BACKGROUND RATIONALE: In December 1995, The Vail Town Council approved, an 2nd reading, Ordinance No. 24, Series of ~ 995, repeating and reenacting Chapter ~ 8.39 (Ski Base/Recreation Zone District) of the Vail Municipal Cade and approving the Deveiopmen# Plan for the ski base. During the discussion of the project, Vail Associates representatives expressed concern that if #here were not sufficient pre-sales of the spaces in the proposed structure, the entire project may be delayed or canceled. The Town Council members requested that V.A. keep them updated regarding the progress of the parking spaces pre-sales. 2:35 P.M. 3. A request by Eas# West Hospitality, developer of the Covered Mike Mol{ica Bridge Building, to proceed through the planning process to allow Peter Dann far the expansion of a private brick paver walkway onto Town of Vail Land. Location: Southwest comer of the Covered Bridge pocket park in Vail Village. ACTION REQUESTED OF COUNCIL: Approve/deny the applicant's request to proceed through the planning process. If approved, the applicant would be authorized to proceed to the Design Review Board, to obtain design approval fora "mini-plaza" adjacent to the residential condominium entrance, located at the northwest corner of the Covered Bridge Building, (see attached site plan). BACKGROUND RATIONALE: The proposed "mini-plaza" would encroach approximately 5' onto Town owned property. This property is one of the Town open-space parcels, and is currently zoned Outdoor Recreation District. Although staff does not believe that the "mini-plaza" would nega#ively impact the Covered Bridge pocket park, staff believes that the use would be inconsistent with the purpose section of the Outdoor Recreation Zone District. Section 18.33.010-Purpose states: "The Outdoor Recreation District is intended to preserve undeveloped or open-space lands from intensive development while permitting outdoor recreational activities that provide opportunities far active and passive recreation areas, facilities and llse5." 4;20 P,M. 4 4:30 P.M. 5. 4:40 P.M. 6. STAFF RECOMMENDATION: The staff recommendation is for denial of the applicant's request to proceed through the planning process. The staff does not believe that the request for amini-plaza, dedicated- solely to private residential use, would be consistent with the purpose section of the Outdoor Recreation Zone District. Site Visit re: an appeal to the Town Council, pursuant to Section George Ruther 1$.54.090 of the Municipal Cade, of the Design Review Board decision to deny the Oleson/Volinn duplex separation request for a proposed residence to be constructed an Lot 11, Resubdivision of Lot 7, Block 1, Vail Village 12th Filing13275 Katsos Ranch Road. ACTION REQUESTED OF COUNCIL: Visit site. BACKGROUND RATIONALE: On December 20, 1995, the applicant met with the Design Review Board to request a determination of significant site constraints and the opportunity to separate the duplex struc#ure proposed for Lot 11, Block 1, Vail Village 12th i=icing in accordance with Section 18.54.050(1) of the Municipal Code (see attachment 1 }. Upon review by the DRB, a motion was made to deny the applicant's request since the DRB could not find evidence of significant site constraints. The motion passed unanimously (4-0). A letter from the applicant dated December 29, 1995, appealing the DRB decision, has been attached (see attachment 2). In the applicant's letter, he refers to tike intent of the Design Review Guidelines {Section 18.54.010) as a possible basis for overturning the DRB decision. A copy of Section 18.54.010 from the Municipal Code has bee attached for reference (see attachment 3). STAFF RECOMMENDATION: Upon review of the applicant's separation request, staff recommends that the Town Council uphold the DRB decision of December 24, 1995, of denial. In staff's opinion, the applicant has not demonstrated the existence of significant site constraints on the lot as required in Section 18.54.050(1} of the Municipal Code. 5:20 P.M. 8. An appeal of the Planning and Environmental Commission's (PEC) denial Randy Stouder of a request for a height variance to allow for a residence, currently under construction, to exceed the 33-foot height limitation for residential structures. The project is located at 1339 Westhaven Circle/Lot 23, Gien Lyon Subdivision (SDD #4). Applicant: Biif Anderson representing Mr. and Mrs. Hovey. ACT10N REQUESTED OF COUNCIL: Visit site. BACKGROUND RATIONALE: The application is in the process of constructing a residence on Lot 23, Glen Lyon Subdivision. The Improvement Location Certificate (ILC} submitted by the applicant indicates that sections of #hree separate roof ridges were constructed at heights exceeding the 33-foot height res#riction for residential structures. The ridges in question are labeled A, B and C, starting at the lowest of the ridges and going up to the highest. See the attached site plan and elevation drawings. According to the interpolated existing grades provided by Intermountain Engineering (based on the original topographic survey), and the ridge height figures provided by Eagle Valley Surveying {ILG), ridges A, B, and C were constructed a maximum of 8.4 inches above the 33-foot height limitation. The applicant requested that the PEC grant a height variance to retain the roof ridges at the existing, constructed heigh#s. The PEC unanimously denied the requested height variance by a vote of 4-0. They made the finding that granted the requested height variance would be a grant of special privilege to the applicant. STAFF RE=COMMENDATION: Staff is recommending denial of the applicant's request to overturn the PEC decision. 