decision of the Design Review Board.
BACKGROUiVD RATIONALE: At the August 2, 1995, Design Review
Board meeting, the Board approved (by a vote of 4-1) an addition to
the Stevinson residence, located at 1498 Springhill Lane. The
adjacent neighbor, located at 1468 Vail Valley Drive has appealed
the decision to approve this application. Please see the attached
letter from the adjacent properry owner for further information.

of demo/rebuild at 18.04.065 of the Municipal Code of the Town of Vail.

ACTION REQUESTED OF COUNCIL: Review options, for example, day
care or a community meeting room, and provide direction to the Vail
Commons Development team as to the use of the community facility.

Tom Moorhead Chapter 18.71 Additional Gross Residential Floor Area.

• ACTIOIV REQUESTED OF COUNCIL: Approve, deny or modify Ordinance
No. 6 as presented.
BACKGROUIVD RATIONALE: Ordinance No. 6, Series of 1995 passed on
first reading with the following provisions: five years must have passed since
the unit was issued a Certificate of Occupancy (whether temporary or final)
or , in the event a Certificate of Occupancy was not required for use to the
dwelling at the time of the completion, from the date of the original
completion and occupancy of the dwelling. We believe this addresses the
issue of the requirement for a Certificate of Occupancy.
The ordinance reflects that these applications will be reviewed by the
Planning and Environmental. However, all proposals will still be required to
conform to the Design Review Guidelines.
This ordinance eliminates 250 eligibility for any dwelling unit not in existence
as of IVovember 30, 1995 or one for which a completed Design Review
Board application for the original construction of a dwelling unit has not been
accepted by November 30, 1995.

In regard to "catastrophic loss" it would be inappropriate to address that
issue in this provision as it is properly addressed in Chapter 18.64 of the
Municipal Code. Section 18.64.090 provides that :"whenever a
nonconforming use which does not conform with the regulations for the
district in which it is located or a nonconforming structure or site improvement
which does not conform with the requirements for ....density control..., is
destroyed by fire or other calamity, by act of God or by the public enemy, its
use may be resumed or the structure may be restored, provided the
restoration is commenced within one year and diligently pursued to
completion." This provision would pertain to any structure that has received
the benefit of 250 additional GRFA from that amount that would normally be
allowable within its zone district.
STAFF RECOMMENDATION: Approve ordinance.
9:30 P.M. 6. Town Council call-up of a Design Review Board approval of an amendment
Lauren Waterton to the sign program at the West Vail Mall.
ACTIOIV REQUESTED OF COUNCIL: Uphold, reverse or modify the
decision made by the Design Review Board.
BACKGROUND RATIONALE: At the request of the Subway Restaurant
located in the West Vail Mall, the West Vail Mall Corporation has applied for
an amendment to the existing sign program for the West Vail Mall. The
current program requires signs to be white wall-mounted letters, with an
allowance for the addition of a logo using corporate colors to be not greater
than 20 percent of the sign area. The West Vail Mall Corporation has
requested that corporate color may be used in 50 percent of the total sign
area.
On July 19, 1995, the Design Review Board approved (by a vote of 4-1) a
change to the West Vail Mall sign program, allowing the sign area for the
Subway sign to be 50 percent color and all remaining signs will continue to
be restricted to 20 percent. At the July 25, 1995 Town Council worksession,
this item was called-up by the Town Council.

resignation of Jim Shearer. I have a genuine interest in being more involved in the town
and this position would allow me that opportunity. I understand the commitment required
and have the time necessary to become an active participant in Vail and its future.
For the record, I have lived in Vail since May 1962, initially as a ski instructor and later as
a principal in real estate brokerage, management and development business. I have
participated in community affairs since Vail began and can bring to the Council a great deal
of experience. I live in the heart of Vail and am aware of the residential and commercial
problems the community faces. I have a strong interest in the economic future of Vail and
feel we must address this issue immediately in order to preserve and enhance our economic
base. I share your concerns regarding the lack of affordable housing and the need for a
continued and expanded transportation system throughout the entire county.

Re: Interim Vacancy on the Town Council
Dear Peggy, Tom, Merv, Sybil, Jan and Paul:
I am writing to request the opportunity to interview for the recent opening an the Vail
Town Council. My involvement on the Vail Planning and Environmental Commission over
the past four years has been and continues to be a very rewarding experience. I am now
interested in becoming involved in the "political" arena at the Town of Vail, an area that has
intrigued me over the years.
I currently a partner in the real estate firm of Amsden, Davis & Fowler and practice real
estate as a career. This has allowed me the experiences and opportunities of rezoning land,
changing subdivision covenants, sitting on various task forces at the Town(GRFA and
Waste Water Monitoring). It also keeps me tuned in to market trends as they affect the area
of locals housing. I am extremely motivated in accomplishing the actual construction of
locals housing units in the Vail Valley and believe that a public/private joint ventures may be
the solution to this never ending dilemma.
I own a home in Intermountain and enjoy what Vail has to offer it's residents. I would like
to focus on staying in the Vail end of the Valley...a desire that is many times overshadowed
by the opportunity to sell and move down valley.

