ACTIOiV REQUESTED OF COUNCIL: Consider Channel 5
request for monetary support.
BACKGROUND RATIONALE: The funding of Channel 5 is no
longer provided for in the Town of Vail Franchise Agreement with
TCI. It is now a matter for consideration separate and apart from
the TCI agreement. Town of Vail is one of several funding sources
for Channel 5. In the past they received 2% of the 5% franchise
fee received by the Town of Vail. The subscribers are paying the
5% franchise fee pursuant to out present agreement with TCI.

fill one vacancy on the Design Review Board. Applicants are Brent
Alm and Bruce W. Crabb.
BACKGROUND RATIONALE: DRB member Sally Brainard is
moving out of. the Town of Vail limits and has resigned her seat.
Her term expires in. February, 1996.

Greg Hall property owners on Larkspur lane to vacate right-of-way for an

a deed or easement to four property owners will permit
development of off-street parking, provide for parking necessary to
create an EHU and enable necessary retaining walls to be put in

STAFF RECOMMENDATION: Vacate right-of-way upon condition
that additional area will not permit additional GRFA.
03:35 P.M. 4. Request to Create 3.2 Acres of Wetlands on Katsos Ranch.

ACTIOiV REQUESTED OF COUIVCIL: The Vail Valley
Consolidated Water District is requesting approval to create 3.2
acres of wetlands on the Katsos Ranch Property. This District is
asking for permission to proceeding through the process to create
these wetiands.
BACKGROUfVD RATIOIVALE: The Vail Valley Consolidated Water
District, as part of their Section 404 permit mitigation requirements
for the Black Lake No. 1 Project is required to restore 6 acres of
scrub/shrub. In 1991 the Town approved the creation of 6 acres
in Katsos Ranch. The District was successful in creating 2.8 acres
of wetlands and still needs to create 3.2 acres. The District.has a
new proposal for creating these wetlands on Katsos Ranch and

_ this requires Town Council approval. The Water District is
requesting the Council's permission to, proceed through the
process. This process would include PEC review and Town
Council approval.

_ Communiry TV Channel 5• Further, we need to determine Channel 5's percentage of the
"pass-through" fee for capital expenditures. I look forward to the discussions as to the allocation of those dollars to our group. In the event that the amount of dollars allocated to Channel 5 is a lesser amount, it would
jeopardize our abiliry to maintain the operation of Channel 5.

I wish to voice my support for Vail Valley Community Television. CHS has been an integral
part of our community. 'I'hey have fostered communicaYion throughout the Vail Valley for
13 years. In May 1995, Vail `Ialley Community Television was nominated as a"Finalist" in
the prestigious "HOMETOWPT i1IDE0 F'ESTI`IAI," for the "Eagle Valley 1Vews Magazine"
monthly series.
Ch5 provides programming that helps me be more informed about our town and county
government issues, and school district board meetings. CHS also offer shows that keep me
familiarized with discussions about open space, Business Education Partnership, and the
roundabout. It is important that we continue to support our Vail Valley Community TV
station which gives us programs such as the "Vail Library Eldventure Series," "Eagle County
Live," "Eagle Valley 1Vews Magazine," and the "`Iail Symposium."
I believe that it is critical that the community not only has a Public Access T`I station that
educates the residents about critical issues in the Vail Valley, but also affords an opporiunity
to voice their opinions and commentary on current events.
I request that tlail Town Council will vote on June 20, 1995 to dedicate at least 2% of TCI's
gross revenues as you have done in the past and a fair share of the "pass through" revenue
for capital expenses to maintain CI-15's operations. Anything less will jeopardize the very

While I have not been a resident of Vail for very long, I have worked for Fritzlen Pierce Briner /
Architects for the past two and one half years. During this time, I have gained great insight into the
many issues facing the community. My interest in serving on the Design Review Board closely
parallels my reasons for moving to Vail - to be more directly involved in the community I contribute to
and work in.
Given the opportunity to serve on the board my goals are as follows:

