(1:30) Greg Hall Mike Rose ACTION REQUESTED OF COUNCIL: Participate with the merchants and amongst each other and the consultant in the parking discussions regarding broad policies on next year, short term, summer and long range parking management strategies. BACKGROUND RATIONALE: The Town of Vail has undertaken a revision of the Master Transportation Plan with regards to parking. The last major overall discussion with regards to parking policies and objectives were almost ten years ago. Since that time various changes have taken place to both management polices and the operating environment. In the context of the Town of Vail's vision of becoming "the premier resort community", what actions need to take place to achieve this status and what improvements long term are necessary to sustain it? What is a prernier experience in rognrds to our ghosts with regards to parking? What part of the overall experience does parking play? We have enclosed a questionnaire to assist you to prepare for the discussions with the representatives of the two villages. We have also had discussions with representatives of the resort company to get their perspective. STAFF RECOMMENDATION: Listen to the merchants, participate in discussions, determine what additional information is needed to continue the discussions. 3. 1-lie purpose of this worksession is to discuss the pros/cons George Ruther of reducing the number of members on the Planning & Environmental Commission from seven members to five. (10 ruins.) ACTION REQUESTED OF COUNCIL: Listen to a brief staff presentation and provide direction to staff on how to proceed. BACKGROUND RATIONALE: On August 1, 2000, the Vail Town Council considered Ordinance No. 17, Series of 2000, on first reading. During the Council's discussion on the ordinance Diana Donovan suggested having additional discussion on the possibility of reducing the number of members on the Commission from seven members to five. The timing of the discussion was to happen prior to second of Ordinance No. 17. Second reading of Ordinance No. 17 is scheduled for Tuesday, August 15th . RECOMMENDATION: Staff recommends maintaining seven members on the Commission. Please refer to the staff memorandum dated August 8, 2000, for further information. 4. Discussion of Third Sheet of Ice. (15 mins.) Bob McLaurin ACTION REQUESTED OF COUNCIL: Discuss the location and cost of the temporary ice sheet. Recommendation: None at this time 5. Discussion of Pro's/Con's of the RETT Election Tom Moorhead (30 mins.) BACKGROUND RATIONAL: Council has had general discussions regarding the possibility of placing a question on the upcoming Coordinated General Election ballot in regard to the use of the Real Estate Transfer Tax Funds. To aid in that discussion, three ineinos have been attached. "I lie first is entitled the Evolution of RF_TT; the second, Progression of RFTT ordinances; and finally, a memo from Tom Moorhead to Bob McLaurin, Steve Thompson and Pam Brandmeyer, considering the scheduling of a RETT election question. If Vail is to achieve the status of our Vision To Be the of Premier Resort Community and if you consider current obstacles blocking us from getting there are resolved (perfect world). Describe a premier customer/guest experience from the business as well as the customer point of view What is the demographic mix of customer visits How does this change from time of season o What are the total number of guests for the season What is the growth rate of guest visits II. What is the premier experience of customers using public parking during their visit? o Availability both in regards to time and location Convenience with regards to their ultimate destination and ease of use o Cost Appearance Safety III. To what degree does public parking relate to the various demographic users with regards to achieving primer resort status. Memorandum To: Vail Town Council From: George Ruther, Chief of Planning Russell Forrest, Director of Community Development Date: August 8, 2000 Re: Reducing the number of members on the Planning & Environmental Commission The purpose of this memorandum is to provide the Town Council with background information and the possible pros/cons of reducing the number of members on the Planning & Environmental Commission. Backeround Information According to the Vail Town Code there shall be seven members on the Town of Vail Planning & Environmental Commission. The Vail Town Council appoints the Commission members. The Commissioners serve two-year terms. The following individuals currently serve on the Commission: Galen Aasland, Chairmen, Open Space Committee (Architect) third term John Scofield, (Airline Pilot) third term Diane Golden, AIPP Rep. (Homemaker) third term Tom Weber (Architect) second term Brian Doyon (Landscape Architect) second term Doug Cahill (Mountain Planner) first term Chas Bernhardt (Contractor) first term Pros/Cons On August 1, 2000, at the request of the Planning & Environmental Commission, the staff presented Ordinance No. 17, Series of 2000, an ordinance removing the requirement for PEC representation on the Town of Vail Design Review Board on first reading to the Vail Town Council. The proposed ordinance was approved 6-1 (Donovan opposed) on first reading. During discussions on the proposed ordinance Councilwoman Donovan requested that staff prepare a memorandum outlining the pros/cons of reducing the number of PEC members from seven members down to five prior to second reading. Second reading is currently scheduled for Tuesday evening, August 15, 2000. The following is a list of possible pros/cons for having seven members on the Commission verses five: Pros: o More