10/19 SNOW STORAGE LAND PURCHASE LARRY/BOB McL: Immediately pursue purchase from VA of Current discussions presume a decision in 6 months (April'95). VA has
current snow storage site, as well as another 10 acres asked to dump.snow at this location. Because of our environmental liability,
adjacent to the west. this request was denied. Larry, Bob, ant Tom are following up. Joe Niacy
was in to see Larry again this week. Has taken the lease to VA attorneys to
address environmental liability issue.

Currently, we do not have the option to reduce mileage until new vans arrive. We
could reduce mileaae cost by $.21/mile by using these vehicles. :
Reduced Equipmeat Level:
Based on size of the vehicle, this will allow us to operate cheaper per mile and allow
to meet service needs with appropriate equipment. This, in time, will offer savings. Based
_ on 100,000 miles a year, we could save the following in fuel costs:

4. Reduced service leveUfrequency on outlying routes:
We operate from Nov. 20 to April 16 with frequencies of 10 minutes on East Vaii peak,
, 20 minutes on Sandstone peak, 15 minutes on West Vail Red peak, and 20 minutes on West Vail Green peak. Golf Course operates at 60 minute intervals at non-peak, with
peak hours at 30-minute intervals. Intown shuttle operates 5-7 minutes between buses.
In 1994, we operated with staff of 53 to 70 after employees due to employee shortage.
Reduced Essential Service Level:
Cut back service on West Vail, East Vail and Intown routes. West Vail would be
opposing loops with 30-minute headways per route with 15 minutes between buses.
East Vail would jo from 10 minute service to 15-20 minute service (non-peak). Intown
would drop from 5-7 minutes to 10-12 minutes between buses.
, These cutbacks may be necessary if enough drivers can't be hired. Last year, 49 drivers
covered 57 schedules, resulting in a hijh overtime cost.
Savings: $69,000
IMPA T:
* Reducino, frequency would increase capacity on buses to where we would be leaving
riders at various times and various locations. We carried 1,163,666 on outlyinor routes for
1994, an increase of 3% from 1993 figures.
# We have figured that by reducinor buses, we would need to carry 70 persons per bus per
run versus our current status of 30-40 persons per bus per run. (Seating capacity is 35 per
bus).
Reducincr staff would also take away flexibility of ADA runs and how they are handled
without a part-time person on staff to do just ADA calls.
No flexibiliry of available buses to handle over-capacity due to overall reductions.

PROPOSAL: Merchant validation for 1'/Z hour and 6pm-9pm free parking currently free parking
makes up 46% of all transactions.
METHOD: lYYerchants would be required to stamp their customers parking ticket in order for
customer receive 1'/z free of free parking from 6pm-9pm. If ticket is not stampeii, customer
would be charged $1 for the first 1'/z hour and the normal rate for parking between 6pm-9pm.
Currently all entries are eligible for free parking.
COST: The cost of the stamp is approximately $10 would be initially paid for by the Town. It
would be then sold for $10 to the merchant. There is approximately 500 various businesses in
Vail which would make the up front cost to the Town $5,000.
REVENLTE: If we reduced the free parking by 5% we would generate approximately $8,500
during the 1'h parking time and $7,000 during the 6pm-9pm period.
ADVANTAGES: The stamps would be coded per the sales tax categories. At the end of the
year, we would know what services were being used with the free parking. This would also get
the merchants involved in the free parking program that the Town has provided for years.

PROPOSAL: Summer parlcing:
METHOD: Install pre-pay equipment at Village and Lionshead parking structures. Charge $1
per entry and extend blue and gold passes, and debit card privileges for $100 for summer
season each pass (216 days X.50 =$108)
COST: $17,000 to install equipment at both structures. The system would be unmanned.
REVENCTE: Average use at both structures is 360,000 transactions during the summer
months. Assuming that 1/2 of these transactions would be .25 local pre-pay parking and 1/2
would be $1 estimated revenue would be $225,000 for the summer season.