SUBJECT: Black Lakes Wetiand Mitigation .
V. BACKGROUND:
On August 21, 1990, the Vail Town Council passed a resolution supporting the expansion of
Black Lakes Reservoir No. 1. Tne expanded reservoir vvas designed to enhance in-stream flows
during the winter, a time when stream flows are tyaically lowest. When the resollation was
passed, the Council recognized that more than 10 acres of wetlands and riparian area would
need to be restored to mitigate the impacts of tne expandea reservoir.
In 1991, Eagle County in conjunction with the Army Corps of Engineers required the Vail Valley
Consolidated UVater District to provide 10.75 acres of weilands and riparian habitat to mitigate the
impact of 5.4 acres wrhich wrere lost as the result of tne Black Lake expansion. Ail but .75 acres
of mitigation wras to be located in the Town of Vail. On January 21, 1992, the Town Council
approved of the w?etland mitigation proposal that included restoring 6 acres of wetlands on
Katsos and more than 4 acres of riparian habitat along different points on Gore Creek.
BB. PROPOSED PR0JECT:
The Vail Valley Consolidated Water District was successful in creating 2.8 acres of wetlands at
Katsos Ranch but still needs to create an additiona! 3.2 acres. The U.S. Army Corps of
Engineers has given the District until August 1995 to create this additional wetland area at
Katsos. The District has a new proposal for creating these wetlands on Katsos Ranch which will
involve utilizing six existing sw?ales that branch off Gore Creek and would be cleared to act as
irrigation ditches. Issues related to this project include: changes to the ffoodplain, short-term
visual impacts, and short-term sedimentation impacts. Hawever, based on a preliminary revievu
of the District's proposal, this project could be beneficial to the Town for the following reasons:
a) At no cost to the Town, w;2ttands wrould be res:ored at Katsos Ranch.
b) Creation of vueilands has significant benefits for wiidlife, water quality, and for reducing
flood impacts.
c) Existing swales can be used which will reduce the visual impact of the project.

The Water District is requesting the Councils permission to proceed through the process. This
process would include PEC review and Town Council approval though a resolution.

VAIL VALLEY COIVSOLIDATED WATER DISTRICT Vail Valley Consolidated Water District, as part of their Section 404 pennit mirigation requirements
for the Black Lake No. 1 Enlargement Project, is required to restore 6 acres of scrub/shrub
wetlands on the Katsos Ranch open space. The permitted mitigation plan includes construction of
stream gradient control structures, and a flood irrigation system to raise ground water levels of the
adjacent alluvial terrace. The purpose of this urigarion system and drop swctures is to restore
wetland hydrology on the terrace, thus improving wildlife habitat in the riparian zone and open
space.
According to the Conceptual Wetlands Mitigarion Plan for the Black Lake No 1 Enlar e,~ ment
Project, prepared by BIO/WEST in 1990, the alluvial terrace most likely was a wetland before the
creek channel incised 3 to 6 feet below the terrace. This incisement is likely due to creek
channelization and urban development that occurred within Vail Valley, and due to the construction
of Interstate 70. Soil motding found 18 to 24 inches below the ground surface provides evidence
the terrace once was a wetland.
BIO/WEST's mirigation plan for Katsos Ranch included the construction of drop swctures and a
irrigation canal with water delivery channels. The canal would start at a diversion structure
upstream of the bike path bridge, and carry water across the terrace to the old creek oxbow. Water
delivery channels would be connected along the length of the canal to discharge and spread water
across the tenace between the bike path and Gore Creek.
In 1991, the BIO/WEST plan was presented to Town Council for approval before constructiori.
The Council asked that only the drop structures be constructed to minimize construction impacts to
existing vegetation. Three drop structures were constructed in fall of 1992 and new plantings were
added to the riparian zone in 1993. During our site survey with the Corps of Engineers last yeaz, it
was determined only 2.8 acres of wetland hydrology was restored to the tenace. The Corps has
required the irrigarion system be constructed to meet the 6 acres of wetland restoration required by
Section 404 permit.
The plan currendy under consideration utilizes existing irrigation ditches and depressions on the
alluvial terrace. It would not require extensive grading and building of new canals as proposed by
the BIO/WEST plan. The enclosed map shows proposed locarions of six irrigarion ditches. Many
of the locations follow exisring irrigation ditches or old creek.meanders. The ditches must be
cleared of willow and regraded to provide consistent downhill flows along each ditch. River
cobble and sandy clay soil will be placed along each ditch to prevent scouring. 1fie ditches will be
approximately 3 to 6 feet wide and 2 to 4 feet deep. Ditch D1-D2 will fl ow under the bike path
through an existing culvert. T'he water in each ditch is expected to saturate a zone 10 to 20 feet on
each side, restoring wetland hydrology to the remaining 3.2 acres required by permit. These azeas
will be planted and seeded with new wetland and riparian plant species to aid with habitat
restoration.
Six inlets along the banks of Gore Creek will allow water to flow into the ditches during the
growing season. Design alternarives discussed for the inlets include extending a pipe through the
creek bank, or building a rock weir to allow water to flow through the creek bank to each ditch.
The design of each inlet will be determined based on creek.bank condirions and surface water
elevations.
Ditch B1 shown on the map utilizes overflow water from a pond on adjacent property to flood the
irrigation ditch. This inlet requires discussion with the property owner before deternuning its
feasibility.
No adverse affect is expected for the 100 year floodplain in Katsos Ranch or upstream of the open
space. The ditches or inlets will not create obstrucrions within the floodplain, and therefore will
not impede flows during a 100 year flood event.
Further study of creek condirions, utility locations, and site topography is needed before finalizirig this plan. The District would like the Town of Vail's comments on this proposal before proceeding
further with the site survey or design. Construcrion is planned for later this summer to meet the
Corps of Engineers required deadline of August 15, 1995 for permit compliance.

