Jeff Bowen Action Requested of Council: Hear comments thanking those involved for the success of the 1994 Trees for Vail event. 2:05 P.M. 2. Eagle County Open Space Committee Action Requested of Council: Request feedback on the Open Space Committee's Russ Forrest preliminary plans. Ellie Caryl Background Rationale: The Eagle Counry Commissioners created an Open Space Committee in December, 1993, to recommend a framework for protecting open space in Eagle County. 2:35 P.M. 3. Discussion Re: R4 Well on Golf Course. Greg Hall Gail Crider Dennis Gelvin Action Requested of Council: Grant/deny WCWD approval to proceed with project. Background Rationale: VVCWD is proposing drilling a new well near the 13th fairway. The District has coordinated with VRD, but needs Council permission as TOV owns the land. VVCWD will provide information on request. Staff Recommendation: Provide VVCWD permission to proceed with project. 3:20 P.M. 4. Review of Draft Ordinance No. 10, Series of 1994, an ordinance amending Chapter Mike Rose 18.52, Off-Street Parking and Loading. Action Reauested of Council: Review and discuss Draft Ordinance No. 10, Series of 1994, concerning parking pay-in-lieu in preparation for first reading at the Evening Meeting this date. Background Rationale: This ordinance would establish the off-street parking fee at $15,0()0.00, up from $8,595.00. The increase is based on the actual cost of a parking stall built in the area. Staff Recommendation: Approve Ordinance IVo. 10, Series of 1994, on first reading at the Evening Meeting this date. 4:05 P.M. 5. Continuation of Parking discussion. Request for permission from the Towrn Council to proceed through the Planning Mike Mollica and Environmental Commission (PEC) and Design Review Board (DRB) processes in order to request a paving variance for the construction of trailhead parking, located on Parcel B, Spraddle Creek. Applicant: SBC Development Company - Spraddle Creek Estates. Action Reauested of Council: Approve or deny this request to proceed through the planning process. Background Rationale: Subsequent to TOV's purchase of Spraddle Creek Parcel 1 Q b'B from the USFS, the Forest Senrice approved a special use permit for the use of a portion of this property as the construction trailer site for the installation of the subdivision's infrastructure. SBC would now like to begin reclamation of this site, and the USFS, as well as TOV staff, have suggested a small trailhead parking area to accommodate the users of the Middle Creek Trail. In order to preserve the natural character of the trailhead area, the Forest Service and SBC have proposed a 6-car, gravel base parking area. Staff Recommendation: Approve/deny permission to proceed through the PEC and DRB processes. 5:20 P.M. 7. Discussion Re: Ordinance No. 14, Series of 1994, an ordinance amending Chapter Andy Knudtsen 18.57, Employee Housing, and setting forth details in regard thereto. Action Requested of Council: Review and discuss Ordinance No. 10, Series of 1994, in preparation for first reading at the Evening Meeting this date. Backqround Rationale: Council directed staff to tighten the language in the Employee Housing Ordinance to make it more effective. Staff believes the proposed language fuffills this goal. On 6/13/94, the PEC voted 7-0 recommending approval of the changes. The memo and minutes from that meeting are included for Council's information. Staff Recommendation: Approve Ordinance No. 14, Series of 1994, on first reading. 5:50 P.M. 8. Review the existing fee schedule for planning applications in the Department of Mike Mollica Community Development. Backqround Rationale: In 1991, the Planning Department's fee schedule was analyzed and subsequently readjusted to reflect the actual expenditures of staff time. UUHEREAS, the curren4 parking fee to be paid by any owner or applicant in lieu of providing parking on their development site is currently inadequa4e to create additional parking spaces or to provide for proper maintenance; and WHEREAS, the Town Council wishes 4o increase the fee so that additional off-streef e- parking and loading facilities can be planned in the future. iVOVU, THEREFORE, be i4 ordained by the Town Council o# the Town of Vail, Colorado that the following amendmen4s shall be made to Chapter 18.52 ofi the Vail Municipal Code: Section 1 18.52.160 6.2. The parking fee to be paid by any owner or applicant shall be determined by the Town Council provided in no event shall. it be less than $1000.00 per space, and in addition, that owners or appticants similarly situated shall be treated equally. Section 3 If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, ~ regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. f Section 4 The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety, and welfare of the Town of Vail and the inhabitants thereof. Section 5 The repeal or the repeal and reenactment of any provision of the Municipal Code of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 6 All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. WHEREAS, THE TOWN OF VAIL'S ECONOMY IS LARGELY TOURIST BASED AND THE HEACTH OF THIS ECONOMY IS BASED ON EXEMPLARY SERVICE FOR VAIL'S GUESTS, AND; ' WHEREAS, VAIL'S ABILITY TO PROVIDE SUCH SERVICES DEPENDENT UPON A STRONG, HIGH OUALITY AND CONSISTENTIY AVAILASLE WORK FORCE, AND; WHEREAS, THE AVAILABILITY OF HOUSING PLAYS A CRITICAL ROLE IN . CREATING QUALITY LIVING AND WORKING CONDITIONS FOR THE COMMUNITY'S ~ . A chart(2) attached to this chapter and incorporated herein by reference illustrates the requirements for each type of