BACKGROUND RATIONALE:
The Betty Ford Alpine Gardens is proposing to construct an addition and
deck on the rear of the existing school house located in Ford Park
adjacent to the Children's Garden which is currently under construction.
Since these improvements are proposed on property leased by the Betty
Ford Alpine Gardens but owned by the Town of Vail; the Betty Ford
Alpine Gardens must have permission from the Town Council, acting as
the property owner, to proceed through the development review process.

CULTURAL ARTS MARKETING ALLIANCE
Background
At a meeting of the Vail Valley Foundation board of directors last December, it was
strongly recommended that, with the addition of the New York Philharmonic to the
already exceptional summer cultural offering in Vail in 2003, the community should
together for a joint marketing campaign featuring the cultural arts.
Following the recommendation, Ceil Folz, John Giovando and Katherine Kersten
gathered with their marketing directors to come up with a plan. A joint venture marketing
agreement was created to bring together Bravo!, the Vail International Dance Festival,
and the Vilar Center for a cooperative marketing effort (Cultural Arts Marketing Alliance,
CAMA).
The concept went out as a request for bid to nine advertising agencies for a pro bono
presentation. Four agencies presented their concepts on April 5 to a committee
including representatives from Bravo! and the Vail Valley Foundation. The winning
concept came from TDA, Thomas Dooley Advertising in Boulder.
VAIL PERFORMING ARTS
The world's best music, theater and dance.
This aositionina statement is the main thrust of the camoaian because it is our unique
selling point; it is a characteristic that sets us apart from competitor mountain resorts
The campaign is focused on our world-class cultural offering, which becomes the
primary message. The name "VAIL" should be used as part of the name to capitalize on
tremendous equity and brand identity. The current marketing campaign focuses on the
destination as a world class resort with a healthy lifestyle, with a myriad of activities, .
shopping and dining to please any guest. This message is also important and will
continue to be an integral part of any marketing campaign.
Message
To showcase the Vail Valley as a summer cultural mecca, offering world-class
programming in music, dance and theater in a spectacular natural setting all summer
long.
Goal
To drive destination visitors using a message of exceptional music, dance and theater.
Funding
Initial funding would come from Bravo!, Dance and Vilar, with each contributing $10,000.
The alliance will then approach other partners, including the Vail Marketing Board, with a
request for a minimum of $30,000 each in initial funding to match the joint funding of the
cultural groups.
The Vail Marketing Advisory Board has given unanimous approval to embrace the
concept in the marketing plan for 2003.
Funding will be sought for three consecutive years in order to maximize the opportunities
created by the joint marketing program.

Longwoods research results point to the importance of communicating an
exciting, vibrant Vail, offering bragging rights through diverse forms of
entertainment and the outdoors.
Cultural offering gives bragging rights.
Cultural product is better than the consumer perceives it to be.
Special events and attractions are a key motivator.
Special events customer spends $96 per day versus touring customer $75 per day.
Entertainment and outdoors are combined at Gerald R. Ford Amphitheater -unique!
Other factors in choosing a destination include Live Music, Theater, Dance, Symphony.
Hot Summer Nights and other area rock concerts broaden appeal even further.
Art fairs, art galleries and other festivals would be woven into message.