After later reviewing the requirements I see that I do not qualify. Technically, I lived in
Avon for two months during the previous two years.

Council Members,
I would like to express my interest in serving as appointee to fill the remaining term of Jim
Shearer.
I have been visiting Vail since 1966. I have resided in the Town since April of 1988, with
the exceprion of August 1992 to July 1993.
I am the sole owner and employee of Wirth 1Vlanagement, Inc. and as such, manage the
condominium association and commercial property at the Vail das Schone building. I also
manage several smaller properties in the West Vail area.
I am currently serving my second term as president of The Falls at Vail Townhome
Association.
I consider myself a fiscal conservative and believe in accomplishing goals in a
straightforward and efficient manner. I feel that the Town Council can best help to
maintain Vail's premier status by facilitating the working together of the citizenry, public
and private sectors. It is the responsibility of everyone to work toward maintaining the
beauty ar.d atmosphPre of the area.
I throughly enjoy living and working in Vail. So many people have worked so hard and
given so much to make Vail what it is today. I would be grateful for the opportunity to
add my efforts to the cause.

Dear Mayor Osterfoss, 1Vlembers of the Town Council:
Please accept this letter as my application for the opening on the council created by Mr.
Shearer's resignation.
The following will illustrate my qualifications and show my interest in contributing in
a positive manner to the future of Vail. •
* I have been a full time resident of Vail since 1966 and for the past seventeen
years have resided in my home at 2725 Bald Mountain Road.
* In 1985 I became a naturalized American citizen.
o I am available to attend the Council Meeting on August 15, 1995.
As a resident of Vail for thirty years, I have developed sensitivity to and concern for
the needs and desires of the local constituency as well as the reality of growth within
our community. As a result, I served on the Vail Planning and Environmental
Commission from 1990 to 1992. (I resigned from that position due to professional
commitments which frequently took me out of country.) I have been involved in the
development and management of resort communities far over 35 years, including
Perisher Valley, Australia; Telluride, and Vail, Colorado.
I believe that I am known and respected as a loyal and caring member of our
community, and I have the interest and energy to contribute in a constructive manner.
As Vail prepares to stage the 1999 World Alpine Ski Championships, I believe that my
background in skiing and racing would be an additional asset to the council.
I have a strong desire to make a positive difference within our community. If
appointed, I would endeavor to gain the trust and support of the members of our town
to become elected in November.

We find our condominium, Vail Intemational, is faced with a proUlem of not being able to phase
in a roof repair and replacemenc prograrn over the nest thrw years because of a requirement of the
Town of Vail to post a bond or letter of credit.
If we obtain a letter of credit, our bank is asl:ing for cash collateral eYCeeding our abilities. It is
questionlble whether we can obtain a bond. If we Nvere able to obtain a bond, the cost will eiceed
$6, 000. 00.
We 1re trying to be prudent owners by stai-ting this roof repair process prior to potential future
ernergency replacement and pay for this maintenance program on a graduated scale of three years,
with a evritten contract evith Plath Construcfion, our roofer. Our consulting engineer, Wayne
Whitaker, set our bid contracts on this fhsee year basis.
Attached to this letter is a copy of our repau• and replacements projects over the past eight years. I
Uring these to your attention to help illustrate that the Ow-ilers of Vail Inteinational have always
insisted on a vexy timely and proper preventative maintenance, repair, and replacement program to
keep the Vail International Ccmdominiums in an excellent condition.

commitments to oursetves or the communiry.

Dear Vail Town Council Members:
As I have been unable to attend any of the recent meetings and more
than likely will not be able to make the meeting on Tuesday, August
15, I wanted to share a few of my thoughts.
Regarding the issue of a Community Center versus a Day Care Center
at the Vail Commons site:
I would like to see a Community Center similar to the Eagle Vail
Pavilion. Like the Eagle Vail Pavilion, this could be a facility
that could be rented out for functions and events.
I think an entity like the Vail Recreation District could manage
and book the facility.
It is also possible that if the demand exists for a Day Care
Facility, that the building could be used for that purpose Mondays
through Fridays during the daytime hours.
With all of the uproar over City Market going in on the Commons
site, has any consideration been given to having Safeway do
something like the City Market plan and then redeveloping the
existing Safeway site?