5:50 P.M. 8. Adjournment. This is an Loren Kroenke Informational update. BACKGROUND RATIONALE: Category III is a proposed expansion ofi Vail Mountain in the two elk drainage. The proposed action involves expanding the ski area by approximately 1000 acres. The USFS is currently reviewing this action and has prepared a draft Environmental Impact Statement (EIS). The Category III EIS is intended to identify and analyze the environmental consequences of this proposed action and alternative actions so that an informed decision can be made by the Forest Supervisor. A critical component of this action is the Town of VaillVail Associates Agreement to manage peak periods. This program involves a task force made up of representatives from the Town of Vail, Vail Associates, and the community. This task force will implement programs to manage skier days in a way that reduces pressure on Town infrastructure during peak skier days and increases skier numbers during traditionally slow times of the season. Applicant's representative: Eric Johnson. ACTION REQUESTED OF COUNCIL: Visit site. BACKGROUND RATIONALE: On January 8, 1996, the applicant's representative met with the Planning and Environmental Commission requesting a driveway grade variance for a residence under construction at 795 Potato Patch Drive, in accordance with Chapter 18.62, Variances, of the Municipal Code {see attachment 1 }. Upon review of the requested variance, a motion was made to deny the applicant's request since the PEC could not make the findings necessary to grant approval of a variance (see attachment 2). The motion passed unanimously (4-0}. A letter from the applicant's representative dated January 17, 1996, appealing the PEC decision, has been attached {attachment 3). In the applicant's letter, he refers to Section 17.28.030, Design Criteria, as being the section of the Municipal Code from which he seeks relief. Specifically, the applicant is seeking relief from the maximum grade for heated driveways (12%). In this appeal, the applicant wishes to be permitted a heated driveway with a finished grade of 14.1 %. A copy of the memorandum prepared by staff to the Planning and Environmental Commission on January 8, 1996, has been attached for reference {see attachment 4). STAFF RECOMMENDATION: The Community Development Department staff recommends that the Town Council uphold the decision of the Planning and Environmental Commission to deny the Koenig driveway grade variance request. 2:25 P.M. 3. The Vail Recreation District is requesting approval from the Vail Town George Ruttier Council to proceed through the planning process. If approved by the Mike Ortiz, VRD Council, the Vail Recreation District will proceed with a Conditional Use Permit to allow for the construction of four new sand volleyball courts on the east end of the existing soccer field, south of Vail Valley Drive {See attachment). ACTION REQUESTED OF COUNCIL: Approve, approve with conditions, or deny the request by the Vail Recreation District to proceed through the planning process. BACKGROUND RATIONALE: The Vail Recreation District is proposing to construct four new sand volleyball courts on the east end of the existing soccer field in Ford Park. Since the Vail Recreation District leases this area of the park from the Town of Vail, it is a rec{uirement of the Conditional Use Permit application that the owner of the property approve the proposed request. At this time, it is not necessary for the Town Council to review the details of the applicant's Conditional User Permit proposal. The Conditional Use Permit public hearing will take place at the Planning and Environmental Commission meeting held on Monday, February 26, 1996. Once the Planning and Environmental Commission has reviewed and taken action on the Conditional User Permit request, the Town Council will be informed of the decision. BACKGROUND RATIONAL: The Eagle Mine, located south of Mintum was declared as a Superfund site in 1988. impacts from the mine includes: high heavy metal concentrations in water quality, near elimination offish populations within 3-4 miles downstream of the mine, and posed a threat to drinking water. The Eagle River Environmental Business Alliance (EREBA) was established to help monitor the clean-up of the mine. The Vail Town Council has provided letters of support for EREBA in the past to help move the clean=up forward. Town of Vail staff have participa#ed in EREBA meetings, site visits, and press releases and the annual fish monitoring project. Since the clean-up has begun water quality has improved and trout are now found in the Eagle River downstream of the mine. BACKGROUND RATIONALE: This is the only