BACKGROUND RATIONALE: On March 5th, Merv Lapin
appeared before Council to request that a committee be sanctioned
by Council to study a site for a memorial park or cemetery. The last
unsuccessful attempt at providing a local Vail cemetery occurred
several years ago, and an election determined the residents in Vail
would support operating and maintaining the cemetery but would
not fund the capital construction of this cemetery. At the time, the
location was the upper bench of Donovan Park, which has
subsequently been placed in a special Charter category of
Designated Open Space (Section 13.11), such designation can be
changed only through an election. Council will also recall the local
veteran's group has approached Council about establishing a
memorial in one of the town's park areas and is still actively
pursuing this idea.
Staff would like direction from Council on whether this idea should
be again pursued and whether public moneys should be used to
fund this project.

Dear Bob,
In accordance with the current Town of Vail (TOV;
Town) and Vail Park and Recreation District (VRD; District)
Lease (The Lease) dated December 21, 1993 the VRD
respectfully requests reimbursement of various capital costs
associated with the Dobson additions and renovations project of
2001. Specifically, section 3.B.v. of The Lease states, "The
repair, maintenance, and replacement of the refrigeration system
for the ice surface in the Dobson Ice Arena shall be the sole
responsibility and cost of the District." Further, "The Town shall
be responsible for all capital improvements including
replacement of structural and non-structural components such as
would be depreciable pursuant to the federal tax rules and
regulations."
I have provided a cost breakdown (Exhibit A) detailing
the Four (4) primary components of this project. In summary
they are; Ice Replacement, $870,080.00; Site work,
$634,650.00; Additions and Renovations, $1,994,502.00; and
ARRUP Work, $89,950. Based on the above referenced lease
language the VRD is seeking reimbursement for the Site work
and Additions and Renovations components of the project (TOV
has paid for ARRUP) which totals $2,629,152.00.
As you maybe aware the VRD issued Series 2002
Enterprise Revenue Notes totaling $3,445,000.00 to fund this
project. The term of these notes is 20 years. I would offer a 20-
yearpayback from the town, which could be applied towards the
annual debt service requirements of the VRD. The particulars

RE: MEMORIAL SITE
In preparation for Council's work session on April 16th set to provide direction on
a local Vail "memorial site," staff wanted to summarize discussions with Moses
Gonzales, representing the local VFW. Merv Lapin also approached Council at
their evening meeting March 5th to request a similar program. As well, staff has
received informal inquiries from others. Although the VFW is proposing an
approximately 3,000 SF site more in military alignment with flags and a "naming
wall," Merv's suggestion also included simple plaques with names and dates, and
perhaps, an area in which to spread ashes.
In an inventory of currently owned parks and open spaces, the following sites
have been identified as possible locations (but this list does not preclude
consideration of other areas):
- Ford Park "lowest" bench behind and to the south of the current picnic paviltion
- Donovan Park
1) Lower bench Phase I I area
2) Entry to lower bench
3) Middle bench
- Stephen's Park -east end
- Intermountain pocket park (former location of Interlochen swimming pool)
- Roger Staub Park (west of Vorlaufer)
- Booth Creek tennis court site
- Par 3/Tract A
- King Arthur's Court (immediately south of Bighorn Park/East Vail)
- Katsos, off Bridge Road
- In conjunction with the °'Front Door" Project

Also considered but ultimately discarded:
- Ruder Cemetery, Lot 1, Block 9, Intermountain/2850 Bassingdale (remote,
access to site difficult, no parking)
- Bighorn Park (eventual relocation of memorial site to east end of park, thus
adjacent to restrooms and picnic facility, unacceptable to veterans; experimental
free run dog park)
- Donovan Park upper bench (designated open space constraints and political
challenges).
- 4 lots east end of Bighorn (remote, steep, limited parking)
Staff would like direction as to how to proceed. If the direction is to form a
committee to select a location (or to investigate further in some other fashion),
staff would also request Council prioritize public space to be considered, as well
as clarify what would be included in the design.