WHEREAS, prior to 1985 the Planning and Environmental Commission entertained many
requests for GRFA variances for small additions to homes that provided primary residence; and
WHEREAS, such applications were to improve the property and enhance its livability such
as a mud room, an airiock, enlarging an existing room or adding a bathroom; and
WHEREAS, much of the housing stock was originally built for vacation use and needed
small improvements to be better adaptable to fulf time living; and
WHEREAS, these dwelling units in many instances did not meet the Design Review
Guidelines in regard to landscaping, gravel driveways and parking areas and overhead power lines;
and
WHEREAS, it was apparent that the increase in GRFA would be off-set by the
enhancements to the property which resulted in a benefit to the Town by improving the housing
stock; and
WHEREAS, the Town Council has studied the effects of Chapter 18.71 in the Town of Vail
as it has been applied; and
WHEREAS, this examination has led the Town Council to find that there have been abuses
of the additional GRFA process and that the original intent of the allowance of additional GRFA is
not being met in the majority of the "250 additions"; and
WHEREAS, The Town Council finds that allowing a demo/rebuild to take advantage of an
additional 250 square feet has not met the purpose and intention of the ordinance and does not
prove to be an inducement for the upgrading of existing housing stock but rather simply confers a
benefit upon an individual with no benefit being conferred upon the Town; and
WHEREAS, Council finds it is inappropriate to allow an additional 250 square feet in the
instance of a demo/rebuild where the same advantage is not provided to a parcel of land, or lot
similarly situated that has never been developed.

~NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
VAIL, COLORADO AS FOLLOWS:
1) Section 18.71.010 is hereby amended to read as follows:
18.71.010 Purpose
The purpose of this Chapter is to provide an inducement for the upgrading of existing
dwelling units which have been in existence within the Town of Vail for a period of at least five (5)
years by permitting the addition of up to two hundred fifty (250) square feet of gross residential floor
area ("GRFA") to such dwelling units, provided the criteria set forth in this Chapter are met. This
Chapter does not assure each single family dwelling or dwelling unit located within the Town of Vail
ari additional two hundred fifty (250) square feet, and proposals for any additions hereunder shall
be reviewed closely with respect to site planning, impact on adjacent properties, and applicable
Town of Vail development standards. The 250 square feet of additional GRFA may be granted to
existing single family dwellings, existing two family and existing multi-family dwelling units only once,
but may be requested and granted in more than one increment of less than 250 square feet.
Upgrading of an existing dwelling unit under this Chapter shall include additions thereto or
renovations thereof, but a demo/rebuild shall not be included as being eligible for additional gross
residential floor area.
2) Section 18.71.020 is hereby amended to read as follows:
18.71.020 Single Family Dwellings and Two Family Dwellings
Any single family dwelling or dwelling unit in a two family dwelling shall be eligible
for additional GRFA not to exceed a maximum of 250 square feet of GRFA per single family dwelling
or two family dwelling unit in addition to the existing GRFA or the allowable GRFA for the site.
Before such additional GRFA can be granted, the single family dwelling or two-family dwelling shall
meet the following criteria:
A. At least five (5) years must have passed from the date the single family
dwelling or two-family dwelling unit was issued a certificate of occupancy (whether temporary or
final), or, in the event a certificate of occupancy was not required for use of the dwelling at the time
of completion, from the date of original completion and occupancy of the dwelling.
B. The single family dwelling or dwelling unit shall have received its final
certificate of occupancy.
C. Proposals for the utilization of the additional GRFA under this provision shall
comply with all Town of Vail zoning requirements and applicab{e development standards. If a
variance is required for a proposal, it shall be approved by the Planning and Environmental

Commission pursuant to Chapter 18.62 before an application is made in accordance with this
Chapter. The applicant must obtain a building permit within one year of final Planning and
Environmental Commission approval or the approval for additional GRFA shall be voided.
D. Adjacent properry owners and owners of dwelling units on the same lot as
the applicant shall be notified of any application under this Chapter that involves any external
alterations to an existing structure. Notification procedures shall be as outlined in Section 18.66.080
of the zoning code. E. If any proposal provides for the conversion of a garage or enclosed parking
area to GRFA, such conversion will not be allowed unless either the conversion will not reduce the
number of enclosed parking spaces below the number required by this Code or provision is made
for creation of such additional enclosed parking spaces as may be required for the-new total GRFA .
under this Code. Plans for a new garage or enclosed parking area, if required, shall accompany
the application under this Chapter, and shall be construed concurrently with the conversion.
F. Any increase in parking requirements as set forth in Chapter 18.52 due to any
GRFA addition pursuant to this Chapter shall be met by the applicant.
G. All proposals under this Section shall be required to conform to the Design
Review Guidelines set forth in Chapter 18.54 of the Vail Municipal Code. A single family dwelling
or dwelling unit for which an addition is proposed shall be required to meet the minimum Town of Vail landscaping standards as set forth in Chapter 18.54 of the Vail Municipal Code. Before any
additional GRFA may be permitted in accordance with this Chapter, the staff shall review the
maintenance and upkeep of the existing single family dwelling or two-family dwelling and site,
including landscaping to determine whether they comply with the Design Review Guidelines. IVo
temporary certificate of occupancy shall be issued for any expansion of GRFA pursuant to this
Chapter until all required improvements to the site and structure have been completed as required.
H. The provisions of this Section are applicable only to GRFA additions to single
dwelling units. No pooling of gross residential floor area shall be allowed in single family dwelling
or two-family residential dwelling units. iVo application for additional GRFA shall request more than
250 square feet of gross residential floor area per single family dwelling or two-family dwelling, nor
shall any application be made for additional GRFA until such time as all the allowable GRFA has
been constructed on the property, or an application is presently pending in conjunction with the
application for additional GRFA that utilizes all allowable GRFA for the property.

