BACKGROUND RATIONALE: The Town of Vail is currently
in the process of preparing plans for the development of
Donovan Park. A small tract of land (Lot 4, Vail Village West
Filing No. 2) on the westernmost end of the park site is
zoned Residential Cluster district. The remaining area of the
park is zoned more appropriately as General Use district.
Staff believes that since the intent of the park development is
to provide recreational amenities and facilities to the
community and it is not to provide residential uses on the
site, that Lot 4 should be rezoned to General Use district.
STAFF RECOMMENDATION: The Community
Development Department recommends that the Town
Council approve Ordinance No.33, Series of 2000, on first
reading.

MEMORANDUM

SUBJECT: A request for a final review of a conditional use permit, to allow for the
construction of Phase I improvements on the lower bench of Donovan
Park/unplatted, generally located southeast of the intersection of
Matterhorn Circle and the South Frontage Road, and a request for the
rezoning of Lot 4, Vail Village West Filing No. 2/1774 Matterhorn Circle
from "Residential Cluster zone district" to "General Use zone district',.
Applicant: Town of Vail, represented by Odell Architects, P.C.

1. DESCRIPTION OF THE REQUESTS
The applicant, the Town of Vail, represented by Odell Architects, P.C. has submitted two
applications to the Town of Vail Community Development Department for consideration;
.1) an application for a conditional use permit, and
2) an application for the rezoning of Lot 4, Vail Village West, Filing No. 2.
The nature of the two requests are described below.
Conditional Use Permit
The Town of Vail is requesting a Conditional Use Permit, pursuant to the requirements
outlined in Chapter 16 of the Town of Vail Zoning Regulations, to construct a community
park, outdoor recreational facilities and a community park pavilion on the approximately
12.3 acre site known as the lower bench of the John F. Donovan Park. The proposed
plan includes:
a 150' x 300' soccer field,
an open turf recreation area, playground equipment, and park shelters,
restroom facilities,
a community park pavilion,
a full-size outdoor basketball court,
paved recreation paths, and
an approximately 150 space, structured parking area.
The improvements also include drop-off and loading zones; loading and delivery;
improvements to the South Frontage Road; and a pedestrian bridge over Gore Creek.
These improvements are referred to as Phase I improvements in the recently adopted
Donovan Park Master Plan Amendment. Phase II improvements are proposed on the
adopted Conceptual Site Plan, an element of the master plan, on a future Phase II
building envelope pad site.

In keeping with the intent of the Donovan Park Master Plan Amendment, the community
park pavilion is proposed to be approximately 6,500 - 7,000 square feet in size. This
square footage includes a multi-purpose room, a front entry lobby, a pre-function space',
an administrative office, a kitchen, restrooms, storage areas and a 4,000 square foot
exterior deck. The pavilion is intended to provide sites for community meetings and
gatherings, wedding receptions, musical and theatrical performances, art exhibits,
banquets, open houses, etc.
Rezoninq
The Town of Vail is also requesting to rezone a small portion of the designated park
area. According to the Official Town of Vail Zoning Map, a small tract of platted land
within the boundaries of the lower bench of Donovan Park is zoned Residential Cluster
zone district. This tract of land is legally described as Lot 4, Vail Village West, Filing No.
2. This rezoning request will rezone Lot 4 from Residential Cluster zone district to
General Use zone district. The new zoning designation is more consistent with the
intended use of the property.
II. STAFF RECOMMENDATION
Conditional Use Permit
The Community Development Department recommends approval of the request for a
conditional use permit to allow for the construction of the Phase I Donovan Park
improvements. The staffs recommendation for approval is based upon the review of the
criteria outlined in Section V of this memorandum.
Should the Planning & Environmental Commission choose to approve this conditional
use permit request, staff recommends that the following findings be made part of the
Commission's motion:
1. That the proposed location of the use is in accordance with the purposes
of the Zoning Regulations and the purposes of the General Use zone
district.
2. That the proposed location of the use and the conditions under
which it would be operated or maintained would not be detrimental
to the public health, safety, or welfare or materially injurious to
properties or improvements in the vicinity.
3. That the proposed use will comply with each of the applicable
provisions of the Zoning Regulations.
Should the Planning & Environmental Commission choose to approve the conditional
use permit request, staff recommends that the following conditions be made part of the
approval:
1. That the applicant submits a final Development Plan to the Community
Development Department for review and approval by the Town of Vail Planning &
Environmental Commission prior to ANY site work being completed on the