Council-appointed board currently not receiving any type compensation benefit. Previous discussion with Council centered around equity and how to treat boards of "mixed regional appointments." The issue is four of the seven board members are appointed by Council, with the remaining three supplied by other contributors to the WMB. It is Staff's recommendation that the four TOV-appointed members be eligible for either the blue parking pass or the summer recreation package, which benefits coincide with compensation for other Council-appointed boards. Clarification Re: Housing Authority Compensation: Since the Housing Authority is es#ablished pursuant to 29-4-201, et seq., it is a matter of state wide concern and therefore disallows certain types of compensation. What is allowed is our ability to assume responsibility for their "expenses," therefore making a blue pass appropriate as an advance on their expenses. In the past, the choice of a summer recreational pass or blue parking pass has been offered. This change in benefit will be communicated to those board members. BACKGROUND RATIONALE: The 208 plan is a required plan for coordinated regional water quality management under Section 208 of the Federal Clean Water Act. There are two volumes of the 208 plan. Volume 1 identifies six broad policies for water quality management. Volume 2 contains specific watershed plans. One of these Watershed plans is for the Eagle River Watershed which includes Gore Creek. This plan addresses specific actions to protect and improve water quality in the Eagle River and Gore Creek. Issues and recommendations in the plan address point sources of pollution, nonpoint sources, and stream flow. The recommendations in this Plan can be used to modify state water quality standards and to provide direction for local water resource management. 2:45 P.M. 3. Review of Berry Creek 5th Sketch Plan and Future Planning Process. Peter Jamar Associates ACTION REQUESTED OF COUNCIL: provide direction to Peter Jamar Associates and TOV representatives to the Eagle County Recreation Authority as to TOV position on potential uses on the property. BACKGROUND RATIONALE: A previously approved sketch plan will expire in June. The planning process which has not gone forward since sketch plan approval is being resumed. The potential use of the property has been impacted by the development taking place on the Miller Ranch property by the Eagle County School District. 3:30 P.M. 4. Amplified Sound Update Tom Moorhead ACTION REQUESTED OF COUNCIL: Motion by Council directing staff to resume issuing amplified sound permits for 1996. BACKGROUND RATIONALE: in December of 1994 the Town Council suspended the renewal of amplified sound permits for 1995 pending the examination of the Town's amplified sound ordinance and enforcement ofi the ordinance. STAFF RECOMMENDATION: Authorize renewal of amplified sound permits and new applications. Staff will evaluate the amplification and will continue rigid enforcement. Sound permit will provide for loss of the permit in the event of amplified sound violations. 4:00 P.M. 5. A request to present an alternative to the Vail Town Council for the third George Ruther employee housing unit required under the Cornice Building Special Development District, Ordinance No. 7, Series of 1994. The request is to establish the third employee housing unit in an existing primarylsecondary residence located at 2635-B Larkspur Lane (Intermountain). ACTION REQUESTED OF COUNCIL: Approve, approve with conditions, or deny the proposed location of the third required employee housing unit for the Cornice Building Special Development District. BACKGROUND RATIONALE: On April 5, 1994, the Vail Town Council approved Ordinance No. 7, Series of 1994, the establishment of Special Development District No. 32, the Cornice Building. Approval of Special Development District No. 32 required that the property owner provide three, deed restricted employee housing units. Section 6 of Ordinance No. 7, requires that the Town Council review and approve the proposed location of each employee housing unit. The applicant is back before the Council requesting approval of the proposed location for the third, and final required employee housing unit. STAFF RECOMMENDATION: Upon review of the request to allow the secondary unit at 2635-B Larkspur Lane to be deed restricted as an employee housing unit, to satisfy the third and final employee unit for the Cornice Building, the Community Development Department recommends approval of the reques#. In Staff's opinion, the proposal meets the criteria listed in Section 6 of Ordinance No. 7, Series of 1994, for the employee housing units for the Cornice Building SDD. 4:20 P.M. 6. ACTION REQUESTED OF COUNCIL; ApprovelDenylModify Ordinance No.13, Series of 1996, on first reading. BACKGROUND RATIONALE: Over the years, the Sign Code has been amended and zoning districts have been added to the Zoning Code, which have not been reflected in the Sign Code. This has created some inconsistencies within the Sign Code. In order to correct these inconsistencies and create a Sign Code which is easier to read and understand, staff is proposing to reorganize the code. The amendments and reorganization are accomplished with minor changes to the substance of specific sign regulations or definitions. The proposed changes include: Addition of zoning districts not currently reflected in the Sign Code by the creation of a table which shows all of the zoning districts and which signs are allowed in each district. 