Operations:
• Winter -Both centers were open everyday from 9:00 - S:OOpm. The Village booth
was usually open by 8:00 am and stayed open until 6:00 pm. We have found that
once it gets dark in the winter, we do not see many guests. We have maintained the
24 hour phones outside both of the centers to assist guests when. we are closed
(after hours).
• Off season hours will continue now until Memorial Day weekend. Both centers will be
open -Vail Village 9:00 - 5:00 and Lionshead hours will vary.
• Summer - We will be open from 9:00 to 7:00 everyday. Staffing levels will consist of
2 staff members in each booth

• Room nights outside of Vail occurred when Vail was sold out (usually on Friday
and Saturday nights and Holidays) as well as when Vail properties were not
within the guests price range -all economy properties in Vail were called first
and then the guest sent out of Vail when they were sold out.
• The goal of the information centers is to keep the guest in Vail, if that is not
possible, we try to keep them in the Valley with the knowledge that they will come
.back to dine and shop more so than if we let them leave the Valley to go to
Summit County or Aspen.
Activities:
• November 1, 2001 -April 15, 2002
• Total reservations - 331 for a total of 653 guests
Programs:
• Concierge Web-site
This program will take the visitor services department into the next realm. By using
technology, the information that is in the information. services staff's minds will now
be accessible to all front line employees in Vail. Partnering with Vail Resorts on this
will allow for the information to be compiled and distributed to all .parties. The goal of
the program into enhance the guest's stay and give them the best level of product
knowledge possible by all front line employees. Currently we are testing the program
with 15 lodges and will launch to the entire community before the summer season.

Community Host Program
o The community host program is a partnership with the Town of Vail and Vail
resorts. The TOV supplies 25 blue parking pass, VRI supplies 25 season ski
passes and the VVCTB provides the management of the program.
o The hosts assist the guests from the parking structures to the mountain, the goal
is to create a streamlined process from the time they park their cars till they
reach the lifts. They serve as the first impression of Vail and assist with
answering many questions about the town.

• 45 active full time community hosts
• _ 10-12 hosts per day on the streets
• 45 actual host days
• 1,980 hours of customer service
• Valley Wide Map
o In conjunction with the Chamber department we produce the Valley Wide map.
The goal of this program is to create one map that will work for all uses, a map
for our day guest {pedestrian), a source for building locations and as a driving
map for the Va11ey.
• Vail 101
This program is geared directly towards employees. The {nformation Services staff
holds "Vail 101" sessions at the business location or in the form of a walking tour to
train front line staff on Vail Information. The course will focus 50/50 on Vail's History
and basic guest services information.
o The goal of this program is to get the front line employees excited about Vail's
history and provide them with the basic questions that all guests need answered.
We have seen the desire from guests that every employee in town have the
answers to their basic questions. This program will assist in addressing this guest
need.
• Vail Walking Tours
The Tour aspect of the Information Services Department has two components.
o Historical walking tour of Vail. This tour is aimed towards guests in the area and
allows for them to learn a little history of the area as well as have the opportunity
to speak with a local. The tours are offered on a regular basis throughout the
summer.
o Custom Vail Tours: These tours are aimed towards corporate groups and can be
geared towards what ever the group is looking for. Examples of tours offered
include: Gallery, Dining, Shopping, Alpine Garden and Sculpture tours. These
tours benefit retail and dining establishments in both Vail Village and Lionshead.
They also provide an insight to the guests of everything Vail has to offer.
• Parade of events:
The Parade of Events program collects and distributes valley wide event information.
The program consists of Monthly calendars listing major tourist related events that
are distributed to all retail, dining and lodging outlets throughout Vail Valley. The
Discover the Vail Valley brochures are printed monthly in the winter and biweekly in
the summer. The brochure includes information on current events, daily activities,
children's activities, high altitude health tips as well as event, activity and restaurant
features. The brochure is delivered to lodging properties throughout Vail Va11ey.

This website is geared towards Vail Valley Concierge, Front Desk and Reservations
staffs. The goal of this program is to provide an on-line source of information to better
assist the front line staff when helping guests.
The program will have up to date information on Vail Resorts, restaurants, activities,

RE: CRITICAL STRATEGIES: HOUSING
I believe there are 2 items that need additional discussion. The first is the
employee generation ordinance and the second is the Berry Creek housing
project. At the meeting on Tuesday, Nina Timm and I will be prepared to discuss
these items in detail. Attached to this memo is a brief update from Nina
regarding the Berry Creek housing. If you have questions or need additional

