TOV COUNCIL CHAMBERS NOTE: Times of items are approximate, subject to change, and cannot be relied upon to determine at what time Council will consider an item. 1. Presentation of two Vail Youth Recognition Awards to Sarah Hallenbeck-Vail Mountain School and Chris Jackson-Battle Mountain High School. (10 min.) 2. Proclamation #1, Series of 2001, a proclamation recognizing the efforts of Battle Mountain High School Men's Alpine and Nordic Ski Teams in achieving the State Championships for the year 2001. (5 min.) 3. CITIZEN PARTICIPATION (5 min.) 4. ITEM/TOPIC: Overview of Town of Vail and Vail Resorts Patrick Hamel Environmental Programs and a look at possible partnerships between the programs. (40 min) ACTION REQUESTED OF COUNCIL: Provide direction on environmental programs and partnerships. BACKGROUND RATIONALE: The Town of Vail and Vail Resorts have many environmental programs that are similar to one another. We believe that by partnering on many of these programs we can send a stronger message to the public on what our environmental programs encompass. The Town of Vail's current environmental programs include the following: Curbside Household Hazardous Waste collection for residents Green Star Environmental Certification Program Recycling at Municipal Building and at 7 locations throughout the Village and Lionshead Ongoing water quality study of the Gore Creek Noxious Weed Abatement Program Pine Beetle Abatement Annual Spring Clean Up of Town of Vail Mauri Nottingham Environmental Quality Awards The Town has recently been working with Vail Resorts on pine beetle mitigation, noxious weed abatement and most recently has partnered on a car pooling incentive for skiers. Since both the Town and Vail Resorts have recycling and Green Star Programs, we feel that we should be partnering in these areas as well as other environmental areas that have not been addressed by either group. RECOMMENDATION: Town staff believes that we should work in conjunction with Vail Resorts to help one another communicate a strong environmental message to the public and possibly adopt the Natural Step philosophy of doing business. 5. ITEM/TOPIC: Patrick Hamel The Division of Wildlife has requested time to speak with the Town Council regarding bear issues in the Town of Vail. (45 min.) ACTION REQUESTED OF COUNCIL: Provide direction to Town staff on whether or not to proceed with actions that would help to minimize the occurrence of bear encounters in the Town of Vail. BACKGROUND RATIONALE: The Town of Vail is located in Black bear habitat and bears are frequently seen within the Town of Vail. Each year there are hundreds of reports to the Division of Wildlife and the Vail Police Department of Black bears in the Town of Vail. Many of the complaints received by the Division of Wildlife are due to bears getting into peoples trash that was left out overnight, or because of the incidental feeding of bears because people left their pet's food out or hung their bird feeder to low. Bears, once accustomed to easily available garbage and pet food, will continue to pursue these options on a regular basis. The bear soon associates humans with food, which becomes inherently dangerous. Several other communities throughout the United States have adopted ordinances that either limit when trash can be put out or require bear proof containers to be used. RECOMMENDATION: Town staff believes we should work with the Division of Wildlife to come up with some bear ordinance options for the Town Council to review and decide on what would work best for the residents of Vail. 6. Allison Ochs ITEM/TOPIC: First reading of Ordinance #5, Series of 2001, an ordinance amending the Town Code, Title 12, Chapter 13, to allow for corrections to the Employee Housing Regulations; Chapter 21, to allow for corrections to the Hazard Regulations; Chapter 15, to allow for corrections to the Gross Residential Floor Area Regulations; Chapter 2, to allow for corrections to the definition chapter and for the addition of a definition of "owner"; Chapter 6, to allow for clarification to the 425 credit; Chapter 7, to allow for clarification to the PA Zone District; and Title 13, Chapter 2, to allow for clarification to the definition of "subdivision"; and Title 8, Chapter 3, to allow for clarification of the Department of Public Works role in the issuance of right-of-way permits and setting forth details in regard thereto. Phone Phone Fax Fax # f to ORDINANCE NO. 7 SERIES OF 2001 AN ORDINANCE MAKING SUPPLEMENTAL APPROPRIATIONS AND BUDGET ADJUSTMENTS FROM THE TOWN OF VAIL HEAVY