I. Any single family dwelling or two-family dwelling which has previously been
. granted additional GRFA pursuant to this section and is demo/rebuilt, shall be rebuilt without the
additional GRFA as previously approved.
3) Section 18.71.030 of the Vail Municipal Code is hereby amended to read as follows:
18.71.030 Multi-Family Dwellings
Any dwelling unit in a multi-family dwelling shall be eligible for additional GRFA not
to exceed a maximum of 250 square feet of GRFA in addition to the existing GRFA or the allowable
GRFA for the site. Any application of such additional GRFA must meet the following criteria:
A. At least five (5) years must have passed from the date the building was
issued a certificate of occupancy (whether temporary or final), or, in the event a certificate of
occupancy was not required for use of the building at the time of completion, from the date of
original completion and occupancy of the building.
B. The building has received its final certificate of occupancy.
C. Proposals for the utilization of the additional GRFA under this provision shall
comply with all Town of Vail zoning requirements and applicable development standards. If a
variance is required for a proposal, it shall be approved by the Planning and Environmental
Commission pursuant to Chapter 18.62 before an application is made in accordance with this
Chapter. The applicant must obtain a building permit within one year of final Planning and
Environmental Commission approval or the approval for additional GRFA shall be voided.
D. Portions of existing enclosed parking areas may be converted to GRFA under
this ordinance if there is no loss of existing enclosed parking spaces in said enclosed parking area.
E. Any increase in parking requirements due to any GRFA addition pursuant to
. this Chapter shall be met by the applicant. .
F. All proposals under this Section shall be reviewed for compliance with the
Design Review Guidelines as set forth in Chapter 18.54 of the Vail Municipal Code. Existing
properties for which additional GRFA is proposed shall be required to meet minimum Town of Vail
landscaping standards as set forth in Chapter 18.54 of the Vail Municipal Code. General
maintenance and upkeep of existing buildings and sites, including the multi-family dwellings,
landscaping or site improvements (i.e., trash facilities, berming to screen surface parking, etc.) shall ,
be reviewed by the staff after the application is made for conformance to said Design Review
Guidelines. This review shall take place at the time of the first application for additional GRFA in
any multi-family dwelling. This review shall not be required for any subsequent application for a
period of five (5) years from the date of the initial application and review, but shall be required for

the first application filed after each subsequent five (5) year anniversary date of the initial review.
IVo temporary certificate of occupancy shall be issued for any expansion of GRFA pursuant to this
Chapter until all required improvements to the multi-family dwelling site and building have been
completed as required.
G. If the proposed addition of GRFA is for a dwelling unit located in a
condominium project, a letter approving such addition from the condominium association shall be
required at the time the application is submitted.
H. iVo deck or balcony enclosures, or any exterior additions or alterations to
multi-family dwellings with the exception of windows, skylights, or other similar modifications shall
be allowed under this Chapter.
1. The provisions of this Section are applicable only to GRFA additions to individual dwelling units. iVo "pooling" of GRFA shall be allowed in multi-family dwellings. No
application for additional GRFA shall request more than 250 square feet of gross residential floor
area per dwelling unit nor shall any application be made for additional GRFA until such time as all
the allowable GRFA has been constructed on the property.
J. Any building which has previously been granted additional GRFA pursuant
to this section and is demo/rebuilt, shall be rebuilt without the additional GRFA as previously
approved.
4) Paragraph 18.71.040 is hereby amended to read as follows:
18.71.040 Procedure
A. Application shall be made to the Community Development Department on
forms provided by the Community Development Department and shall include:
1. A fee pursuant to the current schedule shall be required with the
application.
2. Information and plans as set forth and required by Section 18.54.040,
paragraph C.
3. A list of the names and addresses and stamped envelopes of all the
adjacent property owners and owners of dwelling units on the same
lot as the applicant.
4. Any other applicable information required by the Community
Development department to satisfy the criteria outlined in this
Chapter.

B. Upon receipt of a completed application for additional GRFA, the Planning
and Environmental Commission shall set a date for a hearing in accordance with Section 18.66.070.
Notice shall be given, and the hearing shall be conducted in accordance with Sections 18.66.080
and 18.66.090.
C. If the community development department staff deterrriines that the site for
which the application was submitted is in compliance with Town of Vail landscaping and site
improvement standards, the applicant shall proceed as follows:
1. Application for GRFA additions which involve no change to the
exterior of a structure shall be reviewed by the Community
Development Department staff.
2. Applications for GRFA additions involving exterior changes to a
building shall be reviewed by the staff and the Planning and
Environmentat Commission in accordance with the provisions of this
Chapter.
D. If the Community Development Department staff determines that the site for
which additional GRFA is applied for pursuant to this chapter does not comply with minimum Town
of Vail landscaping or site standards as provided herein, the applicant will be required to bring the
site into compliance with such standards before any such temporary or permanent certificate of
occupancy will be issued for the additional GRFA added to the site. Before any building permit is
issued, the applicant shall submit appropriate plans and materials indicating how the site will be
brought into compliance with said Town of Vail minimum standards, which plans and materials shall
be reviewed by and approved by the Community Development Department.
E. Upon receiving the necessary approvals pursuant to this chapter, the
applicant shall proceed with the securing of a building permit prior to beginning the construction of
additional GRFA. .
F. Any decisions of the Communiry Development Department staff pursuant to
this chapter may be appealed by any applicant in accordance with the provisions of Section
18.66.030 of the Town of Vail Municipal Code.
5) Chapter 18.71 is hereby amended to read as follows:
Chapter 18.71.050 Eligibility.
In addition to all other criteria set forth in this Chapter, any dwelling unit shall be
eligible for additional GRFA pursuant to this section that is in existence as of November 30, 1995