Berry Creek 5`'' Update
- Through an agreement between Eagle County and the Eagle County School District
the site for affordable housing has grown from 16 acres to 31 acres. The number of
proposed units has gone from approximately 160 to 285.
- Eagle County signed a Development Agreement with ASW (Auerbach Southwest,
Inc.) on March _, 2002. The Development Agreement outlines the responsibilities
ofboth ASW and Eagle County. As the development will not go through the Town
review process the Town does not have a role in this. An iGA needs to be
implemented between the County and the Town to define roles going forward.
- Eagle County Commissioners approved the overall PUD for Berry Creek 5`''

the site for affordable housing has grown from 16 acres to 31 acres. The number of
proposed units has gone from approximately 160 to 285.
I, - Eagle County signed a Development Agreement with ASW (Auerbach Southwest,

of both ASW and Eagle County.. As the development will not go through the Town

AN ORDINANCE ADOPTING THE TOWN OF VAIL COMMISSION ON SPECIAL EVENTS ("CSE") AND;
ESTABLISHING A COMMISSION FOR THE PROCESS OF
REVIEWING ANDIOR FACILITATING PUBLIC SPECIAL EVENTS IN THE TOWN OF VAIL;
AND SETTING FORTH DETAILS IN REGARD THERETO.
WHEREAS, it is the Town Council's opinion that the health, safety and welfare of the citizens of the
Town of Vail would be enhanced by the establishment of a special events program setting forth policies and
guidelines relating to the funding, reviewing, oversight and orchestration of special events to be presented in
the Town of Vail.
WHEREAS, to insure a single contact point for special event operations in Vail; and
WHEREAS, to be supportive of providing street entertainment and special events for vitality,
economic viability, and fun year'round; and
WHEREAS, to increase the Town of Vail's lodging occupancy and sales tax collections; and
WHEREAS, To create. a sense of community in Vail and increase the quality of experience for
guests and residents; and
WHEREAS, in order to administer Special Events, the Town Council, in accordance with Section
8.6 of the Charter of the Town of Vail, wishes to create a Commission on Special Events ("CSE").
NOW, THEREFORE, be it ordained by the Town Council of the Town of Vail, Colorado, that:
Title 3 of the Municipal Code of the Town of Vail is hereby amended by the addition of Chapter 6,
Commission on Special Events, to read as follows:
Section 1. Board Established
The Town Council hereby establishes the Town of Vail Commission on Special Events ("CSE")
composed of five (5) voting members who shall act in accordance with the Charter, this Chapter, the
direction of the Town Council, as outlined in this ordinance, the ordinances of the Town of Vail, and shall be
appointed and serve at the pleasure of the Town Council as provided in this Chapter.
Section 2. Definitions
A. Special Event - A Special Event is a function whose primary purpose is to promote an
exciting, lively, fun and/or prosperous. business climate within the Town of Vail.
B. Qualifying Cultural Event - A Qualifying Cultural Event is a function whose primary purpose
is cultural in nature rather than economic. These events are typically, but not necessarily,
held in a performing arts venue such as Ford Amphitheater or Dobson Arena. The Town
Council shall establish by Resolution anon-exclusive list of Qualifying Cultural Events.

Section 3. Members -Appointments -Terms
The CSE shall consist of five (5) voting members appointed by the Town Council to be designated
as follows: 1 Retail; 1 Restaurant; 1 Lodging; 1 (from any of 3 categories previously stated); 1 at large. All
five voting members shall be residents of the Town of Vail, own real property within the Town of Vail, own a
business in the Town of Vail, or be employed within the Town of Vail. No current event promoters, producers
or board members of organizations requesting funding, or their employers, may serve as voting members.
The initial terms of two members of the CSE shall be for one year, and the initial term of three members
shall be for two years, to be appointed in 2002. Thereafter, the council shall annually appoint CSE members
to two year terms every January.
In addition to the five voting members of the CSE, up to ten (10) honorary advisory member groups
may be included by Council invitation. In order to act as an honorary advisory member of the CSE, each
member group shall nominate one representative within that group to be ratified by Council. Honorary
advisory member groups shall be approved by council and may include:
Vail Resorts, Inc. (VRI)
Vail Valley Foundation (WF)
Vail Valley Chamber and Tourism Bureau (WCTB)
Vail Chamber and Business Association (VCBA)
Vail Recreation District (VRD)
Town Council
Town of Vail staff
VLMDAC
Ratified, honorary advisory members shalt assist the CSE by providing information, coordination
and consultation and shall not have the power to vote on issues that come before the CSE. The number
and terms of such advisory members shall be at the discretion of the Town Council. Advisory members of
the CSE should be individuals who have a demonstrated expertise in special event production,
establishment of criteria by which to gauge event success, or knowledge of and/or a strong interest in
special events.
Section 4. Removal From Office
Members of the CSE shall serve at the will of the Town Council and shall be subject to
removal by the Town Council for inefficiency, neglect of duty, failure to attend meetings (70% mandatory
attendance at scheduled meetings), malfeasance in office, or any other reasons the Town Council deems
proper.
Section 5. Vacancy
Vacancies on the CSE shall occur whenever a member of the CSE reaches the end of his term, is
removed by the Town Council, dies, becomes incapacitated and unable to perform his or her duties for a