EQUIPMENT FUND, REAL ESTATE TRANSFER TAX FUND, GENERAL FUND, CAPITAL PROJECTS FUND, OF THE 2001 BUDGET AND THE FINANCIAL PLAN FOR THE TOWN OF VAIL, COLORADO; AND AUTHORIZING THE EXPENDITURES OF SAID APPROPRIATIONS AS SET FORTH HEREIN; AND SETTING FORTH DETAILS IN REGARD THERETO. WHEREAS, contingencies have arisen during the fiscal year 2001 which could not have been reasonably foreseen or anticipated by the Town Council at the time it enacted Ordinance No. 28, Series of 2000, adopting the 2001 Budget and Financial Plan for the Town of Vail, Colorado; and, WHEREAS, the Town Manager has certified to the Town Council that sufficient funds are available to discharge the appropriations referred to herein, not otherwise reflected in the Budget, in accordance with Section 9.10(a) of the Charter of the Town of Vail; and, WHEREAS, in order to accomplish the foregoing, the Town Council finds that it should make certain supplemental appropriations and budget adjustments as set forth herein. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. 3. The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety, and welfare of the Town of Vail and the inhabitants thereof. 4. The repeal or the repeal and reenactment of any provision of the Municipal Code of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. 5. All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extend only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution, or ordinance, or part thereof, theretofore repealed. Based upon our discussion, the following changes are proposed for Ordinance No. 2 on second reading. 1) Our existing definition of the term "Administrator" (from the Zoning Regulations) will be added to the Subdivision Regulations. 2) The terms "Administrator," "Department of Community Development," and "staff" are no longer used interchangeably. Only the term "Administrator" will be used. 3) We will reference our existing definition of "Designated Open Space" from the town charter in the exemption plat chapter. 4) The term "Zoning Ordinance" has been replaced with "Zoning Title." 5) Further clarification that the approval or denial of an exemption plat does not become final until the Planning and Environmental Commission votes on the request at a public hearing. 6) The word "or" has been deleted from Finding #1 in Section 13-12-3(B). 7) Clarification that a plat may not be recorded until the time period for appeal has expired. These changes are indicated in bold or stricken text in the attached Ordinance No. 2, Series of 2001. SUMMARY OF ORDINANCE CONTENT The proposed ordinance provides the following: ¦ A review process for the platting of land where multiple parcels are not created. • Criteria and standards to be used in the review of exemption plats. ¦ Notification requirements for adjacent property owners that exceed the requirements for other types of subdivision plats. ¦ A requirement for the solicitation of public comments at a public PEC hearing. ¦ The right to appeal a decision on an exemption plat to the Vail Town Council. This includes the Town Council's ability to "call up" any PEC decision. RECOMMENDATIONS PEC: On January 8th, the PEC voted unanimously to recommend approval of the proposed amendments to the Subdivision Regulations. Staff: The Department of Community Development recommends that the Town Council approve Ordinance No. 2, Series of 2001 on second reading. EXAMPLES 1. Desianated Open Space: The platting of any lot that is owned by the Town of Vail and is and zoned Natural Area Preservation, Outdoor Recreation, or Agriculture/Open Space and is designated as open space in accordance with the town charter. ORDINANCE NO. 2 SERIES OF 2001 AN ORDINANCE AMENDING THE TOWN OF VAIL SUBDIVISION REGULATIONS AND CREATING A NEW CHAPTER TO ALLOW FOR THE CREATION OF AN EXEMPTION PLAT AND CORRECTION PLAT REVIEW PROCESS WHEREAS, the Town of Vail has been regulating the subdivision of land under statutory and home rule authority since 1970; and WHEREAS, the Town of Vail wishes to provide reasonable and efficient development review and subdivision review services to the public; and WHEREAS, The Planning and Environmental Commission of the Town of Vail has recommended approval of these amendments at its January 8, 2001 meeting, and has submitted its recommendation to the Vail Town Council; and WHEREAS, the Vail Town Council considers it in the interest of the public health, safety, and welfare to adopt these amendments to the Subdivision Regulations. