BACKGROUND RATIONALE: Vail Associates has submitted an
application for the redevelopment of the Golden Peak Ski Base.
There are many policies related to this application that will dictate the
design of the new facility. Developing a vision for the area and
defining policies to be addressed and answered will aid the applicant,
staff and the PEC in this review process.

MEMORANDUM

DATE: July 11, 1995
SUBJECT: Vail Associates, Inc. Proposed Golden Peak Redevelopment
The purpose of this memorandum is to advise Council of a possible strategy for processing Vail
Associates' proposed Golden Peak redevelopment application given the evolving nature of the
proposa(, VA's desire to move expeditiously through the revievu process, and the existence of
several fundamental policy questions for resolution by the Town Council.
The information contained in this memorandum supplements the staff memorandum to the
Planning and Environmental Commission dated June 12, 1995, which vuas previously distributed
to Council.

The proposed major changes to the development plan, originally approved in 1984, with several
subsequent modifications, that are identified as follows in VA's application materials submitted in
May, 1995:
- The proposed program for the Golden Peak Ski Base facility calls for a building of
approximately 73,000 sq. ft., located virtually in the same location as the previously
approved building site. The residential portion of the building (6 condominiums) is
considerably larger than the original plan, expanded from approximately 13,000 sq. ft. of
GRFA to approximately 20,626 sq. ft. of GRFA in the new plan. Additionally, the amount
of retail and conference/meeting room space has been expanded as compared to the
. previously approved plans.
- Both ski lifts 6 and 12 are proposed for replacement as a part of this redevelopment
plan. Chair 6 is currently a double chair with a hourly capacity of 1,130 skiers per hour.
It is proposed for replacement with a detachable quad chair lift with a hourly capacity ofi
2,250 skiers per hour. Chair 6 will be designed to allow skiers to unload at a midpoint on
the top of Golden Peak, or to continue on to the top terminal located near the base of
Chair 11. In the future, Chair 10 will be realigned and extended, ultimately enabling
skiers to ride a 6 to 10 connection to the Two Elk Restaurant and China Bowl. The
existing Chair 12 is also a double chair with a hourly capacity of 960 skiers per hour. The
proposed replacement chair will be either a triple or a quad chair, with a slow loading
speed to assist in the instruction of children and first time skiers. This lift is proposed to
have a hourly capacity of 1,000 to 1,400 skiers per hour. In addition to the replacement
of Chairs 6 and 12, the applicant is proposing to relocate the "poma" lift from its current
location on the west side of Chair 12 to the Children's Center area. 1

- The 130-space surface parking lot, which is open to the public for a fee, is proposed to
be replaced with a 150-space privatized parking structure. This structure is proposed to
be approximately 64,800 sq. ft. in size (32,400 sq. ft. on each of the two levels) and is
partially buried and surrounded on three sides with landscaping.
- The skier drop-off zone, shown on the 1984 p{an, has been expanded and relocated to
the north side of the new building and parking structure. This skier drop-off area has
been designed to accommodate approximately 30 vehicles. Some of the spaces are
depicted on the site plan as angled spaces and others are depicted as "active" Idrop-off
spaces, which are designed as an "airport style" drop-off, maintaining a continuous flow of
vehicles through the area. I
- The four existing tennis courts at the Golden Peak area are proposed to be removed in
conjunction with this redevelopment proposal. An agreement has been reached between
the Vail Recreation District (VRD) and Vail Associates that calls for a cash payment to be
provided in order to cover the cost of relocation, resurfacing and construction o,f new
court(s) elsewhere in the Town of Vail. The number and location of the courts will be determined by the VRD, with Ford Park being considered as the possible new location. .
The 1984 approved development plan contemplated the possible relocation of one tennis
court to the Chafet Road right-of-way. It is the intention of the VRD to leave the existing
tennis courts next to Chalet Road, but not to expand the tennis program at that site.
Therefore, no additional courts have been proposed in the Chalet Road right-of,-way.
- The Children's Center parking area has been expanded from 21 spaces to 281~ spaces
and relocated to an area on the inside loop of the new dedicated bus lane. ~I
- Vail Valley Drive is proposed to be relocated and realigned to allow for a new 4our-way
intersection" at the existing Manor Vail entrance. '