period of sixty (60) days, resigns, ceases to meet the qualifications for CSE members or is convicted of a
felony. Vacancies shall be filled by a majority vote of the Town Council.
Section 6.Officers -Meetings -Rules
The CSE shall be chaired by the advisory Town Council member until the commission decides a
director is appropriate or decides otherwise as to a different chairperson. The term of the Chairman shall
be for one two-year term to coincide with the Town's regular municipal election, with eligibility for re-election
for three additional two-year terms. The CSE shall meet as it determines to be necessary, and its meetings
shall be in accordance with Roberts Rules of Procedure unless it adopts other rules for the transaction of
business. Three or more members must vote for any action for it to pass. The CSE shall keep a record of
its resolutions, transactions, findings and determinations. The CSE will provide quarterly informational
reports to the Vail Town Council, in addition to a full annual financial report at budget time. An annual
evaluation of events shall be included.
Section 7. Functions of the CSE
The CSE shall support the Town Council's goals and objectives and align its mission with the Town
Council's marketing direction. The Functions and/or duties of CSE shall include, but are not limited to:
Hiring and overseeing a director and/or staff, as well as event producers and/or promoters; creating, funding
and seeking special events for the Town of Vail; evaluating event applications and event success;
submitting an annual budget for operations and events; coordinating the community calendar for special
events: seeking out additional funding for special events through sponsorships and donations; evaluating
and executing contracts for special events; and all other functions as directed by the Town Council.
Qualifying Cultural Events shall be exempt from the purview and funding of the CSE. .However,
coordination and timing of Qualifying Cultural Events shall be considered by the CSE and included in the
CSE master calendar.
Section 8. Appeal to Town Council
A. An appeal to the Town Council may be made by an adjacent affected property owner or by
the Town Council itself by a majority vote.
B. Any appeal must be filed in writing within ten (10) days following the decision of the CSE, or
must be called up by the Town Council within 10 days of the decision.
C. The Council shall hear the appeal within 30 days of its being filed or called up with a
possible 30-day extension if the Council finds that there is insufficient information.

If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held
to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the
Town Council hereby declares it would. have passed this ordinance, and each part, section, subsection,
sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections,
sentences, clauses or phrases be declared invalid.
The Town Council hereby finds, determines, and declares that this ordinance is necessary and
proper for the health, safety, and welfare of the Town of Vail and the inhabitants thereof.
The repeal or the repeal and reenactment of any provision of the Municipal Code of the Town of Vail
as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation
that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or
proceedings as commenced under or by virtue of the provision repealed or repealed and reenacted. The
repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or
superseded unless expressly stated herein.
All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed
to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order,
resolution, or ordinance, or part thereof, theretofore repealed.

We have scheduled an Executive Session at the end of the regular council work
session on Tuesday afternoon. The purpose of this executive session is to
further discuss employee compensation for the upcoming year.
In preparing the budget last year, a merit pool of 5.5% was included. When the
budget was adopted last year, the Council wanted to review the revenue
situation prior to implementing any increase. The purpose of the executive
session is for the Council to decide how much you wish to appropriate for the FY
2002 budget. We need to get a decision on this in order implement any change
by the June 1 deadline.
The town's compensation practices are based on the overall TOV compensation
philosophy. Generally speaking, the Town of Vail seeks to be a "competitive

payer with all or selected target markets. Because of revenue trends and our
ability to pay, we have begun to lag our competitors. This data was illustrated by
JP's slides.
I continue to believe it is important to be a competitive payer. This is even more
important given the geographic location of Vail and the fact that most of our
employees must commute up valley (or across mountain passes, e.g., Leadville
and Frisco) to work. I believe the demand for labor will continue to increase as
these populations grow. Without competitive pay, we will have difficulty enticing
our work force to continue to work in Vail.
Although the revenue forecast continues to be uncertain, it is my belief that we
need to move forward with the implementation of this year's merit pay. It is my
recommendation that a merit pool be approved at 5.5%.