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. If the Administrator determines that the subject application would circumvent significant and relevant elements of the subdivision review process, the applicant shall be required to comply with the requirements of Chapter 13-3 and/or Chapter 13-4 of this title. 13-12-3: EXEMPTION CRITERIA AND REVIEW STANDARDS: A. Exemption Criteria: Notwithstanding the provisions of Sections 13-1-3 of this title, the Administrator may exempt from the provisions of Chapter 13-3 and/or Chapter 13-4 of this title an application that meets any one of the following criteria: 1. Designated Open Space: Any plat that would result in the division of property for the purpose of creating or maintaining designated open space. "Designated Open Space" shall be defined pursuant to Vail Town Charter Section 13-11. 2. Condemnation: Any lot created pursuant to the powers of condemnation. 3. Pre-existing Properties: Any plat for the purpose of establishing and/or correcting lot boundaries for properties in existence (and established in the records of the Eagle County Clerk and Recorder) prior to January 12, 1970 where no additional parcels are created and conformance with applicable provisions of the Vail Town Code has been demonstrated. 4. Public/Quasi-Public Use: Any plat that would create a parcel for public or quasi-public use such as community facilities, including but not limited to: utility facilities, parks, open space, fire/police stations, libraries, hospitals, municipal offices, schools, and places of worship. Community facilities which include dwelling units or employee housing units shall be required to process the appropriate plats to delineate ownership of residential properties. 5. Boundary-line adjustments (including right-of-way adjustments) where no additional parcels are created and conformance with applicable provisions of the Vail Town Code has been demonstrated. 6. Plat corrections that do not alter the general character and intent of the originally approved plat including, but not limited to: address changes, plat note amendments, plat title corrections and other minor corrections. 7. Vacation and/or replatting of a building envelope, easement or common single-family or duplex zoned lot boundary. B. Review Standards: The burden of proof shall rest with the applicant to show that the application is in compliance with the intent and purposes of this Chapter, the Zoning 9rdieaRee Title and other pertinent regulations that the Administrator deems applicable. The Administrator shall review the application and consider its appropriateness with regard to the applicable criteria for review and evaluation. The Administrator may approve an exemption plat pursuant to the provisions of this Chapter upon the findings that: 1. That the approval of the plat would result in the creation of a lot that conforms to the provisions of the Vail Town Code and /GF relevant master plan documents. In the case of non-conforming lots, non-conformities have not been expanded or increased by the approval of the plat, unless approved in accordance with the provisions of Section 13-1-7 ("Variances and Amendments") of this Title. 2. That the approval of the plat will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. 3. The amended proposed plat is consistent with the Town's established site development guidelines and with the character and intent of the originally approved plat, if applicable. 4. Provisions for adequate infrastructure and site access have been clearly demonstrated by the applicant. 13-12-4: EXEMPTION PLAT REQUIREMENTS AND PROCEDURE: A. These applications do not involve a subdivision of land. 4 MEMORANDUM TO: Vail Town Council FROM: Bob McLaurin, Town Manager RE: Town Manager's Report DATE: March 20, 2001 DONOVAN PARK UPDATE Continental West Constructors has requested to begin Site Preparation work at Donovan Park as early as possible. They have crews and equipment available and would like to put them to work. They are prepared to mobilize within a day or two of the issuance of a Notice to Proceed. The Site Preparation work includes snow removal, tree protection fencing; silt fencing/erosion control; vegetation removal, and traffic control. Continental West has chosen to remove many of the aspen trees by having them dug by a landscaper rather than bulldozing them. The trees are Continental West's responsibility and the landscaper will remove them for the salvage/resale value. There are no issues with this from a staff perspective, and in fact, would provide some additional latitude with the overall construction schedule. Staff would like direction from