- Pedestrian and bicycle connections leading to the Golden Peak Ski Base are proposed
for improvement. ~
At the joint worksession with the PEC and Town Council (see description below), VA ~
characterized the proposed "privatized" parking as "managed" Parking, which would allow for
greater flexibility in financing the parking improvements and more efficient utilization ofthe
parking spaces. i
Subsequent to the June 12, 1995 joint worksession, VA has floated the concept of con~structing a second parking structure this one located on the Soccer Field parking lot to provide
additional "managed" parking opportunities for Golden Peak, as well as to provide additional
public parking opportunities. Preliminary analysis. indicates the possibility of 196 parking spaces
in two open layers on the existing parking lot site. VA's concept is that the construction of this
off-site parking structure would be financed through revenues generated by the manag',ed parking
in both the proposed on-site and off-site structures. ,
II. The Review Process To Date ' A joint worksession with the PEC and Town Council was held on June 12, 1995. The purpose of
the joint worksession was to provide.on overview of the project for the board membersand the

public and to attempt to identify/clarify the Tovun's position on a number of policy issues related
to the proposed redevelopment project. The joint worksession was not intended to be a detailed
review of all aspects of the proposal.
Six (of seven) PEC members and four (of seven) Council members participated in the joint
worksession. Staff's summary of the discussion is as follows:
1. It appeared obvious that all.members of the PEC and TC present at the meeting, as well
as members of the public, that providing parking on the property was acceptable.
2. All persons present in the room agreed that if any long-term parking is to be provided aY
Golden Peak, it should be underground.
3. UVith the exception of twro, it would appear that the board members felt comfortable with
the idea of privatizing the parking on the property. There were, however, related
concerns that need to be addressed in the future, ie: displacement of public parking, one-
waying Vail Valley Drive, design-related issues, etc.
4. There appeared to be consensus that VA should address the loss of public parking
spaces currently on-site more fulty.
5. Although the privatized parking was not discussed in much detail, Staff pointed out to the
Council, PEC and the Applicant that much more detail must be provided as to exactly
how this privatized parking is going to function in order to adequately review the impacts
associated with it.
6. With regard to VA's current and anticipated employee parking, although not discussed
specifically or in great detail, there vuas some concern amongst the board members that
VA employees are, as a practical matter, the first to arrive in the morning and are
monopolizing the soccer field parking.
7. 1lVith the exception of Merv Lapin, there seemed to be consensus that general skier drop-
off is acceptable and should be provided on-site. The group realized that if it is not
provided, people will come anyway.
8. The consensus seemed to be that the Children's Center parking/drop-off design is the
vueakest part of the plan, and there is a conflict uvith the bus lane. There was support for
underground parking to be located on the east side of the Children's Center. It appears
that the board members felt that it uvas acceptable to leave the bus lane in its currently
drawrn location, but everyone had a concern with the mixture of the busses and the
Children's Center parking.
9. It did not appear that a separate (dedicated) bus lane along Vail Valley Drive was a
concern and that the most convenient location for drop-off (on the east side of the
building closest to the ticket office) be given to bus users.
10. It vuould appear that a majority of the board members feel that Vail Associates should
provide some employee housing in conjunction with this redevelopment application.

II1. Status I
Given the evolving nature of the proposal, the potential impacts on public infrastructure and
Town-owned lands, the opportunities for mutually beneficial action, and the existence'~of several
fundamental policy questions requiring resolution by the Council--- and in the spirit of cooperation
and partnership of the TOV-VA managed growth agreement staff recommends the following
strategy for reviewing VA's proposal. IV. Staff's Recommended Strategy I
Staff's proposed strategy for processing VA's application is to address, first, the big pi,cture,
second, the policy issues that flow from the vision, and third the design which is dependant upon
the policy determinations. What would the TOV like to achieve through the Golden Peak
redevelopment project? What experience do we want residents and visitors to have! in and