The construction of water diversion projects by Denver and other Front Range cities has had
serious environmental and socioeconomic impacts in the headwaters counties. Future diversion
projects also have the potential to cause injury to the West Slop environment and economy.
county and municipal land use regulations promulgated pursuant to H.B.1041 (C.R.S.
are one of the only tools available to minimi7e these negative effects.
1. Legal challenges to the facial validity of land use regulations for transmountain diversion
projects should be defended through a cooperative effort whenever possible. Contribution
to specific permit decisions of individual members should be evaluated on a case-by-case
basis, depending upon potential benefits to other members.
2. Any legislative proposals to weaken or eliminate 1041 authority should be defeated. Staff
should develop a specific plan for monitoring and lobbying to be approved by the QQ
members and NR/CCOG Board prior to each legislative sessions.
3. NWCCOG will actively seek the support of other local governments and build coalitions
with appropriate organizations in its efforts to protect 1041 authority.
4. Legislation or policies designed to protect the basin of origin from negative effects of
transmountain diversions should be developed. Water diversion proponents should
compensate the basin of origin for any incremental negative effects attributable to the
diversion.
5. NWCCOG will provide technical assistance to member jurisdictions who wish to amend
existing 1041 regulations controlling water projects.

1. Transmountain Diversion I'rojects will be supported by NWCCOG if a.nd only if all
socioeconomic and environmental effects are mitigated to the satisfaction of the affected
governmental units.
2. All projects should be in substantial compliance with applicable state, federal, and local
regulations.
3. With approval by the Land Use and Water Fund members, the NWCCOG legal division
will actively pursue all available administrative and legal remedies to ensure that proposed
admin.istrative and legal remedies to ensure that proposed projects are mitigated
satisfactorily and comply with regulations.
4. 1Vlaximum cooperation and conservation ofwater resources should be required before
additional transmountain diversions are permitted.
5. Operation of existing water supply projects by Denver and others should be integrated in a
manner that elimiuates negative effects to municipal water supply, water treatment,
wastewater treatment, recreation, agriculture, aquatic life, and aesthetics.
6. Iu order to accomplish regional goals for protection of water quality and quantity,
NWCCOG will participate in state and federal permit processes which regulate
transmountain diversion projects and coordinate its efforts with other organizations which
share common interests.
7. The legal division will provide legal counsel to member jurisdictions duriug the local permit
application process for transmountain diversion projects. The degree to which the Land
Use and Water Fund members contribute to litigation resulting from local permit decisions
will be decided on a case-by-case basis.

Water Qualn~
1. Water development activities should not have a significant adverse effect upon the quality
of the Region's water resources.
2. Mitigation of negative water quality impacts associated with water use and development
should be the responsibility of the water developer.
3. Water developers and in-basin users should share responsibility for the reduction of
non-point source pollution:
4. State, local, and federal wastewater treatment facilities should be protected through
mitigation of any additional treatment costs caused by hydrologic modification.
5. The Region XII Water Quality 1Vlanagement "208" Plan will be updated annually and will
continue to be used to assess and document the relationship between water quality and
water development activities. The legal division in cooperation with the NWCCOG Water
Quality Manager, will continue to defend the Plan from administrative or legal challenge
by water development interests.
6. State and Federal water quality regulations should not immunize the exercise of water
rights from reasonable water quality regulations. To that end, the legal division shall
continue to monitor and participate in state and federal rulemaking hearings.
7. Limitations on water quality control regulations found in Section 104 of the State Water
Quality Control Act, which protects water rights from material injury, means "no
unreasonable harm" to water rights rather than "no change in yield."