--Request for Funding to Conduct Lodging Forecast Study
The Council voted 6-0 (Rlavas absent) to contribute $5,000 toward the annual cost of a
lodging forecast study for the Vail Valley: The study, to be funded by Beaver Creek
Resort Company and Vail Associates, among others, is designed to provide a 90-day
occupancy forecast to pinpoint upcoming periods of peak or low occupancy levels. The
study, based on reports from 50 participating lodges, is considered to be a tool to assist
with implementation of the Town of Vail-Vail Associates managed growth plan.
Although Council members Tom Steinberg and Merv Lapin expressed concern about
subsidizing private enterprise, they offered support for the study so long as the
information provides valuable results for the town. For more information, contact Town

--Discussion of 250 Ordinance The Council directed staff to prepare a compromise version of the 250 ordinance for
first-reading at the evening meeting. (See evening meeting briefs for details).
--Information Update
Representatives from the Vail Public Library invited the Council to attend a book
signing on Aug. 21 and a children's theater production on Aug. 5.
Senior Environmental Policy Planner Russell Forrest gave an update on an action plan
to prepare a solid waste management plan for the town. A steering committee has
been established to assist with the document. For more information, contact Forrest at

Two calendar items were announced: Aug. 3 Community Breakfast at the Evergreen
Lodge and a farewelf gathering for Police Chief Ken Hughey on Aug. 4.

Senior Planner Andy Knudtsen gave a brief update on the Vail Commons project. He
indicated four issues needed to be presented for public dialague at an Aug. 22 work
session: 1) day care facility versus community pavilion; 2) lottery criteria for sale of the
53 housing units; 3) how to use the revenue stream generated by the commercial
development; and 4) should the town lease or sell the residential portion of the
development.
--Council Reports
Paul Johnston gave a brief update on ESPN's interest in working with the Vail Valley
Foundation to shoot an extreme sports television program in Vail. Johnston also "
indicated efforts to reshape a Vail youth award are continuing.
Peggy Osterfoss said the TOV-VA Task Force has been honing in on special events
and creation of value-added pricing to beef up early season business as part of the
peak, non peak managed growth plan. She said the group is also working on a
strategy to reinforce Vail's international image through signs, information and additional
translation services.
Ostertoss also reported consensus was reached at last week's regional transportation
meeting in which bike paths would get 10 percent of the proceeds from a proposed
° half-cent sales tax to be presented to Eagle County voters in November.
Tom Steinberg and Sybill Navas gave a brief update on a recent Northwest Colorado
~ Council of Governments meeting in which efforts are underway to improve the next
census count in mountain communities by beginning the canvassing in February rather
than April. Officials believe the earlier count will more accurately reflect the permanent
population.

--Resolution declaring Sept. 2-4 as First Annual Jazz Party Weekend
The Council voted unanimously to pass a resolution supporking the September'Jazz
Party Weekend at the Westin. Spokesman Howard Stone says the event will bring 28
world-renowned jazz musicians to Vail for three days of jazz education. Spectators will
be coming from as far away as Japan and Canada.
--250 Ordinance
The Council voted 4-3 (Shearer, Steinberg and Lapin against) to approve on first-
reading an ordinance modifying the town's 250 square feet expansion provision. As

--Immediately eliminate demolition-rebuilds from utilizing the 250 square feet
expansion. Demo-rebuilds are defined as the destruction, demolition or removal of 50
percent or more of the gross residential floor area of an existing unit or structure.
--Eliminate 250 eligibility for new dwelling units constructed after IVov. 30, 1995.
--Enable qualifying properties built or in process before iVov. 30, 1995, to receive the
250 square feet expansion after five years from the date the dwelling received a
certificate of occupancy. "In process" means a complete application has been
accepted by the Community Development Department.
--Allow 250s to be applied to deed-restricted employee housing units.
--Allow continuation of interior 250s for multi-family properties while prohibiting exterior
alterations.
--Review of 250 applications to be handled by the Planning & Environmental
Commission rather than the Design Review Board.
The 250 ordinance was originally adopted in 1985 to allow small additions and
expansions (up to 250 square feet) to residential property which was five years old or
older. That provision, which has triggered 176 approvals for expansions totaling an
additional 38,252 square feet of GRFA, has allowed for too much density potential to
be built in the town, say some Council members. In granting first-round approval to the
ordinance modification yesterday, the Council sought to reduce possible density. ,
However, in voting against the ordinance, Steinberg and Lapin, in particular, said they
preferred to eliminate the entire provision as a means to limit the town's density. The
ordinance comes up for second-reading approval at the Aug. 15 evening meeting. For