Staff's vision of the area in and around Golden Peak includes: Vail Valley Drive is made one-way from Blue Cow Chute to a new bridge at Fo;rd Park in

• There is a unified pedestrian linkage from theTransportation Center through Golden Peak
to the Soccer Field parking lot which implements the TOV's Streetscape Master Plan, as

is the second highest emphasis. All other modes of access to the ski portal are
subordinate to bus and pedestrian access. I

~ There i.s no net loss of public parking spaces. Loss of public parking spaces o,n-site may
be offset off-site, proximate to Golden Peak. "Public parking" may include.daily parking
by previously-purchased seasonal pass and by reservation or similar arrangement.
• The Soccer Field parking lot is the preferred location for additional parking. ,
VA employee parking for Golden Peak is addressed through provision of additional
parking spaces or seasonal passes on the regional bus system or park-'n-ride
arrangements. • Additional parking is available for Ford Park users in summer. ,
• Trail connections are completed and enhanced.
• All Golden Peak residential parking is incorporated into the structured on-site parking in
order to eliminate surface parking and the need for a four-way intersection at the Manor
Vail entrance. ~

separated?
9. Should Golden Peak be the main venue for Winter and Summer special events?
Council may agree with Staff's vision or may vuish to use it as a point of departure for its ovun
articulation of a vision. In either event, once Council describes its vision and addresses the
fundamental policy issues resulting therefrom, staff can meet in working sessions with VA's
consultants to discuss the details of issues including: basic portal usage assumptions and the
traffic and parking assumptions; Children's Center design issues; privatized, public, employee
and residential parking; pedestrian linkages; and co'st estimates and responsibilities for off-site
improvements. It may be desirable to have twro representatives from Council and two from the
PEC participate in those worksessions in order to provide some continuity. Followring those
intensive staff-to-staff uvorksessions, the project can be brought to the PEC for standard revieuv.

All of us at City market are very pleased that the Vail Town Council selected our Vail Commons
development proposal for final negotiations to reach a conclusive agreement.
Our management team at City Market is excited about this opportunity to design a state of the art
store for Vail, and partner with Vail to achieve your development goals and objectives for the Vail
Commons.
We especially wish to thank you for the impartial adherence to the process, and the level playing
field which resulted, as these proposals were evaluated. We made our proposal with the knowledge that
other developers who controlled key properties perhaps had an advantage over us, just hoping that we
could overcome such advantage. Without the impartiality of you and the Council, we probably would not
have succeeded.
We understand, that final negotiations are the next step. We believe that placing these negotiations
in a"fast track" mode would be beneficial to both us and the Town. Accordingly, we request your
suggestions on how we both might bring the necessary time and people together efficiently and without
delay.
Again, we are delighted at this opportunity to enter the Vail marketplace, and to provide to Vail
both quality affordable housing and a supermarket adequate to the Town's word-class resort status. We

The time, effort, and dedication put forth by the Council as representarives of `Iail's residents and
property owners does not go unnoticed nor unappreciated. However, as the state and county grows,
more and more decisions must be made that will ensure a quality of life for present and future
residents, as well as those who provide services to the guests that drive the economy in a resort
community.
It is in this context that we address the issue of urilization for the Vail Commons property purchased
by the town and owned by its taxpayers.
Given that future growth is down valley, and that Vail is more than 90% at buildout, we do not
believe it a good idea to take one of the last sizeable tracts of land, suitable for open space and
housing, and use a section of it for a 55,000 sq ft supermarket when the town has the East Vail
Market, Craig's 1Vlarket, Alfalfa's and Safeway! Surely these outlets can service a year round
population of 19,000. If these choices are not satisfactory, then a 10 minute drive provides additional
choices in Avon or Edwards.
A Task Force was appointed to advise The Council on the best use for the Vail Commons land. They
regarted back, that according to their fact gathering studies, obtained by interviewing residents in the
VVest Vail area and other sections of town, the land should be used for affordable housing and open
space. They further recomended that the Council not make any hasty decisions.
Our question to you is: VVhy a decision was made to rush into negotiations with a supermarket when
the Task Force advised otherwise? 1'he Town has spent considerable dollars buying open space, so
why can't we consider this as open space designed around affordable housing? If we cannot provide
afordable housing, the demographics of our town will change, and we will loose the mix of full time residents that make up a vital community. It is very shortsighted to think only about the tax revenue
from this proposed sugermarket project. To have affordable housing available is an investment in
Vail's future. If it's not the talc revenue you're thinking about, then we'd like to know what other
reasons you have for tHinking we need an additional supermarket instead of living space and green
space.
1Vo indications, to the best of our knowledge, have come from the progerty owners and/ or residents
of ilail that the need exists for another supermarket. Quite the opposite, you have heard from the Task
Force and your own surveys to residents, that the housing situation needs to be addressed and open
space needs to be preserved. Why aren't you listening to what you've heard? Do you know
something that we should know that has led you to your present conclusions? If so, please share it
with us.

