adjacent to the west, this request was denied. Larry, Bob, and Tom are following up. Joe Macy
was in to see Larry again this week. Has taken the lease to VA attorneys to

Dear Mr. Vezzani,
The Town of Vail would like to request that the Board of Land Commissioners maintain the
recreation designation on the Dowd Junction property in Eagle County and not change the
designation to urban lands. We hope you would keep the existing recreation designation on the
Dowd property for the following reasons:
1) The area on the south portion of this property (south of I-70) is geologically unstable.
Development at this location could result in an increased likelihood of debris flow on I-70
blocking our major access into the Town of Vail from the west.
2) This property provides a valuable open space buffer between Vail and Eagle-Vail and is
critical in the open space character of this area.
3) This area provides critical habitat for elk and deer. This winter, large herds of elk
inhabited tlus area. We would also hope that you would maintain the Division of Wildlife
lease on the south portion of the property to protect wildlife habitat.
4) There is a river access point west of River Run Aparhnents which is on this property
and provides valuable river access for commercial rafting. Maintaining and enhancing
swiuner recreational opportunities are a strong interest of the Town.
We respectfully request tbat the Board consider the above reasons and keep the Down Junction
property in the recreation designation. Sincerely,

--Update on Bikes, Blades, etc. in 4he Village Core
Police Chief Ken Hughey gave a brief status report on the effectiveness of "slow zones"
in the Village core. The new slow zones, marked by distinct red and black signs, are
intended to help reduce conflicting speeds of bikes, blades, boards, cars and
pedestrians. Since assigning two police officers to the "bike beat" this summer (double
the effort from last year), officers have made 89 public contacts regarding enforcement
of the zones. They estimate a slow zone compliance rate of about 80 to 90 percent,
according to Hughey. However, compliance with "rules of the road," such as stop
signs, is somewhat lower. Susan Harvey, representing the Village Merchants
Association, said businesses have mixed opinions about the issue. Noting that local residents may contribute to the problem more than tourists, Harvey suggested
additional education efforts to reach those residents. The Council agreed with
Hughey's recommendation to continue the slow zone program, although leaving the
door open for implementation of dismount zones if safety issues become more
prevalent. The two "bike beat" officers use modified mountain bikes to patrol an area
from Ford Park to Lionshead, writh an emphasis on weekends and other peak periods.

On a related Village core issue, Town Attorney Tom Moorhead indicated the amplified
sound committee would be appearing before the Council soon to make a
recommendation on possible modifications to the amplified sound ordinance. The
committee has been sfiudying regulation and enforcement issues with a consulting

--Garton's Sign Variance Site Visit
The Council visited Garton's Bar & Grill in preparation for a sign variance request at the
evening meeting. -
--Discussion of Vail Nonpoint Source Water Quality Management Plan resolution
The Council met with Russell Forrest, senior environmental policy planner, to learn
more about the water quality management plan in preparation for the evening meeting.

--Information Update
Paul Johnston agreed to serve on the board of the Avon-Beaver Creek Resort
Association. The term will run to December 1996. Upon discussion of a proposal to commemorate the 1994 World Mountain Bike
Championships, the Council agreed to combine the discussion with a larger review of a
plan acknowledging all championships held in Vail. The Council also discussed the
possibility of a plan for citizen 'memorials.
The Council reviewed three topic areas to be discussed during the evening meeting
with State Rep. Jack Taylor and State Sen. David Wattenberg. Also in preparation for
the evening meeting, the Council reviewed the 250 ordinance modification. (See
evening briefs).
Jan Strauch expressed concern about a street widening project in the Golf Course
area. Public Works Director Larry Grafel said the project has become controversial
because it requires the town to improve portions of the public right of way. This
includes removal of grass, trees, rocks and other areas originally landscaped on the
town's easement by the property owners. The Council asked Grafel to return with
additional information on the.town's standards for street reconstruction and repair.

--Citizen Participation
Werner Kaplan, an East Vail resident and spokesperson for the "Common Sense for
the Commons Committee," appeared before the Council and presented a petition
bearing the names of 684 citizens, collected within the last 8 days, urging the Council
to halt negotiations with City Market and put the Vail Commons development decision
to a vote of the people. Kaplan said the Council must be responsive to its constituency
regarding the fate of the" last sizeable piece of property within the town." It was
purchased by the town for $3.2 million in 1993. Kaplan said the Council should revisit
its finding that the only viable option for obtaining affordable housing on the Vail
Commons site is to tie it in with a supermarket. He said the other issue is one of

citizens spoke in support of the "Common Sense" effort. In response, Niayor Peggy
Osterfoss said the Council takes the group's concerns very seriously. She encouraged
consfiituents to become active participants at all levels of the process rather than
appearing at the 11th or 12fih hour. After providing a summary of the various steps
involved in the Vail Commons process--a{I aimed at providing deed-restricted, low-
density, quality housing on the site--she said the Council had unanimously agreed to
con4inue negotiations recognizing an "information gap" existed between the Council
and the community. She said the Council was wrorking to improve its communications
and responsiveness to the community and outlined several activities already in place:
1) a meeting wrill be held with the Vail Commons Task Force at 7:30 a.m. Wednesday
(7-19) to discuss hov?r 4o use task forces more efficiently; 2) a community breakfast to
discuss Vail Commons and several other issues has been scheduled for 7:30 a.m. Aug.
3 at a location to be announced; 3) as negotiations proceed with City iViarket, the public
will be kept informed and asked to share perspectives on particular issues; 4) a master
planning process for the West Vail area will be undertaken; and 5) a question and
answer sheet has been prepared to help provide addi4ional information abou4 the Vail
Commons project. OsferFoss concluded by asking 4he group to help the Council stay in

