RULES OF PROCEDURE
BOARD OF BUILDING AND -FIRE CODES APPEALS
TOWN OF VAIL, COLORADO
PREFACE
Article 10, Chapter 1 of the Town of Vail Municipal Code adopts by reference certain
model building and fire codes, including selected amendments to those codes. The
adopted codes include provisions for the establishment of appeals boards and authorize
appeals boards to adopt rules and regulations governing their procedures.
The following rules of procedure have been adopted by the Building and Fire Codes
Board of Appeals in the interest of economical, efficient, expeditious and equitable
determination of all matters properly presented to the board.

I. MAKEUP OF BOARD. The Board of Building and Fire Codes Appeals, hereinafter
referred to as "THE BOARD," shall consist of five (5) regular members and two (2)
alternate members, all of whom shall be full time residents of the County of Eagle,
Colorado. Alternate members shall be called by the board chairman to hear appeals
during the absence or disqualification of a regular member. Members shall be appointed
by the Town Council as follows: one for five years, one for four years, one for three
years, one for two years and one for one year. Thereafter, each new member shall serve
for five years or until a successor has been appointed. Alternate members shall be
appointed for five years or until a successor has been appointed.
II. MEMBER QUALIFICATIONS; LEGAL ADVISOR; SECRETARY
(A)MEMBER QUALIFICATIONS: At least three (3) regular members and one (1)
alternate member of the Board shall be either a licensed architect, a registered
engineer with building related structural engineering experience, or a construction
company executive or superintendent with at least ten (10) years of construction
experience, five of which shall have been in responsible charge of work. Board
members shall not be employees of the Town. No Board member may hear or vote.
upon any appeal in which that member has any personal, professional, or financial
interest, pursuant to applicable state statutes and Town Charter and ordinance
provisions. In addition, the following qualifications for Board members are
desirable:
1. A registered design professional with mechanical and plumbing engineering
experience; or a mechanical and plumbing contractor with at least ten years'
experience, five of which shall have been in responsible charge of work.
2. A registered design professional with electrical engineering experience; or an
electrical contractor with at least ten years' experience, five of which shall have
been in responsible charge of work.
3. A registered design professional with fire protection engineering experience; or a
fire protection contractor with at least ten years' experience, five of which shall
have been in responsible charge of work.
4. An individual with at least ten years' general construction experience, five of
which shall have been in responsible charge of work.
(B) LEGAL ADVISOR. The Town Attorney shall serve as legal advisor to the board.
(C) SECRETARY TO THE BOARD: The Building Official shall serve as Secretary to
the Board for building-codes-related appeals and the Fire Chief shall serve as Secretary to
the Board for fire-code-related appeals, respectively. The Secretary shall be the
custodian of the Board's records, conduct the Board's correspondence, collect all fees, and
be responsible for the clerical work of the Board. The Secretary to the Board shall have
no voting power on any matter coming before the Board.
III. POWERS AND DUTIES:
(A) APPEALS: The Board shall have jurisdiction to hear the following matters:
1. The Chief Building Official or Fire Marshal has rejected or refused to approve an
alternate method or material of construction which the appellant alleges to be the
equivalent of that prescribed in the applicable code in terms of suitability, strength,
effectiveness, fire resistance, durability, safety, or sanitation. In order to grant the
appellant's request, the Board must find that test results, factual documentation, or other
such data or evidence provided by the appellant substantiates the appellant's claim that
the method or material of construction is equal to or superior to that prescribed in the
applicable code in terms of suitability strength, effectiveness, fire resistance, durability,
safety, or sanitation.
2. The appellant alleges that the Chief Building Official or Fire Marshal has made an
error in the interpretation of a Code. In order to grant the appellant's request, the Board
must find that the Chief Building Official or Fire Marshal has made an error in the
interpretation of a code.
