Direction Given durina Januarv 2001 Partnership Retreat:
• Reinstitute the Community Task Force as referenced in the 1995 Managed
Growth Agreement:
"TOV and VA will jointly appoint a broad-based community task
force by June 1, 1995 to explore additional mechanisms to better
utilize existing resources during the nonpeak periods and to
recommend a plan of action. The goal of the task force is to seek
out ways to coordinate events and pricing with the business community,
VVTCB and the Vail Valley Foundation to enhance nonpeak period
visitation. This task force, made up of four community residents and
business owners and members of the Assessment Committee,
referenced in Section VI.B., will meet at least four times a year."
Conclusion:
• With establishment of the Vail Local Marketing Advisory Committee in 1999,
it appears efforts would be duplicated in resurrecting the Task Force as
originally intended. Therefore, refining the role of the Task Force, as
originally outlined, may be in order.
Refinement Possibilities for TOV-VRI Discussion:
• Would the Vail Town Council consider directing the Vail Local Marketing
Advisory Committee to develop strategies for winter shoulder seasons (early
and late ski season) to more fully execute nonpeak activities described in the
Managed Growth Agreement?
• Would there be merit in creating a body to replace the Task Force for the
purpose of high-level strategic discussions and information-sharing on resort
community issues? This body could meet quarterly (or more often as
needed) and could be comprised of a board member and staff representative
from the following organizations:

Vail Resorts
Vail Chamber and Business Association (lodging representative, food &
beverage representative, retail representative)
Vail Valley Tourism and Convention Bureau

The Colorado Department of Transportation (CDOT) is holding the third set of Open Houses for
the I-70 Mountain Corridor Programmatic Environmental Impact Statement (PEIS). The
meetings will begin with a 30 minute open house where guests can review information about the
families of alternatives. Promptly at 4:30pm on 4/4 and 4/11 and at 1:30pm on 4/7 a 20 minute
presentation will be given followed by a 30 minute question and answer period. The team will
then break into small working groups devoted to specific aspects of the project. The purpose of

The purpose of this memo is to keep us informed of the number of Employee Housing Units
(EHUs) that exist within the Town of Vail.
As of today, we have 430 approved EHUs within the Town. They breakdown as follows:
231 EHUs created prior to Ordinance 9 series 1992 (which means that there is no
requirement that these units be occupied, and the restrictions are not in perpetuity.)
These units include:

(restriction expires in 2001)
33 dispersed units
(i.e. units connected to a single family home, duplex or other private development.)

Brain storming ideas for improving Town of Vail Commercial Area Quality
Actions Taken to Date:
• Parking Pay in lieu for retail properties in the village pedestrian area are now except
from parking pay -in-lieu
• Properties in Lionshead have significant incentive in the form of new development
standards to upgrade.
Rouah Ideas to improve Commercial Buildina Qualitv in the Villaae:
1. Implement an objective rating system, like the lodging quality initiative, to classify
commercial properties, i.e. Gold, Silver, Bronze, Not ranked
2. Properties not receiving at least a bronze ranking could receive a letter from the
Mayor requesting the owner work with the Town to improve the property to at least a
bronze ranking.
3. The Town could implement minimum maintenance requirement for buildings (need to
evaluate the legal ability to do this).
4. Implement an annual awards program to promote and acknowledge properties that
upgrade. There could also be various categories - best overall redevelopment, best
window display, and landscaping, pubic art....)
5. Fund a ULI team to visit Vail and recommend solutions to improve commercial and
retail quality.
6. Fund a position to be an advocate for commercial property improvements. This
person would help secure contracts and help owners through the TOV process.
7. Pool commercial projects together to increase bargaining position for construction
and reduce the overall cost.
8. Implement an incentive package to improve commercial quality
• Provide a tax credit for buildings that upgrade
• Advertise and promote businesses / properties that upgrade
• Develop a video for promoting outstanding upgrades (this could also show the
properties that really need to upgrade).
• Work with banks to provide low interest loans.
• Reduce or eliminate building permit fee for commercial property upgrades.
• Freeze property tax valuation on properties that upgrade and maintain the
property. Most likely would only be able to use the 4-mil TOV property tax as an
incentive.
• Develop a grant for design assistance to help with commercial upgrades.
9. Create more commercial area that will increase competition and encourage existing
property owners to upgrade, i.e. Lionshead, Village parking structure.