2. Changes were made to specific sign categories, in order to be consistent with recent changes to the Sign Cade that were approved by Town Council on April 2, 1996. The changes include revising language that required Design Review Board approval for signs over 5 sq. ft. in size, in order to allow staff approval. 3. Amendment of the regulations far Temporary Site Development Signs to allow #ar a development sign on all residential properties under construction. This was proposed based on a request by Bill Anderson and on the fact that the way the regulations currently read, a single family or two-family house in an SDD is allowed a sign, but houses in other zones are nat. Staff believes the policy should treat like uses the same no matter what district they are Iota#ed in. A fetter from Bill Anderson regarding site development signs is included in the packet. The proposed temporary site development sign would be limited to 6 sq.ft. in size and the information on the sign would be limited to the project name, project address, the display of permits, and a site depictianlrendering. The Planning and Environmental Commission reviewed the proposal on May 20, 1996 and recommended approval (unanimously). The PEC amended the regulations for a Temporary Site Development Sign to allow a site depiction or rendering. There was discussion among the members of the PEC about the information allowed on a commercial sign of this nature. The proposal leaves intact the ability of commercial or multiple family developments to display the names of real estate agents, contractors, architects, and developers in addition to that information allowed on a sign for a single family, two_family, orthree-family development. A copy of the proposed changes are attached. Items that are stricken are being removed from the ordinance and text that is shaded indicates new text being added or zoning districts being added that are not presently part of the code. ACTION REQUESTED OF COUNCIL: Review and discuss Ordinance No.14, Series of 1996. BACKGROUND RATIONALE: The applicant is requesting a Zoning Code amendment to modify the definition and the conditional use criteria for a brew pub. See the attached PEC memo for more details. The Planning and Environmental Commission reviewed the proposal on June 10, 1996 and recommended approval of the amendment (unanimously). There was discussion of possible impacts due to odor and loading and delivery demands. The applicant stated that because the brewing will still occur during the same hours, the odor impacts will remain the same at the Hubcap. The applicant stated that owner of the Crossroads commercial property will be requiring an odor filtration system prior to any major expansion in brewing operations. The applicant also stated that the loading and delivery demands will be reduced due to the fact that the distributor will require fewer trips to pick up beer. If the Hubcap is able to produce more quantity of beer, they can more fully load a truck and therefore not require additional visits. These concerns are valid for such an operation, however, the conditional use permitting process will allow the PEC to evaluate the impacts at specific locations in Vail. The conditional use permit for the Hubcap is subject to numerous conditions to ensure compatibility with other uses in the zone district. Presently, the CSC zone district is the only district which allows a brew pub. 2:40 P.M. 4. Review list of properties recommended by the Open Space Board of Russell Forrest Trustees far designation as open space as per Ordinance 13, Series of 1995. ACTION REQUESTED OF COUNCIL: Determine if the list is acceptable to the Town Council. BACKGROUND RATIONALE: The purpose of this work session is to review the properties the Open Space Board of Trustees approved for placing in a designated open space status as per Ordinance 13, Series of 1995. This Charter Amendment was approved by the Vail Voters with approximately 90% voting in favor of the amendment. The Open Space Board of Trustees met on June 13th and 17th to develop and decide on a list of properties for designation. The Committee unanimously agreed to the properties identified in attachment A of the letter from the Board to the Town Council. If the Town Council agrees to the list the Board has prepared, the next step would be to complete the necessary survey work for the Cozies property and then create an ordinance designating these properties as open space. Mr. Charlie Stone, the shop owner, would like to remove the center section to provide for direct pedestrian access to the store entrance. Mr. Stone believes his proposa[ will increase access and visibility #o Charlie's Shirts. STAFF RECOMMENDATION: S#aff recommends denial of the request to proceed through the development review process. The rationale for denial is based on the following: • The installation of stairs, in the area where the planter is proposed to be removed, will increase the maintenance responsibility and liability for the Town. • The proposal will result in a lose of snow storage in Lionshead Mall. According to Public Works, snow storage space is already at a premium in the Mall. • The proposed gap in the middle of the planter would reduce the already minimum amount of landscaping in Lionshead Mall and effectiveness o the planter. • Impacts of construction could extend into the Mall due to potential changes in the existing irrigation system located within the planter. • No advantage or benefits are provided to the community at large by the proposal. 