--Vail Nonpoint Source Water Quality fVlanagement Plan Resolution
The Council approved this resolution on a 6-0 vote (Lapin absent). The managemen4
plan addresses storm water runoff and its impact on Gore Creek. With increased
concentrations of salt, phosphate, ammonia, nitrate and other chemicals commonly
found in fertilizer compounds within the creek, the plan recommends education,
engineering and policy solutions to improve the Gore's water quality. Recommended
engineering solutions include: a regular sweeping program for streets and parking lots;
. use of grass strips and creation of wetlands; creation of a maintenance schedule for
catch basins; developmen# of minimum criteria for erosion control on construction sites; use of porous pavement materials; and water quality improvement techniques for
parking areas and large commercial areas. If unchecked, the water runoff
concentrations could produce a loss of aquatic life; increased algae growth along the
creek; and increased water 4reatment costs, according to Russell Forrest, TOV senior

The Council asked Rep. Tayfor and Sen. V1/attenberg to assis4 at the state level for help
with four projects: 1) sponsorship of legislation to create voter-approved taxing districts
that wrould be drawn diffieren4fy than county boundaries for purposes such as transportation and marketing; 2) $5 to $10 million worth of state-funded infrastructure
improvemenfis for the 1999 Vllorld Alpine Ski Championships; 3) property fax reductions

for full-time residents who are otherwise being driven out of the mountain communities
due to rising taxes; and 4) assistance in improving the Colorado Department of
Transportation's snow plowing program and/or privatizing snow plawing on Vai! Pass.
The legislators agreed to help sponsor a voter-approved taxing district bill and to lend
assistance with the additional items through continued discussions.
--250 Ordinance
After two attempts to pass amended motions on the ordinance, the Council voted 7-0 to
table the matter until a later evening meeting. The postponement followed
appearances by about a dozen residents, most of whom spoke against the measure.
As drafted, the 250 ordinance modification would exempt demolition-rebuilds from
utilizing the 250 square feet expansion provision. Also, any dwellings built after 1985
would be prohibited from the remodel incentive. Deed-restricted employee housing
units would qualify for the expansion. Many of those who spoke against the measure called the 1985 date arbitrary and unfair. Architect Lynn, Fritzlen also warned of the
difficulty of defining demo-rebuild. Attorney Art Abplanalp suggested exempting
properties from the 250 provision for those dwellings built after passage of the
ordinance, thus, giving property owners fair notice. Hermann Staufer asked the .
Council to wait until after the November 1995 elections to decide the fate of the 250
rule. Others in the audience wondered what problem had necessitated a review of the
current provision. The 250 ordinance was originaily adopted in 1985 to allow small
additions and expansions (up to 250 square feet) to residential property which is five
years old or older. Several Council members have said the 250 provision allows for too
much density to be built in the town in the future. As of December 1994, the town has
granted 176 requests totaling an additional 38,252 square feet of GRFA. For more

--Katsos Ranch Park. Wetlands
The Council voted 7-0 to approve a resolution authorizing permission to the Vail Valley
Consolidated Water District to create 3.2 acres of wetlands on the eastern portion of
Katsos Ranch property east of the golf course. The project would complete the
district's mitigation plan mandated by the U.S. Army Corps of Engineers as part of the
Black Lake No. 1 praject, located on the west side of Vail Pass. Black Lake was
created to augment flows in Gore Creek. The water district has been successful in
creating 2.8 acres of wetlands and now needs to create an additional 3.2 acres to meet

--Town of Vail Pension Plan
The Council voted 7-0 in support of a resolution adopting the Town of Vail deferred
compensation plan and terminating its deferred compensation plans with Great West
and the International City Managers Association (ICMA). The action was

Dear Town of Vail Council:
I respectfully request that you read my letter at the Town of Vail meeting scheduled for
July 18th regarding the elimination of the 250 square foot ordinance. I would love to attend this
meeting and personally voice my opinion, however our schedule does not allow us to be in Vail at
this time.
I have been a long time Vail winter resident and have owned several properties in Vail
Village. I feel that this ordinance has served to assist many individuals whose family needs have
changed and they have needed additional space. I also feel that this is an extremely useful
ordinance that allows many people who have older residences to improve their dwellings. I see
no reason to have a change in this ordinance, as I believe it has been used to benefit many citizens
of the Town of Vail.

I would ask that the staff please keep me apprised of the Town's decisions on this ordiance
and am hopeful that wisdom will prevail.

John Horan-Kates, who volunteered his tiaie to qet
the organization started, stated, "The varied aspects of such a
program are important in providing an example to ous children that
work in tourism is a worthy career choice."
One of the first events cominq up for the WE fs a
visit to. the Vaf1 Valley in mfd-November by st. Moritz city '
leaders, business people and elacted ofPicials. This trip is one
of the results of the Vail Valley visit to St. Morita last year.
After a lengthy series cf planninq meetings in
sprinq and early summer of 1994, a delegation of business people,
elected officials, and community leaders from the Vail Valley
traveled to St. Moritz, 3witzerland, long-time sister city of Vail. .
While on the trip participants attended work sessfons with their
counterparts in St. Moritz. These workshops gocused on spscific
needs of the Vail Valley community related to business seasonality, oultural exahanqes, marketinq programs and oommunity cooperation.