• Reinstitute the Community Task Force as referenced in the 1995 Managed
Growth Agreement:
"TOV and VA will jointly appoint a broad-based community task
force by June 1, 1995 to explore additional mechanisms to better
utilize existing resources during the nonpeak periods and to
recommend a plan of action. The goal of the task force is to seek
out ways to coordinate events and pricing with the business community,
WTCB and the Vail Valley Foundation to enhance nonpeak period
visitation. This task force, made up of four community residents and
business owners and members of the Assessment Committee,
referenced in Section V1. B., will meet at least four times a year."
Conclusion:
• With establishment of the Vail Local Marketing Advisory Committee in 1999,
it appears efforts would be duplicated in resurrecting the Task Force as
originally intended. Therefore, refining the role of the Task Force, as
originally outlined, may be in order.
Refinement Possibilities for TOV-VRI Discussion:
• Would the Vail Town Council consider directing the Vail Local Marketing
Advisory Committee to develop strategies for winter shoulder seasons (early
and late ski season) to more fully execute nonpeak activities described in the
Managed Growth Agreement?
• Would there be merit in creating a body to replace the Task Force for the
purpose of high-level strategic discussions and information-sharing on resort
community issues? This body could meet quarterly (or more often as
needed) and could be comprised of a board member and staff representative
from the following organizations:
Town of Vail
Vail Resorts
Vail Chamber and Business Association (lodging representative, food &
beverage representative, retail representative)
Vail Valley Tourism and Convention Bureau
Vail Commercial Property Owners Association
Vail Local Marketing Advisory Committee
Vail Village Homeowner's Association
Vail Valley Foundation
Vail Recreation District
Would it be appropriate for the Vail Town Mayor to chair such a body?
• Could this body become an extension of the peer resort group and serve to
represent Vail on fact-finding trips to other resorts?
• What other focus areas could this body represent?
Next Steps:
• Mayor Kurz and counterpart Jensen will discuss these possibilities with
organizational colleagues during the next few weeks.

RE: Update on the number of Employee Housing Units within the Town of Vail
The purpose of this memo is to keep us informed of the number of Employee Housing Units
(EHUs) that exist within the Town of Vail.
As of today, we have 430 approved EHUs within the Town. They breakdown as follows:
231 EHUs created prior to Ordinance 9 series 1992 (which means that there is no
requirement that these units be occupied, and the restrictions are not in perpetuity.)
These units include:
198 Timber Ridge units
(restriction expires in 2001)
33 dispersed units
(i.e. units connected to a single family home, duplex or other private development.)
24 EHUs created between Ordinance 9 series 1992 and Ordinance 14 of 1994 (which
means that these units are divided by type, that there is no requirement that the units be
occupied, and that the restrictions are in perpetuity.)
These units include:

175 EHUs created after Ordinance 14 of 1994 (which means that these units are divided by
type, that the units are required to be occupied, and that the restrictions are in perpetuity.)

Marriott Discussion:
George Ruther presented the situation of the Marriott's Design Review application and the
recent appeal by the Vail Spa. Typically, an appeal of an application stays all activity in
relation to the project, unless the staying of such application will present an imminent peril
to the property. As the Marriott was substantially damaged by the fire earlier this year, staff
has determined that a stay of the application would present an imminent peril to the property.
Staff is recommending that the PEC uphold the staff decision that the application not be stayed, in
accordance with the Town Code. A letter has been submitted by the Vail Spa, stating that notice is
required for this type of action.
Tom Moorhead, Town Attorney, stated that notice is not required for this action. John Schofield
asked if the applicant had standing. Tom Moorhead stated that whether or not the applicant has
standing, the administrator has the ability to make this finding. Galen Aasland asked about the
notice that has been given to the Vail Spa. Dick Cleveland asked about the definition of "imminent
peril." Tom Moorhead stated the applicant for the Marriott will speak to that. Henry Pratt presented
the existing conditions of the Marriott, including the status of steel beams which are supporting the
entire east half of the structure, which cannot be fixed without a building permit. John Schofield

questioned what the effect of a large spring snowfall would have on the safety of the structure.
Henry Pratt stated that the current structure would be in danger with a large heavy snowfall. Doug
Cahill stated that he supported the staff decision. John Schofield stated that he believed the current
status of the building, should the application be stayed, was an eminent peril, and believed that
expediting the reconstruction would be a benefit to the health, safety, and welfare of the community.
Dick Cleveland also stated that he supported the administrator's decision and recognized that
mitigation of the safety hazard was necessary. Chas Bernhart stated that he believed that the
PEC's role was to ensure the health, safety, and welfare of the community and he agreed with the
administrator's decision. Galen Aasland asked about the process.
John Schofield moved to uphold the staff decision that the Marriott did not constitute a major
exterior alteration. George Ruther clarified that that was not the decision being made today.
John Schofield struck his motion and moved to uphold the finding of the administrator that staying
the design review application of the Marriott would present an imminent peril to the property.