2:5D P.M. 3. BACKGROUND RATIONALE: In May of 1996, the Town and Warner Development learned of standards for accessibility required by the Fair Housing Act, which exceed the standards of ADA. Vail Commons was one of many developments in the Valley which have been recently modified to comply with the Act. Priar to presenting the changes to DRB, the staff and architect met with the neighbors in Buffehr Creek Park to discuss the proposal. The neighbors' comments were related to the DRB at its July 17, 1996 meeting. In addition, two neighbors and a representative of a third neighbor appeared at the DRB meeting. Based on this analysis staff believes that brew pubs should be listed as a conditional use in all of the commercial.zone districts including: Commercial Core 1 (CC1), Commercial Core 2 {CC2}, Commercial Core 3 (CC3) (West Vail commercial area}, Commercial Service Center (CSC) and Arterial Business (ABD} (Glen Lyon commercial area} zone districts. Tom Moorhead ACTION REQUESTED OF COUNCIL: Motion by Council to allow amplified sound permits to remain effective for a period of six months. BACKGROUND RATIONALE: In December of 1994 the Town Council suspended the renewal of amplified sound permits but permitted the previously issued permits to remain effective for 1995 pending the examination of the Town's Amplified Sound Ordinance and enforcement of that ordinance. On April 9, 1996, the Town Council voted 6-1 to permit the Town's amplified sound permits to remain in effect for six months and continue discussion as to whether amplified sound permits should remain or be discontinued in the future. While there have been citations issued far violation of the sound ordinance which are presently pending in the Municipal Court, there has been continued discussion between amplified sound permit holders, merchants, and residents of the Village concerning effective use of amplified sound and other noise issues that will not interfere with the general ambiance that is required in the Village. On July 24, 1996, there was a meeting conducted by Jim Lamont as Executive Director of the East Village Homeowners Association that was well attended and provided a very effective exchange of ideas. A copy of the agenda from that meeting is attached. Tom Moorhead, Town Attorney and Greg Morrison, Chief of Police, attended on behalf of the Town. On September 26, 1996, a meeting was held concerning the present status and interaction of the different entities which was attended by representatives of Pepi's, the Red Lion, the East Village Homeowners Association and Town administrative staff. All affected entities continue to exhibit willingness to cooperate and coexist in a more pleasant sound environment. STAFF RECOMMENDATION: Authorize continuation of presently issued amplified sound permits. Staff will continue to evaluate the amplification issues, continued rigid enforcement and facilitate discussion between affected entities. 3:45 P.M. 5. Local businesses should contribute, as well as government. The Town of Vail is but one "business" in this community. Even though the Village Merchants Association has established dues of $2001year recen#ly to commence January 1997, local businesses should still sponsor and support this important star# up activity. 2. The Council could contributed up to $2,000 from Council contingency, based on these factors: A. 204 FTE x $10/pp admission = $2,000. B. Ordinance No. 18, Series of 9996, implements the revisions to this SDD. The fo{lowing is a summary of the request. The proposal adds 1free-market unit to Building #5 for a total of 2 free-market units and 2 EHUs. The proposal adds an additional story to Building #5 far a total of 4 stories, one.of which is substantially I?ebw grade. The additional story was added upon the PEC recommendation that the applicant provide athree-bedroom EHU (1,300 sq. ft.} in the building instead of the 600 sq. ft. one-bedroom EHU originally proposed. The PEC also recommended that 2 enclosed. parking spaces be provided. The building is now 46' in height from existing grade (in the worst case scenario} and approximately 35' in height above the Lions Ridge Loop elevation. Building #5 is located in the same area as previously approved and adds about 126 sq. ft. of site coverage. Seven (7} of these conditions were conditions placed by Council on the 1995 development plan. Three (3) of the conditions have been satisfied by the applicant since the PEC review.