property. The Development Plan, once approved, shall become the Approved.
Development Plan for the lower bench of Donovan Park and shall prescribe the
development standards for the property, pursuant to Section 12-9C-5 of the Vail
Town Code.
2. That the applicant appears before the Vail Town Council for the review and
approval of a request to rezone Lot 4, Vail Village West, Filing No. 2 from
Residential Cluster zone district to the General Use zone district.
3. That the approval of this conditional use permit request is conditioned upon the
rezoning of Lot 4, Vail Village West, Filing No. 2.
4. That this conditional approval shall become null and void should the applicant not
receive final approval from the Town of Vail Planning & Environmental
Commission for an Approved Development Plan.
Rezoninq
The Community Development Department recommends approval of the request to
rezone Lot 4, Vail Village West, Filing No. 2, from Residential Cluster District to General
Use District. The staffs recommendation for approval is based upon the review of the
criteria outlined in Section VI of this memorandum.
Should the Planning & Environmental Commission choose to recommend approval of
this request to the Vail Town Council, staff would recommend that the following finding
be made part of the motion:
That the request to rezone Lot 4, Vail Village West, Filing No. 2 complies with the
expressed goals and objectives of the Town of Vail as stated in the Donovan Park
Master Plan Amendment, the Town of Vail Land Use Plan and the Town of Vail
Comprehensive Open Lands Plan. Further, this Commission finds that the rezoning is
necessary to achieve the town's objectives and that the rezoning will not be detrimental
to the public health, safety and welfare. This finding is based upon the Commission's
review of the required criteria as outlined in Section VI of this memorandum.
III. APPLICABLE MASTER PLANS
On October 3, 2000, the Vail Town Council adopted the Donovan Park Master Plan
Amendment. The purpose of this amendment was to update and identify the appropriate
uses for the lower bench of Donovan Park. According to the recommendations of the
master plan, the site is to be developed in two phases. The first phase of improvements
includes the construction of a community park pavilion, outdoor recreation facilities and
the required parking areas. The second phase of improvements, while discussed and
debated, has yet to be determined. A pad site to accommodate a location for Phase II
improvements is to be preserved.
On November 16, 1986, the Vail Town Council adopted the Town of Vail Land Use Plan.
The purpose of the plan is to provide a basis for making land use decisions and to insure
that the long-term needs and desires of the community are addressed as the town
matures. According to the Land Use Plan, the lower bench of Donovan Park is
designated as "park" use.

IV. BACKGROUND
The entire 51 acre parcel known as the John F. Donovan Park was acquired in 1980. A
master plan for development of the site was adopted in 1985 which recommended a
ballfield, play areas, picnic shelters, a basketball court, a skating pond, volleyball courts,
and parking on the lower bench and a cemetery, open space and hiking trails on the
middle and upper benches. The original master plan, now 15 years old, was never
implemented.
Community facilities and park development were determined to be two of the top issues
resulting from the Vail Tomorrow and Common Ground processes which have occurred
over the past 3 % years. On September 21, 1999, the Vail Town Council decided to
move forward. with a process to determine which uses are appropriate and compatible
with the Donovan Park site. The Vail Town Council and the Vail Recreation District
Board have directed staff to move forward with the following uses to be included in a
revised master plan amendment (generally in order of priority):
W Park use and soccer field
W Pavilion
W Multi-recreational space (gymnastics, yoga, martial arts, etc.) (may
be considered on other sites)
Children's Center (day camp, year-round youth enrichment
programs and multi-purpose/generational activity rooms)
R Gymnasium
Indoor pool (25 meter by 25 yard)
ABC/Learning Tree Pre-schools
On October 3, 2000, the Vail Town Council adopted the Donovan Park Master Plan
Amendment in the passing of Resolution No. 10, Series of 2000. The master plan
amendment anticipates the development of the park in two phases. Phase I
improvements are as described in Section I of this memorandum. A location for Phase ll
improvements has been reserved on the site. The final improvements, however, have
yet to be determined.
V. CONDITIONAL USE PERMIT REVIEW CRITERIA
The issuance of a conditional use permit is required to allow for the construction
of the Phase I improvements in Donovan Park. In accordance with Chapter 12-
16 of the Town of Vail Code, an application for a conditional use permit within the
General Use District shall be subject to the following development factors and
criteria:
1. Relationship and impact of the use on development objectives of the
Town.
Applicable goals from the Vail Land Use Plan are outlined in Section VI of
this memorandum. Development standards for the General Use zone
district are prescribed by the Planning and Environmental Commission in
the form of an Approved Development Plan for the project: Staff believes

this proposal is consistent with the intended recreational uses identified
for this site.
2. Effect of the use on light and air, distribution of population,
transportation facilities, utilities, schools, parks and recreation
facilities, and other public facilities and public facilities needs.
The construction of Phase I improvements to the lower bench of Donovan
Park will have positive impacts on the criteria described above. The
proposed park is located in the Matterhorn Village neighborhood. The
Matterhorn Village neighborhood is one of only a few residential
neighborhoods in Vail that has no recreational park amenities in the
immediate vicinity. The construction of the park will provide the much
needed recreational amenities. Additionally, during the Common Ground
and Vail Tomorrow processes, community members had identified the
need for a community pavilion facility in town. During discussions
regarding community facilities, the Council and community members have
recommended the Donovan Park development site as the most
appropriate location for a community pavilion. For these two primary
reasons, staff believes that this application meets the above-described
criteria.
3. Effect upon traffic, with particular reference to congestion,
automotive and pedestrian safety and convenience, traffic flow and
control, access, maneuverability, and removal of snow from the
streets and parking areas.
The above-described criteria have been addressed in the development of
this application. To insure that traffic congestion, traffic flow, access and
maneuverability are not negatively impacted, the applicant has paid
particular attention to these issues. Significant South Frontage Road and
Matterhorn Road intersection improvements are proposed. These
improvements include the widening of the frontage road to accommodate-
adequate thru traffic flows, the addition of acceleration and deceleration
lanes at the entrance to Donovan Park and at the Matterhorn Road
intersection, the construction of a dedicated bike lane and improvements
and connections to the existing streamwalk.
An approximately 150 space parking area is also proposed. The 150
parking spaces are intended to provide adequate parking for each of the
uses currently proposed on the site. According to information provided by
the applicant, parking shortages only become a problem when a major
recreational event is occurring on the recreation field at the same time as
a large gathering is occurring in the pavilion. This potential problem can
be addressed however, by coordinating and managing events with this
issue in mind.
Overall, staff believes this criterion has been met.
4. Effect upon the character of the area in which the proposed use is to
be located, including the scale and bulk of the proposed use in
relation to surrounding uses.