We have the flexibility to attend meetings at 2 p. m. on a work day, but we think a meeting to decide
such a vital issue should have been held in the evening when more residents would have had the
opportunity to be present and give you their opinions. That is, if you want them. The Task Force
represented the citizens and their conclus'ions fell on mostly deaf ears. Only one of you listened to the
Task Force...is this the future of Vail...let's set up Task Forces and Advisory Groups, ask them to
spend endless hours, have them talk to the cirizens, and then let's ignore the results they come back
with if it doesn't agree with our thinking. Is this Government being responsive to its citizens?
Listen to the people who placed their confidence in you when they voted you into office as their
representatives. We have a housing situation to contend with, not a shortage of mazkets for purchasing
food and other items for the home. In order to solve a problem it has to be first idenrified. The
housing shortage and maintaining open space have been identified time and time again! It makes little
' difference if it's Safeway, City Market, Albertson's, or King Soopers, the Town of Vail does not
need a supermarket on this prime piece of property. If it does need tax payers for revenue, at least let
us have some choices.
We are asking you, in response to your own town survey that open space and housing are the two top
prioriries, to re-examine your postion in this issue and not ignore the advice given by your appointed
Task Force. Please don't rush into something when there appears to be no indicated need. Growth
patterns are down valley not in the Town of Vail and our priorities should be for affordable housing,
open space for visual appeal, service that exceeds the guests' expectations, activities for our guests
and their families,as well as a quality of life for those who choose to live in Vail as full time

The acldition of anothet~ chain supermarket will undoubtedly
create a price war and fierce competitzon. 1"his will be a
temporary benefit to the consumers (residents and visitors alike).
The outcome of having another store in town vvill be to divide
the business and tax dollars between Safevvay and City Market
and neither° store will be proftable. There is not enough volume
or° growth in the tou?n o-f Vail to justify the need for another
supermarkEt. Eventually, two lostng stores evill impair the
consiamer°s expectations for high levels of ser-Vice, store
conditians, freshness, quality, cornrnunity contribution and
involvement that the Vail custorner has a right to expect.
The Vail Commons would be better catilized for low-income
and employee housing and(or other retail that Vail is currently
lacking. Ekamples would be Marshalls, TJ Maxx, Mervyns, Best
Buy, a new rnotel, bowling ailey, civic center, recreatian center,
par°k, etc. I know that rnany residerats and visitors are not a(vvays
satisfied with 5afeway, many of the major problems could be
overcome by working with the Safevvay Company in a plan to
expar?d and remodel the stor°e. In rvty experience this is more
beneficial to the consumer and the community at large. A,s a Vai1
resident I feel vve should aIl take action now to prevent the
development of a new City Market.