or a completed Design Review Board application for the original construction of a dwelling has been
accepted by the Community Development Department by IVovember 30, 1995.
6) Chapter 18.04 is hereby amended with the addition of the following definition at
18.04.065 as follows:
Demo/rebuild means the destruction, demolition, or removal of 50% or more of the
gross residential floor area of an existing dwelling unit or structure. The determination of the 50%
shall be calculated upon gross residential floor area as defined in Section 18.04.130.
7) If any section, paragraph, clause or provision of this ordinance shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph,
clause or provision shall not effect any of the remaining provisions of.this ordinance.
8) All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith
and with documents hereby approved, are hereby repealed to the extent only of such inconsistency.
This repealer shall not be construed to reviving any bylaw, order, resolution or ordinance, or part

9) This ordinance, as adopted by the Town Council, shall be numbered and recorded
by the Town Clerk in the official records of the Town. The adoption and publication shall be

Dear Vail Town Council Members:
I would like to commend you for your action on the 250 Ordinance.
I can live with the wording of the new ordinance in disallowing the
250 square feet to be added to demo/rebuilds.
My feeling all along has been that the 250 Ordinance serves a
purpose in allowing homeowners flexibility in Vail.
If a homesite will allow one to add the 250 square feet under
current site coverage guidelines, we should not end up with too
much density in our neighborhoods. It is when homeowners need
variances on site coverage to expand to the 250 square feet that
densities could become too great. There should be no automatic
variances given.
To me, it is not the 250 Ordinance which should come under
question, but the variance process.
Thank you for keeping the 250 Ordinance in place.

At the request of the Subway Restaurant, the West Vail Mall Corporation has applied for an
amendment to the existing sign program for the West Vail Mall. The current,program requires
signs to be white wall-mounted letters, with an allowance for the addition of a logo using
corporate colors to be not greater than 20 percent of the sign area. The UVest Vail Mall
Corporation has requested that corporate color may be used in 50 percent of the total sign area.
The proposed change is attached. -
On July 19, 1995, the Design Review Board, by a vote of 4-1 (Hans WoldricFi opposed), approved
an amendment to the 1lVest Vail Mall sign program, allowing the sign area for the Subway sign
to be 50 percent color and all remaining and future signs wrill continue to be restricted to 20
percent color.
After a discussion with the Community Development staff and the Town Attorney, the Town
Council called-up this item at the July 25, 1995 Council VVorksession. The concern has been
raised by the staff that an amendment to the sign program must be available to all stores within.
the VVest Vail Mall, not just for one business. If an amendment is to be made, it should be
applicable to all businesses within the mall.

A. Wall Mounted Sign
, 4) Design: subject to approval by the Landlord and the Design Review
Board. The standard wall mounted sign shall be individual pan channeled
letters with 4 1/2" to 7" returns. The returns shall be painted medium
bronze. Letters shall be illuminated by white neon tube. Plexiglass faces
shall be ivory or white with bronze trim cap edging with the eRe following
exceptions: a small corporate logo utilizing colored plexiflass may be
incorporated into the sign ' and the corparate
colors may be used within the text of the sign. The logo shall be no
bigger than 20°l0 of the total allowed sign area, and the corporate colors
cannot -be more than 50% of the sign text. Letters must accompany a
logo: a logo cannot be used alone. The logo will be counted along with the
letters in assessing the size of the -sign. . The letter style shall be.

At the ,4ugust 2, 1995 Design Review Board meeting, the Board approved, by a vote of 4-1 (Hans
1iVoldrich opposed), an addition to the Stevinson residence, locafed at-1498 Spring Hill Lane. The
adjacent property owner, iVeal Groff, located at 1468 Vail Valley Drive has appealed fhe decision
to approve this application. -
The proposed addition includes a one-car garage, expansion of the living room and an exterior
balcony and stair addition on the north side of the building, as well as an enclosure of a balcony
on the south side of the building. The garage addition is approximately 300 square feet and the
residential addition uses the additional 250 square feet of GRFA.
The attached documents include a letter from fVeal Groff appealing the decision, a site plan and
elevation drauvings of the proposed addition.