members allows for greater diversity o More members to share in the responsibilities to other boards and committees (DRB, AIPP, Open Space, etc.) C Less annual turnover which creates greater consistency Cons: o Does not address the issue of time commitment and redundancy of roles More positions to fill each year o Greater cost to the Town (volunteer benefits, meals, etc.) Staff Recommendation Staff recommends that number of members on the Planning & Environmental Commission remains at seven. We believe the current make-up and configuration of the Commission is appropriate and provides the necessary diversity and consistency. We also recognize that seven seats are more difficult to fill than five. I will be ready to present information to Council orally at Tuesday's work session. RECYCLEDPAPER The Evolution of RETT Creation of the Real Estate Transfer Tax (RETT) in 1980 is considered to be among Vail's greatest treasure and the envy of other communities which are now prohibited by state law from enacting such a tax. In Vail, RETT generates approximately $2 million per year. Town officials estimate a $9 million surplus in the fund within the next 10 years. RETT Milestones February 1978 Council voted unanimously to place a Real Estate Transfer Tax for the purposes of "real property, open space, recreational parks or employee housing" on the April 1978 Town of Vail ballot. April 1978 Vail voters rejected the proposed 1 % Real Estate Transfer Tax. The vote was 69 to 101. July 1979 Rather than return the issue to a public vote, the Town Council voted 6-1 to establish a 1 % Real Estate Transfer Tax with a slight modification in use. Proceeds would go towards the "purchase of real property, open space and recreational or park purposes," but not employee housing. December 1980 Although collections hadn't yet begun, the 1979 RETT ordinance was amended by Council to clarify that each person or persons involved in the transfer are jointly responsible for payment. It also explained the full meaning of transfer, real property, how the public is charged and reemphasized who is exempt and who must pay. December 1980 After more than two years of discussion, the Town Council enacted the 1 % Real Estate Transfer Tax with collections beginning Dec. 16, 1980. September 1984 Council amended the RETT ordinance to clarify collection of delinquent accounts. April 1987 Council established a cap of 1 % on RETT unless voted on by town residents. This ordinance is no longer applicable due to passage of the Tabor Amendment, which does not allow the town to raise the 1 % tax under the Colorado Constitution. Additionally, the uses of the transfer tax fee were expanded to include the improvement of land. October 1992 Council passed an ordinance that made it possible to use RETT for "acquisition, improvement and maintenance of real property within the limits of the Town or within a mile of the town boundaries." This allowed the town to proceed with the Dowd Junction recreation path. September 1993 Council passed an ordinance that specified delinquent: taxes and assessments be turned over to the Eagle County Treasurer after October 1 of each year. Progression of RETT Ordinances Ordinance No. 26, Series of 1979. Whereas, the Town Council wishes to impose a land transfer tax on transfers of real property within the Town of Vail and to provide for the earmarking of the proceeds therefrom for the purchase of real property, and it is the intention of the Town Council that at such time as sufficient parcels of property have been acquired, that portion of the tax shall cease. Section 9, Application of Funds. a. All funds received by the Town of Vail pursuant to this ordinance shall be deposited in the Land Transfer Tax Fund, which fund is hereby created. The Fund shall be subject to appropriation only for the following purposes. i. Acquiring land for parks, recreation, open space and/or similar purposes: Ordinance No. 26, Series of 1979, as amended by Ordinance No. 5, Series of 1990. Whereas, the Town Council wishes to impose a land transfer tax on transfers of real property within the Town of Vail and to provide for the earmarking of the proceeds therefrom for the purchase of real property, and it is the intention of the Town Council that at such time as sufficient parcels of property have been acquired for Town purposes and any borrowing or financing therefore has been paid in full, then the tax will not apply to transfers occurring thereafter. Section 9, Application of Funds. a. All funds received by the Town of Vail pursuant to this ordinance shall be deposited in the Land Transfer Tax Fund, which fund is hereby created. The funds shall be subject to appropriation only for the following purposes: acquiring real property for parks, recreation, open space and/or similar purposes, including paying incidental costs and the principle of and interest on any borrowing for the acquisition. Ordinance No. 23, Series of 1984. An Ordinance amending Chapter 3.48.130, Paragraph C, of the Municipal Code of the Town of Vail to provide for certification of delinquent land transfer taxes to the County Treasurer and for the extension of such delinquencies upon the real property tax rolls of the County and the collection of such delinquent fees in the same manner as delinquent general taxes levied upon such property. Ordinance No. 8, Series of 1987. DATE: April 23, 1999 SUBJECT: Scheduling of RETT Election Article X, Section 20, the Taxpayers Bill of Rights provides that "Ballot issues shall be decided in a state general election, biennial local district election, or on the first Tuesday in November of odd number years. Except for petitions, bonded