RE: FINANCING WORKING CAPITAL FOR THE VAIL LOCAL
MARKETING DISTRICT
The issue of funding working capital for the Vail Local Marketing District in the amount
of approximately $350,000 still needs to be resolved. At the end of 2001, the Vail Local
Marketing District will need to borrow from the Town of Vail approximately $350,000 as
working capital to fund the 2001 Marketing Program. The working capital of $350,000 is
needed due to the lag time in getting the lodging tax. I have discussed with the Vail
Local Marketing District's attorney, Paul Cockrell, what the options are for dealing with
this debt at the end of the year. The attorney, Paul Cockrell with Collins and Cockrell,
has recommended three different solutions for dealing with this debt at the end of 2001.
1. The town transfer $350,000 to the Vail Local Marketing District and the town
enter into an intergovernmental agreement with the Vail Local Marketing District
that this $350,000 is a loan from the town to the Vail Local Marketing District and
will be repaid if and when funds are available. However, the town and the Vail
Local Marketing District need to understand that this is merely a moral obligation
and not an absolute obligation. If the town wants an absolute obligation from the
VLMD that this money will be paid back, then the second option needs to be
pursued.
2. The second option is that a Tabor election is held in the fall which would allow
the district to borrow this money and would become a legal obligation of the Vail
Local Marketing District.
3. Loan the money between the town and the Vail Local Marketing District for the
year 2001. Enter into the intergovernmental agreement as described in Option
(1). In 2002, reduce the marketing budget by $350,000 and in 2002 pay the
$350,000 money back to the town. This solution would solve the problem
indefinitely, giving the district the working capital it would need in the future to
operate.
This issue needs to be resolved so that the 2002 budget for the VLMD can be prepared.

RE: Status of Employee Housing Units within the Town of Vail
The purpose of this memo is to provide information the Council has requested regarding the
number of Employee Housing Units (EHUs) that exist within the Town of Vail, and the status of
their enforcement.
EHU count:
As of today, we have 440 approved EHUs within the Town. They break down as follows:
231 EHUs created prior to Ordinance 9 of 1992. (Owners are not required to respond to
our yearly enforcement letter, and the units are not required to be occupied. These
restrictions are not in perpetuity.)
These units include:
198 Timber Ridge units
(restriction expires in November of 2001)
33 dispersed units
(i.e. units connected to a private development.)
23 EHUs created between Ordinance 9 of 1992 and Ordinance 14 of 1994. (Owners are
required to respond to our yearly enforcement letter, however there is no requirement that
the units be occupied. These restrictions are in perpetuity.)
These units include:
23 dispersed units
176 EHUs created between Ordinance 14 of 1994 and Ordinance 6 of 2000. (Owners are
required to respond to our yearly enforcement letter, and the units are required to be
occupied. These restrictions are in perpetuity.)
These units include:
53 Vail Commons for-sale units
18 Vail Commons rental units
24 Buzzard Park seasonal units
18 Red Sandstone for-sale units
63 dispersed units (10 of these units are currently under construction and do not
yet have Certificates of Occupancy)

10 EHUs created after Ordinance 6 of 2000. (Owners are required to respond to our
yearly enforcement letter with a sworn affidavit. and the units are required to be occupied.
These restrictions are in perpetuity.)
These units include:
6 North Trail Town Homes for-sale units
3 dispersed units (3 of these units are currently under construction and do not yet
have Certificates of Occupancy)
Enforcement:
All deed restrictions that include a requirement that the owner respond to our yearly enforcement
letter include the provision that the responses be submitted to our office no later than February 1
of each year. Our 2000 letter, signed by the Town Manager, was mailed on December 27, 2000.
A follow-up letter addressed to our non-responders, signed by the Town Attorney, was mailed on
February 19, 2001. The results of our 2000 enforcement effort are as follows:
25 out of the 33 owners NOT required to respond to our yearly letter did so. According to
their responses, 27 full-time employees and 2 part-time employees are currently housed
in these units.
150 out of the 160 owners required to respond to our yearly letter did so. (These owners
were required to submit a sworn affidavit. Providing false information on such an affidavit
can be construed as the equivalent to perjury in a court of law.) According to their
responses, 190 full-time employees are currently housed in these units.