--Town iVianager's Report
In his report to the Council, Town iVianager Bob McLaurin said the Pulis/Golf Course
Bridge project is proceeding on schedule with construction to occur this fall. The
project is funded through an 80-20 match with the state. Also, asphalt will be going
down on the north side of the Main Vail roundabout in two weeks. In addition,
McLaurin said, the engineer who designed the roundabout was in town this week to
work on a feasibility study regarding a roundabout at the West Vail Interchange. A
conceptual design from Leif Ourston is due Sept. 15.

(Vail)--Jim Shearer has given up his seat on the Vail Town Council due to residency
requirements. Shearer, an appraiser for Eagle County, is relocating to Eagle this week
because of his inability to find housing within the Town of Vail. His resignation became
effective yesterday (8-2). Shearer was elected in 1991 to a four year term expiring in
iVovember of this year. Ironically, Shearer served as a member of the Vail Housing
Authority and worked tirelessly to address the lack of affordable housing here.
"These three-plus years have been some of the most rewarding of my life in terms of
'the Vail Town Council," said Shearer. "I have served with some of the most dedicated
and capable people in Vail's history. I'm proud of our sucesses and can count few faux
pas. I'm greatful to the townspeople, the town staff, all members of both councils, to
Peggy Osterfoss for being one of Vail's best mayors and to my daughter, Annie, for
putting up with all of this for me," Shearer said.
According to the Town Charter, the council may choose to call an election or to .
appoint an individual to fi11 the term if the vacancy occurs with 364 days or less
remaining in the term.

election are available in the Town Clerk's office beginning Sept. 25. Candidates have
until Oct. 20 to circulate the nominating petitions. A minimum of 10 si.gnatures of
registered voters who reside in Vail is required for certification. Town elections are
non-partisan.
Council members receive a saiary of $200 per month; the mayor receives a$500

$40 million for more open-space purchases, without

(Vail)--Application packets are now available for local charitable organizations
seeking 1996 funding assistance from the Town of Vail. The Town Council will
consider the outside agency funding requests as part of its 1996 budget review pr.ocess
at a public hearing on Sept: 19. Applicants have until 5 p.m. Sept. 1 to submit funding
requests.
Agency requests for cash contributions,, in-kind services and parking pass donations
-for the entire year will be considered during this process. No additional funding
requests will be considered beyond the application deadline.
Application forms will be mailed to organizations which have received funding in
previous years. Other agencies interested in applying for the funding should contact
Christine Anderson, finance controller, at 479-2119.
The town's budget this year contains about $740,000 in contributions to 27 local
agencies:

Dear Helen:
The purpose of this letter is to reaffirm our numerous discussions concerning the construction of the Alpine
Garden Visitor's Centers. Although previous Councils have indicated a willingness to allow the expansion,
and have in fact assisted in the funding of this expansion, it is important to realize the Ford Park Master Plan
must be revised prior to any issuance of a building permit. It is also important to understand that in revising
the Ford Park Master Plan, the Town must balance the competing uses at Ford Park.
As was discussed in my letter of June 1, 1995, the Town has long supported and continues to support the
A{pine Gardens. The Council recognizes the gardens as an amenity of world class significance. However,
as the owner of the property, the Town must continue to deal responsibly with all the uses on the site. The
Town intends to try to do so through the reconsideration of the Ford Park Master Plan.
It is important to understand and realize that the proposed expansion cannot be accomplished until such time
as the Ford Park Master Plan is revised and the project has received the appropriate approvals from the Town
of Vail. It is not my intention to discourage you with your project. It is important that you understand there are
no guarantees with respect to the outcome of either the Ford Park Master Plan revision or the development
review process.
I would be happy to sit down with you and Sammye Meadows if you would like to discuss this matter in more
detail. Thank you for your understanding with regard to this issue.