Sections 12-9C-2 & 3 outline the permitted and conditional uses allowed
in the General Use zone district. The following are listed as conditional
uses in the General Use zone district:
- Public and private parks and active outdoor recreation areas, facilities,
and uses.
- Public and quasi-public indoor community facility.
- Public buildings and grounds.
All of the uses proposed for the lower bench of Donovan Park fall into one
of these categories.
Section 12-9C-5 of the Zoning Regulations outlines the standards for
developments in the General Use zone district. The Zoning Regulations
state:
In the General Use zone district, development standards in each of the
following categories shall be proposed by the applicant and prescribed by
the Planning and Environmental Commission:
1. Lot area and site dimensions
2. Setbacks
3. Building Height
4. Density Control (dwelling units and GRFA)
5. Site Coverage
6. Landscaping and site development
7. Parking and loading
The applicant will be submitting a Development Plan to the Community
Development Department for the review and approval of the Planning &
Environmental Commission at an upcoming meeting.
The Donovan Park Master Plan Amendment was developed with the
wishes of the community in mind. Over the course of the nearly one year
development timeframe, numerous public meetings and discussions
occurred to insure that the applicant.and design team received comments
and feedback from community members. Much of the feedback
influenced the final conceptual design proposal. For example, the
pavilion is proposed to be one story in height, the parking is substantially
screened from public view outside the park, access to the park is from the
South Frontage Road as opposed to through the neighborhood, a
pedestrian bridge will be constructed to improve pedestrian access and

safety and no construction will occur within the riparian corridor of Gore
Creek.
VI. REZONING REQUEST - CRITERIA FOR EVALUATION
1) Is the existing zoning suitable with the existing land use on the site and
adjacent land uses?
Staff believes the existing zoning designation is suitable with the existing and
adjacent land uses. However, staff does not believe that the existing zoning is
suitable for the proposed use of the property as identified in the Donovan Park
Master Plan Amendment. The town's intent as stated in the master plan has
been to provide opportunities for public recreation at this location. Through the
conditional use permit process, staff and the Planning & Environmental
Commission can ensure that all future uses of the site will be compatible with
master plan goals and development objectives. The town's intent is not to
provide for residential uses on this site as permitted by the current zoning
designation of Residential Cluster District.
General Use Purpose Statement
The General Use District is intended to provide sites for public and quasi-public
uses which, because of their special characteristics, cannot be appropriately
regulated by the development standards prescribed for other zoning districts, and
for which development standards especially prescribed for each particular
development proposal or project are necessary to achieve the purposes
prescribed in Section 12-1-2 of this Title and to provide for the public welfare.
The General Use District is intended to ensure that public buildings and grounds
and certain types of quasi-public uses permitted in the District are appropriately
located and designed to meet the needs of residents and visitors to Vail, to
harmonize with surrounding uses, and, in the case of buildings and other
structures, to ensure adequate light, air, open spaces, and other amenities
appropriate to the permitted types of uses.
2) Is the amendment presenting a convenient workable relationship with land
uses consistent with municipal objectives?
Through the conditional use permit review process, the PEC can ensure that any
future proposals are consistent with municipal objectives. This review process is
intended to address development impacts such as traffic, parking, noise, hours of
operation, etc. The municipal objective is not to construct residential uses on this
site as currently permitted in the Residential Cluster zone district.
3) Does the rezoning provide for the growth of an orderly viable community?
In accordance with the provisions of the Town of Vail Zoning and Subdivision
Regulations and Vail's Master Plan Elements, staff believes this rezoning
provides for the growth of an orderly viable community. The construction of the
Phase I improvements is an expressed goal of the Vail Town Council to be
underway by April of 2001. The need for park and recreation amenities in this
particular neighborhood have been a desire of the community for some time.

4) Is the change consistent with the Land Use Plan?
The Vail Land Use Plan places a future land use designation of "Park" on the
subject property. These types of parcels are intended "for both active recreation.
activities such as athletic fields, golf courses and playgrounds, as well as areas
for various passive recreation activities." Staff believes a zoning designation of
"General Use" (a district intended for public facilities) is consistent with the goals
and objectives outlined for the "Park" land use category. The following goals
from the Plan are specifically impacted by this proposal:
1.1 Vail should continue to grow in a controlled environment, maintaining a
balance between residential, commercial and recreational uses to serve
both the visitor and the permanent resident.
1.10 Development of Town owned lands by the Town of Vail (other than parks
and open space) may be permitted where no high hazards exist, if such
development is for public use.
1.12 Vail should accommodate most of the additional growth in existing
developed areas (infill areas).
1.5 The community should improve non-skier recreational options to improve
year-round tourism.
2.7 The Town of Vail should improve the existing park and open space lands
while continuing to purchase open space.