Next Steps:
Chapter 3 of Title 12 of the Vail Municipal Code provides for the enforcement of all zoning
regulations. According to Section 2 of this chapter, "The (zoning) Administrator and his/her
designees shall have the right to enter on any site or to enter any structure for the purpose of
investigation or inspection related to any provision of this Title..." Section 10 of Chapter 3 states
that "The owner or general agent of a building or premises where a violation of any provision of

this Title has been committed or shall exist ...shall be guilty of a misdemeanor and subject to
penalty as provided in Section 1-4-1 of this Code for each and every day that such violation
continues." Section 1-4-1 states that fines shall be no more than $999.00, however, every day
that a violation continues shall be considered a separate offense.
All EHU deed restrictions state that "the provisions hereof may be enforced by the Owner and the
Town." Only restrictions executed after Ordinance 6 of 2000 specifically state that "All employee
housing units governed by this title shall be operated and maintained in accordance with this title.
Failure to do so may result in enforcement proceedings in court of competent jurisdiction and in
accordance with Chapter 3 of Title 12."
Staff recommends that with the recent addition of a Code Enforcement Officer to the Community
Development Department, the inspection of non-compliant units could be implemented. Should
our Code Enforcement Officer find a unit in violation of the deed restriction, the owner would be
given a reasonable time to cure. After such time, a second inspection would occur. If the unit is
still not in compliance, court-determined fines could be imposed for every day from the date of the
first inspection until the unit is no longer in violation.

2003 World Kayak Championships

What: Vail has the opportunity to add a third gem to our crown by hosting another
World Championships. This would be the fourth time in twelve years that we
host such a world-class event in Vail. The World Kayak Championships happens
every two years with "Pre-Worlds" happening in the interim years (even years).
The Pre-Worlds and the World Championships are awarded at the proceeding
World Championships. The 2001 World Championships are to take place in Sort,
Spain June 25 through July 1St
The World Championships is an excellent opportunity for Vail to continue to
position itself as a year-round destination, appeal to the "echo-boom" generation
and reinforce our image as a world-class resort. The Worlds would additionally
give us excellent media opportunities nationally and globally.
When:
• Pre-Worlds: May 25 - 27, 2002
• Worlds: May 24 - June 1, 2003
How: Two things need to happen to give us a chance to host the World
Championships:
1. Fine-tune the Whitewater Park: We have now seen how the Park flows
at high water. We need to do some minor revisions to make the park a
world-class venue. Specifically, we need to focus the water a little tighter
over each of the structures to create bigger features. In particular, we need
to make the third feature the equivalent of what the Birds of Prey is to
Downhill skiing, a venue that is top of the line.
The total cost of the original project is significantly under budget. With
the massaging we need to do, we would still be under original cost
estimates. The cost to do the changes would be $50,000 from The RETT
fund.
2. Send a Bid-Contingency to Sort, Spain to land the 2003 World
Championships. In order to secure the event we would need to do a
presentation in Spain during the 2001 World Championships, June 25tH
July 1, 2001. The budget is outlined below for a group of five.

Benefits of the Worlds:
1. Additional room nights in May. An expected 250 athletes would compete in the
event. Each team is responsible to provide their own housing to their athletes.
On an average an athlete will spend two plus weeks in the host Town. Meaning
an estimated 875 room nights generated in late May (Currently the lowest
occupancy month in the calendar year). The average room rate during May is
$82, generating an estimated $71,750 in lodging revenue.
2. Early Summer Media. We would have an incredible story to be talking about in
what is traditionally known as our slowest month of the year.
3. International Attention. This would give us another opportunity to position
ourselves as a world-class resort on an international basis.
4. Great Positioning in the "Echo-Boom" Generation. The Rocky Mountain
News reported that the only growing sport among High School students in Denver
was kayaking (November, 2000)
5. Summer Positioning. The Denver Post reported that Vail is ahead in the
Summer game, by embracing things like Whitewater Parks.
Request for funds: The VVTCB is requesting assistance with the financial
obligations to send a contingency to bid on the World Championships. To share in the
cost of this endeavor, the VVTCB will absorb the increase in costs of the Pre-Worlds in
2002. Additional costs (TBD) for the 2003 World Championships will be requested in
our 2003 funding request.