Council. COMMERCIAL CORE ENHANCEMENTS AND BANNERS Staff has been working on some minor aesthetic enhancements, to include: pavement imprinting, manhole covers, and off season (spring/summer/fall) banners. We will be prepared to present scheduled implementation for this upcoming season and costs for these improvements at the next Vail Village Walkabout scheduled for the March 27th work session. GENERAL SIGN CODE FOLLOWUP Responding to a recent Council Follow Up item regarding ski storage in LionsHead, staff wanted to reiterate its understanding that Council would like staff to "back off' on the enforcement of the sign code, albeit, informally. Staff is prepared to work with merchants to do a revised sign code. Based on staff resources, the first step will be to meet with the merchants; this will occur in April and we anticipate having a discussion with the council on this issue in May. Staff continues to work with sign code issues on a case-by-case basis. SEASONAL ICE HOCKEY RINK AT THE VAIL GOLF COURSE Staff felt it would be timely to refresh Council with the terms/conditions/and timeline for the ice dome. Attached you will find the PEC approval with modifications from the Vail Town Council, as well as the MOU between the Vail Recreation District and the Town of Vail as to the operation of the facility. It is our understanding Piet Pieters has signed the MOU but town staff is waiting further input from Council before the MOU becomes final. As a further update, Brent Wilson and Jim Goff (CEO) measured the noise output from the mechanical equipment and it measured 50db. However, adjacent 1-70 traffic noise measured about 62-65db at the property line for the adjacent properties. Therefore, the traffic from 1-70 obscures the noise output from the bubble and renders it inaudible. Also, Greg Hall and Larry Pardee have increased the budget for plowing services at the Golf Course to ensure the entire lot is plowed. The current conditional use permit expires April 1, 2001. TOWN OF VAIL BENCH DONATION PROGRAM Staff has met over the past year with retailers in the Village Core who are interested in supporting and duplicating to some degree a bench donation program such as Beaver Creek provides. It is staffs recommendation that a pilot program be started, to include bench installation in both the Vail Village and LionsHead commercial areas. Basic terms for the program would include: - $2,000 contribution (includes initial purchase, assembly, and maintenance) - Duration: 10 years - TOV property owners and business license holders have first option to purchase Staff would recommend the program be advertised immediately, with installation of this bench program occurring in time for this coming summer. Attached Council will find background material in regard to this proposal. TOV COMMUNITY SURVEY The Town of Vail annual community survey will be launched within the next week. Preliminary results will be available in May. VAIL POLICE VOLUNTEER PROGRAM The Vail Police Volunteer Program (VP2) is really gaining momentum. To date, 17 Valley residents have applied as volunteer candidates. The idea of starting a volunteer program at the Vail Police Department started with discussions during department retreats on how to improve department services. The objective of the program is to provide, not only essential community services carried out by volunteers, but to assist department staff with non-enforcement duties. The program is being implemented in three phases. The first phase will consist of assigning volunteers to in-house positions, such as mug shots assistant, librarian, supply/equipment assistant, administrative assistant and more. The second phase will consist of assigning volunteers to positions on the street, such as special events assistant, code enforcement assistant, Clancy assistant and more. The third phase would consist of assigning a volunteer to work as a call taker or dispatch assistant. As of this date, volunteers who are helping or will soon be on board helping the police department include: Long-time Vail resident, Frank D'Alessio, who is our most active volunteer and a member of the Vail Police Volunteer Program Task Group. (Frank has contributed hundreds of hours towards launching the program.) Clerical assistant, who is currently doing clerical work for the volunteer program. Crime analyst, who will soon be working with the Investigations Team. (This volunteer has a criminal justice degree!) Librarian, who will soon be cataloging the library. Colorado (TOV) and the Vail Recreation District (VRD), hereinafter