RE: REVENUE DISCUSSION
We have scheduled 45 minutes Tuesday afternoon to continue our discussion of
the revenue issue. The first is an update on the legal implications of a rebate on
commercial properties in order to mitigate the inequities established by the
Gallagher Amendment. The second will be a discussion of policy around
spending priorities. I realize that we have been discussing the revenue side of
the ledger for the past several weeks; however as we move forward and begin tc
prepare the fiscal year 2003-2004 budget, I believe it would be helpful to
establish some priorities in the expenditure of the town's revenue.
Gallagher Amendment Issue
We have consulted with Dee Wisor of Sherman and Howard on this matter. His
research indicates that it would likely be illegal to rebate a portion of the property
tax to commercial properties. If you want additional detail, I can make
arrangements to have Dee talk to you directly.
However, as I have discussed with some of you, an idea suggested by Steve
Thompson may have more merit. This would involve rebating a portion of sales
tax to commercial properties. This concept would involve rebating a portion of
sales tax to businesses based on a sales tax generation formula. In other words,
commercial ventures that generate sales tax would be eligible for rebates, while
those that ship out large portions of their inventory would not. This concept not
only provides an offset to the Gallagher Amendment, but provides incentives for
stores to collect more sales tax. Obviously, if the Council is interested in
pursuing this, we would need to work out the details of how this program would
be implemented. Please note that any rebates, direct or indirect, would
effectively reduce the impact of any increase in the mill levy. As you may recall,
one mill equals approximately $563,000.
Spending Priorities
If we are going to seek additional funding this coming November, I believe it is
important that we begin to "make our case" for this initiative. An important part of
making our case, I believe, involves a clear articulation of what the town's
funding priorities are. In other words, what is the priority of expenditures for the
town?
It is my belief that at this point in time in our history, that the funding priorities for
the town should be as follows:
Priority No. 1: Public health and safety
Priority No. 2: Business development (developing resort
infrastructure)
Priority No. 3: Community and neighborhood infrastructure
Obviously, any decision on funding priorities is a policy matter and must be made
and supported by the Town Council. It is my expectation that you will begin this
policy discussion on Tuesday and will likely conclude with the preparation of the
FY2003 budget.
For your information, we are preparing an analysis of Town of Vail spending for
FY2002. Specifically, we have categorized the 2002 operating expenditures into
the three previously identified priority groups. I will a-mail this document to you
tomorrow. Please note that this analysis is a work in progress and in some
cases we have made estimates to differentiate expenditures for economic vitality
and neighborhood development.

I. DESCRIPTION OF THE REQUEST
On May 20, 1997, recognizing the importance of visual connections to the surrounding
environment, the Town Council approved the use of the existing Town of Vail view
corridor ordinance to designate the first protected. public view corridors in Lionshead. In
order to qualify for protection under the Town's ordinance, a view corridor must meet the
following criteria:
1. Is the view corridor critical to the .identity, civic pride, and sense of place in
Lionshead?
2. Is the view seen from a widely used, publicly accessible viewpoint.
3. Is the view threatened? Is there a possibility that development on nearby.
property would block the view?
According to the Town Code, .the purpose statement of Chapter 22, View Corridors is:
The Town believes that preserving certain vistas is in the interest of the Town's
residents and guests. Specifically,- the Town believes that:
A. The protection and perpetuation of certain mountain views and
other significant views from various pedestrian public ways within
the Town will foster civic pride and is in the public interest of the
Town.
B. It is desirable to designate, preserve and perpetuate certain views
for the enjoyment and environmental enrichment for the residents
and guests of the Town.
C. The preservation of such views will strengthen and preserve the
Town's unique environmental heritage and attributes.
D. The preservation of such views will enhance the aesthetic and
economic vitality and values of the Town.
E. The preservation of such views is intended to promote design
which is compatible with the surrounding natural and built
environment, and is intended to provide for natural light to
buildings and in public spaces in the vicinity of the view corridors.
F. The preservation of such views will include certain focal points
such as the Clock Tower and Rucksack Tower, which serve as
prominent landmarks within Vail Village and contribute to the
community's unique sense of place.
The Lionshead Redevelopment Master Plan identifies five View Corridors. However, it
recommends that only two legally protected view corridors be established at this time:
The remaining three views are to be established as critical design parameters, not as
benchmarked and surveyed corridors. ,These other three view .corridors are contingent

Lionshead View Corridor 2 is seen from the pedestrian plaza at the east end of the

The Council recommended a few changes to the View Corridors in their review. First,
the Town Council requested a change to the lower boundary of View Corridor 1.
Second, the Council requested that View Corridor 2 be widened to include all of the ski
run. The amended view corridors are attached.
On November 13, 2000, the Community Development Department. initiated the process
for the adoption of the Lionshead View Corridors. The Planning and Environmental
Commission reviewed the proposed View Corridors on November 13, 2000, and
forwarded a recommendation of approval to the Town Council. The recommendation
was forwarded to Town Council in December of 2000. The Town Council requested that
View Corridor 1 be re-surveyed and that View Corridor 2 be considered at a later date
when more information about the core site redevelopment was known. In May of 2001,
Council requested that both view corridors be resurveyed and brought back at a later
date for consideration for adoption. Both view corridors have now been resurveyed and
are attached for reference. On July 23, 2001, the Planning and Environmental
Commission reviewed the proposed changes to the View Corridors. As a result of the
changes, which varied from the original view corridors proposed in the Lionshead
Redevelopment Master Plan, the Planning and Environmental Commission requested
additional information regarding private property and the effects of the amended view
corridors on private development rights. Staff has retained the services of Design
Source of Vail to provide photo images of the view corridors with private property lines
interpolated onto the views.
On June 24, 2002, the Planning and Environmental Commission requested additional
information from staff, including .images which would more comprehensively indicate
private property development rights. In addition, the Planning and Environmental
Commission requested that View Corridor 1 be amended and resurveyed. At the Town