3. The appellant alleges that the Chief Building Official or Fire Marshal is imposing
certain provisions of a code which do not apply to the project being constructed. In order
to grant the appellant's request, the Board must find that the provisions of the applicable
code do not apply to the project being constructed.
4. The appellant alleges that the Chief Building Official or Fire Marshal is imposing a
wrongful requirement in a building matter that is not specifically addressed in the
applicable code. In order to grant the appellant's request, the Board must find that the
requirement is not addressed in the applicable code, is not appropriate; and that granting
the request would be consistent with the intent of the applicable code.
5. The appellant alleges that there are practical difficulties or unnecessary hardships
caused by conformance to the strict letter of a code, that the literal interpretation of a
code will product undesirable results which are inconsistent with the intent of the
applicable code, or that there are special individual reasons that make the strict
application of the provisions of a code impractical. In order to grant the appellant's
request, the Board must find that all of the following requirements would be satisfied:
a. The granting of the request would not endanger public health, safety, or welfare;
b. The granting of the request would be in compliance with the spirit and intent of the
applicable code;
c. The granting of the request is site specific and shall not in any way constitute a
modification of the applicable code;
d. The granting of the request would result in substantial justice being done; and
e. There are practical difficulties or unnecessary hardships involved in conforming to the
strict provisions of the applicable code, the literal interpretation of the applicable code
will produce undesirable results which are not consistent with the intent of the applicable
code, or there are special individual reasons that make strict conformance to the
provisions of the applicable code impractical.
6. The appellant alleges that an omission or error in the plans, specifications, or other data
submitted to the Town for review was not addressed by Town Staff and has resulted in a
code violation which the Chief Building Official or the Fire Marshal is now requiring to
be corrected and brought into compliance with the applicable code. In order to grant the
appellant's request, the Board must find that the Code violation resulting from the
omission or error in the plans, specifications, or other data is not substantial in nature and
that public health, safety, or welfare will not be endangered in the absence of the
correction.
7. The appellant alleges that the Chief Building Official has erred in issuing a notice or
order or in taking an action under the Uniform Code for the Abatement of Dangerous
Buildings. In order to grant the appellant's request, the Board must find that the Chief
Building Official erred in the enforcement of the Uniform Code for the Abatement of
Dangerous Buildings. The procedure for appeals brought under this paragraph shall be
consistent with these rules of procedure and with the Uniform Abatement of Dangerous
Buildings Code. However, if a conflict exists in the provisions, the latter shall control.
(B) DECISIONS OF THE BOARD: The Board shall render a written decision within
fifteen (15) days after a hearing, accompanied by finding of fact and conclusions
based thereon. Conclusions based upon any provision of this document, a Code, or
any other Town of Vail ordinance, rule or regulation shall contain a reference to such
provision, ordinance, rule, or regulation and shall also contain the reason the
conclusion is appropriate in light of the facts found. In rendering a decision, the
Board may grant, modify, or deny the request. A decision in favor of the appellant
shall grant the matter requested and shall be an order directed to the Chief Building
Official or Fire Marshal to carry out such action subject to any conditions or
modifications .imposed by the Board.
(C) CODE ADOPTIONS AND AMENDMENTS. The Board shall also serve as a
technical advisory body to the Town Council by reviewing proposed building and
fire codes adoptions and amendments and making recommendations to the Town
Council.
IV. APPLICABLE CODES: The provisions of this Chapter shall apply to all building
and fire codes and amendments thereto as adopted by reference in Article 10, Chapter 1
of the Town of Vail Municipal Code.
V. MEETINGS:
(A) REGULAR MEETINGS: The Board shall meet once a month unless there is no
business before the Board and there are no requests to be heard or considered. Three (3)
Board members shall constitute a quorum and shall be required for the conduct of any

meeting or the taking of any action. A majority of the votes cast shall be required to grant
any request. An appellant may request postponement of a hearing if fewer than a total of
five (5) regular and alternate members are present. A fee of fifty dollars ($50) shall be
paid to the secretary to the Board with every application for a hearing before the Board at
a regularly scheduled meeting.