Dear Council Members:
On behalf of the Eagle River Environmental and Business Alliance (EREBA), I would like to thank you for your
continued interest in the progress of the Eagle Mine Cleanup and for taking the time to meet with us.
Progress that has been achieved at the site has been a long and arduous process. The EPA, Colorado Department
of Health and Environment (CDHE) and Viacom have been involved in negoriations since the ROD was signed
in 1993, and the progress that has been made in additional work has been the result of Unilateral Administrarive
Orders from the EPA, into which EREBA has had considerable input. While it is encouraging that the
environmental indicators are improving, there are additional concerns that will require continued interest and
involvement from the community.
After the remediation of the Matoit Park Wetlands this sutruner, most of the major construction will have been
accomplished and a period of wait and see will go into effect. The effectiveness of the cleanup measures will be
evaluated on three and five year time frames, and additional cleanup measures may be required at that time.
At this time the major unanswered quesrions include:
-What is the impact of the Waste Rock Piles, and if there is a considerable impact what additional
cleanup measures will be required?
-What will be the procedure for emergency norificarion for downstream users if there is a water
treatment plant failure (shutdown or break in the collection system) resulting in release of
contaminated water from the Eagle Mine?
-Will the capping of the consolidated tailings pile reduce contamination that is now
entering the river in that azea?
-Will the water treatment plant be operating and producing sludge forever, or will the EPA require
Viacom to invesrigate more permanent measures? Where will the sludge go when the disposal
cell at the Contaminated Tailings Pile is full?
-Will the Maloit Park area be restored as a wetlands?
-Will the biological standard be sufficiently stringent to provide for restoration of the Eagle River
fishery?
-Will the town of Gilrnan be able to be occupied in the future?
These and additional questions remain unanswered. We hope that the Town of Vail will remain involved in the
project in a long term fashion and thank you for your ongoing support.

dispatch services. As we discussed, at the current rates, the Town of Vail.is not recovering its costs for this
service, and we will be forced to increase the fees for this service. I understand and appreciate the amount of
increase required to cover fixed and operating costs is significant.
For your information and review, I have enclosed the attached exhibit which shows the existing and proposed
cost for all participating agencies. We understand and appreciate the impact that an increase such as this would
have on your operating budget. We are willing to work with you in order to lessen the impact of this
adjustment by phasing this increase over a three year period.

(7-6) beginning at 9 a.m. in the Vail Municipal Building. Please join us.
(Vail)--A diverse group of community-minded "thinkers and doers" has been
assembled to evaluate and help implement the managed growth agreement negotiated
by the Town of Vail and Vail Associates. The plan, which aims to strengthen non-peak
ski periods while better managing peak periods, was officially signed by the two parties
in June, triggering creation of the task force, which is considered to be a key
component of the agreement. Both Vail Associates and the Town of Vail have
indicated a strong commitment in supporting recommendations of the task force.
The task force advisory board members, as selected by the town and Vail Associates,
represent a cross-section of diverse-thinking business members and residents. The
members are: E.B. Chester, chairman of WestStar Bank; Stan Cope, managing
director of the Lodge Tower, Vail Athletic Club and a member of the board of directors
of the Vail Valley Tourism & Convention Bureau; Diana Donovan, of Vail Honeywagon
and a longtime resident of Vail; Susan Harvey, marketing director of Curtin-Hill Sports
and founder of the newly-formed Vail Village Merchants Association; Frank Johnson,

manager of the Antlers at Vail and president of the Lionshead Merchants Association;
Bob McLaurin, Vail town manager; Allison Parrish, of Bart & Yeti's and president of the
Vail Restaurant Association (Michael Staughton, local business owner, will serve in
Parrish's absence); and Bill Wilto, past chairman of the Vail Board of Realtors and a
former Vail Town Councilman.
Vail Mayor Peggy Osterfoss said the town looks forward to the extended partnership.
"Since our goal is to maintain and or improve the quality of life and qualiry of
experience for both residents and guests, everyone benefits from this effort," she said.
"We look forward to sharing information, exchanging ideas and putting these ideas to
work beginning with the next ski season."
In addition to the task force, a resource team has been created to be called upon
when pertinent topics are discussed. Those members include: Monica Benderly,
president of the Manor Vail Condominium Association; Susan Connelly, director of the
Town of Vail Community Development Department; Art Kelton, realtor; Bob Kunkel, vice
president of marketing for Vail Associates; Johannes Faessler, president of Sonnenalp
Properties, Inc.; John Garnsey, president of the Vail Valley Foundation; Dave Gorsuch,
longtime business owner; Warren Miller, filmmaker; Gilda Kaplan, an East Vail resident
active in community affairs; Chris Moffet, business owner; Rod Slifer, former Vail
mayor; Jonathan Staufer, managing director of Vail Village Inn; and David Tanzer, local
resident and attorney.