PAY THE COSTS, EXPENSES AND LIABILITIES OF THE VAIL LOCAL
MARKETING DISTRICT, FOR ITS FISCAL YEAR JANUARY 1, 2001, THROUGH
DECEMBER 31, 2001.
WHEREAS, the Vail Local Marketing District board received and approved the
operating plan and budget for the fiscal year 2001 on September 12, 2000; and
WHEREAS, in accordance with CRS section 29-1-106 a notice of budget hearing has
been published; and
WHEREAS, notice of this public hearing to consider the adoption of the proposed Vail
Local Marketing District budget was published in the VAIL TRAIL on the 24th of
November, 2000; and

AN ORDINANCE FOR THE REGULATION OF TRAFFIC BY THE
TOWN OF VAIL COLORADO; ADOPTING BY REFERENCE THE
1995 EDITION OF THE "MODEL TRAFFIC CODE FOR COLORADO
MUNICIPALITIES;" REPEALING ALL ORDINANCES IN CONFLICT
THEREWITH; AND PROVIDING PENALTIES FOR VIOLATION
THEREOF
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
VAIL COLORADO:
Section 1. Adoption. Pursuant to parts 1 and 2 of article 16 of title 31, C.R.S., as
amended, there is hereby adopted by reference Articles I and II, inclusive, of the
1995 edition of the "Model Traffic Code for Colorado Municipalities," promulgated
and published as such by the Colorado Department of Transportation, Staff
Traffic and Safety Projects Branch, 4201 East Arkansas Ave., Denver, CO
80222. The subject matter of the Model Traffic Code relates primarily to
comprehensive traffic control regulations for the Town of Vail. The purpose of
this Ordinance and the Code adopted herein is to provide a system of traffic
regulations consistent with state law and generally conforming to similar
regulations throughout the state and the nation. Three (3) copies of the Model
Traffic Code adopted herein are now filled in the office of the Clerk of the Town of
Vail Colorado, and may be inspected during regular business hours.
Section 2. Deletions. The 1995 editions of the Model Traffic code is adopted as
if set out at length save and except the following articles and/or sections which
are declared to be inapplicable to this municipality and are therefore expressly
deleted:
1. Article I, Part 7, Sections 706, 707 and 708 relating to railroad
crossings.
Section 3. Additions or Modifications. The said adopted Code is subject to the
following additions or modifications:
1. Article I, Part 1, Section 109 (9) is hereby amended by the following
addition to said section:
This subsection (9) does not apply to any street, public way or
portion thereof designated by the Department of Public Works as a limited play
street for use of roller skates, skateboards or similar devices. Nothing in this
subsection shall be construed to allow the use of skis, toboggans or coasting
sleds on said limited play streets and the same are prohibited; all businesses
which rent skates shall post in a conspicuous place on the business premises a
map of the Town of Vail with the limited play streets for the use of roller skates
marked thereon; a list of such designated limited play streets (attached hereto as
Exhibit A) as designated by the Department of Public Works shall be kept on file
in the office of the Town Clerk.
2. Article I, Part 2, Section 1101(b) and (c) is hereby amended as
follows: See Attached Exhibit B.
3. Article 1, Part 9, Sections 1203 and 1204 (3) are hereby amended as
follows:
1203 Restricted Parking Area. The Department of Public Works may designate
any parking area, when it is located on a public street, right-of-way, or other public
property, as a controlled or specially restricted parking area. The Department of Public
Works may prescribe any conditions necessary to protect and control the specially
restricted area, including the requirement for parking stickers or other identifying device.
If parking stickers or other identifying devices are utilized, the Department of Public
Works is authorized to prescribe the form of parking stickers or other method of
identification for the restricted area and all vehicles using the restricted area shall display
an approved parking sticker or other identifying device as evidence of permission to park
in the restricted area.
1204 (3) ( C ) At any place designated by the Department of Public Works as a
specially restricted area.
Section 4. Penalties. The following penalties, herewith set forth in full, shall
apply to this ordinance:
(a) It is unlawful for any person to violate any of the provisions adopted in this
ordinance.
(b) Every person convicted of a violation of any provision adopted in this
ordinance shall be punished by a fine not exceeding nine hundred ninety nine
dollars ($999.00), or by imprisonment not exceeding one hundred eighty (180)
days, or by both such fine and imprisonment.
Section 5. ADalication. This ordinance shall apply to every street, alley, sidewalk
area, driveway, park, and to every other public way or public place or public
parking area, either within or outside the corporate limits of this municipality, the
use of which this municipality has jurisdiction and authority to regulate. The
provisions of sections 1401, 1402, 1413, and part 16 of the adopted Model Traffic
Code, respectively concerning reckless driving, careless driving, eluding a police
officer, and accidents and accident reports shall apply not only to public places
and ways but also throughout this municipality.
Section 6. Validitv. If any part or parts of this ordinance are for any reason held
to be invalid such decision shall not affect the validity of the remaining portions of
this ordinance. The Town Council hereby declares that it would have passed this
ordinance and each part or parts thereof, irrespective of the fact that any one part
or parts be declared invalid.
Section 7. Repeal. Existing or parts of ordinances covering the same matters as
embraced in this ordinance are hereby repealed and all ordinances or parts of
ordinances inconsistent with the provisions of this ordinance are hereby
repealed, except that this repeal shall not affect or prevent the prosecution or
punishment of any person for any act done or committed in violation of any
ordinance hereby repealed prior to the taking effect of this ordinance.
Section 8. Interpretation. This ordinance shall be so interpreted and construed
as to effectuate its general purpose to conform with the State's uniform system
for the regulation of vehicles and traffic. Article and section headings of the
ordinance and adopted Model Traffic Code shall not be deemed to govern, limit,
modify or in any manner affect the scope, meaning or extent of the provisions of
any article or section thereof.
Section 9. Certification. The Town of Vail, Town Clerk shall certify to the
passage of this ordinance and make not less than three copies of the adopted
Code available for inspection by the public during regular business hours.