Council meeting on July 2, 2002, the Town Council requested that the View Corridors be
scheduled at the.July 16, 2002, meeting for first reading of the ordinance adopting the
View Corridors. As a result, staff has not has adequate time to get, the additional
information requested by the Planning and Environmental Commission for the meeting
today:
II. STAFF RECOMMENDATION
As it is the Planning and Environmental Commission's role to make a recommendation
to the Town Council for adoption of a new View Corridor, staff recommends that the
Planning and Environmental Commission recommend approval of the two Lionshead
View Corridors. Staff's recommendation for approval is based on the review of the
criteria in Section IV of this memorandum and the evidence and testimony presented on
this application. Specifically, staff's recommendation is based upon the following
findings:

d. That the proposed view corridors are consistent with the Lionshead Redevelopment
Master Plan and Title 12, Zoning, of the Town Code, and furthers a legitimate Town
interest.
Should the Planning and Environmental Commission choose to recommend approval of
the proposed View Corridors, staff recommends the following conditions:
1. That prior to the adoption of Lionshead View Corridor 1, that staff have the view
corridor amended to follow the western most point of Treetops, located at 452
East Lionshead Cr. /Lot 6, Block 1, Vail Lionshead Filing 1.
2. That prior to the adoption of Lionshead View Corridors 1 and 2, that staff provide
the Town Council with additional information regarding the development .potential
of all adjacent properties to the proposed View Corridors.
III. ROLES OF THE REVIEWING BOARDS
Planning and Environmental Commission:
Action: The PEC is advisory to the Town Council.
The PEC shall review the proposed view corridor and make a recommendation to
the Town Council on the compatibility of the proposed view corridor with the
goals and policies of the Vail Land Use Plan, Town policies, and urban design
guide plans and other adopted master plans.
Design Review Board:

Action: The DRB has NO review authority on view corridor adoption.
Staff:
The staff is responsible for ensuring that all submittal requirements are provided.
Staff provides analyses and recommendations to the PEC and Town Council on view
corridor adoption.
Town Council:
Action: The Town Council is responsible for final approval/denial on view corridor
adoption.
The Town Council shall review and approve the proposal based on the
compatibility of the proposed view corridor for consistency with the goals and
policies of the Vail Land Use Plan, Town policies, and urban design guide plans
and other adopted master plans.

A. Lionshead View Corridor 1
General Description
This view corridor is seen from the west end of the Lionshead parking structure,
standing at street level at the main pedestrian exit and looking southwest toward
the gondola lift line. -
The following criteria must be met for the Planning and Environmental Commission to
recommend approval of Lionshead View Corridor 1:
~' 1. That the proposed view corridor protects and perpetuates views from
public pedestrian areas, public ways, or public spaces within the Town
which foster civic pride and are in the public interest for the Town.
Staff believes that the proposed view corridor protects and perpetuates a
primary view from this very important public area. Many visitors park at
the Lionshead structure and enter Lionshead from the west end of the
parking structure. This proposed view corridor protects the view up the
gondola lift line. According to the Lionshead Redevelopment Master
Plan, this view:
a. Fosters civic pride and is central to the identity of Lionshead.
b. Is taken from a commonly used, publicly accessible viewpoint.
This area is the primary point of entry for pedestrian traffic
from the parking structure and is also the primary Lionshead
transit stop.
2. That the proposed view corridor protects and enhances the Town's
attraction to residents, guests and property owners.
As stated above, this proposed view corridor is from a primary point of
entry for many of Lionshead guests and residents. Is protects a view of
Vail Mountain up the gondola liftline. The Lionshead Redevelopment
Master Plan identifies this area as the East Lionshead pedestrian portal,
and encourages improvements to this entire pedestrian plaza area,
including improved transit stops.