referred to as t1ie Parties. A. PURPOSE: To effectively manage the use of the Vail Golf Course temporary ice facility (hereinafter referred to as "the Facility") for the mutual benefit of both parties. To provide a significant amount of ice time for organized hockey activities and public skating. S. OBJECTIVE AND STATEMENT OF MUTUAL INTERESTS AND BENEFITS: It is to the mutual benefit and interest of the Parties to manage the use of the Facility for the benefit of both organized and informal recreation activities. C. THE TOWN OF VAIL SHALL: 1) Provide the improvements to be used in the operation of the facility. D. VAIL RECREATION DISTRICT SHALL: 1) Manage the operation of the Facility in accordance with the provisions of this MOU. 2) Provide a minimum of 7.5 hours of public ice time each week at the Facility to supplement the 10.5 hours of weekly public ice time now provided at the Dobson Ice Arena. This public ice time will be provided between the hours of 7:30 a.m. and 11:00 p.m. As this agreement establishes "minimum" requirements, additional public ice time may be scheduled without amendment or modification to this MOU. E. MODIFICATION: Modifications within the scope of the instrument shall be made by mutual consent of the parties, by the issuance of a written modification, signed and dated by all parties, prior to any changes being executed. F. TERMINATION: As long as the improvements remain in place, this MOU cannot be terminated, in whole or in part, without the mutual written consent of both parties. G. PARTICIPATION IN SIMILAR AGREEMENTS: This instrument does not restrict the Town of Vail or Vail Recreation District from participating in similar activities, either individually or with the same or other public or private agencies, organizations or individuals. H. NON-FUND OBLIGATION DOCUMENT: This instrument is neither fiscal nor a funds obligating document. Any endeavor involving reimbursement, contribution of funds, or transfer of anything of value between the parties to this instrument will be handled in accordance with applicable laws, regulations, and procedures including those for government procurement and printing. 1. Introduction Town Council directed staff to begin to outline the needs for housing in the Town of Vail as it relates to the Mountain Bell site. Focus groups will be held on April 2nd and 3rd with local employees to help define the rental housing needs of local employees. Along with looking at the rental needs of local employees staff was also directed to look at the potential for incorporating the two existing early childhood schools into the site. The current lease for the two schools expires August 31, 2002. II. ABC and Learning Tree Schools A meeting was held March 6, 2001 with the Directors of both ABC and Learning Tree. At this meeting Chris Squadra of ARC Inc. was also present to help in outlining the potential costs and timeline of redeveloping the school buildings into one. The attached cost estimates are based on the list Council previously received from the schools as well as a sketch of a proposed building that would accommodate 60 students. The square footage required for each student is mandated by the accreditation that the schools maintain. Otis Odell of Odell Architects provided further evaluation of the land required by the schools. It was determined that approximately 1.25 acres is required for the schools. This allows for the building, outside play area, drop-off area as well as parking for both parents and staff. This information was incorporated into the estimated budget for construction. Also attached is a proposed schedule that would meet the school's goal of having a new facility in place by the time the current lease expires. Another schedule shows a potential schedule if the schools need to temporarily relocate during construction. III. Conclusion After the focus groups are held with local employees and the information can be summarized staff will present information summarizing both the housing and the school needs. The attached information will be helpful background as Council begins to define its goals for the Mountain Bell site. This project is for ?u US - it is not just for those with two homes, but for those with two 77% jobs as well. The Vail Center may very well be our last, best chance to put the heart back into our community. It could bring a sense of pride iC togetherness and the hometown feeling that some say we've lost 53% in Vail, but could get back if we all get behind this project. Vail's citizens deserves nothing less than the best.