(B) SPECIAL MEETINGS: The chairperson may schedule special meetings of the Board
at such times as deemed necessary by the Board upon receipt of a written request therefor
from the appellant. Such request shall be made on forms provided by the Building
Official. Special hearings shall be paid for by the appellant in the amount of one hundred
dollars ($100). Upon approval. of the appellant's request for a special hearing, a special
hearing shall be scheduled and the appellant shall be notified of the date for the hearing.
VI. CHAIRPERSON AND VICE-CHAIRPERSON. The Board shall annually elect two
of its members to serve as a Chairperson and aVice-Chairperson, respectively.
VII. ADDITIONAL RULES OF PROCEDURE: The Board may adopt additional rules
of procedure for the conduct of its business so long as they are not in conflict with any of
the provisions of these rules of procedure . A copy of all rules of procedure and
amendments thereto shall be kept on file with the Building Official and made available to
the public upon request.
VIII. HEARINGS: The Board shall conduct hearings and make decisions in accordance
with the following requirements:
(A) All hearings shall be open to the public. The secretary to the Board shall notify all
interested parties of the time and place of hearings.
(B) The Board shall keep a record of the proceedings, either stenographically or by sound
recording. At the hearing, the Secretary to the Board shall record the vote of each
member on every case or, if a member is absent or fails to vote, shall record such fact. A
transcript of the proceedings and copies of graphic or written material received in
evidence shall be made available to any person upon request and payment in advance of
the estimated cost of production.
(C) At the hearing, following the introduction of the case, the Building Official or Fire
Marshal, or their designee, may present the Town's position and recommendation, after
which the appellant or a representative of the appellant may present any pertinent
information regarding the request. The burden of proof shall be on the appellant.
(D) All witnesses shall be sworn or shall otherwise affirm their testimony in the manner
required in the courts of record in the Town of Vail.
IX. APPEALS FROM DECISIONS OF THE BOARD: The City or the appellant may
appeal a decision of the Board to the District Court under the Colorado Rules of Civil
Procedure, Rule 106(a)(4).
X. ACTING CHAIRPERSON; QUORUM; PROCEDURE: In the absence of the elected
chairperson, the vice-chairperson shall assume the duties of the chairperson for that
respective meeting. A quorum shall consist of three (3) members, and a decision of a
majority of the members present shall control. All public hearings shall at a minimum be
recorded electronically, or, as deemed necessary by the chairperson, maybe
stenographically recorded by a court reporter engaged by the city and paid out of fees
paid by the applicant.

PUBLIC NOTICE
NOTICE IS HEREBY GIVEN that five vacancies and two alternate positions exist
on the Town of Vail Building and Fire Codes Appeals board (B&FCA). The board
will operate with five regular and two alternate members. Applications are being
accepted for the seven positions. Applicants must be Eagle County residents and
be either a licensed architect, a registered engineer with building-related
engineering experience, a construction company executive or superintendent
with at least ten years of construction experience or an individual with similar
building design and construction knowledge and experience.
Duties of the five-member B&FCA (plus two alternates) include reviewing
disputes over the equivalency of alternate building materials and methods of
construction, as well as interpretations of the town building and fire codes,
among other issues. The board will also review proposed building and fire codes
amendments and code updates, and serve as technical advisors to the town
council regarding the adoption of proposed amendments and updates..
The terms of each new appointment will begin on April 1, 2002. The terms are
staggered so that there is a 1-year term, a 2-year term, a 3-yearterm, a 4-year
term, and a 5-year term. The alternates will be appointed to one-year terms.
The B&FCA will meet as required. Although the position is voluntary, the Town
provides each member with a summer recreation pass OR blue parking. pass in
appreciation of the contribution to our community.