I am a summer visitor to Vail this year expecting to spend about two months in the area. I make
my full-time home in Pompano Beach, Florida and have visited a number of Colorado ski resort towns
in the last 5-6 years.
I have been very favorably impressed with the quality of municipal services Vail offers thus far
in my visit; of particular note has been your library & the people who work there. I have been
especially interested in your "Internet" connection offered free to library visitors.
The library staff, headed most ably by Ms. Susan Boyd, has been an unending source of help &
consolation as I pursue myself through learning the vagaries of using the Internet. Without exception,
the staff has been extremely cordial to my questions.
It was. mentioned that the city is seeking ways of raising revenues from its facilities. It would
seem to me that if the library were to provide a fee-based "office" for visiting businessmen offering
let's say a desk, phone & fax service people such as myself could stay longer with a part-time place to
conduct business affairs in quiet. Indeed, this could enhance tax collections from revenue services such
as meals and lodging.

Repaving Complete on Vail Pass Bike Path
U S WEST Communications' contractors have completed repaving areas damaged
during construction on the Vail Pass Bike Path. The bike path remained open during the
repaving effort which was fully completed the last week in July.
U S WEST crews repaved approximately 8 miles of ttie Vail Pass bike path. Repaving
was done on areas disturbed last year when a fiber optic cable was placed over Vail Pass along
the bike path. Areas damaged by construction work done in 1994 across the Vail Bike Path
were patched for the winter and permanently repaired this summer.
. During all phases of the construction on or near the bike path, U SWEST is
appreciative of all those who assisted in the timely completion of the construction and
repaving work, as well as, the patience of cyclists using the bike path.

Ladies and Gentlemen:
Eagle County, or maybe we should say the Eagle River and Gore Creek
corridors, really does need a reliable, on time system to transport
people. A measure to support such a system is going to be on the
ballot in November in the form of a one half per cent tax. This is
flawed from the very beginning because the powers that be have
decided that 10% of the money to be collected will be used for
bicycle paths.
You will recall that a similar proposal to the public was defeated
in the last election because the people here feel that they are
already taxed too much and they didn't see any reason to support a
mass transit system with public funds. Nobody had taken the time
to convince them. It would seem to me that in the name of all the
common sense that can be mustered that everything possible would be
done this time around to convince the voters that the transportation
system is absolutely necessary and to plead for their cooperation
and understanding.
The surest way to insure defeat is to include money for bike paths.
All the surveys aside, how many people who will vote are bike
riders and will use the paths?? Somebody hasn't been doing their
homework. Thousands of people live up these valleys and north of
here in the Colorado River communities who don't ride bikes and
never will, and who almost always turn up on election day. Does
anybody honestly think they are going to vote to tax themselves to
a greater.degree let alone support something they have no earthly
use for?? '
The future of a transportation system is larSely.unknown. Will
enou^h people ride the buses to pay for a significant amount of
the cost?? Will whatever system that is established meet the
needs of most of the people or will they just write it off as not
being convenient to their needs. We just don't know. Why not
work as hard as you can to get the tax issue passed to fund public
~ mass transit and if it works come back later and ask for money for
bike paths??
From what I've read and been told, the surveys that have been done
so far don't amount to anything. I was told that when the head of
the biker coalition was asked where his survey was done, he said
"at the International Bike Races". The other survey asked select-
ed people if putting the bike tax in would keep them from voting
for the issue. Do tourists that are to be lured here to ride on
bike paths vote in our elections?? Do they pay anything into the
county coffers to build or maintain bike paths?? The ratio of

those who don't ride the paths and the amount they will contribute
if the issue were to pass compared to those who ride and what they
will pay is very lopsided. In the face of these kinds of issues
the measure will never fly and then where are you??
Colorado didn't get the 1976 winter olympic games because the tax- payers didn't believe they were going to get their moneys worth.
The headline in the Vail Daily of July 22d says, "Ski Championship
Funding Meets Resistance." Money for anything all comes from the
same place: the people!! You had better be very sure of your
people before you ask them to pay taxes for anything. And for sure
something they aren't going to use or will not benefit them in
any way.

The Transportation Legislation Review Committee (TLRC) will be traveling
from Denver to the western slope to meet with the public and local
officials. Certain transportation operations and projects in progress or
scheduled will be inspected along the way..
The TLRC will hold a public hearing in Glenwood Springs on Thursday,
August 24th and will be available to discuss local issues and concerns.
The TLRC is currently charged with reviewing the driver's license point
system; developing a uniform traffic citation document and a simplified
'record-keeping system; and examining Colorado's compulsory motor vehicle
insurance system laws.
The Committee also has traditionally reviewed and acted upon requests for
legislative changes brought forward by the Departments of Transportation,
Revenue and Public Safety.
The hearing will be held at the Hotel Colorado, 526 Pine, in the Teddy
Roosevelt Room, beginning at 3:00 p.m. The session is scheduled to
adjourn at 5:00 p.m. In order to accommodate all participants, I am
asking that you limit your presentation to approximately ten minutes.
I encourage your attendance at this hearing. We look forward to meeting