SUBJECT: A request to table Ordinance No. 26, Series of 2000 (Adoption of the
Lionshead View Corridor)
At the November 21, 2000, meeting, the Council requested that staff notify individual owners
within Lionshead Center of the adoption of the View Corridor. To complete this task, staff is
requesting additional time prior to second reading of the ordinance. At this time, staff has
contacted the Condominium Association and made numerous phone calls. However, staff
needs additional time to ensure that all owners have been contacted and notified.
The Community Development Department recommends that the Town Council table Ordinance
No. 26, Series of 2000, on second reading to the December 19, 2000, Town Council meeting.

AN ORDINANCE AMENDING THE TOWN CODE, TITLE 12, CHAPTER 22, SECTION 4,
ADOPTION OF VIEW CORRIDORS, BY ADDING ONE VIEW CORRIDORS IN LIONSHEAD
AND SETTING FORTH DETAILS IN REGARD THERETO.
WHEREAS, the Town Council finds that the proposed view corridor protects and
perpetuates views from public pedestrian areas, public ways, or public spaces within the Town
which foster civic pride and are in the public interest for the Town; and
WHEREAS, the Town Council finds that the proposed view corridor protects and enhances
the Town's attraction to residents, guests, and property owners; and
WHEREAS, the Town Council finds that the proposed view corridor protects views which
are commonly recognized and have inherent qualities which make them more valuable to the Town
than other more common views; and
WHEREAS, the Town Council finds that the proposed view corridor is consistent with the
Lionshead Redevelopment Master Plan, and Title 12, Zoning, of the Town Code; and
WHEREAS, the Planning and Environmental Commission of the Town of Vail has
recommended approval of the proposed view corridor at its November 13, 2000 meeting; and
WHEREAS, the Town Council considers it in the interest of the public health, safety, and
welfare to amend said Chapter and Sections of the Town Code.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
VAIL, COLORADO, THAT:
Section 1. Title 12, Chapter 22, Section 4, Adoption of View Corridors, is hereby
amended as follows:
F. Lionshead View Point #1: A view from the west end of the Lionshead parking structure,
standing at street level at the front of the entrance 395 E. Lionshead Circle and looking
southwest toward the gondola lift line.
1. Purpose: To protect the views of Vail Mountain from the primary entrance point into
Lionshead.
2. Survey control: Based on published material from Town of Vail GPS control map. Points
Spraddle and 1766 were used for this survey. Bearings reported below are tied to this
control.
3. Instrument at Lionshead View Point #1: A 2 inch diameter brass monument, flush in
brick pavers, stamped View 1.
4. Backsight: A 2 inch diameter aluminum Johnson, Kunkel & Associates, Inc.,
monument which bears S11 047'42"W 327.94 feet distant. Located at the north edge of
a concrete ring for a water manhole approximately 15 feet north of the north edge of the
bike path.

inhabitants thereof.
Section 4. The amendment of any provision of the Vail Town Code as provided in
this ordinance shall not affect any right which has accrued, any duty imposed, any violation that
occurred prior to the effective date hereof, any prosecution commenced, nor any other action or
proceeding as commenced under or by virtue of the provision amended. The amendment of
any provision hereby shall not revive any provision or any ordinance previously repealed or
superseded unless expressly stated herein.
Section 5. All bylaws, orders, resolutions and ordinances, or parts thereof,
inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall
not be construed to revise any bylaw, order, resolution or ordinance, or part thereof, theretofore
repealed.