EHU. B. No employee housing unit which is constructed in accordance with this chapter shall be subdivided or divided into any form of time shares, interval ownerships, or fractional fee. C. All types of EHU's rrk,4 shall be leased-bui-ealyto tenants who are full-time , employees who work in Eagle County. An EHU shail not be leased for a period less than thirty consecutive days. For the purposes of this section, a full-time employee is ~ one who works an average e#-a--miAimum of thirty hours each week. 1 1. It shall not be counted as a dwelling unit for the purposes of calculating density. However, it shall contain kitchen facilities and a bathroom; as defined in Chapter 18.04 - Definitions of the Vail Municipal Code. It shall be permitted to be a third dwelling unit in addition to the two dwelling units which may already exist on the lot. Only one Type II EHU shall be allowed per lot. ~ 5. It shall have a GRFA not less than three hundred square feet, nor more than nine hundred square feet. An applicant, however, shall be permitted to apply to the - ' Community Development Department of the Town of Vail for additional GRFA not to exceed five hundred square feet to be used in the construction of the EHU: The applicant shall submit an application for the additional GRFA on a form provided by the Community Development Department. Approval or denial of the request shall be made by the Design Review Board in accordance with Section 18.54.040. If an applicant obtains Design Review Board approval for five hundred square feet of additional GRFA for the EHU, he or she shall not be entitled to receive additional GRFA pursuant to Chapter 18.71 - Additional Gross Residential Floor Area of this code for either unit on the lot. If an applicant obtains Design Review Board approval for not more than iwo hundred fifty square feet of additional GRFA for the EHU, he or she shall be entitled to receive additional GRFA pursuant to Chapter 18.71 - Additional Gross Residential Floor Area of this code for one dwelling unit on the lot. 6. It shall have nol more than two bedrooms. 8. Each Type II EHU shall be required to have no less than one parking space for each bedroom located therein. However, if a one bedroom Type II EHU exceeds six hundred square feet, it shall have two parking spaces. If no dwelling exists - upon the property which is proposed for a Type II EHU at the time a building permit is issued, or if an existing dwelling is to be demolished and replaced by a new dwelling, not less than one of the parking spaces required by this subsection shall be enclosed. A three hundred square feet GRFA credit shall be allowed for the construction of one enclosed parking space for the Type II EHU. Section 3 . If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. • Section 4 The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare oi the Town of Vail and the inhabitants thereof. Section 5 The repeal or the repeal and reenactment.of any provision of the Vail Municipal Code as provided in this ordinance shall not af(ect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under of by virtue of the provision repealed or repealed and reenacted. DESCR9PTION OF THE REQUEST In conversations_with Town Council and Housing Authority recently, Town staff-determined that there were a few minor changes that could be made to the employee housing ordinance to make it more effective. These include requiring that all employee housing units shall be rented and requiring that the rental rate be comparable to the market rate. The proposed text below has been changed as discussed in the worksession with the Planning and Environmental Commission (PEC) on May 16, 1994. There is also a clarification in the code pertaining to Type II EHU's, which has also been included. II. PROPOSED CODE CHANGES Below is one section from the ordinance showing the proposed changes. The new text is shown in shade. The text that is proposed to be deleted is shown in eveFs#Folie. 18.57.020 Employee housing units (EHU) generally. A. A chart(2) attached to this chapter and incorporated herein by reference illustrates the requirements for each type of EHU. B. No employee -housing unit which is constructed in accordance with this chapter shall be subdivided or divided into any form of time shares, interval ownerships, or fractional fee. C. All types of EHU's ff~ay shall be leased-,b4t-eP4jr. to tenants who are fulV-time employees who work in Eagle County. An EHU shall not be leased for a period less than thirty consecutive days. For the purposes of this section, a full-time employee is one who works an average of thirty hours each week. 1 . i 0 L 1. The PEC reached a consensus that Item 7 on Page 4 should be deleted. Kathy Langenwalter referred the PEC back to the last sentence in Item E on Page 2 of the s#aff inemo. She felt this sentence was a compromise to let people know what the requirement was. - - . Ristow's proposal would provide 30-year loans of up to $200,000 on deed-restricted homes within the Town of Vail at interest rates starting below conventional levels. Down payment requirements will be reduced from the conventional 20 percent to as low as 5 and 10 percent. The Town Council would determine eligibility requirements for the program, including residency, employment status and terms of the deed restrictions. Because of Amendment 1, Town Attorney Tom Moorhead said an election might be necessary to implement the program. The Council yesterday agreed to obtain a legal opinion from outside counsel about the effect of Amendment 1 on the proposaV, as requested by