Persons interested in serving on the B&FCA board should submit letters of
interest and experience to the Vail Town Council, Attn: Lorelei Donaldson, Town
Clerk, 75 South Frontage Road, Vail, CO 81657 by mail or in person no later
than 5:00 p.m. on Wednesday, February 13, 2002. All applicants will be
interviewed by the Town Council at their afternoon work session on Tuesday,
February 19, 2002, .with appointments to be made at the evening Council

I vvould like to throw my hat into the ring to be considered for a position on the Town of Vail's Building and Fire Codes
Appeals Board.
As you can see from my enclosed resume, Construction and Architecture is what I do. I am a licensed Architect in Colorado,
Ohio and Massachusetts and have practiced with local firms for the past twelve years inducting my own firm here in Vail the
post three years. My experiences have brought me knowledge of three of the Nation's Building Codes as well as direct
involvement in Fire Restoration and the ensuing Building Code upgrades that affect our Community.
Also, I have immensely enjoyed my past six years with the Art 8 Public Places Board, but I will not be seeking re-
appointment when my term ends this spring. I am hoping to continue my involvement in the Town of Vail such as my
extensive experiences with the AIPP Board, inducting organizing the Seibert Circle Design Competition and Selection process,
the lionshead Master Plan, and the Art in Public Places Master Plan.

Subject: Revisions to the sign code
INTRODUCTION
The purpose of this memo is to update the Town Council on both staff and the
Vail Chamber and Business Associations interest in revising the sign code. If
Council is uncomfortable with staff working on revisions to the sign code it would
be valuable to know now before further discussions occur with the business
community.
2. BACKGROUND/PROBLEM STATEMENT
Planning staff has for the last year discussed numerous problems with the sign
code with Vail merchants. The Vail Chamber and Business Association has
asked staff work with them on revisions to the sign code to address the following
problems:
1. There is no purpose statement for the sign code. This is a significant fault in
any regulation.
2. The Code is difficult to understand and communicate to both new staff
members and merchants. The size and number of signs depends on the type
of business and the frontage a business has on a road or pedestrian right of
way. The current sign code is over 50 pages in length. Many comparable
codes that achieve a higher level of quality are 10-15 pages in length.
3. There are numerous sections of the sign code which simply don't make
sense. Examples of sections that are either loopholes or simply don't make
sense include: prohibiting neon signs but allowing argon sign; allowing
unregulated signage 3 feet from a window i.e. McDonalds; and addressing
signage in pedestrian areas versus business on roads i.e., East Vail signs
must be the same size as Vail Village signs.
Over the Christmas Holidays both the Chamber and the Town received
complaints about temporary signs and outdoor displays. This has prompted an
increase in enforcement. In fact the VCBA is actively working with the Town to
enforce temporary signs which have been the subject of complaints from guests.
The process for enforcement actions involves first warning a manager that they
have an illegal sign and giving them 15 days to remove the illegal sign. If after
15 days the merchant does not comply a citation is issued. Signs can be
immediately removed by the Town if they are in a public right of way.
The VCBA has formed a sign committee to work with the Town on this issue and
a tour to discuss sign issues occurred in December of 2001. On February 12tH
staff met again with Merchants where they expressed their interest in moving
forward with revisions to the sign code. The input staff has received to date from
merchants has been focused on:
• Creating a sign code that results in high quality retail villages.
• Simplifying the code
• Consistently enforcing the adopted code.
3. NEXT STEPS:
Staff is working on developing an outline for sign code changes. Staff has
accumulated examples from other communities along with identifying a number
of examples of signage in Vail that have been helpful in developing ideas on the
purpose of the sign code and how to develop a sign code based on a stated
purpose. Specific next steps include:
• Staff develops an outline of potential changes
• Present to the Council, PEC, and DRB on sign programs to solicit
potential changes to the Vail sign code.
• Sign Code Committee Meeting on March 19tH
• Review language with Merchants on April Stn
• Present proposed Changes to PEC, DRB, and Council
• Prepare Ordinance for review and approval (May, 2002)