We are the developers of "Pazksede Villas", seven single family homes located just south of the Hobbit
Hili duplexes at 1546 Matterhom Circle in West Vail. Curready, we are constructing thrae of the homes
which will have street access on Lower Matterhom Circle. We will however be proceeding with the
construction of the other four homes later this year.
We have worked closely with Terry Martinez, Town of Vail Engineer, during the past few months to '
coordinate the utility requirementc of our project with the Matterhorn street improvement efforts. In
meetings with Town officials during our planning process, we understood that the entire Matterhora
Circle was to be paved, including that stretch which is uphill from our site and adjacent to the Donovan
Park upper bench.
We were thus surprised to learn last week that indeed the upper part of Matterhorn Circle is not included
in the current scope of work. We would urge the you to reconsider the decision not to pave Upper
Matterhorn Circle. As the owners of a multimillion dollaz residential development projectand on behalf
of the future individual unit owners, we are requesting that Council authorize at a miaimum the paving
of Upper Matterhom to our upper entry driveway (represents approximately only an additional IZS lineal
ft. of paving).
This additional paving, along witfi those street improvements already begun and the completion of
Parkside Villas, will be a draznatic improvement aesthetically for the Matterhorn neighborhood. We look
forward to attending the August 15, 1995 meeting to further describe our perspective on this matter. I .

I represent the Fallridge Community Association. They have asked me to contact
you with regard to the pending discussions concerning the bus system schedule to the golf
course area which serves members of this Association.
The Fallridge Community Association consists of both the Fallridge Condominiums
and the neighboring townhomes. In total, there are approximately 150 members.
As I am sure you are aware, the residents in this area are extremely upset and
disappointed over the change in the bus service which was made last winter. In most cases,
the service was reduced to once an hour, compared to once every ten or fifteen minutes for
other areas serviced by the system. As a result of the reduced service, the buses were
. extremely overcrowded and often left passengers stranded at the bus stop. Because of this
extreme inconvenience, this resulted in a substantially reduced number of riders on the system.
The results of the reduced service, inconvenience, and reduced usage becomes
obvious. A system intended to assist in the Town's promotion of a clean environment has,
in fact, become counterproductive. A number of people serviced in this area are either
visitors or owners of a vacation residence. The distance from their units to the center of
town is too far to walk, particularly in the winter. This results either in substantial increase
in automobile traffic back and forth from the golf course to the center of town, or people
not coming into the business section. In either case, it is extremely harmful to the Town.
Increased traffic usage causes serious environmental problems, as well.as overcrowding in
the parking facilities. The alternative of not coming into the center of town reduces the
business traffic with the obvious adverse consequence to the Town's merchants.

When the service was reduced last year, it was explained that this was done to allow
expansion into new areas. While we are sympathetic with the desire, and advantages, of
such expansion, it makes no sense if this is at the expense of a successful system to the areas
already serviced.
We urge you to give proper consideration to the users in the golf course area. \1Ve
believe that the facts well support a substantial increase in service (which existed prior to
the 1994/1995 winter reduction). VE/e urgently request that service be restored to a level at least with the frequency of the service provided to east Vail, and suggest that the historical
use would even suggest an increase in such service.

The Colorado Supreme Court has recently made its decision in Nicho/l v. E-470 Public
Highway Authority. This decision may impact how The Town of Vail calculates its TABOR compliance.
The decision provides useful insight into how local governments determine "fiscal year spending" and
the requirements to qualify as an "enterprise" under TABOR. Section 2(d) of the TABOR Amendment
defines an enterprise to be:
"a government-owned business authorized to issue its own revenue bonds and receiving under
10% of its annual revenue in grants from all Colorado state and local governments combined."
The Court held that any entity which has its own ability to tax cannot be considered a true
business, and therefore not an enterprise. This interpretation may have significant implications for all
local governments which are currently excluding a portion of their operations from TABOR as
"enterprises". Local governments which currently have "enterprises" as defined by TABOR may need
to pass a resolution limiting their "enterprise's" ability to tax. A municipality with a water fund, for
example, may want to pass a resolution explicitly excluding the water fund's ability to tax. The
decision appears to have even stronger implications for single purpose districts who have been
excluding their entire operations based upon the "enterprise" theory. Single purpose districts may be
required to create multiple funds and restrict their taxing authority to "non-enterprise" funds. Ail locai
governments who are currently excluding "enterprises" from their TABOR calculation should consult
their attorneys concerning this recent court decision.

. an evening meeting next week for those interested in having input in the process. The
meeting is scheduled for 1:30 p.ma Aug. 15 in the Vail Town Council Chambers. The
plan, submitted by 1lVarner Developments Inc., Victor Niark Donaldson Architects and
City Market provides for construction of a day care or possible community center, along
vuith affordable residential units and a supermarket component. The 6.6-acre West Vail
property was purchased by the town for $3.2 million in 1993.
Vail Town Nianager Bob McLaurin says the town is interested in hearing feedback on
the day care versus community center topic. The discussion will also include space
and logistical requirements, plus a determination as to who might operate such a
facility. "There are numerous public benefits for each of the two proposals," McLaurin
said. "Public feedback on this issue will assist in evaluation of the community's needs
and interests."