FirstBank. In addition, the Council asked Ristow to investigate whether the bank would be interested in servicing a loan program funded through bonds issued by the Town. Another option to be researched is a bond program to finance specific housing projects, such as Vail Commons. Town Manager Bob McLaurin offered to present a timeline on the financing options at next week's meeting. The timeline would determine, among other things, if a potential election would be feasible in iVovember. For more information, contact McLaurin at 479-2105. --Parking Fees for Fiscal Year 1995 in Village and Lionshead Structures The Council yesterday agreed to set subsidy rates for winter parking passes and coupons yesterday, but delayed a decision on continuation of the evening parking (more) , t TOV Highlights/Add 1 program until additional financial information is presented. Gold or premium parking passes will cost $ 1,100 in 1994-95, up from $ 1,000; while the more restrictive blue passes will be sold for $500, up from $475 last season. The Council also endorsed an upgrade of the parking coupon system. Coupons will be replaced this fall with a computerized debit card system to allow added convenience for customers. The debit cards will cost $4.75 per day, up from the $4.25 coupon program last season. Also yesterday, the Council voted to continue carpooling incentives at the Ford Park lot for the upcoming ski season with free parking for those with two or more occupants in the vehicle. The non carpool rate would remain at $8 between 8 a.m. and 1 p.m. The Council also asked for additional financial information on the cost to operate the parking structures and the projected amount of subsidy. The information will be used to discuss continuation of the free evening parking program at the Jufy 5 work session. The town's parking division attributes a loss of $149,304 during the 1993- 94 season due to value-priced programs such as the extended evening promotion and VA's reduced pass incentive program in April. Although Councilmembers agreed a philosophical discussion was necessary to determine if the structures should continue to be subsidized, the Council was not able to agree on the timing of the discussion. The timing issue will be revisited at the July 5 work session. The eouncil asked to receive more information from the water district at its July 5 work session. --Update on Intermountain Regional Transportation Plan The Council reviewed a lang, prioritized list of regional transportation projects which will compete for funding from the Coiorado Department of Transportation over the next 20 years. Town Engineer Greg Hall said the list, which shows more projects than available funding, presents a bleak outlook for future cost-sharing projects with the state. Councilmembers expressed optimism, however, noting the 1999 World. Alpine Ski Championships could be used as a catalyst to leverage priority projects. (more) , 4( 4. . 4 TOV Highlights/Add 2 ' --PEC Report During an update on actions taken by the Planning & Environmental Commission (PEC), Councilmembers were briefed on a discussion by the town's Public Works Department to expand its administrative offices at 1309 Vail Valley Dr. A conditional use permit would be required to complete the expansion. Over the past month, the Town Council has expressed concern about the lack of "alpine character" in Lionshead and in other areas of the community. In order to address this issue, the Community Development Department suggested moving forward with the Lionshead iViaster planning effort in 1995 rather than 1996, as was originally planned. To make room for the project, a review of the townwide Design ~Review Guidelines would be pushed back from 1995 to 1996. By moving the Lionshead Mas#er Plan to 1995, staff felt the design considerations could be rewritten for Lionshead and additional issues could be addressed which were identified by the planning effort with Sherry Dorward and Eldon Beck who worked for the Lionshead merchants. These issues would include improving public spaces, landscaping, signage, etc. In respect to the concern for a townwide "alpine design character," staff felt this issue could be addressed when the Design Review Guidelines would be updated in 1996. After considerable discussion on the topic of alpine design, the Council directed the department to review the feasibility of replacing the Lionshead Urban Design Considerations with those design considerations used for Vail Village. The Council decided to review the Design Review Guidelines in 1995 and implement the Lionshead Master Plan process in 1996. Councilmembers felt the issue of "alpine character" for the entire community should be decided first before proceeding with design issues in Lionshead. The Town of Vail and the Colorado I)epartment of Transportation continue to be extremely concerned about safety issues along the South Frontage Road. This item has received considerable press in the past. In order to resolve the situation for the summer, the Town approached all of the user groups using Ford Park to see if they were willing to subsidize a bus program which would provide transportation from the Village Parldng Structure to the Ford Park Parliing lot. All of the groups were unable to do so. Therefore, the Town implemented a five minute shuttle system to provide transportation to and from the parldng structure on the 32 targeted days. The purpose of charging $2.00 is to encourage people to park in the Village Structure and to fund a portion of the costs associated with running the shuttle service. I