approximately X60,000. Our fundraising money combined with
a loan from First Bank of Vall would pay for the cost of the
expansion and add 35 spaces a week that we could offer for
child care.
The problem Is the extra X12,800 cost over and above
the X60,000 to pave the parking lot and construct the berm.
(Please see the attached B & B ~uotatlon) We realize the
town requires this of everyone and know the benefits of
having pavement and debris flow protection. We just need
help either monetarily or with the labor for these two
Items to defer the costs and make our expansion a reality
this summer. Just as the building will become the town's
asset when our lease is up, so will the Improvements that we
make: the paving and the berm.
After our original request to Ron Phillips was
reviewed, Csee attached letter) Pam Brandenmeyer referred us
to Greg Hall. After speaking with Greg a few times, we were
Informed that the town would glue us the dirt for the berm '
and that was all at this time. As you can see, the bid from
B & B did not iclude dirt, so we are still at X12,800.
At this point, we would like to request any other
possible help the town could give us. Could we delay the
paving of our parking lot ? Could the town help us build
the berm ? Could the Town allocate funds to defray the
cost?

like to be able to help them.
Being a non-prof it•organization, our funds our 11mlted
for this protect. We have raised X35,000 dollars., but the
bids are coming in around X100,000. The two main obstacles
are the town requiring us to also build a berm and to pave
the parking lot. We spoke with Dan Selbel from B&B who said
a berm built to meet the specifications could run up to
X30,000 alone. The town's bid on the paving was $14,500.
The cost of these two requirements are hindering us from
continuing on with our plans to expand our facility this
summer.
Would it be possible for the Town to donate the dirt and
the crew from the building of Donovan Park and build our
berm ? Would the town also be able to allocate funds to_
help in the paving of the parking lot ? These would both be
wonderful improvements to the Towns' property which we are
leasing.
I know that the lack of daycare facilities is of great
concern to the entire Vail Valley and we would love to be
able to help by doing our expansion. And we will be able to
do It with the Town's help.

3) Place and compact one (1) foot lifts at 90o compaction;

Dear Holly;
In reference to the 1,200 cubic yard berm, the following work
is included:
1) Strip existing vegitation (to be hauled off and disposed of
by owner;
2) Remove any existing topsoil and place at the edges of the
fill area to be pulled back onto the berm for revegitatior.
(owner will need.to provide additional top soil if needed);
3) Place and compact one (1) foot lifts at 90o compaction;
4) Location of the berm to be staked by owner;