AN ORDINANCE PROVIDING FOR THE LEVY ASSESSMENT AND COLLECTION
OF TOWN AD VALOREM PROPERTY TAXES DUE FOR THE 2000 TAX YEAR AND
PAYABLE IN THE 2001 FISCAL YEAR.
WHEREAS, it is necessary for the Town Council to provide for the levy, assessment and
collection of Town ad valorem property taxes due for the 2000 year and payable in the 2001
fiscal year.
NOW, THEREFORE, be it ordained by the Town Council of the Town of Vail,
Colorado, that:
1. For the purpose of defraying part of the operating and capital expenses of the
Town of Vail, Colorado, during its 2001 fiscal year, the Town Council hereby levies a property
tax of 4.705 mills upon each dollar of the total assessed valuation of $513,257,960 for the 2000
tax year of all taxable property within the Town, which will result in a gross tax levy of
$2,414,879, calculated as follows:
Base mill levy 4.690 $2,407,180
Abatement levy .015 7.699
Total mill levy 4.705 $2.414.879
Said assessment shall be duly made by the County of Eagle, State of Colorado, as directed by the
Colorado Revised Statutes (1973 as amended), and as otherwise required by law.
2. If any part, section, subsection, sentence, clause or phrase of this ordinance is for
any reason held to be invalid, such decision shall not affect the validity of the remaining portions
of this ordinance; and the Town Council hereby declares it would have passed this ordinance,
and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that

TOWN OF VAIL EMPLOYEES' PENSION PLAN
WHEREAS, the Town of Vail adopted, effective September 20, 1983, a qualified
money purchase pension plan known as the Town of Vail Employees' Pension Plan (the
"Plan"), for the purpose of providing retirement benefits for certain of its employees; and
WHEREAS, the Town of Vail restated the Plan effective January 1, 1994; and
WHEREAS, the Town of Vail adopted the First Amendment to the Plan effective
March 19, 1996; and
WHEREAS, the Town of Vail adopted the Second Amendment to the Plan effective

WHEREAS, the Town of Vail adopted the Third Amendment to the Plan effective
January 1, 1999; and
WHEREAS, the Town of Vail desires to further amend the Plan to revise the language
eliminating the provision regarding hardship distributions in order to comply with Federal law,
and to revise the language regarding vesting in the event of death, Total Disability or
attainment of normal retirement age;
NOW THEREFORE, the Plan is hereby amended, effective January 1, 2000, by:
(1) Deletion of Section 7.12, Hardship Distributions. and by renumbering Section 7.13 as
Section 7.12; and
(2) By restatement of Section 5.5 (f) in its entirety, as follows:
Section 5.5 - - Vesting of Participants' Interests
(f) Death. Total Disabilitv or Attainment of Normal Retirement Aae..
The vested percentage of a Participant shall be 100% in the event the
Participant dies, becomes Totally Disabled, attains his or her normal
retirement age while still employed by the Employer, or has terminated
--inyloyment because of a Total Disability but has not commenced
receiving a disability benefit.
(3) If any part, section, subsection, sentence, clause or phrase of this ordinance is for any
reason held to be invalid, such decision shall not affect the validity of the remaining
portions of this ordinance; and the Town Council hereby declares it would have passed
this ordinance, and each part, section, subsection, sentence, clause or phrase thereof,
regardless of the fact that any one or more parts, sections, subsections, sentences,
clauses or phrases be declared invalid.
(4) The Town Council hereby finds, determines and declares that this ordinance is
necessary and proper for the health, safety and welfare of the Town of Vail and the
inhabitants thereof.
(5) The repeal of the repeal and reenactment of any provision of the Municipal Code of the
Town of Vail as provided in this ordinance shall not affect any right which has accrued,

TOWN OF VAIL POLICE AND FIRE EMPLOYEES' PENSION PLAN
WHEREAS, the Town of Vail adopted, effective January 1, 1983, a qualified money
purchase pension plan known as the Town of Vail Police and Fire Employees' Pension Plan
(the "Plan"), for the purpose of providing retirement benefits for certain of its employees; and
WHEREAS, the Town of Vail restated the Plan effective January 1, 1994; and
WHEREAS, the Town of Vail adopted the First Amendment to the Plan effective
January 16, 1996; and
WHEREAS, the Town of Vail adopted the Second Amendment to the Plan effective
January 1, 1997; and
WHEREAS, the Town of Vail adopted the Third Amendment to the Plan effective
January 1, 1999; and
WHEREAS, the Town of Vail desires to further amend the Plan to eliminate the
provision regarding hardship distributions in order to comply with Federal law; and
WHEREAS, pursuant to Plan Section 8.3, amendment of this Plan to conform to the
provisions and requirements of the Federal law does not require a vote by the sworn police
officers and firefighters;

PREMIER IMPRESSIONS PROGRAM
After months of planning and preparation, "Premier Impressions," Vail's comprehensive
community-wide customer service program, is being introduced. This is a partnership
between the Town of Vail, Vail Resorts, Vail Valley Tourism and Convention Bureau
and the Vail Chamber and Business Association and is thought to be the only program
of this magnitude in the country. The program draws upon the success of last year's
monthly employee recognition, with the addition of a special shopper program. A
merchant recognition component also is planned. Employees who exemplify exceptional
customer service will be presented with the Premier Emalovee Award and will have the
opportunity to win $5,000 cash and a variety of other prizes totaling $20,000 during an
end-of-season drawing in March. Details of the Premier Merchant Award will be
announced soon. The special shopper program will be conducted by an independent,
outside consultant and will be used to gauge the overall effectiveness of this
community-wide initiative. It should be noted use of the word "premier" in the program's
name is by design and is intended to complement the Town Council's vision to be the
"premier mountain resort community." A news release outlining the program's

ECO TO PROVIDE ADDITIONAL BUS SERVICE THIS NEW YEAR'S EVE
Mike Rose informs us an agreement has been reached with ECO for increased bus
service on New Year's Eve. This year, 10 additional ECO buses will be running, as well,
the hours will be lengthened in the early morning to accommodate the final revelers.