debt, charter or constitutional provisions, districts may consolidate ballot issues and voters may approve a delay of up to four years in voting on ballot issues." "Ballot Issues" regarding scheduling of elections, is limited to fiscal matters. In Zaner vs. Citv of Brighton, 917 P2d 280 (1996), the Supreme Court held that TABOR provision goveming scheduling of elections applies only to issues of government financing, spending and taxation governed by TABOR, and has no bearing on people's ability to schedule special elections on local measures not affected by TABOR. TABOR requires voter approval in advance for any new tax or tax rate increase, but proposed change in the use of revenues generated by an existing Real Estate Transfer tax would not constitute a new tax or tax rate increase. Board of County Commissioners vs. E470 Public Hwy., 881 P2d 412 (Colo. App. 1994). The Vail Town Charter regarding actions on petitions states as follows: Submission to Voters. The vote of the Town on a proposed or referred ordinance shall be held not less than thirty days and not later than ninety days from the date of the final Council vote thereon. If no regular Town election is to be held within the period prescribed in this section, then Council shall provide for a special election: otherwise, the vote shall be held at the same time as such regular election, except that the Council may at its discretion provide for a special election at an earlier date within the prescribed period. B. For the purposes of this Chapter, building shall mean any structure having a roof supported by columns or walls, or any other enclosed structure for the housing of persons, animals, or property. Whereas, the Town Council wishes to amend the land transfer tax to provide that land transfer tax funds can be utilized for the acquisition and improvement of real property not only within the Town, but also within one mile of the Town boundaries; and Whereas, the Town Council also wishes to provide more specific guidelines for the use of the land transfer tax. Section 3.48.090(A) of the Municipal Code of the Town of Vail is hereby amended to read as follows: Section 3.48.090(A). All funds received by the Town pursuant to this chapter shall be deposited in the land transfer tax fund, which fund is hereby created. The fund shall be subject to appropriation for only the following purposes within the Town of Vail or within one mile of the boundaries of the Town of Vail: a) Acquiring, improving, maintaining, and repairing real property for parks, recreation, open space and similar purposes; b) The construction, maintenance and repair of buildings which are incidental to park, recreation, and open space land; C) Landscaping parks and open space; d) The construction, maintenance, repair, and landscaping of recreation paths set forth in the Town of Vail Recreation Trails plan as it may be amended by the Town Council from time to time; e) Paying incidental costs and principle of and interest on any funds borrowed for the purposes set forth in Section 3.48.090(A). See the attached letter. Chuck Ogilby election, as possible to discuss: Employee Generation. 07/25/00 CAPACITY ISSUE AT DOBSON BOB/ROSS: Bring resolution to this issue. Gary Goodell, the Town's Chief Building Official, has been corresponding via e-mail with Brian Meacham, P.E. of Arup & Associates in Cambridge, MA. Brian has been serving with Gary on the International Code Council (ICC) Performance Code Drafting committee since August of 1996. Diana Donovan They recently completed the ICC "Performance Code for Buildings & Facilities," and it is to be published within the next 30 days. Brian is one of the best, if not the best, fire protection engineers ("FPE") Gary has ever seen or heard of. He has written a book and numerous papers on performance codes and has practiced fire protection engineering in Europe and North America. He is currently completing his PhD in performance codes at Worcester Polytechnic Institute (WPI) in Worcester, MA. The reason why the Town is able to get someone of this caliber for this little money is that Gary worked together on the performance code committee and, quite frankly, the Town can use a case study like this to illustrate the practical use of the new performance code as it is applied to an existing building. Gary has sent Brian and his associate with Arup & Associates, Chris Marrion, Gary's memo concerning Dobson and some digital photos that we took of the facility. Stanley Turner of O'Dell architects has agreed to send Brian and Chris copies of the architectural plans for Dobson as soon as possible. Both Brian and Gary will be attending ICBO's annual conference in San Francisco during the week of September 4-9, beginning the Tuesday immediately after Labor Day. They will be presenting the newly published performance code to the ICBO membership as one of the educational sessions August 4, 2000, Page 1 for the conference. Brian has suggested that he may be able to "piggyback" a stop in Vail either immediately before or after the ICBO conference in order to minimize the expenses of such a trip. The Town might want to be thinking about which "stakeholders" it would want to attend such a meeting. As things stand now, Arup & Associates will begin work on the project immediately. It sounds like the VRD/TOV may want to get something going on improvements to Dobson beginning next spring. In the meantime, anything the Town and VRD could do to improve the life safety characteristics of the facility in the way of minor, best bang for the buck improvements or changes in operating procedures prior to the upcoming ski season should be considered.