Synopsus of Edenas:
At 4:23 p.m. on Aug. 5, the Vail Public Safety Communications Center received a 919
phone call about a small child found floating in Gore Creek. The 911 caller stated that
Jim White, an off-duty police sergeant from Greenwood Village, pulled the child from
the Gore and indicated the child had no vital signs.

The Vail Fire Department, Eagle County Ambulance and Vail Police Department were s
dispatched to Casa Del Sol Condominiums at 2055 S. Frontage Road in West Vail. ,
As emergency crews were responding, Jim White and Robert Taylor, a local resident,
began performing CPR on the child. A few minutes later, David Maurer arrived saying
he was a doctor and could help. All three men performed CPR on the toddler, Travis
. Birch, until emergency medical personnel arrived. Once emergency personnel arrived,
Travis was transported to Vail Valley Medical Center.
~ At 4:29 p.m., David Birch, Travis' father, approached a police officer at the scene and
asked if the officer had seen his small child.
Investigation has revealed that Travis stepped out of his parents home on Shasta Place
unbeknownst to his father. As his father was.looking for Travis, he heard sirens and
emergency vehicles arriving approximately one-third of a mile downstream from his
home. Both David and Kathryn Birch were given rides to Vail Valley Medical Center.
Travis Birch was later transported by helicopter to Chitdren's Hospital in Denver.
As of Aug. 7 at 1:45 p.m., Travis was still listed in critical condition.

On August 7, 1995 we received in the Town Clerk's office an Affidavit of a Petitioners' Committee
to propose an ordinance to create a master plan subject to approval by the electorate for the 1Nest
Vail Shopping Mall and the Vail Commons. A copy of the Affidavit and proposed ordinance is
attached.
Lori Aker, the Deputy Town Clerk, is presently working with Pam Brandmeyer and myself to prepare
and issue the appropriate petition sections to the Petitioners' Committee. This is being done in
consideration of the Town Charter and Title 31, Article 11, of the Colorado Revised Statutes
concerning procedures for municipal initiatives. This amendment to Title 31 became effective May
8, 1995. It is anticipated that barring any unforseen difficulties, Lori will issue the petition blanks by
this Friday, August 11 th.
The Petitioners' Committee is required to obtain the signatures of registered electors of the Town
in number equal to at least fifteen percent of the total number of electors registered to vote at the last regular Municipal election. While the Town Charter is silent as to the amount of time available
for the Petitioners' Committee to circulate the petitions, the State statute sets forth a time period of
180 days from the issuance of the petition blanks by the Town Clerk.
Once the petition is filed, the Town Clerk will determine its sufficiency and complete a certificate to
that effect within ten days of submittal.
If the initiative petition is determined to be sufficient, the Town Council will consider the proposed
initiative ordinance in a manner consistent with consideration of any ordinance. In the event Council
fails to adopt the proposed ordinance, it shall be submitted to the registered electors at a Town
election for their acceptance or rejection.

The vote of the Town on a proposed ordinance shall be held not less than thirty`days and not later
than ninety days from the date of the final Council vote thereon. If a regular Town election is to be
held within that period, the vote shall be held at the same time as such regular election, except that
the Town Council may, at its discretion, provide for a special election at an earlier date. The next
regular Town election is to be held on November 21, 1995. That date is ninety days after August
24, 1995.

TITLE: In Order to Revitalize the Vail Community, an Ordinance Creating a Master Plan by
the Town of Vail for the Redevelopment of the West Vail Shopping Mall and the Vail Commons
Parcel of Land.
It Shall be Ordained that the Town Council of the Town of Vail, Colorado shall create an
ordinance establishing a Master Plan for the. West Vail Shopping Mall Area and the Vail
Commons parcel of land.

Be it further ordained that no contracts for redevelopment of the West Vail Shopping Mall or
development• of the Vail Commons parcel be entered into by the Town of Vail until such a
Master Plan is created by the Town of Vail and approved by the electorate of the Town.
All Bylaws, orders, resolutions and ordinances or parts thereof, shall be made consistent with
this ordinance. All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent
with this ordinance are hereby repealed to the extent only of such inconsistency.