WHAT:
Vail America Days, Vail's Fourth of July Celebration. Vail America Days rivals any Fourth of
July celebration in the country. Complete with fireworks, a community parade, and a 30-year
tradition of patriotic celebration.
This year, the event is facing new challenges:
• Chevrolet has been a sponsor of the event for the past 10 years. Due to recent
restructuring, the marketing branch of Chevrolet that provided the funds for this
sponsorship has dissolved; thus, ending the sponsorship relationship. With this
restructuring, the $12,500 sponsorship from Chevrolet disappeared.
• Selling new sponsorship at the presenting level has proved challenging due to the fact that
the VVTCB's marketing efforts are focused on non-peak time periods; thus, eliminating
the marketing element inclusive in most sponsorship packages. The VVTCB's focus on
these non-peak time periods (such as May and September) is not a new initiative. We were
fortunate to have had a Presenting Sponsor, Chevrolet, that was not interested in media
impressions. The VVTCB has approached more than 100 companies regarding
sponsorship support with most declining participation due to the lack of advertising
visibility in the Front Range. Yet, the VVTCB still feels that promoting Vail during high
occupancy time periods in not within Vail's best interest.
FUNDING
Request from the Town. VVTCB is requesting additional funds of $15,000 from the Town of
Vail in order to maintain current fireworks and entertainment levels.
VVTCB Investment. VVTCB views our involvement with Vail America Days as a community
sponsorship. We budget to loose money on the event even when all sponsorship goals are met.
Again, the VVTCB has approached more than 100 companies nationally including many in the
Vail Valley without much success.
WHY:
Without the sponsorship support from the Town of Vail, the VVTCB would be forced to make
budget cuts resulting in fewer bands, a shorter fireworks display, and less entertainment. These
cutbacks would undoubtedly decrease the caliber of the event in the eyes of our guests and local
community. Fireworks and entertainment account for more than 73% of the entire event budget
and would suffer the greatest loss without funds.

Enclosed is a request package for your sponsorship 'to the annual Vail Valley
Rodeo series a Colorado non-profit event. We are in our seventh (7th) season and have
grown to host over'25,000 guests annually during our twelve (12) performances each
summer. These guests come from all over the world and we are fortunate to have a huge
"locals" following each week as well. Our guests are transported from Summit County,
the town of Vail, Avon, Beaver Creek, Bachelor Gulch, Arrowhead, Edwards, Cordillera,
Bellyache, Wolcott, Eagle, and Route County. They are predominately shuttled via hotel
van or our local bus system. You may be aware that Evergreen Lodge, Roost Lodge, The
Westin, Manor Vail Lodge, Sonnenalp, Marriot Hotel, Lodge at Vail, and West Vail Lodge
are huge local supporters of ours, as we start our rodeo every Thursday evening at 5:30
p.m. and finish by 8:30 p.m. we are able to send all guests back up valley to be
entertained in town or back at their hotels.
We utilize the Perry Creek 5th arena each week and were just recently given'
approval by Eagle County to continue with our fine western event this summer (thus the
tardy request to you). With all of our respect, we are requesting that the Town of Vail
saddle up and become a sponsor of our fine western culture event as we are proud to be a

Dear Mr.McLauran:
I am writing both to thank you for your previous support and to appeal for a
critical, and, hopefully, final contribution to the Colorado Alliance for a Rapid Transit
Solution (CARTS). As you are probably aware, the Secretary of State has approved the
ballot language for a TABOR initiative that will transfer $50 million to the Colorado
Intermountain Fixed Guideway Authority (CIFGA) to conduct a test and demonstration
of its proposed high speed monorail system at the Transportation Technology Test Center
(TTCI) in Pueblo, Colorado, the nation's premiere transportation vehicle testing facility.
I recently requested an unpaid, six month leave of absence from my position as CIFGA's
Executive Director in order to coordinate the petition campaign that will place this
question on the November 2001 ballot.
We must collect more than a hundred thousand signatures from registered
Colorado voters by August 6. Organizing this effort, particularly if paid petitioners prove
to be needed, requires cash on the barrelhead. I urge you to regard this appeal as a way to
guarantee the value of your previous contributions. Without the assistance of the towns
and cities along the I-70 corridor CARTS would never have been successful in creating
CIFGA. After three years of effort, I believe we not only have a solution to the growing
congestions on I-70 but a proposal which is popular with Colorado residents. A recent
statewide poll found that voters favored the monorail by nearly a 2 to 1 margin over a
further widening of I-70.
This November's ballot question provides us a unique chance to reshape
Colorado's future in a way that protects the unique qualities that we value so highly. Lets
not kid ourselves, the default solution will be not only to widen I-70, thereby pouring
ever more cars into our mountain co,iu,iLanities, but ultimately to crisscross our mountain
valleys with a network of freeways. I am not suggesting a specific amount in this letter
because I want you to dig as deep as you can to assist this effort. I promise you that
every dollar will be well spent. In the fall we will approach the private sector to fund the
election campaign. For now our sights are set on collecting the signatures necessary to
put this question before voters. Your help is critical.