recognize that this solution is not a perfect one. However, given the competing uses and safety concerns in this area, we feel it is the best solution available to us at this ti_me. As I have indicated in the past, this a pilot program and we are willing to adjust it in order to make it better. We believe, however, that it does provide any resident or user of Ford Park the opportunity to make an informed decision about paying a nominal fee for in-close parking at Ford Park or for using the free shuttle service. Once again, this $2.04 fee is simply to offset a portion of the costs of the bus service being provided. Thank you for your comments and thoughts on this matter. Water shortages are increasing for Colorado's East Slope farms and cities, while the growing lJest Slope water surplus is being permanently lost to fish, feds, and down river states. 2. Federal census data indicates jJest Slope water consumption has declined about 30% since 1970, because of salt buildup on irrigated farms and the continuing economic shift to tourism. 83% of the water flowing out of Colorado is from iJest Slope rivers. 3. Front Range population growth, declining ground water reserves, and mounting threats from Kansas, Nebraska, and federal legal actions are rapidly creating a long-term water crisis for the eastern half of Colorado. The East Slope has about 80% of the ,demand for water in Colorado. 4. The tiqest Slope is currently losing over a million acre feet of Colorado's Colorado River Compact entitlements primarily because of insufficient storage for the heavy snow melt years. This tragic loss compares -with the 300,000 acre feet that is required in an average year for all of Metro Denver. 5. Colorado is the only tiJestern state that does not have a statewide water data base to analyze major water threats, and its areas of surplus and shortage. 6. Colorado is the only 6Jestern state that does not have a consensus building, long-range planning process to guide its major water policy decisions. The politically charged interbasin issues are avoided at all cost. 7. The costly water management gridlock caused by Colorado's water planning vacuum requires 70n of the nation's water attorneys. 8. Although Colorado's high mountain terrain generates most of the reriewable surface waters for Southwestern states, Front Range water tap and service fees are among the region's highest. 9. For the past 20 years, the governor appointees to Colorado's water policy positions have been mostly green leaning water lawyers. The state's more realistic water resource engineers have largely been silent for fear of business reprisals or outright firing, as with the previous highly respected State Engineer. 10. Colorado's Upper Colorado River Basin tributaries west of Deriver have been excessively dewatered by 19 diversions to Front Range cities and farms. The recently approved tiJolford Mountain Reservoir is another unfortunate example of how the lack of a balanced statewide water perspective will soan deplete Colorado's Blue River down to only 30% of original flow. z 11. Incredibly, the Romer Administration is apposing the advanced, high altitude Union Park Reservoir proposal for Metro Denver from the wetter Upper Gunnison Basin. This shortsighted opposition ignores the fact Colorado's interstate losses are mostly from the untapped Gunnison Branch of the Colorado River. 12. The unprecedented Union Park Reservoir will save some of Colorado's wasted wet year Compact waters in an off river site on the Gunnison side of the Continental Divide for gravity delivery to river environments on both slopes during long drought cycles. The drought benefits of this environment enhancing project are double those of the vetoed Two Forks Dam for half the cost. 13. bJithout public debate and legislative approval, the Romer Administration has adopted a 50 to 100 year deferral strategy to develop Colorado's entitled Colorado River flood waters that are being permanently lost to growth in other states. M . 14. Romer water leaders are committing Colorado's entitled flood flows .to the poorly conceived federal program to recover Colorado 12iver endangered fish: No attempt has been made to quantify the devastating long-term environmental and economic impacts for Colorado. Superior alternatives for fish recovery, including managed flows from high altitude reservoirs, have not been evaluated as required by national environmental laws. 15. Romer appointees recently violated their legislative mandate to conserve state waters by allowing the Upper Gunnison River District to improperly transfer about 10/ of Colorado's undeveloped Colorado River Compact waters to the federal government. Upper Gunnison water users consume only 5% of their sub-basin's total flow. Apparently, Colorado water Ieaders agree with `Jest Slope extremists, who would rather see Colorado's water flow to other states instead of to water short East Slope areas. 16. Since the.Two Forks debacle, Romer water leaders have openly promoted the extremist notion that new water conservation reservoirs are politically unacceptable. Meanwhile, the down river states are wisely planning and building several large off river reservoirs with very little environmental opposition. 17. Colorado is at least 20 years behind other states in the development of drought cycle reservoirs that are essential to prosper in the arid 6Jest. To save Colorado's environmental and economic future, all voters should demand their political leaders either challenge these alarming Colorado water facts, or get out of the way for some new direction.