Re: Employee Housing Requirement for Conditional Use Permit
in General Use District
I have been asked to review our General Use District zoning requirements and Conditional Use
Permits to determine whether it is appropriate to require affordable housing to be provided as a
condition of approval.
The only mention of housing in the General Use District chapter is that Type III and IV EHU's are
conditional uses in that district. The purpose of the General Use District is to provide sites for public
and quasi-public uses. Any such development standards provided for each particular development
must meet the general purposes set forth in the zoning title. Therefore, while the providing of
affordable housing is an appropriate goal and objective of the Town, it is not appropriate to require
employee housing on every application in the General Use District.
It may be appropriate pursuant to an application for Conditional Use Permit to require the providing
of affordable housing when appropriate. The application of immediate concern is for a
Conditional Use Permit to allow for a remodel to the Vail Golf Course Maintenance Facility. The
remodel is necessary for improvements to the existing building and landscaping, to improve the
aesthetic appearance of the facility, to better protect and maintain heavy equipment/vehicles, and
to reduce environmental risk. There is no indication in the application that employee housing needs
will be increased by this improvement to the maintenance facility. Before any applicant can be
required to provide housing, either on-site or off-site, it is appropriate that the development create
a need to which the amount of housing required bears some rough proportional relationship. There
does not appear to be any reasonable connection between upgrading of the maintenance facility
and housing.

A Conditional Use Permit is subject to such conditions and limitations as the Town may prescribe
to ensure that the location and operation of the conditional uses will be in accordance with
development objectives of the Town and will not be detrimental to other uses or properties. This
is not a specific requirement to off-set deviations from the zoning requirement as are found in the
Special Development District. There is no reference under the factors to be considered for a
Conditional Use Permit to housing. The factors to be considered are the effect the development will
have on the use of light and air, distribution of population, transportation facility, utilities, schools,
parks and recreation facilities, and other public facilities and public facilities' needs. These factors
to be considered do not specifically refer to housing.
It is also appropriate to evaluate any application for a conditional use and to require housing when
there is a reasonable connection. For example, the development of a fire station which may
increase the number of student fire fighters brought into the community, might be a reasonable
connection for the requirement of providing housing. Likewise, a hospital facility in a General Use
District that is requesting to increase the size of the facility to provide a student nursing program
could reasonably be expected to have additional housing as a condition of approval. An additional
need does not seem to be created by the improvements to the maintenance facility.
There has been some comparison of the Special Development District to the General Use District.
I do not believe that there is similarity between tiie two sections that enable the Planning &
Environmental Commission and Town Council to handle them in the same fashion. Under the
Special Development District it is stated within its purpose "to further the overall goals of the
community as stated in the Vail Comprehensive Plan." Also under the procedures, the Commission
and Council will examine the relationship of the plan to the applicable elements of the Town of Vail
Master Plan. Under the SDD since there is the possibility of approval of development standards that
deviate from the underlying zoning, it should be determined that the deviation provides benefits that
outweigh its adverse effects. Keeping those requirements in mind, it is appropriate to exact housing
under certain circumstances for a Special Development District.
It is appropriate for Community Development staff to point out to any applicant the appropriateness
of housing in connection with the application. A negotiated development agreement is an effective
tool for increasing the stock of necessary housing in the community.
I believe that under certain applications for Conditional Use Permit within a General Use District will
provide an opportunity under certain circumstances to require housing, it is not true in every
instance.

Dear Mayor Osterfoss;
I am using a letter to minimize intrusion on your time. Hopefully
you will find a few convenient minutes to consider my ideas. I
believe positive action will produce significant benefits for the
citizens of Vailo
The Basic Premisee
Zoning ordinances are in place for the justifiable purpose of
maintaining a desirable community appearance.
The Problemo
Vail's present regulations (GRFA restrictions) allow for dwellings
that conform to ordinance yet have internal space that is deemed
unusable! This is illogical and unfair. Internal space, whether
vacuum or bedroom, has no effect on community appearance, and
therefore no bearing on meeting the goals of the Basic Premiseo
GRFA restrictions lead to many problems, especially invasion of
liberty and rights of individualse There are apparently many homes in
Vail with "illegal" interior space. It is wrong to label something
illegal if the rule that makes it so is inappropriateo
Additional ramifications include significant problems for Town
Planners who end up wasting time enforcing poor regulations. Also,
this is one thing that encourages out migration from Vaile
A Solution:
Deep six the GRFA regulations. They are cumbersome and unneces:aary.
Simplified regulations based on footprint, setback and height are
sufficient to meet the basic premise. This change should be made
without delaye
Every person I have spoken with concurs with this view.
Lastly, it seems to me that the "250" rule is a separate issue,, and
should apply only to external modifications.
I would like to hear your thoughts and plan to attend the Council
meeting August 150