L NWCCOG supports the formulation of a State water policy. At a miuimum, any policy
must address protection of the basin of origin, the interrelationship between the exercise of
water rights and water quality, and the conservation of exusting water resources.
2. The process selected to formulate a State water policy should embody the following:
a. The goal of the process must be clearly defined. The difference between "policy" and
"plan" must be articulated.
b. The policy should be based on tasks designed to solve water management problems
identified and agreed upon by all participants.
c. All interests must be represented in the process. Traditional water interests which have
historically fought each other in the Courts may not be representative of all interests.
d. 1'roponents and opponents to change in water policy should be included in the process.
e. Public input should be solicited at every phase of the process.
f. All previous attempts, including the C.C.I. Water I'olicy, should be evaluated.
3. NWCCOC'r will participate in the State water policy formulation process to the greatest .
eXtent possible. Both staff and elected officials will contribute to policy formulation
efforts by the legislature, admivistrative agencies, and the Courts as appropriate, to ensure
the Region's interests are well-represented.

Dear Mr. Hall:
On behalf of the State Board of the Great Outdoors Colorado Trust Fund, I want to invite
you to attend an open house and briefing on Wednesday, June 21, 1995, in Beaver Creek. The
purpose of the briefing is to update you on the work of Great Outdoors Colorado. Board
members also want the chance to learn more about activities that relate to our mission from local
governments, nonprofit organizations, state and federal agencies, and the business community in
Eagle, Garfield, Grand, Lake, Pitkin, and Summit counties.
The reception and briefing will be from 5:00 PM to 7:00 P1VI at The Pines Lodge, 141
Scott Hill Road, in the Grouse Mountain Grill Lounge. T'here will be a brief program at 6:15 P1VT
where staff and Board members will discuss Great Outdoors Colorado grant awards to date and
answer questions.
Great Outdoors Colorado, created by the passage of Amendment 8 in 1992, initiated its
first year of grant-making with Colorado Lottery proceeds for parks, wildlife, outdoor recreation,
open space, and natural areas in 1994. To date, 276 projects throughout Colorado have received
$19.1 million in funds. At their Board meeting to be held earlier in the day, the Board will awazd
grants for planning and capacity b.u-ilding. In September, the F3oard will award open space
grants.

The Town of Vail, in an effort to relieve some of the congestion and frustration caused
by construction delays at 4he iViain Vail Interchange, has opened up alternative routes
to bypass this area. The alternate route for guesfs and residents utilizes the Forest
Road and Crossroads s4reets off the Frontage Road and allows cars to go across the
International Bridge through Checkpoint Charlie when traveling east and west. Signs
will be placed on the frontage roads directing traffic through these alternate routes.
These alternative routes wrill be open to passenger type vehicles beginning Thursday,
June 15, and until further notice. Truck delivery traffic must continue to use the fViain
Vail Interchange. The iViain Vail Interchange will continue to remain open. You will still
experience periodic delays if you choose to use this intersection. On Saturday, June
17, the Chapel Bridge and Beaver Dam Road will be opened to traffic which will also
allow traffic that needs to get to the hospi4al, Amoco, Craig's Deli, Firstbank,
Sonnenalp, or the Gateway areas as an alternate route as wrell. Other alternatives
available to avoid the "consfiruction hassles" are to park in 4he free parking structures
and 4o use 4he free in-fiown shuttles. Discussions continue regarding complete closing

ALTERNATE BUS ROUTES DUE TO 4-IAIAY/ROUIVDABOl1T CONSTRl1CTIOIV
Starting immediately, the Town of Vail Transit Department will be re-routing fiheir
West Vail South bus through part of the Village route in order to to maintain the
schedule and avoid delays due fo the construction at the main Vail 4-way intersection.
The bus will leave the Village Transportation Center and proceed to the Vait Valley
Medical Center stop (vvhich is replacing the fViunicipal Building stop), then on to
Concert Hall Plaza, and then 4he normal West Vail Green route. This temporary route
will be in effect until completion of the roundabout project.
