AgreementwhichwasenteredintoinJanuary,1995, requires acomplete
build-outthesystem with fiber optic cable becompleted by January,
1998.Thiswill not be accomplished. At the time of entering into the
FranchiseAgreement,TCIexpectedbeentering into the providing of
telephony services onalarge scale business wide. We understand that
this business approach has been abandoned.Wehave been informed
that this one of the circumstancesthatleadstothepresent failure to
completely rebuild thesystemwithfiber optic atthis time.
OnOctober7,1997,FredofTCI made a presentationtheTown
Councilinwhichhe outlined thepresent status ofthesystem.
The Town ofVailhasengagedtheservicesofevaluatetheTown
to
ofVail system and tomake appropriate recommendations ashowthe
to
Towncanreceivethebest system and service available under the
present circumstances. This will provide information that will hopefully
assist Town Council making ultimate decisions astowhataction
shouldbetaken on the Franchise Agreement inlightofinabilityto
fulfill its earlier agreement.
ChipWhite and Rickwillprovideinformationastotheir
background which qualifies themevaluatethe present systemand
to
makerecommendations. They willalsoprovide the results oftheir
findings concerning the status of the present system and substantive
recommendationsin the Town'sefforttomove forward with TCI.

BACKGROUNDRATIONALE:The Municipal Codeofthe Town of Vail
was originally published byLook Publishing Company in1977and has
beenkept current byregular supplementation. Over that period oftime
therearemanyprovisionswithin the Codethatnolongerwhere current in
regardcurrent department personnel and practicesofa
substantive nature. wasalsodeterminedthat the formatof the Code
couldbeimproved through a recodification with an emphasison being
moreuser friendly.
Thiseffortwasundertakenunderthe direction of the TownAttorney's and
TownClerksoffices. Each Town ofVail department has reviewed in
totalitythose code sectionsthat fall most commonlyunder their
jurisdiction.
Becausethis recodification process there has been developed amuch
improvedindexwithappropriate cross-referenceswhich were inadequate
previously. Also references individualdepartments and staff members
to
bytitlehave been clarified where necessary. We haveinmost instances
removed schedules offeeswhicharereviewedon an annual basis bythe
Town Council thatwillnotbenecessarysupplementthe Code as
frequentlyaswe had inthepast.Currentlists of feeswillbekept on file
intheofficeofthe Town Clerk and the departmentwhich administers
those fee schedules.
The recodification process is notintendedmakesubstantivechanges
to
the Municipal Code.