BURNE GRANT REQUEST
Attached to this report is a Memorandum from Joe Russell explaining a request to
endorse the town's commitment to matching funds for a Burne Grant, which if approved
would fund up to three full time narcotic detectives and a prosecuting attorney for the
Fifth Judicial District. The matching funds would ultimately be needed in Y2001. The
task force applying for the Burne Grant is a collective effort by the Vail Police
Department, the Avon Police Department, the Eagle County Sheriffs Office, and the
Fifth Judicial District Task Force. The town's share would be $28,887.50.

Re: Burne Grant request for a full time Narcotic's Detective
A grant has become available to fund a task force in Eagle County for 2001 and beyond.
The Vail Police Department, Avon Police Department, Eagle County Sheriff's Office,
and the Fifth Judicial District Task Force are applying for this Grant to fund three full
time narcotic detectives and a prosecuting attorney for the Fifth Judicial District Eagle
Office. The District Attorney's Office will administer the grant. The grant funding year
begins in July of 2001 and would run until July of 2002. The grant would fund 75% of
the funding requested and requires a matching contribution of 25% from each agency that
applies for this grant.
The amount of funds requested by the four agencies for this grant total $250,920.00. This
amount is 75 % of the grant. The 25% matching portion of the grant for all agencies
would be $83,640.00. The Vail Police Department matching portion of this grant would
be $28,887.50.

matching grant request in July of 2001 for a full year for this position.

Since the Council's discussion on Tuesday November 28th, 1 followed up with
Community Development and the Municipal Court so that I could provide you with
complete information in regard to the code violation for Eric Baumann. He was cited
for three specific violations: 1.) Construction out of conformance with approval. 2.)
Unauthorized outdoor activity (outdoor preparation of food). 3.) Unauthorized
signage. This case remains pending at this time and Mr. Baumann has been offered
an opportunity to receive a deferred judgement and sentence on this charge. This is
customary in a matter of this nature and if he does not commit any further violations
of the Town of Vail Zoning Code for a two-year period of time the case will be
dismissed. He is scheduled to appear in court on December 7, 2000. On November
2, 2000 Mr. Baumann failed to appear for a scheduled court hearing.
The outdoor preparation of food or open flames out doors is not Permitted by our
zoning code. On special events such as the October Fest and 4 h of July merchants
in the village do have out door preparation of food. It is appropriate for Mr. Baumann
to display his roasted nuts outside but it is not permitted to prepare that food.
I hope this information clarifies any miss understandings as a result of the discussion
on Tuesday. Please contact me for additional information as necessary.

PREMIER IMPRESSIONS PROGRAM
After months of planning and preparation, "Premier Impressions," Vail's comprehensive
community-wide customer service program, is being introduced. This is a partnership
between the Town of Vail, Vail Resorts, Vail Valley Tourism and Convention Bureau
and the Vail Chamber and Business Association and is thought to be the only program
of this magnitude in the country. The program draws upon the success of last year's
monthly employee recognition, with the addition of a special shopper program. A
merchant recognition component also is planned. Employees who exemplify exceptional
customer service will be presented with the Premier Emalovee Award and will have the
opportunity to win $5,000 cash and a variety of other prizes totaling $20,000 during an
end-of-season drawing in March. Details of the Premier Merchant Award will be
announced soon. The special shopper program will be conducted by an independent,
outside consultant and will be used to gauge the overall effectiveness of this
community-wide initiative. It should be noted use of the word "premier" in the program's
name is by design and is intended to complement the Town Council's vision to be the
"premier mountain resort community." A news release outlining the program's

ECO TO PROVIDE ADDITIONAL BUS SERVICE THIS NEW YEAR'S EVE
Mike Rose informs us an agreement has been reached with ECO for increased bus
service on New Year's Eve. This year, 10 additional ECO buses will be running, as well,

BURNE GRANT REQUEST
Attached to this report is a Memorandum from Joe Russell explaining a request to
endorse the town's commitment to matching funds for a Burne Grant, which if approved
would fund up to three full time narcotic detectives and a prosecuting attorney for the
Fifth Judicial District. The matching funds would ultimately be needed in Y2001. The
task force applying for the Burne Grant is a collective effort by the Vail Police
Department, the Avon Police Department, the Eagle County Sheriffs Office, and the
Fifth Judicial District Task Force. The town's share would be $28,887.50.