Over the years I have supported deed restricted housing projects in the Town. As a
member of the Towns' PEC, I have voted for approval of recommendation of required
Zoning changes to allow for the new deed restricted Project adjacent to Ellifson Park.
This is 4 lots away from my home, and I can see it right out my dining room window.
I believe that project is good for our neighborhood and our community. I believe the
new homeowners are good neighbors will make many important contributions to our
Town. I have also supported the concept of quality deed restricted housing in
conjunction with a number of SDD's over the last 5 years. And I also believe they are
good projects for the developers' and the Town.
In 1990 I deed restricted unit attached to my home. Before both the Town and I signed
the deed restriction on my property; I researched the Town Zoning code, read the
applicable Town Ordinance, and met with the Town Staff. The deed restriction clearly
states that neither the Town nor I can change the terms without mutual consent. I relied
on that. I would under no condition sign the current deed restriction in the P/S zone
district. I signed a restriction for a finite period of time for what I felt was an
appropriate benefit.
One of the most unsettling items that I have dealt with over the past 2 years are the
forms that the Town has sent to me in conjunction with my unit. The most charitable
way I can look at them is that they misrepresent what the Town and I agreed to. I have
spoken to Russ Forrest in the past about this. I believe that I am accountable for what I
agreed to. I also believe that the Town is accountable for what it agreed to. There are
four types of deed restrictions in the P/S district, not a one form fits all.
Last year when the town revised the deed restriction ordinance, I voted against it as a
member of the PEC. The ordinance had no effect on my unit. However, I believe that
what the Town has created is a punitive system of us against them, a one sided control.
I believe that what we should have is a format for mutual understanding and
accountability. Leadership, as well as management is needed. Without that, I believe
4as o eed restricted units in the P/S district and similar districts will fail.

RE: Contributions
Dear:
The Town Council has reviewed and approved the contribution request procedure for 2001
contributions. Please note that contributions will only be awarded to applicants who can show the
contribution will be used directly to benefit the entire community of Vail.
Attached please find the following forms that relate format and policy the Town of Vail has
implemented in regard to requests for funding. These forms are as follows:
1) Contribution Policy/Disclosure
2) Application for Town of Vail Funding
3) Application for Town of Vail Funding/Balance Sheet
4) Application for Town of Vail Funding/Statement of Sources and Uses
5) List of 2001 Requests and Approvals
A completed submission must be received at the Town of Vail by Friday, August 25, 2000, in order to
qualify for funding in 2001. Funding will be determined solely from the written application; no in-
person presentations will be held. If the Town Council has questions about your application, you may
be contacted by a staff member at a later date. Requests for parking passes and/or parking days must
be included in the disclosure. Individual requests throughout the year, outside this process, will not be
considered.
When making your request, please keep in mind the Town is experiencing uncertainty in its revenue
levels and, therefore, is not planning to increase its contribution budget.

CONTRIBUTION POLICY
TOWN OF VAIL
1. All contribution requests received by the Town of Vail will be processed in the following
manner:
A. All requests must be submittted in writing using the Town's application for funding.
You may submit financial information (Balance Sheet and Statement of Sources and
Uses) ONLY IF it does NOT exceed 2 pages in length. Please do not attach additional
information. Incomplete applications and supplemental information will not be
accepted. The Town Council will only be given your completed application forms. No
supplemental information will be given to the Town Council.
B. All applications for funding in 2001 shall be sent to the Town by Thursday, August 31,
2000.
L C. The Town Council will evaluate the various proposals based on their direct benefit to
the community of Vail, fulfillment of the town's mission, and how this contribution will
affect our resort community's future health. The Town Council's mission statement
reads: In order to be the premier mountain resort community, we're committed to
providing citizens and guests with a superior level of environmentally-sensitive services
and an abundance of recreational, educational, and cultural opportunities.
2. Disclosures to all applicants:
A. No money will be disbursed until March 1, 2001. Each recipient must invoice the Town
of Vail for the total approved contribution prior to March 1, 2001.
B. Because of uncertainty of revenue estimates, please note the following possibilities:
1) Contribution funding may be reduced based on 2000 revenues.
2) The Town of Vail may choose to disburse funding in quarterly installments
throughout 2001.
C. Notification of awards will be sent after the Council approves the final budget,
currently scheduled for November, 2000