offer ideas on the topics at hand. Communication also will be an important component
of the process, she said. Community meetings and task force updates will be
scheduled regularly. The task force will begin meeting in earnest this week with a
three hour session starting at 9 a.m. Thursday (7-6) to review skier trends and other ,
data.
According to Chris Ryman, senior vice president for Vail Associates, the volunteer
group will work on specific action plans involving such topics as: value pricing and
packaging; greater promotion of Vail's assets and amenities; identification of new
ventures and opportunities for the future; improvement in guest relations standards;
and involving the community in a peak management plan.
1lVith an exchange of information on lodging forecasts, marketing strategies and other
cohesive activities, the task force should produce renewed synergy and collaboration
throughout Vail, Osterfoss said. "This managed growth agreement is more than a
marketing plan," she said. "It's a commitment to the quality of experience by those who
live-and visit here."
The managed growth agreement was formulated over a two year period and has
received national attention for its innovation. It is the first partnership between a ski
company and a municipality in the country, Ryman said. The agreement addresses the
valley's winter visitation patterns, the town and mountain's circulation flows, parking
issues, infrastructure predictions, green space and growth.

I do not believe that the pcoposal to develop the Vail Commons property with a
supermarket/housing combination is appropriate use for this tract of land. ,4 need for
additionsi housing exists in the Town of Vail, but with the exception of holiday
periods, no need has surfaced for an additional supermarket.
I want you to reconsider your decision made on June 27th at the council meeting to
move forward with the City Market proposal and reconsider the opinion of the Task
Force aNpointed to advise you on this issue. '
I would havd attended the meeting on the 27th if it had been in the evening, however,
a 2pm session was impossible due to my work schedule.

Dear Madame Mayor and Lady and Gentlemen Members of the Town Council:
I am writing this letter in hope that the Town of Vail will consider
introducing a commemorative stone recognizing that Vail hosted the 1994 World
Mountain Bike Championships. This could be designed similarly to the 1989 World
Ski Championship sculpture that I am sure will be placed in a prominent location
near the new entry way to the roundabout. By recognizing the sport of mountain
biking; we will project an image that the town is not merely a winter resort. There is
Owners and Operators o/ clearly a following for the new sport of mountain biking and we might as well
Vail, Beaver Creek Resort position ourselves as a Mecca for bike enthusiasts. Although, some may perceive
and Arrowhead Mountain the sport as being one for the young and adventurous, mountain biking has a large
appeal for families as well. This appeal is something on which Vail should
capitalize. (See attached news release related to the World Championships) .

Dear Bill:
Thanks for taking the time to meet with me to discuss the Town of Avon/Town of Vail dispatch contract. As
we discussed, we have been conducting a number of cost accounting studies to identify the cost of service
provision for many of the services provided by the Town of Vail. W hen we reviewed the costs for providing
dispatch services, we determined the amount currently charged does not cover the cost of the service
provided.
Pursuant to our discussion, it will be necessary to increase the charges for this service in order to cover our
costs. The charges for dispatch service will be increased from $38,460 to $82,062 for Avon Police and Fire,
effective January 1, 1996.
For your information, I have attached an exhibit which shows the existing charges for service for all dispatch
contracts, as well as the services which will be effective January 1, 1996. If you have questions regarding the
manner in which this was calculated or wish to discuss this in more detail, please do not hesitate to give me
a call at 479-2105.

opposed to the expansion of the International wing
at The Lodge at Vail as presently proposed. We
believe this proposal.to be illegal in that it
ignores the density regulations.

owners and members of the Lodge Condominium Owners
Association, never voted for this proposal. As we
were present at every meeting, I do not understand
when or by whom this vote was taken.