Re: Bume Grant request for a full time Narcotic's Detective
A grant has become available to fund a task force in Eagle County for 2001 and beyond.
The Vail Police Department, Avon Police Department, Eagle County Sheriff's Office,
and the Fifth Judicial District Task Force are applying for this Grant to fund three full
time narcotic detectives and a prosecuting attorney for the Fifth Judicial District Eagle
Office. The District Attorney's Office will administer the grant. The grant funding year
begins in July of 2001 and would run until July of 2002. The grant would fund 75% of
the funding requested and requires a matching contribution of 25% from each agency that
applies for this grant.
The amount of funds requested by the four agencies for this grant total $250,920.00. This
amount is 75 % of the grant. The 25% matching portion of the grant for all agencies
would be $83,640.00. The Vail Police Department matching portion of this grant would
be $28,887.50.

Salary and Benefits for a full time Officer: $18,900.00
Equipment for the grant: $200.00

year.

Reservations
*Incorporation of ratings into the reservations sales pitch in order to let the guest know
what they can expect from the accommodations booked
The Vail Valley Tourism& Convention Bureau reservations department and Vail Beaver
Creek Central Reservations each have a list of the overall property scores. Both
companies are in the process of loading ratings into the computer. Property ratings will
be incorporated into the reservations sales pitch and relayed to customers by the end of
December. The Lodging Quality Department will train all central reservation agents how
to use the ratings information during the reservations process.
Website
*Makes information about lodging quality readily available to the public. Streamlines
the administration, communication, and reporting involved in the program.
Hill & Tashiro Marketing has completed the first phase of the Lodging Quality
Assurance website. Lodging Quality information will be available through the websites
of the VVTCB and Vail Resorts. We are in the process of populating the database with
information, in order to go live this month. In addition to making LQA information
readily available to the public, this site has been set up in order to facilitate the tracking
and paperwork involved in the entire lodging quality process. Broadcast e-mail
capabilities will make it extremely easy to communicate with all of those involved in
lodging quality. Attached is a brief description of information to be included on the site.
Communication ,
*The VVTCB will stay in touch with the second homeowners, as well as the community
regarding Lodging Quality.
Lodging Quality "Magazine"- Bi-annual: This is a publication that we will publish in
house twice a year. This piece will highlight Lodging Quality information and upgrades,
as well as skier and resort trends. There will also be a vendor resource guide, aimed at
the second homeowner, included in this piece. Our intent is to distribute this publication
to all second homeowners, property management companies, and hotels. It will be
displayed in various businesses throughout the Vail Valley, as well as both information
centers. We expect the first issue to be out spring of 2001.
Guest Feedback:
We are developing a guest survey tool that will be used to measure, specifically, the
progress of Lodging Quality. Data will be published as it is received and interpreted.

Public Page
-Overview, history, and description of the Lodging Quality Program. This page is an
introduction to the site.
Pronerties & Ratings
-Comprehensive list of all properties and their ratings.
Newsletter
-Will contain current Lodging Quality information. This page gives us a way to
communicate program updates to the public, as well as the community.
Vendor Section
-These pages will contain a list of building contractors, furniture stores, and other
businesses that will facilitate the renovation process for owners and property managers.
Anyone will be able to log on and search for vendors that can assist them with their
particular upgrades.
Member's Onlv
-This section will provide information for the property management. Managers will be
able to log on and retrieve their property checklists, as well as property requirements, and
monthly inspection schedules. There will also be a section where they can e-mail
feedback and comments to lodging quality management.
In addition to the above, the VVTCB will be able to load all checklist and touring
information into the database that was built for the site. We will be able to run reports
that will help in identifying problem areas and improvements throughout the valley.
Communication will be extremely efficient with our broadcast e-mail capabilities, and
instead of copying all checklists for the properties; we will simply send them
electronically- saving a lot of time and paper.

RATING DESCRIPTIONS OVERVIEW
P: PLATINUM 90%-100%
A unit with this rating represents the finest accommodations in the area. The
furnishings and appointments are superior, as are all other aspects of the interior. First
impressions are "WOW!" Everything in the unit is first rate and coordinated. Style and
design are unsurpassed. These properties are the best of the best and are not lacking in
any area.
G: GOLD 800/o-890/o
A unit with this rating reflects recent interior design motifs and coordinated decorating
efforts. Inventory contained within each room of the home or unit is upscale and in
excellent condition. In short, a gold unit is comfortable and stylish with the feeling of
home.
S: SILVER 700/o-790/o
A unit with this rating reflects a nice accommodation with quality furniture that is
gently used. A consistent style is apparent throughout, although unit is a bit older and
lacking in thoroughness and finishing touches.
B: BRONZE 600/6-69%
A unit with this rating reflects a more sterile environment. Personality and decorating
motifs are present, albeit not fully coordinated; there may be a "pieced together" feel.
First impressions are "OK". Inventory contained in each room of the home or unit is
mostly utilitarian and meets minimum expectations. In short, a bronze unit offers a no
frills, but acceptable lodging experience.
0: SUBSTANDARD Below 600/6
A unit with this rating does not meet minimal rating standards. First impressions are
generally, "1 won't stay here!" Inventory contained in each room of the home or unit is
sparse, mismatched, and/or severely worn or broken. In short, a substandard unit does
not reflect first class resort lodging to destination vacationers. We will not rent
substandard properties in the Vail Valley.