3. That the proposed view corridor protects a view which is commonly
recognized and has inherent qualities which make it more valuable to the
Town than other more common views.
According to the Lionshead Redevelopment Master Plan, this view
corridor is potentially threatened by redevelopment in the foreground of
the view. As the primary pedestrian portal to Lionshead, it is more
valuable to the Town than other common views. This view corridor
preserves the view up the gondola liftline, an important visual reference
for Vail visitors.
B. Lionshead View Corridor 2
General Description
This view corridor is seen from the pedestrian plaza at the east end of the
Lifthouse Lod e, lookin south direct) u the ondola~ lift line. ` "' '

recommend approval of Lionshead View Corridor 2:
That the proposed view corridor protects and perpetuates views from
public pedestrian areas, public ways, or public spaces within the Town
which foster civic pride and are in the public interest for the Town.
Staff believes that the proposed view corridor protects and perpetuates a
primary view from an important public area. This is a primary public plaza
and popular public space. According to the Lionshead Redevelopment
Master Plan, this view:
a. Fosters civic pride and is central to the identity of Lionshead.
b. Is taken from a commonly used, publicly accessible viewpoint.
2. That the proposed view corridor protects and enhances the Town's
attraction to residents, guests and property owners.
As stated above, this is a primary public plaza. According to the
Lionshead Redevelopment Master Plan, this plaza area is identified as
the resort retail and commercial hub of Lionshead. The Lionshead
Redevelopment Master Plan recommends improvements to this plaza
area and encourages more pedestrian connections through Lionshead.
3. That the proposed view corridor protects a view which is commonly
recognized and has inherent qualities which make them more valuable to
the Town than other more common views.
According to the Lionshead .Redevelopment Master Plan, this view
corridor is potentially threatened by redevelopment in the foreground of
the view, specifically, the Vail Associates core site. In addition, as a
primary pedestrian plaza, this view is more valuable than other views.
This view corridor preserves the view of the gondola lift line, an important
visual reference to guests.

AN ORDINANCE AMENDING THE TOWN CODE, TITLE 12, CHAPTER 22, SECTION 4,
ADOPTION OF VIEW CORRIDORS, BY ADDING TWO VIEW CORRIDORS IN LIONSHEAD
AND SETTING FORTH DETAILS IN REGARD THERETO.
WHEREAS, the Town Council finds that the proposed view corridors protect and perpetuate
views from public pedestrian areas, public ways, or public spaces within the Town which foster civic
pride and are in the public interest for the Town; and
WHEREAS, the Town Council finds that the proposed view corridors protect and enhance

f `the~Town's attraction to residents, guests, and property owners; and

WHEREAS, the Town Council finds that the proposedwiew corridors protect views which are
•commonly recognized and have inherent qualities which make them more valuable to the Town than
other more common views; and
WHEREAS, the Town Council finds that the proposed view corridors are consistent with the
Lionshead Redevelopment Master Plan, and Title 12, Zoning, of the Town Code; and
WHEREAS, the Planning and Environmental Commission of the Town of Vail has
recommended approval of the proposed view corridors at its July 8, 2002, meeting; and
WHEREAS, the Town Council considers it in the interest of the public health, safety, and
welfare to amend said Chapter and Sections of the Town Code.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
VAIL, COLORADO, THAT:
Section 1. Title 12, Chapter 22, Section 4, Adoption of View Corridors, is hereby
amended as follows:

Section'2. If any part, section, subsection, sentence, clause or phrase of this
ordinance is for any reason held to be invalid, such decision shall not effect the .validity of the
remaining portions of this ordinance; and the Town Council hereby declares it would have
,passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof,
.regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or
phrases be declared invalid.
Section 3. The Town Council hereby finds, determines and declares that this
ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the
.inhabitants thereof. ~ ~ ~ ~ ~ '~ ~ ~ ' ~ '
Section 4. _ The amendment of any provision of the Vail Town Code as provided~in
this ordinance `shall not affect any right which has accrued, any duty imposed, any violation that
occurred prior to the effective date hereof, any prosecution commenced, nor any other action or
,proceeding as commenced under or by virtue of the provision amended. The amendment of any
provision hereby shall not revive any provision or any ordinance previously repealed or
superseded unless expressly stated herein.
Section 5. A'll bylaws, orders, resolutions and ordinances, or parts thereof,
inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall
not be construed to revise any bylaw, order, resolution or ordinance, or part thereof, theretofore
repealed.
